The announcement, by TCEQ, in Waco last March that the new proposed rules would include an Advanced Maintenance Provider Course and that all individuals who intended to remain in the maintenance provider business would have to take this course caused a huge outcry from TOWA Members. The obvious question was what was TOWA going to do about this requirement. This question suddenly became “The” topic of discussion among individuals at the convention. The TOWA Board of Directors met Wednesday afternoon, after the closing of the show, and started formulating battle plans. The membership had “spoken” and expected TOWA to take action which would remove this requirement for another training course. Most of TOWA’s members who were in the maintenance industry felt, and rightly so, that they had achieved a level of expertise that should exempt them from having to attend another maintenance course. Many of these individuals have been maintenance providers for 10 years. They did not believe that another 16 hour course would improve their knowledge base and would just be a waste of their time. The main emphasis of the Board had centered on rebuilding TOWA’s membership but it was apparent that the current membership was more concerned with this proposed rule change. As a result the TOWA Board voted unanimously to take on TCEQ and to obtain an amendment to the proposed rules which would exempt most of our members from having to take this advanced course. The TOWA Board and several TOWA Members worked tirelessly to get State Senators and State Representatives to pressure TCEQ to include an exemption which saved current Maintenance Providers thousands of dollars. When you see a current Maintenance Provider ask them if they are a member of TOWA. If they say NO ask them why they are sitting back and allowing the rest of us to carry their load. Details on the projected savings and TCEQ’s actual wording on the exemption are outlined in detail on another page of this newsletter. I am amazed by the number of people who I talk to on a daily basis who do not have a clue that TOWA has been actively pushing TCEQ, since March 2008, for an amendment to the proposed rules which will save current Maintenance Providers money and time. These same people also are unaware that, due to a lot of hard work by TOWA Members, the Heart of Texas TOWA Chapter and the TOWA Board of Directors we were successful in our eff ort. TOWA’s staff respond to many calls each day from members with questions ranging from how do I obtain parts for aerobic systems to how many CEUs do I have and when is my license due as well as questions on where and when can I attend a class to obtain CEUs. DETAILS “TOWA commented that while they support the need for a licensed maintenance provider, current Installer II and Wastewater C licensees should not have to take an advanced course and examination to obtain a maintenance provider license.” “The commission also received over 250 form letters from members of TOWA.” These form letters supported the exemption for existing maintenance providers.

“ The commission agrees that individuals who meet the requirements of §30.240(e) and who held a current maintenance provider registration on the eff ective date of these rules should be exempt from the requirement for completing an advanced aerobic course and passing the maintenance provider licensure examination, provided that they meet the remaining requirements for licensure as a maintenance provider. As a result, §30.240(e)(7) has been added to allow an exemption for maintenance providers from taking the advanced aerobic maintenance course and licensing examination provided that they meet all of the other maintenance provider licensing requirements as of the eff ective date of these rules.” The eff ective date of the rules was September 11, 2008.

DETAILS ON THE $1200 SAVINGS ABOVE - This exemption saved current maintenance providers some $300.00 in course cost, about $200.00 in motel bills, at least $100.00 in travel expense, probably $100.00 in meals and 2 ½ days off the job (20 hours at $25.00/hour = $500.00. I can’t understand how those of you who have not joined TOWA can, with a clear conscience, just sit back and let your fellow TOWA members carry the weight for you. Think how much more TOWA could have accomplished if you had been supporting us!

I have talked to many installers and manufacturers and they all say the same thing, business is slow. We are at a time when business is slowing down due to the economy, more for some than others. We have had several years of a strong housing market, lots of work and made good money. Some of you went through the same thing back in the early eighty’s when housing hit bottom and people lost money due to builders going broke and not paying their bills. I was not in business for myself back then but worked for a good size company. After getting laid off I went to work doing other things and later started a septic company with a partner and that did not work out. But back to the slow down. I have met lots of business people and have seen them go through bad times. One man I know went to see a business analyst to fi nd out how to save his company. The analyst asked him lots of question about how he was running his business and then he asked, if you were in a car accident and you were cut and bleeding what would you do fi rst? A C said I guess I would stop the bleeding. The analyst said you just saved your business, go back and fi nd where you are bleeding and stop it. After taking a hard look at things he cut out all the unnecessary things and made it though the bad times. So it may be time to take a good look at things and make changes before it’s too late. Just a suggestion for the road ahead. As we head in to these changing times its good to know that TOWA has changed its direction and is looking to the future and helping us along the way. TOWA membership is a necessary expense. It is your professional organization, your “go to” place for industry information.

• HINT!: When you get to this point, mark the page in your browser as a favorite or bookmark!

• Login using “guest” as your Contact ID, and again as your password,

• Select “Local contact search”

• Use the pulldown menu, and select a county. The county selection will provide all authorized agents within the county.

• Select Search

• Select the authorized agent whose order you want to view.

• You will then see a screen with contact information and an item labeled “Current Order (Click to download)”. Select the fi le name shown to the right of the message (It will look like 620nnn.pdf).

Rule Status:

The TCEQ Commissioners adopted proposed revisions to the rules, chapter 30 TAC 285, with an eff ective date of September 11, 2008. Important changes to the licensing and registration requirements were implemented in the licensing rule, 30 TAC 30 (Subchapter G), with an eff ective date of September 11, 2008.

You can download or print the revised rules from the TCEQ website. To view the rules, make the following selections, starting at the TCEQ homepage: RULES>CURRENT TCEQ RULES> VIEW, PRINT OR DOWNLOAD RULES…>.

Changes in the Rules:

Here are some highlights in the rule changes:

• Tank leak testing and riser requirements have been added, along with additional specifi cations for pressurized pipe;

• System design requirements for aerobic treatment unit sizing, food service establishments, high strength wastewater and separation distances for retention, and detention, ponds are now addressed in the rules;

• Requirements for passing under driveways and sidewalks are now included, and other separation distances have been revised;

• Current maintenance provider registration will become a license. • The licensed maintenance provider will be responsible for fulfi lling the maintenance contract and supervising the

work of the maintenance technician.; • The maintenance technician is a new registration for individuals who work in OSSF maintenance, under the

supervision of a licensed maintenance provider. • Maintenance company registrations will not be needed after September 1, 2009. • On September 1, 2009 the licensed maintenance provider will be responsible for fulfi lling maintenance contracts

and all work performed. • Manufacturer certifi cation of maintenance providers is not required, as of September 11, 2008.

These are simply highlights of the rule changes. We encourage everyone to contact TCEQ and your local authorized agent with your questions. This topic is important to your business and there are changes which will aff ect all licensees and regulatory personnel. Read the rules, and ask questions.

Authorized Agent OSSF Orders:

The OSSF orders include local requirements which may be more stringent than TCEQ’s rules. These requirements are enforceable, in the same way that the state rule is enforceable. Also, if you work in multiple counties, cities and/or special districts you may be eff ectively subject to multiple sets of local requirements. You can view, download or print all OSSF orders through the TCEQ web site, using your browser and Adobe Acrobat.

By participating in TOWA’s eff ort you helped TOWA “convince” TCEQ to amend the new rules. TCEQ added an exemption to the new Maintenance Provider rules which will save most current MPs from having to take the new Advanced Maintenance Provider Course. Some of you who sent the forms back did so after the deadline so your names may not appear on this list. and does not insure that everyone in our industry gets a copy of TCEQs response. In fairness to TCEQ they have lost two very valuable employees. These individuals were transferred out of the OSSF branch of TCEQ and this branch is operating shorthanded. This however is a problem created by the Agency but one which is aff ecting most of us working in the fi eld. If you are a TOWA Member and have a question concerning a new rule or the interpretation by a DR of a rule you can email me or fax me a clear, concise explanation of what your question and situation are and I will write to TCEQ, in Austin, and request a written explanation from them. Because of the limited number of hours in a day TOWA can only off er this service to current TOWA Members. TOWA has already performed this service for several TOWA Members. Please do not simply call me. I need something in writing to make sure I am asking the right questions. The above process works but is NOT the ultimate answer to obtaining a clear, concise interpretation when rule changes take place. There must be a better way! TOWA is open to suggestions.

The Same Old Rules ProblemBy Tim Taylor

It seems that it takes forever for news of any changes in the Texas OSSF Industry to be passed on to the people who need them the most, the men and women working in the fi eld. I understand that everyone is busy trying to make a living but the lack of communication in our industry is very hard to understand. What would “seem” to be the natural fl ow of information does not appear to be working. The logical progression, as I see it, would be TCEQ passes information to the DRs and the DRs then pass this information on to the Installers, Maintenance Providers and Manufactures in the DRs area of responsibility. In addition TOWA has attempted to have TCEQ personnel attend local TOWA Chapter meetings to directly inform TOWA Members of rule changes and how

they will aff ect day to day business. This approach by TOWA appeared to be working rather well but TCEQ in Austin is shorthanded and for the immediate future there will be no more appearances by TCEQ Staff at local TOWA Chapter Meetings. Some local DRs are holding meetings in their areas to explain what rule changes have been made and how these changes will aff ect the local onsite industry. This is a great idea but due to local DRs interpreting the rules, as opposed to Austin sending out a concise interpretation, there is much confusion and a lot of ill will being generated. Perhaps it would be a good idea for local DRs to hold meetings to fi nd out which rule changes are open for interpretation and obtaining a clear, concise interpretation from TCEQ and then hosting a second meeting to explain TCEQ’s stance on these rules. I certainly do not claim to have all the answers on how to best handle all the questions generated by a TCEQ rule change but I do know that simply leaving the interpretation of a new rule up to local DRs will lead to mass confusion. TOWA was promised, by TCEQ, that we would receive a document which clarifi ed the changes in the rules. We have yet to receive such a document and as a result TOWA has been writing letters to TCEQ asking for clarifi cation on diff erent sections of the rules as these questions come up. This is a slow, time consuming process

Changes to the OSSF RulesBy Tim Taylor

House Bill 2482 changes

Allows homeowners to maintain their own systems without training or self reporting. This applies only in Counties which have not changes their control orders to adopt stricter standards. Allows DRs to inspect any system at any time and allows DRs to require the homeowner to obtain a maintenance contract if they are in violation and fail to correct the violation within 10 days. If a homeowner violates the rules twice within a three year period they must contact with a maintenance company.

There will no longer be a designation for a Maintenance Company. There will be Maintenance Providers and Maintenance Technicians. A Maintenance Provider must have an Installer II or a Class C wastewater license or 3 years verifi able experience as a Maintenance Provider. They also must have taken the Basic Maintenance Provider Course. If they do not have these credentials before September 11, 2008 they must also take the new advanced Maintenance Provider Course. A Maintenance Technician must take and pass the Basic Maintenance Provider Course

and must work in a company under a licensed Maintenance Provider. They cannot sign maintenance reports or contracts and cannot receive compensation from anyone other than the Maintenance Provider they work for.

No one is required to obtain Manufactures Certifi cation to maintain any brand of aerobic treatment plants.

The following are direct quotes from TCEQ in Austin:

No need to do anything new until after January 1, 2009!• Even then – you have until April 31, 2009 to change

your status, if you prefer.• You can continue to operate as you have until September

1, 2009.

Other Rule Changes A DR who does work in the OSSF industry outside his jurisdiction must notify his employer he is doing so. Eliminates the necessity for a site evaluator to maintain an installer II or DR license for renewing a site evaluators license. Registered Sanitarians may now design OSSF systems on buildings whose slabs exceed 5000 sq.ft. Any site that is generating food service waste must have a system designed to handle high strength waste. The minimum acceptable BOD5 from a site serving food is 1200 mg/l. It is no longer acceptable to spray irrigate in dedicated easements such as overhead power line easements. Aerobic Treatment Plant sizing has changed. A 500 GPD plant is no longer acceptable on a 5 bedroom house. The pump tank sizing and disposal fi eld sizing has not changed. Check the tables in the new rules for exact sizing. Aerobic tank sizing is now based on 120 gallons per bedroom. All sprinkler lines must now be SCH-40 purple pipe. Some counties have started requiring this eff ective September 11, 2008 while others are allowing suppliers to use up their inventories. Check with your DRs.
