CIRCULAR

In continuation to this office O.M. of even no. dt.7.7.2011, the admissibility ofEarned LeavelHalf Pay Leave to persons serving in Vacation Department by invitingreference to Rule 28 of CCS (Leave) Rules, 1972 is hereby re-circulated as below:

A. Earned Leave:(1) Normally Earned Leave shall not be admissible to teaching & non-teaching Govt.

servants if they avail the full vacation in any year in terms of Rule 28 (1) (a) of theCCS (Leave) Rules, 1972. However, as per Govt. of India's decision No.4 belowthe said Rule, Earned Leave for 10 days on full pay in lieu of 20 days HPL isadmissible to regular teaching & non teaching staff in a year w.e.f. 1.9.1982 to31.8.2008 as a special case subject to the other conditions under Rule 28.

(2) When a teaching/non-teaching staff/officer avails only a portion of the vacation ina year, he/she may be entitled to E.L. in such proportion of 30 days, as the numberof days of a vacation not taken bears to the full vacation of the year and suchLeave shall not be admissible in respect of the first year of temporary service interms of Rules 28 (1) (B) of the CCS (Leave) Rules, 1972 and proviso thereunder.

3) When a regular vacation staff/officer does not avail any vacation during the year(12 months), E.L. shall be admissible to him/her at par with other State Govt.employees under Rule 26 read with Rule 28 (I) (c) ibid.

Provided further that if he/she, by an order from higher authority, cannot availmore than 15 days of vacation in a year, he/she shall be considered to have availedhimself of no portion of the vacation.

B. Half Pay Leave:

The facility of Half Pay Leave for 20 days in a year shall be given to the vacationstaff/officers under School Education Department availing full vacation prior to1.9.1981 in terms of Rule 29 ibid and w.e.f. 1.9.2008 in terms of Govt. of India'sDecision No.5 below Rule 28 ibid.
