Preliminaries  

Purpose of this Document

This document defines the requirements specification of the IP Trade Portal for CIPC and

outlines the envisaged solution for approval by CIPC management.

Target Audience

This document is for authorised use by CIPC management as well as Sword SA project

personnel or subcontractors involved with the project. Updates to this document will be

versioned and form part of the configuration and change control process that will be

adopted within the design life cycle. A record will be kept of all versions however the later

version will always replace the previous versions.

Design

Essentially a "Design" is about shape and features that appeal to the eye. Some designs are necessitated by function and others are aesthetic. Design is about the shape, form, appearance, pattern, ornamentation and configuration of a product or article for e.g. the design of a ring (Jewellery) is generally dictated by aesthetic features.

IP Intellectual Property

Patent

A patent is an exclusive right granted for an invention, which is a product or a process that provides a new way of doing something, or offers a new technical solution to a problem. The patent provides protection for the owner, which gives him/her the right to exclude others from making, using, exercising, disposing of the invention, offering to dispose, or importing the invention. The protection is granted for a limited period of 20 years.

Trade Mark A trade mark is a brand name, a slogan or a logo. It identifies the services or goods of one person and distinguishes it from the goods and services of another

Design  Specification  

1 Introduction  

The CIPC IP Trade Portal is intended to be a subset of the web portal www.zaip.org. The

branding, look and feel should be similar even though improvements in some of the functional

elements are sought. A menu item or hyperlinks in relevant locations within www,zaip.org will

launch the IP Trade Portal. It is a place where buyers and sellers of IP rights are introduced to

each other. In this resource, buyers can find rights that are offered for purchase or licence of

right. They can also advertise their own rights for sale, licencing or even franchising. Beside

patented intellectual properties, the portal will extend to ideas and innovation that are not

patented. Such ideas (e.g. business concept) can be negotiated for commercialisation between

buyers and sellers. The diagram below illustrates the high level design of the portal. The current

scope of this project will deliver a fully functional prototype for trading patents only

1.1 Purpose of the IP Trade Portal

The IP trade Portal is intended to be an enablement platform for South African companies

to improve competitiveness, innovativeness and to generate new business opportunities. It

is intended to be an interactive platform or market place where sharing of intellectual

property, for commercial gain, is maximised. The following business objectives are

targeted:

a. Help South African based businesses to improve innovation processes by obtaining

access to knowledge globally while also gaining maximum yield from own research

and development by allowing other businesses to gain access to knowledge that

they may be able to exploit better than the owners of the IP rights, ideas or

innovation.

b. Selling or licensing IP rights can increase earnings. Businesses can assess

opportunities of creating income from selling, buying or licensing IP rights.

Promote the development, acquisition and commercialisation of IP rights i.e.

convert IP from dormancy to economic relevance by matching idea generators with

idea implementers.

c. The portal supports the following objectives of Government and the DTI:

• Economic development

• SMME development

• Industrial development

1.2 Design Approach

The approach to the portal design should be fully responsive to the client's system

objectives. Since CIPC wishes to benchmark the solution globally, it will be useful to apply

software prototyping, the activity of creating prototypes of software applications, as an

effective method of creating the solution. In this method, the prototype will be subjected to

several iterations until desired functional and ergonomic attributes are achieved.

The process of prototyping involves the following steps

1. Identify basic requirements

Determine basic requirements including the input and output information desired. Details,

such as security, can typically be ignored.

2. Develop Initial Prototype

The initial prototype is developed that includes only user interfaces. Review

The customers, including end-users, examine the prototype and provide feedback on

additions or changes.

3. Revise and Enhance the Prototype

Using the feedback both the specifications and the prototype can be improved. Negotiation

about what is within the scope of the contract/product may be necessary. If changes are

introduced then a repeat of steps #3 and #4 may be needed.

1.3 Project Scope

The scope of this project will deliver a fully functional prototype for trading patents

only. The enhancement of the system to include trade marks, designs, and copyright is

recommended for future consideration. It is included in the overview for conceptualisation.

The following categories will be considered:

• Technology

• Construction

• Household

The site will further organise the IP according to following transaction types:

• Purchase

• License

• Franchise

Buyers and sellers can decide how the transaction type will be classified.

2 Functional  Requirements  

2.1 General Specifications

2.1.1 Information  Pages  &  Navigation  

The informational portion of the portal has to be quite comprehensive to promote the

inclusivity objective of the South African government. This objective that relates to

economic empowerment should make the site attractive to small businesses and big

business alike. Navigation through the site should be easy.

2.1.2 Link  to  Patent  Database  

Users will have a simple link or menu item to access the CIPC patent database to view

granted patents – http://patentsearch.cipc.co.za/patents/patentsearch.aspx

2.1.3 Access  to  intermediary  services  

Although intermediary services (such as valuation, financing, etc.) will normally be

performed outside of this site, access to such services should be provided within the site.

This service should enable potential innovators to access other government and non-

governmental resources that complement the purchase, licensing and franchising of IP

rights. An example of such a service could be the access to financing resources for the

purchase or commercialisation of the traded IP rights.

2.1.4 RSS  Feeds  

With RSS feeds, users can be informed when a new advertisement comes into their

interest area.

2.2 Security Requirements

2.2.1 User  Roles  

The following user roles are required in order to enable platform operations:

a. Buyer: will require access to an indexing screen in the scanning software to add the

additional index values, will have read-access to documents as soon as stored in the

repository.

b. Seller: will require write access to the documents stored in the repository, can change the

applied retention policy.

These user roles are further broken down in the application roles table in the relevant

section of this document.

c. Moderator: will require access to all content and messages. They will constantly re-

organise the advertised material according to defined business rules.

d. Technical Administrator: access to the technical platform to ensure performance –

scaling infrastructure to demand.

2.2.2 Application  Role  Requirements  

The following diagram shows the approach to managing security within the application.

Users have one or more user roles. The user roles relate to one or more application roles.

These application roles identify a combination of application functions (accounts, system

privileges and permissions) that will enable the user to perform that role.

In this way, application implementation is separated from application mobilisation. In other

words, the business process and user roles can be adjusted to accommodate different

customer requirements and different service provisioning models, without major redesigns

of the application implementation.

2.3 User Interface

The interface presents how the users interact with the system. The external users will use

the web interface while the internal users make use of the repository.

2.3.1 Front  Page  

The diagram below illustrates the functional features of the user interface. The diagram is

not intended to be proof for acceptance purposes. It is merely an indication of the key

features of the user interface.

The external users will make use of this user interface to access the IP Trade Portal,

depending on their roles and access rights some pages will not be accessible. They will

register on the web interface using a registration form and an e-mail will be send to the

system administrator for activation.

The users will be presented with this page when they visit the IP Trade Portal.

2.3.2.1 Referral  page    

This page is used to introduce the buyer to the seller. It will provide an overview of the IP

to be traded, the IP register summary and the contact form for the potential buyer to send

their contact details and offer to the seller. After that contact is established, CIPC will

not be involved in further negotiations between the parties. The pages below are for

illustration and discussion purposes only. They do not represent actual register

information.

The search results pages will vary in content depending on the context. They will have a

common design template. The results will be delivered at 2 levels.

The 1st level will be a list of results in a tabular format with the column headers shown

2.4 Intermediary Services

The intermediary services listed below are excluded from the scope of this project. Although the

services are concomitant to the successful commercialisation agenda, they can be drawn from

3rd parties. CIPC may not have the necessary competencies to provide these services.

• Legal services

• Valuation

• Finance

• Consulting

• Brokerage

It is envisaged that other agencies of the Department of Trade & Industry (DTI) can be co-opted

into the ecosystem of the IP Trade Portal.

For example, an SMME interested in an IP and demonstrating the required competencies to

commercialise that IP should be able to access finance and consulting from relevant DTI

agencies to further that objective.
