    4. If property lies within a scheduled area (but not on scheduledbuildings see note 7 below) a DNO notification is required

    to be submitted to MEPA before installation and still subject

    to above requirements. Clearance will be issued within 30days unless the installation is objected to. In other locations,no such notification is required; the other requirements(maximum size and height, screening requirements, etc.) still

    apply.

    5. Where the rear of the building is located at the edge of aridge, a setback of 3m from the rear elevation is alsomandatory, unless the dish antenna is duly screened (on the

    rear side of the building) by an existing parapet wall and theheight of the dish as fixed is less than the height of the

    parapet wall.

    6. A satellite dish is not permitted development on the followingbuildings located outside development zones (e.g. in thecountryside):

    field rooms, agricultural stores and such similarstructures; beach rooms, kiosks and similar structures;fireworks factories; buildings used for parking of vehicles ormachinery.

    7. A satellite dish is not permitted development on scheduled

    historic buildings.

    2 TABLES & CHAIRS IN PUBLIC AREAS

    2.1 The Authority (MEPA) is proposing to relax its policy on the placing oftables and chairs outside bars and restaurants in a bid to breath new life

    into Malta's urban centres.

    2.2 Until now, development permission for the placing of tables and chairsoutside catering establishments was given on condition that on-siteparking was provided, or alternatively, a contribution was made to theCommuted Payment Parking Scheme.

    2.3 Funds collected through this scheme go towards improving parking andtraffic provisions in the locality.

    2.4 However the Development Notification Order that replaced the GeneralDevelopment Order last year allows the placing of tables and chairs

    outside catering establishments in most cases without the need to apply

    for a development permission. According to this legal notice, thedeveloper is to notify MEPA of his intention to place tables and chairsoutside his establishment and ensure that he meets certain requirementsregarding pedestrian passageways and traffic obstruction, among other

    conditions.

    2.5 MEPA is now proposing to review the application of the current StructurePlan policy (TRA4) which regulates such development by removing therequirement for on-site parking or CPPS contribution on all applications forthe placing of tables and chairs outside catering establishments in urbancentres, thereby bringing it in line with the Development Notification Order.

    2.6 It is being proposed that the policy would be retroactive to when the CPPSwas introduced and that the Lm30,400 collected so far are refunded to thedevelopers without interest, so long as they meet the requirements andparameters set out in the Development Notification Order. A draft policypaper on this amendment is being published for public consultation and

    may be seen on website. Submissions in writing are to be sent to theundersigned by 2ndJuly 2002.

    3 MARFAACTION PLAN PUBLIC CONSULTATION

    3.1 The draft Marfa Action Plan has been launched on Thursday 13th June,2002 for the purpose of public consultation for a period of six weeks.

    Written representation shall be received not later than 26thJuly 2002.

    3.2 The Action Plan sets out policies and proposals for land use anddevelopment in the area known as L-Ahrax tal- Mellieha, indicates guidingprinciples of the plan and identifies where development is to be locatedand the countryside and the coastline are to be protected.

    3.3 The Action Plan identifies and promotes the development of sites for

    recreational pursuits which will enable domestic and international visitorsto enjoy a wide range of facilities. These include sites for camping andtouring caravans. A proposed small boat sailing and canoe centre islocated at Ir-Ramla tal-Bir. A system of cycle ways and footpaths areidentified together with appropriate locations for picnic sites.

    3.4 The plan protects areas of ecological and scientific importance. Irrigatedfarmland will continue to be protected from development in support of asustainable agricultural policy.

    3.5 The plan initiates increased protection of Scheduled Buildings and theirsettings by the designation of Buffer Zones (historic spheres of influence)

    in which historic buildings can be appreciated in a wider physical setting

    and context in which they were built. The plan also proposes greaterprotection for Giren (corbelled stone huts) and an overall strategy forafforestation.

    3.6 The plan endeavours to achieve a better balance between variouscompeting uses of the coast and foreshore, together with enhancement of

    the amenities of the area. Emphasis is given to securing access to theforeshore and coastline by the identification of a Public Access Zone.

    3.7 The plan recognises, in accordance with Structure Plan Policies, the needto provide holiday accommodation for visitors to the beaches of the Action

    Plan area. Sites have been designated for the construction ofBeachrooms with a maximum footprint of 12m x 5m with provision forliving accommodation, toilet/shower and kitchenette facilities betweenVendome Battery and the White Tower on the northern coastline.

    3.8 Road improvements are proposed on the arterial road to Cirkewwa and tothe road at Marfa.
