Incentives Guidelines: CURRENT POLICY
ELIGIBILITY OF APPLICANTS 1. No member of the San Angelo City Council, or
person related to a council member within the second degree by consanguinity or affinity, shall be eligible for assistance from the COSADC during his/her tenure or for six months thereafter.
2. No member of the San Angelo Economic Development Corporation Board of Directors, or person related to a board member within the second degree by consanguinity or affinity, shall be eligible for assistance from the COSADC during his/her tenure or for six months thereafter.

Development Corporation, or person related to an employee or supervisor of the Department within the second degree by consanguinity or affinity, shall be eligible for assistance from the COSADC during his/her employment or for six months thereafter

Incentives Guidelines: STATE LAW
• Applicant may be an individual or a business organization
• Limited liability company or corporation has an independent legal existence and the capacity to act and transact business separate and apart from its members under the law
• When a company applies for incentives under the program, it is the company, not its individual members, who is the applicant
• It is the company and not its members that incurs the obligations and receives the benefits
Incentives Guidelines: STATE LAW
• State conflict of interest laws are only used in discussion, deliberation and voting when it involves assistance, the award to and approval of the contract with an entity in which a member of City Council has a financial interest and may require the member to abstain from discussion and voting
• When considering matters about a company in which a board member has a financial interest, the State’s nonprofit corporation laws require the board member to abstain from discussion, deliberation or voting on the matter.
