Justification:AM by Cristian Terheş for S&D

Investigative journalists are extremely vulnerable professionals, with very limited resources. Two of them got killed in the EU only in the past 6 months. Their work is crucial in unvealing transborder money laundering and massive corruption. LuxLeaks, Panama Papers, Paradise Papers, the Azeri or the Russian Laundromats are examples of sensible investigations. For their activities to be sustainable, investigative journalists need protection, direct support and financial support.

— actions relating to operational cooperation between Member States and third countries, This appropriation is also intended to cover foregone fees from visas issued for the purpose of transit and additional costs incurred in implementing the Facilitated Transit Document (FTD) and the Facilitated Rail Transit Document (FRTD) scheme in accordance with Council Regulation (EC) No 693/2003 of 14 April 2003 establishing a specific Facilitated Transit Document (FTD), a Facilitated Rail Transit Document (FRTD) and amending the Common Consular Instructions and the Common Manual (OJ L 99, 17.4.2003, p. 8) and Council Regulation (EC) No 694/2003 of 14 April 2003 on uniform formats for Facilitated Transit Documents (FTD) and Facilitated Rail Transit Documents (FRTD) provided for in Regulation (EC) No 693/2003 (OJ L 99, 17.4.2003, p. 15).

At the Commission’s initiative, this appropriation may be used to finance transnational actions or actions of particular interest to the Union. To be eligible for funding, those actions shall in particular pursue the following objectives:

— to support preparatory, monitoring, administrative and technical activities, required to implement external borders and visa policies, including to strengthen the governance of the Schengen area by developing and implementing the evaluation mechanism as established by Council Regulation (EU) No 1053/2013 of 7 October 2013 establishing an evaluation and monitoring mechanism to verify the application of the Schengen acquis and repealing the Decision of the Executive Committee of 16 September 1998 setting up a Standing Committee on the evaluation and implementation of Schengen (OJ L 295, 6.11.2013, p. 27), to verify the application of the Schengen acquis and the Schengen Borders Code in particular mission expenditure for experts of the Commission and the Member States participating in on site visits,

— to improve the knowledge and understanding of the situation prevailing in the Member States and third countries through analysis, evaluation and close monitoring of policies,

— to support the development of statistical tools, including common statistical tools, and methods and common indicators, with gender-disaggregated data,

— to support and monitor the implementation of Union law and Union policy objectives in the Member States, and assess their effectiveness and impact, including with regard to the respect of human rights and fundamental freedoms, as far as the scope of this instrument is concerned,

— to promote networking, mutual learning, identification and dissemination of best practices and innovative approaches amongst different stakeholders at European level,

— to enhance awareness of Union policies and objectives among stakeholders and the general public, including corporate communication on the political priorities of the Union,

— to boost the capacity of European networks to assess, promote, support and further develop Union policies and objectives,

— to support particularly innovative projects developing new methods and/or technologies with a potential for transferability to other Member States, especially projects aiming at testing and validating research projects,

— to support actions in relation to third countries as referred to in Article 4(2) of Regulation (EU) No 1053/2013,

— awareness-raising, information and communication activities in relation to Union home affairs policies, priorities and achievements.

– to support actions in relation to and in third countries as referred to in Article 4(2) of Regulation (EU) No 1053/2013,

– awareness-raising, information and communication activities in relation to Union home affairs policies, priorities and achievements.

Amend text as follows:

This appropriation shall also cover financial assistance to address urgent and specific needs in the event of an emergency situation which means a situation of urgent and exceptional pressure where a large or disproportionate number of third-country nationals cross or are expected to cross the external border of one or more Member States. 

This appropriation will provide for reimbursement of the costs incurred by the Commission and Member States experts for the on-the spoton-the-spot evaluation visits (travel cost and accommodation) regarding the application of the Schengen acquis. acquis. The cost of supplies and equipment needed for the on-the-spot evaluation visits and for their preparation and follow-up must be added to these costs.

 Revenue from the contributions of Iceland, Norway, Switzerland and Liechtenstein, in the context of the Agreements on their association with the implementation, application and development of the Schengen acquis entered in Item 6 3 1 3 of the statement of revenue may give rise to the provision of additional appropriations in accordance with point (e) of Article 21(2) of the Financial Regulation.

Justification:This budget line should focus on enhancing and facilitating the crossing of the Member States' external borders and support a common application of the visa policy. There is no need to finance actions directly in third countries, so less money is needed.

This appropriation shall also cover financial assistance to address urgent and specific needs in the event of an emergency situation which means a situation of urgent and exceptional pressure where a large or disproportionate number of third-country nationals cross or are expected to cross the external border of one or more Member States. 

This appropriation will provide for reimbursement of the costs incurred by the Commission and Member States experts for the on-the-spot evaluation visits (travel cost and accommodation) regarding the application of the Schengen acquis. acquis. The cost of supplies and equipment needed for the on-the-spot evaluation visits and for their preparation and follow-up must be added to these costs. 

Revenue from the contributions of Iceland, Norway, Switzerland and Liechtenstein, in the context of the Agreements on their association with the implementation, application and development of the Schengen acquis entered in Item 6 3 1 3 of the statement of revenue may give rise to the provision of additional appropriations in accordance with point (e) of Article 21(2) of the Financial Regulation. 

Justification:This budget line is decreased by 30% in order to cancel any ongoing or new expenditure related to actions in relation to and in third countries and in particular sharing information with third countries, joint operations, Eurosur, etc. Evidence shows that cooperation with third countries in the field of border management has an impact on fundamental rights, in particular in countries that do not apply the Geneva Convention in full or do not ensure an adequate level of fundamental rights.

Justification:This budget line is decreased by 30% in order to cancel any ongoing or new expenditure related to actions in relation to and in third countries and in particular sharing information with third countries, joint operations, Eurosur, etc. Evidence shows that cooperation with third countries in the field of border management has an impact on fundamental rights, in particular in countries that do not apply the Geneva Convention in full or do not ensure an adequate level of fundamental rights.

The Commission should present a legislative proposal to set up a Search and Rescue Fund. Given the challenges faced in the Mediterranean, and the humanitarian tragedy unfolding there, the EU must do more to encourage the saving of lives and to show solidarity among Member States in the carrying out of SAR operations. It is more appropriate to create such a Fund than to increase, on an ad-hoc and non-transparent manner, Frontex's budget for SAR. The operations reimbursed thorugh the Fund could also cover a wider range of operations than those carried out by Frontex.

- to guarantee access to international protection for those needing it, in accordance with the obligations contracted by the Member States in the field of human rights and maritime law, including the right to life and the principle of non-refoulement, and with due regard for the specific characteristics of the people concerned.

This appropriation is intended to cover the expenditure related to maritime search and rescue operations in or by Member States, as well as by private actors.

Justification:The number of deaths in the Mediterranean remain high in the absence of legal and safe pathways to Europe for both refugees and migrants. As no Union body has a mandate to carry out proactive SAR activities, there should be direct funding from the EU budget to SAR operations carried out by Member States and NGO's.

The amount indicated here should be taken from FRONTEX' budget.

Conditions for releasing the reserve:Add following text:

The appropriations put in reserve will be released when the agency's director presents to the EP a satisfactory follow-up of the concerns and the recommendations made by the Frontex consultative forum in its latest annual report. A letter was sent in this regard by the LIBE chair in April 2019 asking the Agency take immediate action and provide the LIBE Committee with feedback regarding the steps taken to respond to the recommendations made and the solutions found to the problems.

In order to release the reserve, the Director should present evidence as to the successful resolution by the Agency of the issues linked to:

Improvement of the ‘Information and Transparency’ policy;

The follow-up of the recommendation launched in December 2018 on statelessness in the activities of the Agency;

The follow-up to the recommendations regarding the issues of gender in all the Agency’s activities;

The enhancement of child protection in Frontex activities;

The fundamental rights implications of Frontex cooperation with third countries; and

Staffing of the Agency’s Fundamental Rights Office (FRO), the respect of the independence of the FRO and the revision of the 2011 Fundamental Rights Strategy.

Justification:During the negotiations on the FRONTEX regulation, articles related to fundamental rights were considered crucial by the European Parliament. Following the alarming reports by the Consultative Forum, there is a pressing need to see how these concerns have been integrated into the implementation of the current FRONTEX regulation.

We also propose a much slimmer budget for the Agency. The money freed up by this is to be used to support SAR operations by Member States and private actors.

This appropriation is intended to enhance solidarity and responsibility sharing between the Member States, in particular towards those most affected by migration and asylum flows, including through practical cooperation as per the objective laid down in Article 3(2)(d) of Regulation No 516/2014 of the European Parliament and of the Council of 16 April 2014 establishing the Asylum, Migration and Integration Fund.

This appropriation is also intended to cover actions related to the resettlement, transfer of applicants for and beneficiaries of international protection and other ad hoc humanitarian admission

Justification:AM by Cristian Terheş for S&D

It is proposed to split the two current budget lines (18 03 01 01 and 18 03 01 02) of AMIF into four to reflect precisely the four specific objectives of the Fund and increase transparency. The fair and transparent distribution of funding between the different objectives of the Fund was a priority for Parliament during negotiations leading to the adoption of that Fund. The amount deducted from budget line 18 03 01 01 has been transferred to new budget line 18 03 01 04.

During the course of the financial year 2020, the Commission may present one or more transfer proposals in accordance with Article 31 of the Financial Regulation to release the amount or part of it, where justified on the basis of a thorough assessment of needs in response to the ongoing migration crisis.

Justification:According with UNICEF data, more than 30,000 children arrived in Europe in 2018, 42% are accompanied minors. Children make up more than 30% of all asylum seekers across Europe. Legal barriers, insufficient human and financial resources, lack of psychological and mediation supports are the key challenges and gaps in the accessioning to the education systems. This amendment aims to make fund available and is in line with the Commitment of the EU to not leave no one behind, the EP resolution and EC Communication on the protection of children in migration.

Justification:Access to education is a key element for the successful integration in line with the action plan to support Member States in the integration of third-country nationals adopted by the Commission, the Agenda 2030 a specifically the SDG 4. In addition, the foster family reunification is crucial for the best interests of the child and to provide inclusive integration models. The Best interest of the Child has to be guaranteed in the effective integration and enhancing fair and effective return strategies in line with COM(2017) 211 final – the protection of children in migration.

The fair and transparent distribution of funding between the different objectives of the Fund was a priority for Parliament during negotiations leading to the adoption of that Fund. The amount deducted from budget line 18 03 01 02 has been transferred to new budget line 18 03 01 03.

Heading:Pilot project — A European handbook to fight hate speech

Proposed pilot project foresees the creation of a European Hate Speech Handbook devoted to this issue. In principle, it shall define the concept of hate speech, trolling and phenomena such as patostreaming or, particularly dangerous, social engineering allowing for deliberate manipulation of society. The handbook should become a source of knowledge about the internal laws of all Member States guarantying protection against enlisted phenomena, as well as the legal repercussions foreseen for its propagators.

Project’s implementation foresees planning of meetings with experts from across the European Union, as well as cooperation with local authorities and non-governmental organizations.

The project would be composed of three key elements:

1) Semantics - currently none of the European or national legislation defines precisely hate speech. Therefore, it is necessary to undertake in-depth research to diagnose this issue and determine its main characteristics. The idea would be to feed into the creation of a definition at the European level, which ideally could be applied across EU member states.

2) Diagnosis - due to the lack of concept of the hate speech in the legal order, the project foresees meetings, debates and conferences with experts allowing the approximation of the problem and acquiring of the specialist knowledge. Those activities would be instrumental in sensitizing the society and public authorities about this ever-growing problem.

3) Education - remains one of the crucial elements. It shall be directed towards various social groups in order to efficiently raise awareness about the undeniable problem of hate speech in the modern world. Education factor should mainly rely on the capacity building activities for educational practitioners and be based on the organization of meetings and trainings accompanied by the analysis of legal experts in the field. The focus should be put on raising awareness among children and young people who are considered particularly vulnerable. The importance of the digital habits of this group shall be also taken into account. Eurostat data shows that 93 % of young people aged 16-19 years made daily use of the internet in 2016 compared with 90 % among young people aged 25-29 years. To sum up, an important element of the project will be a grass roots work in schools, as well as interactive meetings, discussions and debates with students and teachers instructing them how to react quickly to the arising threats. Additionally, cooperation with communication services and social media providers is foreseen.

Justification:The project will provide a response to the increasingly spread throughout the EU issue of hate speech. The goal of the project is to understand and prevent this phenomenon. Applicable EU law (Framework Decision 2008/913/JHA) and recommendations of the Council of Europe limit the interpretation of hate speech. In order to efficiently prevent this phenomenon, education of children, young people, education practitioners, as well as other groups, is necessary to assess inappropriate behaviours and to influence its quick exclusion from social life.

Justification:One in three women in the EU has been a victim of physical and/or sexual violence since the age of 15, over half of women have experienced sexual harassment and one in 20 has been raped. The proposed preparatory action would build on the pilot project JUST/2014/RPPI/PR/EQUA/0150 which is reaching its end, and by learning from the lessons of it, the preparatory action would continue contributing in an improved way to the strengthening and further capacity building of Roma and pro-Roma civil society as well as to the monitoring mechanism regarding Roma inclusion, especially with the production and dissemination of independent civil reports where civil society coalitions could present alternative information and data to the reports submitted by Member States concerning the implementation of their strategies. These civil reports could provide local knowledge to national and European policy processes and reflect on the real social impact of government measures.

The monitoring would focus on the local implementation of strategies in the four priority areas (employment, education, housing, health), in the fields of anti-discrimination, fighting against anti-Gypsyism and for gender equality and would also provide information on the level of involvement of civil society, the use of EU Funds and the mainstreaming of Roma inclusion measures.

This pilot project aims to create an EU intersex expert group which will work with policy makers and key stakeholders on the EU and national level to address the fundamental rights violations faced by intersex people. The expert network will work in the administrative, legal, health and educational area and enable the sharing of good practices among the EU Member States in combating discrimination based on sex characteristics.

- Background -

Intersex people are born with sex characteristics that lie between the stereotypical definitions of male and female. Variation in sex characteristics may manifest themselves in primary sex characteristics (sex organs) or secondary sexual characteristics (muscle mass, hair distribution, breast development).

Due to the pathologisation of intersex bodies often corrective surgeries (intersex genital mutilations) and medical interventions are performed on newborns so they fit in one gender category. ‘Sex normalising surgery’ is performed in at least 21 Member States, even though most of the time it is not medically necessary. Medical treatments often have to be repeated throughout childhood and are followed by life-long hormonal treatments, not without consequences for intersex people’s health.

Intersex babies, children and adults are victims to a number of violations of their human rights, dignity and bodily integrity throughout their life, because of non-consented medical treatments, lack of access to their medical files, pathologisation and discrimination. However these human rights violations remain widely invisible and unknown by policy makers.

Over the past five years, international human rights organisations have adopted a number of statements, reports and resolutions regarding the rights of intersex people, the most recent being the resolution 2018/2878(RSP) adopted by the European Parliament on 14 February 2019. The resolution notes « the urgent need to address violations of the human rights of intersex people”. It calls specifically on the European Commission to enhance the exchange of good practices on measures to prevent and address intersex human rights violations, so Member States can eventually adopt appropriate legislation (para 11 & 16), and to support and fund research on the human rights situation of intersex people (para 13). In 2015, a report on "the fundamental rights situation of intersex people" by the EU Agency for Fundamental Rights (FRA) was already recommending for EU institutions to act on intersex human rights violations.

The European Commission has included combatting discrimination of intersex people in the EC List of Actions to Advance LGBTI Equality, with a special focus on awareness-raising through the ‘we all share

the same dreams’ campaign. The pilot project will offer the opportunity to further invest in the work on intersex human rights, developing expertise and data collection, as well as supporting Member States in properly addressing intersex human rights violations and putting in place protection measures.

This pilot project follows recommendations of international and European human rights standards including the EP resolution 2018/2878(RSP).

- Outcomes -

1) An EU forum of legal, sociological, medical and human rights experts on the rights of intersex people collects best practices and provides legal expertise to national policy makers, while working hand in hand with activists and civil society organisations such as OII-Europe.

2) Policy makers in the areas of non-discrimination, justice and gender equality are provided clear guidance, data and expertise to inform legislation and policies protecting the human rights of intersex people in different policy areas.

3) Establishing active conversations, peer learning and exchange of good practice between EU institutions and different member states.

4) Gathering data and exchanging knowledge to ensure evidence-based policy making.

This project should ensure consistency of approach in this project and in future policies and programmes supporting intersex people (EP resolution 2018/2878(RSP), para 14).

EP resolution 2018/2878(RSP) clearly highlights the urgent need to address human rights violations faced by intersex people. Despite few legislative initiatives to protect intersex people from human rights violations and discrimination, the situation still is critical across the EU. This pilot project will contribute to implementing the recommendations of the EU FRA and the EP, including the call on the EC to build knowledge, awareness and capacities of policy makers at national and EU levels to be able to act on the human rights violations faced in all areas of life by intersex people.

Pilot project within the meaning of Article 54(2) of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002 (OJ L 298, 26.10.2012, p. 1).

Justification:Work on intersex issues is underfunded with the EU with the REC-DISC-2018 and 2019 allowing only for 250.000,-€ per project (for up to 24 months) and no operational support for any intersex let organisation available so far.

Human rights violations intersex people face are still commono practice with all EU member states except for Malta and with certain nuance Portugal. As long as this is the case there is obvisouly a strong need for a project that facilitates knnowledge transfer between governments, stakeholders, researchers and intersex people an allies.
