the House that are friends of vocational educationo You

have sbown vour concern for us recentlv when you passed the

VIP... which gives concern for the students in our schools.

This year the recipient is a graduate of the University of

Illinois and father of three children. He has a long

record of achievement in the #-H Clubsv both as a member

and as a club leader for the past 31 years. As a ?outh, he

received the bighest honors in &-H, serving as a delegate

to the National #-H in Chicago and the National #-H... in

Washington. He eas appointed Itlinois Director of

Agriculture in t970. He has been a promoter of industrial

Illinois agriculture in Europe. Russia and Japan. He was

elected as a State Representative in the 88th District in

November 1978 and he remains that District*s

Representatlve. The legislative chairman of IIEA gave me a

that :r. Ropp has done here in tbe Legislature. Uhat I

would like to saM is that when I came to lllinois in 1956

as a member of the facultv of Illinois State Universitv,

one of the first things that was told as I worked...

organizations was that if you need some help with programs,

we have a great member in our community, Mr. Clarence Ropp.

I immediately took hold of that and whenever 1 needed

proqramsv I found the man that was interested in students,

in the youth and recognized these youth as a natur... one

of our greatest natural resources. Iem proud to sav that

this was passed onto his son, and I*m proud today to

present this award to Gordon Ropp, outstanding tegislator,

for his contributions of vocational aod industrial

technology education. Congratulations.o

finds itself bankrupt. The purpose of the Amendment is oot

to set a precedent for statewide relief. I understand that

this Bill creates a separate authority for the purpose of

these bailouts. He are not necessarily opposed to helpkng

Robbins. He are reluctant to allow tbis agency to be

the home rule powers would be left in tact. I guess my

response is that the home rule powers applv only to

municipalities in excess of 254000. decause of that and

because of the substantial number of municipalities between

104000 and 25,000, it is our position tbat Amendment 4%

does not adequately address our concerns. He would ask to

proceed with Amendment 91.4:

this commission to be set up and assist them to try to

alleviate the financial problems that tbey have. This ls

an important Bill not only for one municipalit? in the

state. This could be... This is a Bill that would glve

other municipalities, other municipalities without the

clout, of munîcipalities over one million, to be able to

come to us and sa#, *Look, we have a legitimate problem.

He need your expertise to try to help us out of it.:

of the House. I Just wanted to reiterate the arguments in

opposition to the Amendment. The Gentleman, the Sponsor of

the Bill, has indicated that he would use the 25,000

population limit, whîch is a logical choice in tbat ites

alreadv in the statutes. The population of Robbins, I

understand, is abeut 8500 people. By taking an arbitrarv

figure of 1040004 it*s very close to the population of

Robbins. It doesn*t seem to me to make any sense. If a

munîcipality of 1t4000 has the same problems that Robbins

hasv it would seem to me that this same Bitl should apply

to them as well. So4 for that reasonp l uould support the

Sponsor of the Billes position that he is opposed to the

Amendment, and I would ask for a eno* vote.e:

apply to a specific situation. don't think in my 20

years in the Legislature that we have faced any similar

situation as we*re facing in the community of Robbins

today, and I think with this Amendment we are going to

narrow the focus of this issue down as closelv as we can

and in a reasonable wa9 that think we can all feel secure

with. And for that reason, and with a1l due respect to the

Sponsor of the legislation. endorse the ûmendment

provided bv the Representative from Eook and would ask the

rest of the Members of the General Assembly to do

likewise.fê

Mccracken: t.Thank you. hlr. Speaker. I#d like to address the

Amendment as eell. The first part or the Amendment allows

the Comptroller in his discretion to create the Eommission

and that if he chooses to do so in his discretion, he must

do so eithin 30 davs. Nowv the purpose for this is not to

slow down anv response to the emergency, if@ in factv it is

valid. This is used as a check by which the Comptroller

may pass upon the validity of the emergency. If this check

is not in place, then the mere expression by the local

autborities of an energency requires the creation of the

commission and, in fact, puts into play al1 of these items

and powers by which is autborîzed under this ôill. Sov

we think that that is an appropriate check. given the fact

tbat this is going to be the creation of an agencv able to

incur financial obligations; that ites appropriate that

there be a check of some sort upon its creatîon. If tbe

Comptrollerv who currently is a meuber of the Democratic

Party. chooses to create the commisslon. he will. in

effect. agree that an emergency exists. He don*t think

that*s onerous. He donet think that*s unfair. We think

tbat the state should have some sort of discretion in

enterinq into this compact. in essence, with this

commission. The second portion of the âmendment, likewise,

is in the nature of a safeguard against the statees being

involved too greatl? for the expenses created by the

commission. Section l04 as amended by this Amendment,

would now read that the General Assembl: maM appropriate

monies to the comaission solely for reimbursing commîssion

membars for necessary and actual expenses incurred. Right

now, there is no limitation upon; onev the ability of the

commission to incur debt; twov the reasons ror that

incurring of debt; and threev the aaount of debt. This

Amendment seeks to limit ehat wa can be obligated to by

this quasi-independent. or semi-independent commission.

There Ss absolutely no reason to feel that this an undue

restraint upon the commission. And in deletinq the Section

of... on page l2. lines :9 through 2: of tbe Bil1. merelv

conforms it to this previous Amendment that the General

Assembly shall reimburse commission members and appropriate

for tbat purpose onlv. You:ve got to rememberv this

authority has the ability to raise money on its own. Hhat

is the... what is tbe need for giving a cart blanche right

of incurring debt payable out of the Generak Revenue Fund?

There is no valid purpose for it. 1 submit that thls

Amendment does no harm to the Bill. It offers appropriate

safeguards. It offers appropriate checks and balances.

So4 I think that this ls an Amendment whicb the Sponsor and

those in favor of tbis legislation can live with. And in

the absence of tbis Amendmentv Rr. Speakerv would

encourage my friends on this side of the aisle to not agree

witb this legislation. The precedent it creates is a ver?

wide-rangingv potentiall? harmful precedent which can

opposition to Amendment #2. And in listening to the

debate. lem not so sure weere reading the same Sllt. Ieve

Neard that we need to provide 30 days to the Comptroller to

be able to determine whether or not a fiscal emergency

exists. I contend that that is not necessar? because in

order for the local authority to invoke the clauses

contained in House Bill 300. they aust, in fact, ensure

tbat there is a fiscal emergenc? and there is onl: certain

items that would be defined as fiscal emergencies. Number

one would be the existence of a default in the payment of

principal and interest on any debt obligation for more than

90 days. That certainlv would be a fiscal obligation or a

fiscal emergency. The failure to make pavment over 20

percent of al1 payroll to employees, etcetera, etcetera,

etcetera, etcetera. Those are specific indications tbat

allow those local... that local unit of government to

invoke the provîsions of House 3i1l 300. And, in factv

when they dov it has to be by a two-thirds vote. So4 when

we've heard the comment about a mere expression b: locat

authorities, that simply not the case. House Bilt 300

is quite to the point as to what constitutes a fiscal

emergency and how Lhose local authorities can come to the

state. So, tbe Comptroller certainly needs... does not

need another 30 days, because it:s limited as to how this

authority can be invokedo With regard to Section l0# we#re

saving that tbe commission members can be reimbursed for

their expenses. for their actual expenses; howeverv there

a legitimate. good-faith attempt not to bailoutv because

there are no bailout monies that are... that are specified

in the Bill and certainlv anything over and above would

have to be approved by the General Assembtv. Mhat weere

providing for these local governments is their fiscal... is

our fiscal expertise to help them get back on track again.

within those confines, we have established certain

addresses is one that allows an extra perlod for

implementation by the Comptrotler, an extra review by tbe

Malority of 60 votes. 3ut the question vou ask yourself

is, does reallv affect what the Sponsors believe it to

affect? And 1 think on reflection the answer is probabl:

no. This does not supersede bome rule powersv but the

question is4 wby would there be a conrlict between this Act

and home rule powers? If a home rule communitv came to the

Comptroller and certified a fiscal emergency, I donft see

an? conflict between local law and tbe state statutes Wbich

would necessarilv render this an issue of preemption. So,

1 don#t think it does what. in fact, the Sponsors believe

it does. I certainl? know that they act in good faith and

that that is the intent of their Amendaent, but I believe

tbe fact of the matter is that vou will not find a

situation of conflict whera the state is seeking to

supplant home rule authority or municipal authoritv. This

is triggered b? a request of the municipalitv to receive

help from the state. That's the only wav it's triggered,

real meaning of the Amendment is that it requires only a

Eonstitutional llaloritv to pass this Bill. 1 think that

although the author of the Amendment cartainly sincere

in his intentv the fact of the matter is it has no bearing

on the issue of the scope of this provision. The scope of

this Bitt. wîth or without thîs Section in the statute,

will remain a11 municipalities în the State of Illinois

which first request or dzclare the fiscal emergencv. l

would ask evervbodv to vote against tbis Amendment, retain

this home rule preemption ghich the Bill bow has and which

will then require an Extraordinary zlalority for passage./
