ITEM: First reading of Ordinance 2621.2 amending the Future Land Use Map of the City to reflect a Land Use designation of Residential for property located at 3060 W 30th Ct. BACKGROUND INFORMATION: The property is currently has a single family home and would like to continue use as such. The property’s present County Land Use designation is Residential. The owner and applicant, Joe Tannehill, Sr., is requesting the Land Use change in order annex to utilize City services. This is a single family home in a residential neighborhood. Other properties in the area have Future Land Use and Zoning designations of Residential (Bay County and Panama City). The proposed Land Use amendment will not create a nuisance. The request will not result in any deficiencies in concurrency standards. The proposed development is compatible with the development standards pertinent to the proposed Land Use and zoning designations. The request meets all requirements of the Comprehensive Plan and the Land Development Regulations. The Planning Board considered this item at its regularly-scheduled meeting on July 10, 2017. A motion was made to recommend approval. All Board members voted in favor of the motion to recommend approval of the request. Members present: Ray Dubuque, Dennis Wallace, Carl Russ, and Robbie Hughes. Members absent: Mary Sittman DEPARTMENT HEAD RECOMMENDATION: Conduct a first reading of the ordinance.

AN ORDINANCE AMENDING THE
COMPREHENSIVE PLAN FUTURE LAND USE
MAP OF THE CITY TO REFLECT A LAND USE
DESIGNATION OF RESIDENTIAL FOR A
PARCEL OF PROPERTY LOCATED AT 3060 W
30th
COURT, PANAMA CITY, FLORIDA,
PROVIDING FOR A REPEALER, PROVIDING
FOR SEVERABILITY, AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF PANAMA CITY,
FLORIDA;
WHEREAS, the Legislature adopted Chapter 163, laws of Florida, which
requires the City of Panama City to prepare and adopt and enforce a comprehensive plan;
and
WHEREAS, the Panama City Planning Board held a Public Hearing to consider
Proposed Comprehensive Plan Amendment PB 17-12 on July 10, 2017, and
recommended the Amendment be approved by the Panama City Commission for
adoption, and
WHEREAS, the City Commission of the City of Panama City held a first reading
on August 8, 2017, and a Public Hearing and second reading on August 22, 2017, to
adopt Comprehensive Plan Amendment PB 17-12, with due public notice having been
provided, and having reviewed and considered all comments received during the public
hearing, and having provided for necessary revisions; and,
WHEREAS, in exercise of its authority, the City Commission of the City of
Panama City, Florida, finds it necessary and desirable to adopt and does hereby adopt
Comprehensive Plan amendment PB 17-12, in order to encourage the most appropriate
use of land, water and resources, consistent with the public interest; and deal effectively
with future problems that may result from the use and development of land within the
City of Panama City, as follows:
Section 1: Purpose and Intent.
The land use designation of the identified parcel shall be and hereby is changed from a
Land Use designation of County Residential to City Residential as described in Small
Scale Amendment PB 17-12, with said property having the following legal description:
Parcel 1: Lots 21 and 22, Block A, located in the Northeast corner of NW ¼ of
Section 25, Township 3 South, Range 15 West according to unrecorded plat.
More accurately described as follows: Commence at the Northeast corner of the
NW ¼ of Section 25, Township 3 South, Range 15 West, Bay County, Florida.
Thence South along the center line of King’s Road for 195 feet; thence South
along the 89° 57’ 20” West along said North Right of Way line of 30th Court for
1833 feet to the Point of Beginning. Thence continue South 89° 57’ 20” west
along said North right of way line for 178.32 feet to the P.C. of a curve concave
to the Northeast and having a radius of 30.00 feet and a central angle of 78° 19’
30”; thence Northwesterly along said curve for a chord distance of 37.89 feet;
thence North 11° 43’ 10” West for 174.69 feet to the North line of said NW ¼;
thence North 89° 57’ 20” East along said North line of the NW ¼ for 243.04
feet; thence South 0° 02’ 40” East for 195 feet to the Point of Beginning.
This property is deeded for the purpose of one residence only, and is subject to
the restrictions of King’s Point recorded in Official Records Book 55, Page 207,
along with modifications of Restrictions recorded in Official Records Book 164,
Page 4, Bay County, Florida.
Commence at the NE Corner of the NW ¼ of Section 25, T3S, R15W, thence
S89°57’20” W along the North line of said NW ¼ for 2,076.19 feet; thence
S11°43’10” E for 40 feet to the point of beginning; thence continuing S
11°43’10” E a distance of 50 feet; thence S78°16’50” W for 50 feet; thence N
33°16’50” E 70.7 feet more or less, to the point of beginning.

Section 2: Comprehensive Plan Amendment.
The City of Panama City Comprehensive Plan is hereby amended as set forth in and
incorporated herein by reference, and consists of a Future Land Use Map Amendment.
Section 3: Severability.
If any provision or portion of this Ordinance is declared by any court of competent
jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions
and portions of this Ordinance and the City of Panama City Comprehensive Plan shall
remain in full force and effect.
Section 4. Copy on File.
An official, true and correct copy of all elements of the Panama City Comprehensive Plan
as adopted and amended from time to time shall be maintained by the City Manager or
his designee.
Section 5: Effective Date of Amendment.
This amendment shall not become effective until 31 days after adoption. If challenged
within 30 days after adoption, small scale development amendments shall not become
effective until the state land planning agency (DEO) or the Administration Commission,
respectively, issues a final order determining the adopted small scale development
amendment is in compliance. (§163.3187, F.S.)
PASSED, APPROVED AND ADOPTED at the regular meeting of the Mayor
and City Commission of the City of Panama City, Florida, the 22nd day of August, 2017.
