    A BILL FOR AN ORDINANCE

    RELAT ING TO NUISANCES ON PUBLIC SIDEWALKS.BE IT ORDAINED by th e Peo ple of th e City and Coun ty of Honolulu:

    SECTION 1 . Purpose. HRS Sec tion 46-1 .5(12) au thorizes th e City and Countyof Honolu lu to enac t and en fo rce o rdinances necessa ry to p re vent o r summarily removepub lic nu isances and to compel t he c lea ring or removal of any public nuisance fromsidewalks. The purpose of this ordinance is to author ize th e summary removal by th ecity of pub lic nu isances from th e sidewalk.SECTION 2. Chapter 29 , Rev ised Ord inances of Honolulu 1 990 , as amended, isamended by adding a new ar ti cle to be app rop ria te ly des igna ted by th e R evis or o fOrdinances and to read as fol lows:

    Article Nuisances on Public SidewalksSec. 29-_~1Counc il f ind ing and declaration o f nuisance.

    The Council f inds and declares that objects erected, es tab li shed , placed,constructed, maintained, kep t or operated on sidewalks to be public nuisances,hazardous to th e h ea lth , s afe ty, and welfare of the res iden ts of th e city, and there fo re,shal l be subjec t to summary removal pursuant to th is article. Nuisances on publicsidewalks are inconsistent with and frustrate the purposes , funct ions, and activities fo rwhich th e s idewalk is in te nd ed . T h e purp os e of this article is to promote traffic andpedestr ian health, safety, and wel fa re ; p revent v isual b ligh t ; and ensure that th esidewalk is free of obstacles and available fo r use and enjoyment of members of th epublic.Sec. 29-_.2 Defini t ions.

    As used in th is ar ticle , unless th e context otherwise requires:Director means th e director and chief engineer of th e depar tmen t of facilitymaintenance or th e directors authorized representat ive.Expressive activity means speech or conduct, th e pr inc ipal object ofwhich isth e express ion , d issem ina tion , o r commun icat ion by verbal, visual , l iterary, or auditorymeans of political, rel igious, ph ilosoph ica l, o r ideo log ica l op in ions , v iews , or id ea s, a ndfo r which no fe e is ch arg ed o r required as a condition of part icipation in or a ttendance a tsuch activity.     fo r vehicular t rave l, exc lus ive of th e berm o r shoulde r.Sidewa lk inc ludes s idewa lks and rep lacement s idewalks .Sidewalk-nuisance means any ob jec t o r co llec tion of objects const ructed,erected, ins ta l led , maintained, kept, or operated on o r o ve r any sidewalk, including butno t lim ited to structures, stalls, stands, tents, furniture, and containers, and any of their

    contents or at tachments.Sec. 29-_.3 Summary removal of s idewalk-nuisances .(a ) No person shal l erect, establ ish, place, construct, maintain, keep or operate anysidewalk-nuisance on any sidewalk, except as provided in Section 29-.6 or asotherwise author ized by law. Any sidewalk-nuisance in violation of thissubsect ion shall be subject to summary removal.(b ) The director may immediately and summar i ly remove o r c au se th e immediateand summary removal of a sidewalk-nuisance. A s idewa lk -nu isance may be

    disassembled fo r removal.(1 ) The director shal l store o r ca us e to be stored any sidewalk-nuisanceremoved pu rsuan t to th is subsection until th e director is au tho r ized todestroy, sell, o r o th e rw ise d ispose of th e sidewalk-nuisance pu rsuan t toth e applicable provisions of this sect ion, but in no even t less than 30ca lenda r days from th e date of removal.(2 ) Notif ication.

    (A ) Writ ten notice of the c ity s remova l of th e sidewalk-nuisance shal lbe posted fo r th ree consecut ive days fol lowing removal of th esidewalk-nuisance on th e public p rope rty whe re th e s idewa lk-nuisance was removed. If notice cannot be posted as provided,then it shal l be posted on th e in ternet websi te fo r th e c ity fo r threeconsecut ive days follow ing remova l of th e sidewalk-nuisance.

    (B) The written notice shall s ta te :

    (i) The date, v io la t ion and removal of th e sidewalk-nuisance;(ii) Tha t th e own er m ay r ec la im the sidewalk-nuisance within 30ca lendar days from th e date of the remova l of the s idewa lk -nuisance;(iii) Contact information and instructions on how th e ow ne r mayr ec la im the sidewalk-nuisance;(iv) Tha t the ow ner h as the r ight to appeal the removal of th esidewalk-nuisance in accordance wi th subsect ion (d); and(v) That , if not t imely reclaimed or th e subject of t imely appeal ,th e s idewalk -nu isance sha ll be subjec t to d isposa l.

    (C) If a name and mail ing a ddre ss h as be en legibly and conspicuouslyprovided on a sidewalk-nuisance removed pursuant to th issubsect ion, then th e d ir ec to r a lso sha ll issue a written notice, bycertified mail, to th e per son named on th e sidewalk-nuisance withinseven ca lendar days fo llow ing the date of th e removal of th es idewalk-nu isance; provided that if only an address is provided on as idewalk-nu isance, th e d irector sha ll issue a written notice, bycertified mail, a dd re s sed to th e Occupant of that address, withinseven ca lendar days following the date of th e removal of th esidewalk-nuisance. No such notice shal l be required if only th ename is provided and th e director is unable after a good faith effortto determine the add ress of th e named person.

    (D) Shopping Carts. If a shopp ing ca rt is removed and impoundedpursuant to th is subsect ion, th e city shal l notify th e RetailMerchants Associa tion o r i t s successor organizat ion, of the locat ionwhere th e shopp ing ca rt may be claimed. The Retail MerchantsAssociat ion or i t s successor organizat ion sha ll no tify th e owner ofth e shopping cart or owners agent of th e loca tion where th eshopping cart may be claimed. The owner o r owne rs agen t shal lhave three business days from th e date th e c ity notifies th e RetailMerchants Assoc ia t ion or i t s successor organizat ion to retrieve th eshopping car t without charge. If th e owner o r owne rs agen t fails toretr ieve th e shopp ing ca rt within three business days, th e shoppingcar t shal l be t reated as a removed sidewalk-nuisance pu rsuan t tothis subsect ion, and written notice shal l be provided as in

    subsect ion (b)(2), and th e owne r sha ll be sub je ct to a fe e purs uantto subsec tion (c), un less the owne r success fu lly con tes ts th eremoval as provided in subsect ion (d).(3 ) The director may destroy, sell, o r o the rw ise dispose of a sidewalk-nu isance removed under the p rov is ions of t h is subsec tion after a period of30 ca lendar days from th e date of removal of th e sidewalk-nuisanceunless a t imely a pp ea l h as been filed under subsect ion (d).

    (c) A sidewalk-nuisance removed pursuant to th is s ectio n may be reclaimed by th eowner within th e app licab le 30-day period specified in subsect ion (b). To re cla ima sidewalk-nuisance, an own er o r th e owner s au thorized representa t ive shallmake arrangements with th e director to rec la im th e sidewalk-nuisance; shallappear in person within th e applicable 30-day p erio d a t th e t ime and placedesig nated by th e d irector ; sha ll provide sat isfactory proof of iden tit y andentit lement; and shal l pay to the city a $200.00 fe e fo r the c ity s costof removal ,storage and handl ing of th e sidewalk-nuisance, whereupon the c ity shal l releaseth e sidewalk-nuisance to the own er o r th e owner s author ized representative, asi s .

    (d ) An owner of a sidewalk-nuisance removed pursuant to th is s ectio n may contestth e r emova l by written request fo r a hearing to th e director received no l ater than25 ca lendar days after removal of th e s id ewa lk -n uis an ce . T h e owne r s ha llprovide a current mailing address to re ce iv e th e notice of th e decision of th edirector regarding th e appeal. The hear ing shall be conduc ted by th e director inaccordance wi th th e provisions of HRS Chapter 91. The appeal shall be lim itedto a determinat ion ofwhether th e sidewalk-nuisance was p roperly removed and afe e proper ly assessed pursuant to th is s ec tio n. The director shal l con tinue tostore or hav e s to re d th e sidewalk-nuisance until th e a pp ea l h as been decided. Ifth e decision of th e director is in favor of th e owner, then th e own er m ay arrangeto rec la im th e sidewalk-nuisance without p ayin g th e fe e fo r th e removal , storage,and handl ing of th e sidewalk-nuisance. If th e decision of th e director is in favorof th e city, then th e s idewa lk -nu isance may be returned to th e own er o r th eowner s au thor ized representa t ive upon payment of th e removal , storage, andhandl ing fe e of $200.00. If th e own er o r th e owner s author ized representat ivefails to re cla im th e sidewalk-nuisance w ith in seven ca lendar days of th e postmarkfo r th e notice of th e decis io n, th e s idewa lk -nu isance may be destroyed, sold, orotherwise disposed of by th e director.

    Sec. 29-_A Rules.The director may adopt rules pursuant to HRS Chapter 9 1 fo r t he imp lementa tionof this article.Sec. 29-_.5 Miscel laneous provisions.(a ) The p rov is ions of this article shal l be in addit ion to and shal l not limit any o the rappl icable prov is ions of federal , state or city law, o rd inance , o r rule.(b ) The provisions of this article shal l not create a duty on th e part of the c ity

    regarding s idewalk accessibil ity other than is already required by law.Sec. 29-_.6 Except ions.

    The prohibit ions in this article shal l not a pp ly to th e fol lowing:(1) An object or collect ion of objects smal ler than 42 inches in le ng th , 25inches in width, and 43 inches in height, provided that:

    (A ) T he o bje ct o r collection of objects is a ttended to by an individual atall t imes;(B) The obje ct o r c olle ctio n of ob jec ts , o r any port ion the reo f, does notextend in to th e roadway;(C) T he o bje ct o r collection of objects does not obstruct th e use of 36inches in width of th e sidewalk and doe s not obstruct th e freemovemen t of pedestr ians;(D) T he o bje ct o r collection of objects does not obstruct individualsfrom access to or egress from legally parked veh ic les ;(E ) The obje ct o r c olle ctio n of o bje cts d oe s n ot interfere with otherlawful act iv i ties tak ing place on th e sidewalk and i t s placementcomplies with other provisions of this chapter ; and(F ) The obje ct o r c olle ctio n of o bje cts d oe s n ot otherwise threatenpublic health and safety.

    Sec. 29-_.7 City no t l iable.T he ow ner of a removed s idewalk -nu isance sha ll bear th e responsibil ity fo r anyloss o r d amage to th e s idewa lk -nu isance . The city, i t s officers, employees, and agentsshall not be l iable to any per son en title d to a removed sidewalk-nuisance because ofany d isposa l o r other disposit ion of th e p rope rty made pu rsuan t to th is article.The remed ies availab le to a pe rson en titled to a removed sidewalk-nuisance arelim ited to those provided in t h is a r tic le .

    Sec. 29-_.8 Severabil i ty.The p rov is ions of this article a re decla red to be severable . If any por tio n o f th is
