Chief Executive’s Report

(Chief executive Report on submissions received on part VIII PLANNING Application for rock face stabilisation and railway protection works - PLunkett Railway StationJanuary 2019) (Waterford City and COunty Council) (Chief Executive’s Report)

Introduction

This Chief Executive’s Report forms part of the statutory process as required by Part XI of the Planning and Development Act 2000 (as amended) and Part VIII of the Planning and Development Regulations 2001 (as amended).

The Chief Executive’s Report summarises and details the outcomes of the public consultation on the Part VIII Planning Application relating to the stabilisation of the rock face and railway protection works in the vicinity of Plunkett Railway Station, Waterford.

A description of the nature and extent of the proposed development including a plan of the proposed development and map of the area to which it relates (Section 1 and Appendix A).

An evaluation of whether or not the proposed development is consistent with the proper planning and sustainable development of the area (Section 1.3).

The screening determination on why Environmental Impact Assessment (EIA) is not required (Section 1.4).

A list of the persons or bodies who made submissions or observations (Table 2.1).

A summary of the issues raised and the response of the Chief Executive (Table 2.2. and Table 2.3); and;

A recommendation as to whether or not the proposed development should proceed with as proposed, or as varied or modified as recommended in the report or should not proceed with, as the case may be (Section 3).

Description of the Proposed Works - Consultation

The notice of the Part VIII planning application for the rock face stabilisation and railway protection works was advertised in the Irish Examiner, a national newspaper, on Thursday 8th November 2018 and placed on public display on site from 8th November to 6th December 2018.

Plans and particulars of the proposed development were made available for inspection or purchase, at the Council offices in Waterford City and Dungarvan between the hours of 9.30am to 4.00pm Monday to Friday for the period 8th November to 6th December 2018 inclusive (excluding Bank and Public Holidays).

A copy of the plans and particulars were also available to view online, on Waterford City and County Council’s website at http://waterfordcouncil.ie/projects/public-consultations/index.htm

Notice was also given to prescribed bodes in accordance with Article 81 of Part 8 of the Planning and Development Regulations 2001 (as amended) and circulated internally within the various departments of WCCC including Planning, Architects, Conservation, Heritage, Water Services, Roads and Environment.

Prior to the publication of the notice, public consultation involved:

Briefing the Elected Members of Waterford City and County Council;

Meetings with stakeholders, including:

· Irish Rail

· NTA

· Bus Eireann

· The prospective North Quays SDZ development company

Subsequent to the publication of the notice, the Elected Members for Ferrybank were briefed on the contents of the Part VIII proposals at the joint meeting of the Piltown and Waterford Metropolitan Municipal Districts on 5th December 2018.

Summary of the Proposed Development

The nature and extent of the proposed works, as described in the notice is as follows:

Waterford City and County Council advertised the Part VIII planning application for

“Remedial works consisting of a combination of rock face stabilisation and railway protection works in the form of rock fall protection systems and drainage measures to approximately 400 metres of rock face located immediately to the north of Plunkett Railway Station in the townland of Ferrybank, Waterford. A protected Irish Rail signal box (Recorded Protected Structure, RPS 571) may require to be taken down and stored off site in the interest of avoiding accidental damage, such determination, if required will be made prior to the commencement of the stabilisation works.”

The proposed development will be carried out in the townland of Ferrybank, Waterford.

Refer to Appendix A of this Report which includes a plan of the proposed development and appropriate map of the area.

Planning Policy

The need for the proposed development stems from a principal goal of the North Quays Strategic Development Zone (NQ SDZ) Planning Scheme (adopted in February 2018) “to provide for a sustainable transport hub on the North Quays.” In order to facilitate this, passenger trains on the Dublin to Waterford Railway Line will be required to continue past Plunkett Station along the existing Waterford to Rosslare railway corridor to a proposed new Transport Hub adjacent to the SDZ site. In order to secure the safety of this railway line, an approximately 400m long rock cutting located immediately adjacent to the line in the vicinity of the existing Plunkett Station will require remedial works.

Historically, a number of landslides have occurred along the extents of this rock face. Iarnród Éireann track inspection records provide evidence of this with rockfall of varying size being recorded in the 1950’s, 1977, 1983 and 2013.

In order to reduce the risk of global slope instability and of rockfalls which could affect railway infrastructure and public safety including Irish rail staff, remedial works in the form of rock bolting, netting & drainage measures (stabilisation) and rock fall barriers and embankments (protection) are proposed.

A review of other national, regional and local planning policy documents has been undertaken. The key policy documents relating to the proposed development are discussed below.

Project Ireland 2040: National Planning Framework and National development Plan 2018-2027

As part of Project Ireland 2040, the Government announced the establishment of a new Urban Regeneration and Development Fund (URDF). The Department of Housing, Planning and Local Government (DHPLG) has responsibility for implementing the URDF, which has an allocation of €2 billion in the National Development Plan (NDP) to 2027, primarily to support the compact growth and sustainable development of Ireland’s five cities and other large urban centres.

In line with the objectives of the National Planning Framework (NPF), the Fund is designed to leverage a greater proportion of residential and commercial development, supported by infrastructure, services and amenities, within the existing built ‘footprint’ of our larger settlements. The proposed development supports national policy and the NPF objectives.

Regional Planning Guidelines for the South East Region 2010-2022

The Regional Planning Guidelines support the re-development of the North Quays. It was included as a Critical Enabling Investment Priority in the RPGs in 2004. Through the

“Expansion of the commercial and civic centre of Waterford City through the redevelopment of the North Quays.” These proposed works will facilitate the relocation of the train station which is an integral part of the North Quays SDZ Planning Scheme.

The NPF and NDP and the associated legislative framework will guide the Regional Assemblies’ delivery of statutory Regional Spatial and Economic Strategic (RSESs) which will supersede the current RPGs and which have recently been published in draft form as outlined below.

Draft Regional Spatial & Economic Strategy for the Southern Region (2018)

As part of the Draft Regional Spatial and Economic Strategy for the Southern Region the Waterford Metropolitan Area Strategic Plan (MASP) Policy Objective 6 on Sustainable Transportation includes the following text and objective with regard to the relocation of the Plunkett train station from its current location to a more central location in the North Quays SDZ site with more direct access to city centre on the south shore:

a. “It is an objective to prepare a Waterford Metropolitan Area Strategic Transport Strategy during the lifetime of this MASP with all relevant stakeholders and it is an objective to ensure investment and implementation of the Waterford Metropolitan Area Strategic Transport Strategy.

b. Local Authorities and public bodies including state transport agencies shall prioritise investment in the following road and rail infrastructure in the Metropolitan Area in support of Modal Shift from the private car to sustainable transport subject to the outcome of environmental assessments and the planning process, including measures to address environmental issues associated with brownfield development:

· Relocation of the Railway Station to the North Quays…”

The Draft RSES also refers to Transforming Waterford – Integrated Transport Proposal which includes the Integrated Transport Hub as a key requirement for the delivery of the SDZ and the transformation of Waterford City (described below). The rock stabilisation and railway protection works are key to enabling this transport hub to be developed.

Waterford City Development Plan 2013-2019

Waterford City Development Plan 2013-2019 supports the development of the North Quays SDZ and is a zoned ‘opportunity site’.

A range of objectives support the proposed development, these include:

Support for the PLUTS is included in the City Development Plan and states “Provision of a rail-passenger platform on the North Quays as part of a new Public Transport Interchange”;

To “ensure mixed-use and well-designed higher density development, particularly near town centres and public transport nodes like railway stations.”

“To expand the network to connect the city centre to any proposed North Quay development with a foot/cycle bridge. (OBJ 6.2.2)”

“To provide cycle and walking networks between neighbourhood areas, further negating the need for car based journeys. (OBJ 6.2.4)” (P.87)

“Surface water runoff from all new hard-surfaced infrastructure draining directly into the River Suir and John’s River shall be considered for appropriate hydrocarbon interception where the risk of hydrocarbon pollution is deemed significant, and the feasibility of retrofitting such interception to existing infrastructure, where such a significant risk is identified, will be examined. (OBJ 6.2.19)”.

To protect and enhance the vibrancy and vitality of Waterford City Centre. (OBJ 2.1.7)

Transforming Waterford: Integrated Transport Proposal

Waterford Planning, Land Use and Transportation Study (PLUTS) was adopted by Waterford City and County Council in 2004 to provide a vision and strategy for the development of Waterford City and Environs up to the year 2020. A key element of the strategy is to allow the City to reinforce and develop its role as the economic driver of the South-East region of Ireland. It states that one core provision of PLUTS is the:

“provision of a rail-passenger platform on the North Quays as part of a new Public Transport Interchange.”

3(f): Integrated Transport Hub – Redefining Urban Transport Model Integration describes how the existing transport integration in Waterford City is:

“exceptionally poor and is significantly damaging efforts for modal change. The existing Railway Station is at the heart of this problem with its location at Rice Bridge and restricted/nearly unsafe access denying integration with other modes of transport and compromising the commerciality of inter-city train services.

This is further compounded by the station being restricted to one platform and passenger trains not being allowed access beyond a certain point due to an unstable rock face. No capacity to improve the situation is available at the current location due to the restrictions in width imposed by the station residing between the River Suir and the imposing cliff face to the North.

Redevelopment of the North Quays provides an opportunity to dramatically alter circumstances and to provide a unique transport interchange facility incorporating a fully enclosed facility for walkers, cyclists and train, bus and car users. The combination of pedestrian bridge, green route, train and bus services will be unique in Irish circumstances and as near optimal as can be achieved anywhere in this country given the nature of our city centres.”

The redevelopment of the North Quays and the relocation of Plunkett Railway Station provides an opportunity provide an integrated transport hub which is accessible for walkers, cyclists and train, bus and car users.

North Quays Strategic Development Zone Planning Scheme (2018)

The North Quays Strategic Development Zone (SDZ) Planning Scheme was adopted by Waterford City and County Council in February 2018. The Planning Scheme sets out a vision to:

To create a sustainable, compact extension to the City Centre that will serve a future population of 83,000 people.

A regeneration catalyst for the City and Region and the establishment of a sustainable modern city quarter.

Creation of an integrated multi-modal transport hub designed to sustainably meet the access requirements of the City.

Building on the context and the riverside location of the site to create a high-quality urban quarter as a natural extension of the City Centre.

The Planning Scheme vision is supported by a range of principal goals. The following are the Goals relevant to the Proposed Development:

To provide a sustainable transport hub on the North Quays.

To provide for sustainable patterns of movement and access with priority for pedestrians, cyclists and public transport.

The Vision and Goals are supported by several ‘Specific Objectives’ relating to: Physical and Social Infrastructure. Planning Strategy, Architectural Strategy and Actions and Implementation objectives. The Planning Scheme details the Access Strategy that is required as part of the development of the North Quays SDZ in order to improve access and connectivity to the site. The proposed development is consistent with the Vision, Goals and objectives of the Planning Scheme and the access strategy.

Chapter 1.9 of the North Quays Strategic Development Zone Planning Scheme (2018) states how one of the visions for the North Quays Strategic Development Zone Planning Scheme is the creation of an integrated multi-modal transport hub designed to sustainably meet the access requirements of The City. It states that:

“Specifically, it is proposed to relocate the train station to the North Quays close to the new sustainable transport bridge creating a new integrated transport hub.”

Chapter 3a.6 states that:

“The development of the North Quays area presents an opportunity, long acknowledged as being necessary, for the City to relocate the train station from its present isolated location to the west of Rice Bridge into the City Centre. “

“The Planning Scheme envisages the realisation of this opportunity and takes the opportunity to further develop the principles of the PLUTS strategy by ensuring that the design of the North Quays and surrounding roads encompasses a transport hub where pedestrian cycling, car, rail and bus users can interchange in a comfortable environment.”

The Waterford Planning, Land Use and Transportation Study 2004 (PLUTS)

The Waterford Planning, Land Use and Transportation Study 2004 (PLUTS) recognises the potential of the North Quays as an extension of the city centre and prioritises a new city centre pedestrian bridge and a new public transport interchange at the North Quays. Key recommendations of the PLUTS include:

A new City Centre bridge for pedestrians and cyclists which will link the redeveloped North Quays with the existing City Centre;

Provision of a rail-passenger platform on the North Quays as part of a new Public Transport Interchange.

A future 3rd bridge crossing downstream on the Suir which would complete the loop around the system connecting the N25 Bypass, the River Suir Bridge and the Outer Ring Road.

Waterford City Centre Urban Renewal Scheme (2015)

The Urban Renewal Scheme outlines public realm upgrades, alterations to traffic circulation and urban realm improvements. Its vision includes maximising the potential of the City Centre to continue to grow as a national and regional destination. The North Quays is located in a brownfield site located in the city centre. The regeneration of the SDZ has the opportunity to compliment and facilitate the urban renewal of this area and Waterford city through integrated transportation proposals including proposals for a new transportation hub.

Evaluation of the Planning Policy

Having regard to the provisions of national, regional and the current Waterford City Development Plan and the North Quays SDZ Planning Scheme as described above, this evaluation has found that the proposed development supports and is consistent with the proper planning and sustainable development of the area to which the proposed development relates, for the following reasons:

1. A principal goal of the North Quays (SDZ) Planning Scheme adopted in February 2018 is “to provide for a sustainable transport hub on the North Quays.” In order to facilitate this, passenger trains on the Dublin to Waterford Railway Line will be required to continue past Plunkett Station along the existing Waterford to Rosslare railway corridor to a proposed new Transport Hub adjacent to the SDZ site. In order to secure the safety of this railway line, an approximately 400m long rock cutting located immediately adjacent to the line in the vicinity of the existing Plunkett Station will require remedial works.

2. The proposed development broadly supports the policies and objectives of the Waterford City Development Plan 2013 – 2019 and in particular will support the relocation of Plunkett Railway Station to the North Quays SDZ Transport Hub and enhance the vibrancy and vitality of the City Centre which is a key objective of the Development Plan

3. The proposed development aligns with the vision, aims and objectives, and the access strategy contained within the North Quays SDZ Planning Scheme (2018).

4. The proposed development also aligns with the NPF and the draft RSES in that its objective is to enable Waterford to become a Regional City of scale leading the economic recovery of the South East and expanding and enhancing the local economy to realise the potential of the City and the region as a whole. The regeneration of the North Quays SDZ and the relocation of the Plunkett Station to a more central location providing more direct connectivity to the City Centre and the southern shore is identified as a key growth enabler for Waterford.

Environmental Impact Assessment Screening Determination

Waterford City and County Council has carried out an Environmental Impact Assessment (EIA) Screening Report in accordance with requirements of Section 120(1B)(b)(i) and has determined that there is no real likelihood of significant effects on the environment. Accordingly, it has determined that EIA is not required in respect of this proposed development. The EIA report and recommendation of the screening were made available with the Part VIII planning application for the duration of the consultation period.

A total number of four submissions were received within the statutory timeframe. The person/ organisation and/ or prescribed bodies who made the submissions are detailed in Table 21.

Department of Culture Heritage and the Gaeltacht

The proposed development may require the dismantling and off -site storage of a signal box which is included on the Record of Protected Structures in the Waterford City Development Plan 2013-2019 [RPS 571] and which was recorded by the National Inventory of Architectural Heritage [NIAH 22500027] with a Regional Rating Value.

In the event that the signal box is to be dismantled and stored off site to facilitate the proposed development the Department makes the following recommendations:

· A full survey is made of the protected structure, including measured elevations and plans and a photographic record annotated and cross-referenced with the elevations and plans, in order to facilitate a faithful reconstruction of the protected structure on completion of the proposed development.

· Every care should be taken during the dismantling, off-site storage, and reconstruction of the protected structure to ensure that the protected structure and its features of special interest are protected from damage as per Architectural Heritage Protection – Guidelines for Planning Authorities (2011).

· The applicant shall engage appropriately qualified and competent professionals, as necessary, to specify the works and oversee their correct completion on site.

· The works shall be undertaken by skilled and experienced contractors and specialists with relevant experience of traditional materials and techniques.

Archaeological:

Having considered the submitted information, and further information as submitted on 21st December 2018 that included an Archaeological Impact Assessment for remedial works to the Rock face at Mount Misery, the National Monuments Service agrees in principle with the proposed mitigation for archaeological monitoring, with the following additional requirements:

· It is advised that the vegetation clearance on the top of the rock, that needs to be done as part of the works, is undertaken well in advance and under close archaeological supervision/monitoring. No clearance or other works shall take place on the top of the rock without the presence on site of the monitoring archaeologist.

· Once the recorded archaeological monuments have been located, a dedicated/specific report shall be submitted to the National Monuments Service as Further Information with details of proximity of proposed works to the archaeological monuments and an updated archaeological mitigation strategy shall be proposed as part of the Impact Statement in the report. The National Monuments Service shall then make further comment in this regard.

· The above requirement for clearance well in advance is to ensure that no delays will occur to the proposed works from an archaeological perspective, as it will allow time to mitigate any archaeological requirements that may arise.

Archaeological Monitoring:

· All works are subject to close archaeological supervision/monitoring. No further clearance or other works shall take place in relation to this application without the presence on site of the monitoring archaeologist.

· All works within the zone of protection for the recorded archaeological monuments shall be subject to full and close archaeological monitoring. Should evidence of the standing stones be identified, further archaeological mitigation by way of testing may be required. The monitoring archaeologist shall consult with the Department in this regard.

· The applicant shall engage the services of a suitably qualified and suitably experienced archaeologist to carry out the monitoring.

· The monitoring shall be licensed by the Department and a detailed method statement shall accompany the licence application.

· A detection device licence shall also be taken out by the archaeological to cover all metal detection of soil removed within the zone of protection for the recorded monument as part of the proposed drainage works.

Contents of the submission are noted. WCCC commits to including all additional built heritage mitigation measures as listed in the submission at construction stage.

WCCC provided the DAU with a report ‘Remedial Works to the Rock Face at Mount Misery, Waterford’s North Quays on behalf of Waterford City and County Council’s Economic Development Division’ completed in December 2018 that addresses many of the archaeology issues raised and includes recommendations that WCCC will bring forward as part of the proposed development.

Recommendation: WCCC commits to including all additional archaeological mitigation measures as listed in the submission at construction stage.

Further to Waterford City and County Council, Compulsory Acquisition of Land Notice in the Waterford News and Star, dated the 30 of October 2018, Waterford Golf Club claims ownership to the land labelled unregistered, by virtue of many years of exclusive occupation and periodic maintenance.

Recommendation

Having regard to the provisions of national, regional and local policy (in the current Waterford City Development Plan 2013-2019, the North Quays SDZ Planning Scheme (2018) and PLUTS) as described above, this evaluation has found that the proposed development supports and is consistent with the proper planning and sustainable development of the area to which the development relates.

The results from the consultation period, including the submissions and observations received and meetings held with stakeholders has resulted in no changes to the proposed development. The recommendations included in Tables 2.2 are recommended to be included.

It is recommended that the proposed development should proceed as detailed in this Report.

Next Steps

The members of a local authority shall, within 6 weeks of the receipt of this Report consider the proposed development and the contents of this Chief Executive’s Report.

Following the consideration of this Chief Executive’s Report, the proposed development may be carried out as recommended in the Chief Executive’s Report, unless the local authority, by resolution, decides to vary or modify the development, otherwise than as recommended in this Report, or decides not to proceed with the development.

For a resolution to have effect as per above, the resolution has to be passed not later than 6 weeks after the receipt of this Report, and in the case of a resolution not to proceed with a proposed development, it shall state the reasons for such resolution.
