These are available at the meeting and at local libraries and Information and Advice Centres) (iv) Environmental and Highway Services The Area Conditions Officer and Highways Officer will attend the meeting to provide an update on matters raised at the last Area Committee meeting. The Area Committee is requested to recommend that the Service Director (Communities) grant a management licence to the Stockport and District Anglers Federation to manage and bailiff angling activities at Abney Hall Park pond. CHURCH STREET AND MARY STREET, CHEADLE – PROPOSED CONFIRMATION OF EXPERIMENTAL TRAFFIC REGULATION ORDERS To consider a report of the Service Director (Environment) (Enclosed) The report informs the Area Committee of the results of a public consultation exercise carried out concerning the proposal to confirm experimental orders to permanent traffic regulation orders in Church Street and Mary Street, Cheadle. (Enclosed) The report requests the Area Committee to reconsider a request from the Trustees of Cheadle Town Football Club to acquire the Councils freehold interest in the land and buildings currently leased to them. CHEADLE AREA COMMITTEE Meeting: 14 September 2010 At: 6.00 pm PRESENT Councillor Pam King (Vice Chair) in the Chair; Councillors Peter Burns, Sylvia Humphreys, John Pantall, Adrian Nottingham, Iain Roberts and June Somekh. 1. MINUTES The Minutes (copies of which had been circulated) of the meeting held on 17 August 2010 were approved as a correct record and signed by the Chair. Councillor Peter Burns requested that the Head of Area Governance clarify at the next Area Committee meeting the costs associated with the deployment of the ' Mobile Speed Sign Road Safety Initiative ' (see minute 13 of the meeting held on 17 August 2010) for the Heald Green Ward. 2. DECLARATIONS OF INTEREST No declarations were made. 3. PROGRESS ON AREA COMMITTEE DECISIONS A representative of the Head of Area Governance submitted a report (copies of which had been circulated) updating the Area Committee on progress since the last meeting on decisions taken by the Area Committee, the current position on Ward Flexibility Funding and the Highway Maintenance and Traffic Management delegated budgets. RESOLVED – (1) That the report be noted. (2) That the Service Director (Environment) be requested to provide an update as a matter of urgency in respect to what action has been taken to address the problems associated with flooding at (i) Ladybridge Road and (ii) Broadway/Wilmslow Road. 4. URGENT DECISIONS No urgent decisions were reported. 5. COMMUNITY ENGAGEMENT (i) Chair’s Announcements The Chair read out a letter received from the Cheadle Green Focus Group thanking the Area Committee for their donation and explaining that the archaeological dig and Launch weekend had been a great success with an estimated 800 people taking the tour around the Cheadle Hall dig. All the comments from local residents were very positive with everyone looking forward to the Green being landscaped and the pond updated with lighting and a Fountain.

(ii) Neighbourhood Policing Inspector Gilbertson, Greater Manchester Police attended the meeting to answer questions from Councillors and members of the public in relation to Neighbourhood Policing issues within the Cheadle Area Committee area. The following issues were raised/comments made:- Francis Avenue Gatley - Cannabis arrests Planning for Halloween and Bonfire nights Crime prevention Tesco robbery and associated arrests Anti-social behaviour in Heath Bank Park Crime on Turves Road and Albert Road Cars parking on pavements on Finney Lane Underage drinking and the role of Trading Standards

RESOLVED – That Inspector Gilbertson be thanked for his attendance. (iii) Public Question Time No questions were submitted. (iv) Environmental and Highway Services A representative of the Head of Area Governance reported that the Highways Officer and Area Conditions Officer had been unable to attend the meeting. RESOLVED – That the report be noted. (v) Petitions No petitions were submitted. (vi) Open Forum No organisation had indicated that they wished to address the Area Committee as part of the Open Forum arrangements. (vii) Ward Flexibility Funding There were no ward funding applications to consider. 6. DEVELOPMENT APPLICATIONS A development application was submitted. (NOTE: Full details of the decisions including conditions and reasons for granting or refusing planning permission and imposing conditions are given in the schedule of plans. The Corporate Director, Communities, Regeneration & Environment is authorised to determine conditions and reasons and they are not therefore referred to

in committee minutes unless the committee makes a specific decision on a condition or reason. In order to reduce printing costs and preserve natural resources, the schedule of plans is not reproduced within these minutes. A copy of the schedule of plans is available on the council’s website at www.stockport.gov.uk/planningdecisions. Copies of the schedule of plans, or any part thereof, may be obtained from the Communities, Regeneration & Environment Directorate upon payment of the Council’s reasonable charges). A representative of the Head of Area Governance outlined the procedure approved by the Council for public speaking on planning applications. In respect of plan no. 44595 for a single storey side extension and erection of 1.8 metre fence to enclose side garden at 23 Crescent Grove, Cheadle, a member of the public spoke against the application and the applicant spoke in support of the application, It was then RESOLVED - That planning permission be granted. 7. APPEAL DECISIONS, CURRENT PLANNING APPEALS AND ENFORCEMENTS A representative of the Head of Area Governance submitted a report of the Service Director (Legal & Property) (copies of which had been circulated) listing any outstanding or recently determined planning appeals and enforcements within the area represented by Cheadle Area Committee. RESOLVED –That the report be noted. 8. DISTRICT CENTRES STREET TRADING A representative of the Head of Area Governance submitted a report of the Service Director (Environment) (copies of which had been circulated) informing the Area Committee that all legal proceedings required to change the status of the Cheadle, Hazel Grove, Edgeley, Reddish and Romiley District Centres to 'Consent Street' areas for the purpose of street trading had now been completed. RESOLVED – That the report be noted. 9. LICENSING POLICY CONSULTATIONS A representative of the Service Director (Environment) submitted a report (copies of which had been circulated) requesting the Area Committee to comment on and if necessary make suggested amendments to the licensing policy documents in respect to the licensing of premises under the Licensing Act 2003 and the licensing of sex establishments under the Local Government (Miscellaneous Provisions) Act 1982, as amended by the Police and Crime Act 2009. The following issues were raised/comments made:-

It would be useful to have an annual report providing details of establishments

which provide late night refreshments and their operating hours. Sex establishment locations should be restricted to a designated area in the

Town Centre and the potential for them being located in District Centres should be resisted.

RESOLVED – That the report be noted and the comments be forwarded to the Service Director (Environment). 10. MOTCOMBE ROAD, HEALD GREEN - 'NO BALL GAMES SIGN' A representative of the Head of Area Governance reported that this item had been placed on the agenda at the request of Councillor Adrian Nottingham. Councillor Nottingham submitted a report (copies of which had been circulated) explaining the investigation he had carried out concerning disturbances on Motcombe Road and suggesting that the problem could be alleviated somewhat through the erection of a 'No Ball Games Sign'. RESOLVED – That in view of the investigation carried out by Councillor Nottingham and the advice provided the Service Director (Communities) the Executive Councillors (Transportation) and (Communities) be recommended to approve the installation of a 'No Ball Games Sign' on Motcombe Road. 11. VENUE FOR AREA COMMITTEE MEETINGS A representative of the Head of Area Governance reported that this item had been placed on the agenda at the request of Councillor Mick Jones. RESOLVED - That consideration of this item be deferred until the next meeting of the Area Committee. 12. APPOINTMENT OF COUNCILLORS TO LAY WREATHS AT REMEMBRANCE DAY SERVICES ON 14 NOVEMBER 2010 A representative of the Head of Area Governance submitted a report (copies of which had been circulated) requesting the Area Committee to nominate Councillors to lay wreaths at Remembrance Day Services on 14 November 2010. RESOLVED – That the following Councillors be nominated to lay wreaths at the Remembrance Day Services indicated on 14 November 2010: Cheadle - Councillor Paul Porgess Gatley - Councillor Mick Jones Heald Green - Councillor Peter Burns 13. HGV'S - Councillor Lane

That the Service Director (Environment) be requested to investigate details of the cost for carrying out traffic counts at Councillor Lane, Birdhall Lane, Garners Lane, Edgeley Road and Birdhall Road and report back to a future meeting.

The Service Director (Environment) informs me that the cost will be £250 per location for 1 week of an automated classified (separates cars, HGV’s etc) count – which gets speeds & volumes hour by hour for 7 days. He suggests that Councillor Lane & Birdhall Lane during the same week to see relative numbers of HGV’s on both roads

Service Director (Transportation & Planning) detailed proposals for the introduction of No Waiting at Any Time restrictions; to rationalise the on-street parking on Ashfield Road, Cheadle and to inform the Committee about the options for adopting Ashfield Road (part) and the implications. Site notices to be erected from the 30th September 2009. Notices have come down today 22/10/09 at end of objection period. 1 objection received. Works order due to be placed, site visits have been made, however problems are needed to be rectified before lines can be implemented such as carriage way surfacing of some sections and clearing of Japanese knotweed. To be marked out on site and work to be completed ASAP – knotweed treaded and no longer a problem but we do need to coordinate with relevant departments. Works to complete scheme have been underway during the last two weeks.

Request for residents permit parking in the Hall Street area of Cheadle. Petition referred to the Service Director (Transportation & Planning) for consideration. Permit Parking consultation letter has been delivered, responses have started to be returned. Closing date for replies was 20th August 2010. Site surveys to commence when schools have resumed. BIRD HALL LANE/EDGELEY ROAD JUNCTION AND BIRD HALL LANE – CHEADLE HEATH – ROUNDABOUT JUNCTION ALTERATIONS AND IMPROVEMENTS FOR PEDESTRIANS AND CYCLISTS MC

Construction works in respect of the scheme for the roundabout junction at Bird Hall Lane/Edgeley Road are nearing completion. Additional works to improve facilities for pedestrians and cyclists along the Bird Hall Lane corridor are now underway.

STOCKPORT TO MANCHESTER AIRPORT CYCLE ROUTE – PROPOSED 20 MPH LIMIT (EXTENSION) SOUTH OF BROWN LANE VICINITY, HEALD GREEN AM

Service Director (Environment) seeking approval to formally advertise the proposed 20mph speed limits in the vicinity south of Brown Lane, Heald Green. With democratic services. Implementation proposed Sept 2010

DISTRICT AND LOCAL CENTRES – FESTIVE DISPLAYS AND EVENTS

Report of the Service Director (Regeneration) 1. MATTER FOR CONSIDERATION To inform the Area Committee of the proposed arrangements for

Festive displays and events supported in the District and Local Centres.

2. INFORMATION 2.1 Festive lights within the borough’s commercial areas continue to be

welcomed and appreciated by the business community, shoppers/visitors and residents and since 2003 the District and Local Centres Partnerships has responded to this by installing decorative lights in the District Centres and key Local Centres.

2.2 The total investment by District and Local Centres team in 2009 in the

18 centres was 450 Displays installed on street lighting columns 9 Christmas Trees (large) 150 Christmas trees (Small located on buildings) Storage and testing of all equipment by Solutions SK 12 Events (6 Festivals and 6 switch on events) All the displays on street lighting columns are installed by the beginning

of December and are controlled by timers to operate from 3:00pm to midnight. A number of traditional Christmas trees were replaced by ‘small pea lights’ installed in existing trees, however these have suffered the ravages of time and the majority are beyond repair. Where available funding allows these are being replaced with small LED lights.

2.3 For a number of years the Council has worked closely with local

businesses and residents through the District and Local Centre Partnerships and together with the Business Associations has established and supported a number of events that have grown in both variety and popularity.

2.4 The proposed programme of installations and events for the District

and Local Centres for Christmas 2010, from the £60k budget allocated to the District and Local Centres team, are attached as Appendix A.

The neighbour consultation period expired 19th August 2010' CONSULTEE RESPONSES Highway Engineer: 'The property is relatively small and would not be able to accommodate a large number of covers is in not therefore likely to generate a significant level of traffic. It is located within the District Centre with good access to car parking and opportunities for alternative travel modes. This is an appropriate use for such a location and I raise no objections'. Planning Policy Retail Officer: The unit has been vacant according to the applicant since 01/03/10. The site does not lie within a designated frontage but does fall within Cheadle District Centre. The indicative opening hours are 07:00 -23:00 Monday to Saturday and 08:00-22:00 Sundays and Bank Holidays, which would provide an active frontage during the shopping day all week. UDP Review Policy PSD1 (Hierarchy of Shopping Centres) seeks to focus a range of shops and services within the Stockport Shopping Hierarchy. The proposal is consistent with this Policy. UDP Review Policy PSD2 (District Shopping Centres) encourages services within

District Centres. The proposal is consistent with the Policy whilst safeguarding shopping provision UDP Review Policy SE1.1 (Control of Food and Drink Outlets) takes into consideration:

i) highway safety and capacity; ii) car parking; iii) impact on residential amenity by reason of noise, litter and nuisance; iv) hours of use

PPS4 Policy EC10 (Determining planning applications for economic development) takes into consideration the following impacts:

a) whether the proposal has been planned over the lifetime of the development to limit carbon dioxide emissions, and minimise vulnerability and provide resilience to, climate change;

Observation – The proposal would encourage the occupation of an existing building within an accessible District Centre and provides linked trip opportunities, consistent with this criterion.

b) the accessibility of the proposal by a choice of means of transport…the effect on local traffic levels and congestion (especially to the trunk road network) after public transport and traffic management measures have been secured;

Observation – The site is accessible by bus, walking and cycling and car parking also serves the centre, consistent with this criterion.

c) whether the proposal secures a high quality and inclusive design which takes the opportunities available for improving the character and quality of the area and the way it functions;

Observation – The proposal does not involve design alterations thus this criterion is not relevant.

d) the impact on economic and physical regeneration in the area including the impact on deprived areas and social inclusion objectives;

Observation – The proposal would encourage the occupation of an existing building within a District Centre offering linked trip opportunities, contributing to the diversity of A3 use units in the centre and therefore to its vitality and viability, consistent with this criterion.

e) the impact on local employment Observation – The application form indicates 3 staff would be employed at the site, consistent with this criterion. Environmental Health Officer Pollution Control: No overall objection but notes the following: i. The ventilation system shown is unsuitable as it is fitted at its outlet with a cowl which restricts the dispersion. He recommends that this is removed. ii. The hours of use proposed are to finish at 11.00pm. Whilst he advises no specific

hours he suggests that it needs to be compared with the hours of operation of similar uses in the Centre. iii. 'Noise from the operation of any fixed plant/machinery shall be attenuated such that the rating level of noise emitted by all fixed plant on the site shall not exceed the existing background noise level by more than 5dBA, at any time. The noise levels shall be determined at the nearest noise sensitive property. The measurements and assessment shall be made according to BS 4142:1997' Conservation Officer: The site lies within the Brooklyn Crescent Conservation Area. The proposed alterations would appear to have no detrimental impact on the character and appearance of the Conservation Area and no objections are raised. ANALYSIS In land use terms, the application can be assessed as follows: i. There is no objection to an A3 Use in respect of District Centre shopping policies. It is consistent with the aims of both Policies PSD1 'Hierarchy of Shopping Centres', and PSD2 'District Shopping Centres' which seek to ensure that District Centres provide a wide range of services and facilities serving both day and evening uses to ensure that they maintain vitality and viability in an accessible location. Planning Policy therefore raise no objection. in land use terms. ii. There is no objection from the Highway Engineer as there is adequate parking in the vicinity and the use will not generate significant higher levels of traffic than the existing use. iii. As there will be no significant external alterations, the Conservation Officer raises no objection. iv. In terms of the extraction equipment, Environmental Health offer no objection in principle but advise that the flue is re-designed to remove the 'hat' or cowl. In the event of planning permission being granted, a condition can be imposed to ensure that details of the extraction equipment is submitted for assessment and approval in respect of design, location and noise attenuation. iii. In terms of hours of use, there obviously has to be a balance between the need to allow the applicant to run a profitable business and the need to protect the amenities of adjacent occupiers from noise and nuisance. The later the restaurant opens the later staff will be on the premises clearing up and equally the earlier the premises open, the earlier staff will arrive to prepare and cook. There appears no consistent opening and closing times for other comparable uses in the Centre and some are unaffected by the immediate proximity of residential property. The Committee need to make a judgement of what they consider appropriate, if they do not regard the applicants proposed hours of opening acceptable. Following discussions with the agent, the applicant has indicated that they are willing to close at 10.45pm Monday-Saturday which seems more reasonable but wish to retain the 7.00pan opening in order that they can access the breakfast market. In support of this requirement they refer to the early opening of the newsagents and Tescos which also has early

deliveries. iv. In terms of the issue of litter raised by objectors, it should be borne in mind that it is not a takeaway where people are taking food off the premises. v. In respect of Policy HP1.5 'Living Over The Shop', the applicant has indicated that they will not be utilising any of the flats. The policy is aimed at premises where residential is being introduced above A3, A4 and A5 Uses and seeks to have them occupied by people associated with the business, unless it can be demonstrated by way of an acoustic Engineer's report that adequate sound insulation measures exist between the ground and first floors. In this case however, the accommodation already exists and no objections have been received from the occupiers of the flats. Furthermore, the agent has explained that the property has in recent times been refurbished and sound insulation measures were incorporated in order to comply with Building Regulations. Hence they consider to property to be already well sound attenutaed between the ground and first floor. Conclusion In land use terms there is no objection. It appears an acceptable alternative use for a vacant unit, subject to conditions that cover: i. Hours of Use and ii. Submission of filtration/extraction details The agent has been requested to provide an internal layout even if it is indicative for Committee as they appear to have an end user under consideration. SK8 3EP COMMITTEE STATUS Cheadle Area Committee. Application called up by Cllr Humphreys. DESCRIPTION OF DEVELOPMENT The applicant seeks permission to provide a two storey rear extension. The extension will project 3.96 metres from the rear wall of the original house adjacent to the existing two storey rear projection on the western side of the property. The extension will have a double gable valley roof, the ridge of which will sit below the ridge height of the main dwelling. The proposal has been amended since submission, the minor changes include the removal of the rear platform / canopy and provision of windows instead of double doors on the rear elevation. The attached plans illustrate the proposal. SITE AND SURROUNDINGS The application site is a detached property situated in a predominantly residential area. The property lies on the southern side of Turnberry Road, a cul de sac off the Gleneagles estate in Heald Green. Numbers 10-20 Turnberry Road are all large detached properties of a similar age and design. NEIGHBOURS VIEWS The occupiers of 3 surrounding properties were notified in writing of the application. One letter of objection has been received from number 14 Turnberry Rd. The objections can be summarised as follows:

• Excessive, not be in balance with the forms of the existing dwelling. • Oppressive, unneighbourly feature when viewed from adjoining residential

accommodation. • Concerns regarding parking and congestion. • Concerns regarding privacy due to side facing frosted glass window. • Overpowering cooking smells due to new kitchen location.

POLICY BACKGROUND The site lies within the predominantly residential area as defined on the proposals map of the Stockport Unitary Development Plan Review, adopted 31St May 2006. The following policies are therefore relevant: DCD1: DESIGN AND CHARACTER DCD 1.1: Design Principles CDH 1.1: New Residential Development in Predominantly Residential Areas CDH 1.8: Residential Extensions Supplementary Planning Guidance: Extensions and Alterations to Dwelling Part One and Part Two. ANALYSIS UDP Review Policies CDH 1.1 and CDH 1.8 and Supplementary Planning Guidance (SPG): Extensions and Alterations to Dwellings will permit extensions to residential properties provided: 1. That the extension complements the existing dwelling in terms of design, scale

and materials and does not adversely affect the character of the street scene; 2. Does not cause damage to the amenity of neighbouring properties by reason of

overlooking, overshadowing or loss of privacy and does not unduly deprive the property of amenity space or parking areas;

3. Does not prejudice similar developments by the occupiers of neighbouring properties.

In assessment of the application it is considered that the main issues of contention are the impact of the proposed development on the character of the area, impact to neighbouring amenity and parking provision within the site. The extension will extend just under 4 metres from the rear of the house. The extension is sited to adjacent to the existing two storey rear gable which is on the western side of the property, the extension will project 600mm beyond this building line. In terms of scale and design the proposal is considered acceptable. The gabled roof design complements the existing dwelling and the bulk and massing is not considered detrimental to the character of the area with ample space retained around the dwelling. The application states the materials will match the red brick/ concrete of the existing dwelling, the achievement of this can be reserved by condition. The extension is to the rear of the property and will not be immediately visible or noticeable from the street or any other public vantage points. It is considered that the proposal would complement the existing dwelling in terms of design, scale and materials and will not adversely affect the character of the street scene.

In terms of impact to neighbouring properties, the application is considered acceptable. To the east of the site is number 18 Turnberry Rd, this property sits further back from the street in the plot and as such the proposed extension at number 16 does not project beyond the rear building line of this property. Number 18 does have a window in the side elevation, however this appears to serve a non habitable room being obscure glazed. The privacy and outlook of this property will not be materially affected. Number 17 Carnoustie Drive to the rear (south) of the site is set side on to the host site and again will remain relatively unaffected by the proposed development. Number 14 to the west of the site has submitted a number of objections to the development however it is not considered that the impact to this property is of any significance as to warrant a refusal. The existing two storey rear gable already projects beyond this property. The extension will be the other side of this away from the property in question. Although the extension will project 600mm beyond this gable, this is not considered to be of any material harm. There is a small window proposed in the side of this 600mm projection, to avoid a loss of privacy this should be conditioned to be obscure glazed and retained as such. The extension will not have any impact upon existing in terms of outlook from habitable room windows as the existing gable will block any views of the extension from the perspective of number 14. Privacy will be unharmed subject to the window condition. In light of the above it is considered that it would be unreasonable and unjustifiable to refuse the application on grounds of residential amenity. In terms of parking, no changes to access or parking provision are proposed. The dwelling will retain the garage with parking for 1 vehicle and a further 2 off street spaces retained on the drive. The parking provided on site is more than sufficient for a domestic dwelling and it is not considered conceivable to refuse the application on grounds of impact to highway safety. The application is considered to be in accordance with the adopted policies of the UDP Review and is recommended for approval. RECOMMENDATION Grant

External alterations consist of mainly of renovations, ie new window frames and doors) and construction of individual balconies at the front. The agent has indicated that his client owns the access road around the rear of the property and each flat will have an allocated parking space. In support of the proposal, the applicant has indicated that the offices are not attractive when compared to more modern purpose built accommodation as they lack adequate parking, no lift provision, hence not DDA compliant, have low ceilings and not conducive to installation computer floors and caballing. SITE AND SURROUNDINGS The property is located at one end of a parade of mixed use 'shop units circa 1960's. The ground floor currently consists of: A bookmakers at 14 A pizza takeaway at 16 20 is vacant but was previously a Threshers off licence. The offices extend over a vehicular access that extends around the back, where there is also a limited number of parking spaces. To the rear, the site backs onto the gable ends of two blocks of flats nos 1-15 Dixon Court these are separated from the property by the service road. The site is located towards the fringe of the Cheadle District Shopping Centre. POLICY BACKGROUND UDP designation: District Centre. Within the District Centre it falls in a Secondary Frontage. RELEVANT PLANNING HISTORY None relating to the upper floors NEIGHBOURS VIEWS Objections have been received,from the occupiers of 1,2, 3,4,5,7,10,11,12a,14, and 15 Dixon Court. With the exception of the letter from the occupier of 2 Dixon Court, all are identical. Grounds of concern: i. Where will occupiers park? There are already parking problems in the area and around the serviceway and visitors to Dixon Court find it difficult to park. The situation will only be made worse by a residential use. Wheel clamping is a problem in the accessway. ii. Where will residents put their litter? There is already problems with rubbish. iii. The access is frequently blocked by delivery vehicles day and night which would limit the ability of emergency vehicles to reach Dixon Court. iv. There are problems with antisocial behaviour which could get worse. Overall, their concerns relate to a combination of factors that cause inconvenience and nuisance to the occupiers of Dixon Court and they do not consider the introduction of flats eases these issues. The Neighbour consultation period expired 19/9/2010 CONSULTEE RESPONSES Highway Engineer: The application is for change of use of first and second floor office accommodation into 8 flats. Residential use is acceptable in a District Centre location which has good access to amenities and sustainable travel choices. There is scope for some resident car parking to the rear and other spaces are available within the Centre for those who have car usage. No highway objections are raised. Provision is required for covered and secure cycle parking for each flat, presumably a communal facility in the rear yard. Recommend grant subject to a condition requiring cycle parking. Planning Policy: Have verbally indicated concern over the loss of floorspace that provides employment in District Centres and have requested that the applicant justifies the loss of office this floorspace by the submission of information on whether the site has

been marketed, for how long and the level of response.. Whilst they acknowledge that Policies PSD2.3 and HP1.5 do allow for the establishment of living accommodation in underused floorspace above shops in District Centres they also refer to the fact that this has to be balanced against the potential loss of employment. Berkley Brown, the letting agents, have subsequently indicated that have had a board up for a least 2.5 years and have had one enquiry.which was not followed up. They indicate that the premises had been on the market previously with other agents, again with little or no interest. Planning Policy have verbally indicated that this is a reasonable time to demonstrate that the premises have been marketed. Design Officer 'The proposal includes fairly minor external works to the 1st and 2nd floor levels of the above addresses, including some alteration of the openings (mainly to the rear), new window frames/ doors, new balustrade, painting of the brickwork and increasing of the height of the kitchen ductwork to the rear. I have no objection in principle to the above application; however it is a shame that the whole block is not being proposed for upgraded at this time. The success of this scheme will be dependent on the window frames selected and I view that windows with slim glazing bars would be more appropriate for the building, so a powder coated frame is likely to be a better solution that UPVC (I note that the material proposed for the window frames is not indicated Design on the application form). I ask that this suggestion is made to the applicant. In response, the applicant has verbally agreed to install powder coated aluminium frames as opposed to UPVC Environmental Health Officer, Pollution Control:

'I have assessed the above application and have severe reservations about this development as there are already wide spread complaints about odour and noise from the businesses on this parade. The parade houses 4 takeaways 3 have extraction systems running vertically and extracting onto the roof of the property and there is also associated fixed mechanical plant to the rear. Enforcement action has been taken formally and informally.

The floor structure is of solid concrete and the applicant proposes to put in a suspended floor. This will protect the development from noise from the commercial premise below but may not prevent structural vibration from the business and the external extraction/plant which are mounted on the external elevations.

The applicant has indicated that there will be improvements made to the extraction system for the pizza takeaway on the end of the parade via increasing the height of the ducting. This will have to go above ridge height and the terminal will have to be changed so that the odour extracts the ducting vertically with a high velocity cowl on top to reduce ingress of water and increase the extract velocity to protect the top floor apartments from odour nuisance.

There may need to be more insulation needed in the roof space to reduce any noise from the extraction system penetrating the top floor apartments, when air is rushing through the ducting it causes noise and may penetrate into the apartment.

The applicant is proposing to fit double glazed draught sealed windows with sound insulated glass; this will prevent some noise from entering the apartment. During the summer months if the occupant wishes to open the windows they may be bothered by noise from the extraction systems which run for approximately 12 hours per day 7 days per week also mechanical plant running 24 hours. There will be a need for ventilation this can be provided by fitting acoustic trickle vents to the windows, however from the application I am not sure if the proposed window design is for the front and back or the back only.

A number of the apartments have bedrooms which back onto the rear of the parade, therefore being subjected to noise at the most sensitive time of the day. Assurances would have to be made that the noise levels must not exceed 35dBA (reasonable standard) in the bedrooms in line with World Health Organisation Community Noise Guidelines.

She concludes that it is likely that the occupiers of the proposed flats will make complaints about the existing extraction equipment. She is aware that the outcome of an application for a flue at KFC is awaited. ANALYSIS Policy E4.1, Industrial Warehouse and Office Premises Outside Employment Areas. This Policy indicates that proposals to redevelop or change the use of existing business premises outside 'Employment Areas' will be permitted, provided; i. The proposal would not adversely affect the provision of small and affordable business premises. ii. It would not adversely affect sustainable journeys and work patterns. iii. Occupiers of any new or existing residential development would have a reasonable standard of amenity iv. The character and appearance of the surrounding area and environment would be protected and enhanced. v. There would be no adverse impact on the operation of the local transport system. Taking each in turn, the application can be assessed as follows: i. The offices appear to have been marketed for some considerable time without attracting new occupiers. The applicant and agent have said that in comparison with other accommodation on the market, it is no longer attractive for office use, particularly with the plentiful alternative options available. Bearing in mind the level of floorspace, it is unlikely to significantly impact on the overall provision of office

space. ii. The loss of office space will not have an adverse affect on sustainable transport. A condition will be imposed to require provision for cycle facilities. iii. The Environmental Health Officer raises concern that the occupiers of the flats will be affected by noise and nuisance from the existing extraction equipment despite any measures to mitigate their impact. iv. Allowing a change of use to flats would result in the property being renovated and should have no adverse impact on the surrounding area. Whilst the concerns of local residents are noted, the applicant has indicated that each occupier will have a parking space, a new refuse area will be constructed and there is no overlooking. Their concerns seem to relate mainly to the commercial operations of the block v. The scheme is small scale and will have no adverse impact on the local transport system On balance the proposal has more positive elements than negative, the main adverse issue being the reservations of the Environmental Health Officer. 2. Policy PSD2.3 'Use of Upper Floors in Shopping Centres' This Policy indicates that a change of use of upper floors in shopping centres will be permitted provided: i. It complies with the requirements of Policy HP1.5 'Living Over The Shop' ii. The scale of the proposal would not lead to parking problems. iii. Proposals for office use meet the requirements of Policy E4.2 'Office Conversions' iv. Residential amenities would not be adversely affected. v. There would not be a net loss of residential accommodation. vi. Separate access can be provided. Taking each in turn the application can be assessed as follows: i. Refer below ii. The Highway Engineer offers no objection and the applicant has indicated that parking will be provided. iii. Not relevant iv. The replacement of commercial with residential use should not have a adverse material impact on adjacent residential occupiers.

v. Not relevant vi. Separate access is available for the flats 3. Policy HP1.5, 'Living Over The Shop', This indicates that the creation of creation of residential accommodation will be permitted provided that the scheme adequately safeguards residential amenities. Where the accommodation is above A3/4/5 Uses evidence must be produced to indicate adequate sound attenuation can be met In assessment of this policy, the main issue is the comments of Environmental Health over the extraction system associated mainly with the pizza takeaway as well as others. Whilst these concerns are noted, this has to be offset by the fact the these extraction systems are already in existence. They cannot be removed as part of the current application. Conclusions In land use policy terms, the scheme appears an acceptable alternative use for vacant upper floor premises in a District Centre where there appears no immediate chance of a commercial occupier. In terms of detail: i.There are no objections from The Highway Engineer in terms of access, parking and traffic generation and he acknowledges that the site is in a sustainable location. A condition can be imposed in respect of cycle storage for the flats in the event of an approval. ii. There are no overall objections from Planning Policy,to the loss of offices, bearing in mind the level of floorspace involved and the fact that attempts have been made to market the premises for some considerable time. iii. There are no objections from the Design Officer, bearing in mind the applicant has indicated willingness to change the style of the windows. iv. The Comments of Environmental Health clearly do not favour residential accommodation but it has to be noted that any person moving to the flats would be aware of the location of the extraction equipment associated with adjacent premises. The question is how much weight should be placed on this aspect or whether as the equipment is already in existence and whether any problems with the equipment would be better dealt with underseparate legislation. It is accepted that the application is not without a certain compromise but it is recommended for approval as a result of the on balance benefits. If however, Committee are mindful to grant consent, the application would have to be deferred and delegated for a Commuted Sum under Policy UL1.3 RECOMMENDATION Grant

Report of the Service Director ( Communities ) 1.0 Purpose of the Report 1.1 To re- consider a request from the owner of 10 Priest Avenue, Gatley

Cheadle who wishes to take a lease of the area as shaded grey on attached plan following consultation with residents and assessment of the planning implications.

2.0 Detail 2.1 As previously reported ( Item No 6 on 17th August 2010 ) ), the land in

question, is owned by the Council and appropriated to the Communities Regeneration and Environment Directorate (Parks and Rec) is located in a fairly inaccessible part of Scholes Park, Gatley. The area comprises a small pond which is surrounded by heavy foliage.

2.2 Further to the meeting on the 17th August 2010 Members requested

that a site consultation be carried out to capture residents views on the proposal and that the planning implications are clarified.

3.0 Results 3.1 A number of public notices were erected in the immediate vicinity of the

pond on the 17th August 2010 and a 21day period was allowed for residents to feedback. Analysis of the responses are summarised as follows ( copies are appended to this report )::

Against the proposal---45 no with the main concerns cited as the loss of public access if the area is fenced, and the potential loss of further open space should other residents apply.

Support for the proposal---1 No but qualified that appropriate controls are put in place.

3.2 In terms of the planning implications, the land is allocated on the

proposals map of the Stockport Unitary Development Plan as Local Open Space. The enclosure of this land into a domestic curtilage would result in a material change of use of the land which is contrary to adopted policy. With regard to the two existing adjacent garden tenancies,( shown crossed hatched on the attached plan ) these have

been in place for over ten years and fall outside current policy and in such circumstances are precluded from the formal planning process.

2.3 Recommendations 2.4 Members are asked to consider the results detailed at 3.0 above.

MANAGEMENT OF ABNEY HALL PARK FISHING POND

Report of the Service Director (Communities)

1 MATTER FOR CONSIDERATION 1.1 At the Committee meeting on 25th November 2008, the Committee requested that

the Service Director (Communities) report back on the management of Abney Hall Park pond for angling activities. The following report is to update Members.

2 INFORMATION 2.1 The pond at Abney Hall Park, off Newlands Road has been used for fishing since its

creation in 1988. Issues around the management of the pond for angling and anti social behaviour around the pond have been highlighted in the past by members of the local community and Friends of group. In an attempt to try to address this meetings have been held the between the Parks Department, Environment Agency, Committee members and the local community to discuss how the pond could be better managed for fishing, wildlife and the benefit of legitimate users of the pond.

2.2 In 2008 the Environment Agency recommended that a management plan be

produced for the site and also suggested that the Council seek expressions of interest from angling clubs to manage and bailiff the water.

2.3 The Parks Department produced a management plan for Abney Hall Park in 2009

detailing how the park and ponds are to be managed for recreation and nature conservation as the site is designated as a Local Nature Reserve.

2.4 Earlier this year the Council sought expressions of interest from suitable angling

organisations to manage angling activities at Etherow Country Park, Reddish Vale Country Park, Woodbank Park and Abney Hall Park.

2.5 Stockport and District Anglers Federation were the only organisation to respond

with an interest, and following discussions with them it is proposed to issue a seven year licence agreement to the Federation to manage the angling at those waters. Access to the park, the footpaths around the pond and management of the rest of the park will not be affected by this agreement.

3. RECOMMENDATION

That the Area Committee request the Service Director (Communities) to grant a management licence to the Stockport and District Anglers Federation to manage and bailiff angling activities at Abney Hall Park pond.

1 PURPOSE OF REPORT 1.1 Members will recall that experimental orders were made last year in

and around Church Street and Mary Street Cheadle when measures were put in place to protect St Mary’s church wall. To gauge opinion of how the experimental orders have operated, the Service Director (Environment) has carried out a consultation exercise in September 2010.

2.2 Church Street One Way

The results show that the majority of respondents would like to see that the existing one way flow on Church Street be made permanent, although comments were received that despite clear signing, some drivers still ignore the signs and travel the wrong way. This transgression will be brought to the attention of the Police.

2.3 Mary Street Loading Bay

Despite a small majority of respondents commenting that the loading bay has not been successful, the majority of remarks regarding this referred to the lack of enforcement rather than removal of the bay. The rest of Mary Street is no waiting and no loading at any time and there is nowhere else on Mary Street for adjacent businesses to legally use. It is proposed therefore to retain the loading bay and enforce the restrictions more effectively.

2.4 Waiting restrictions on Church Street, Mary Street and Lime Grove The majority of responses referred to the enforcement of the waiting

restrictions and not specifically to the adequacy or level of restriction in force. The traffic regulation orders on Mary Street are very restrictive – to enable Mary Street to function as the only entrance point into the area. It is therefore proposed to retain the current restrictions and increase the level of enforcement.

3. FUNDING 3.1 The proposals will be funded from the 2010 / 2011 Capital Programme. 4. RECOMMENDATIONS 4.1 The Area Committee is requested to recommend that the Executive

Councillor (Transportation) approves that the experimental orders listed in paras 2.2 – 2.4 be progressed to permanent orders, subject to further consultation where necessary.

LEASE OF PARK ROAD STADIUM, PARK ROAD, CHEADLE TO

CHEADLE TOWN FOOTBALL CLUB

Report of the Managing Director of NPS Stockport Ltd 1 Purpose of the Report 1.1 To reconsider a request from the Trustees of Cheadle Town Football

Club to acquire the Councils freehold interest in the land and buildings currently leased to them.

2 Background 2.1 On the 29th July 2008 the Cheadle Area Committee considered a

request from Cheadle Town Football Club to purchase the Councils freehold interest in the site as shown single hatched on the attached plan which the Club has held on Lease from the Council since 1981.

2.2 At the time this Committee resolved that rather than dispose of the

freehold, it was happy for the Council to enter in to a long term lease arrangement with the Club.

2.3 Since the above, discussions have taken place with the Club and the

Trustees of the Club have been working on proposals to completely redevelop the facilities at Park Road Stadium and as such they have recently submitted plans showing their future proposals for the site which includes a new spectator stand with changing facilities for teams and officials, a new all weather football pitch and 2 new 5 a side pitches, new perimeter fencing and railings and a new 60 m x 40m grass pitch.

2.4 The costs of carrying out the above proposals have been estimated at

£1.9 million. 2.5 The proposed sources of income are The Trustees, The Football Foundation, Brewery Loan, The Football Trust and Sport England. In this instance Sport England have visited the facilities at Park Road and are, in principle, supportive of the Clubs future proposals / plans. 2.6 Recent dealings, however, with similar transactions have shown that

funders have become more responsive where applicants hold the freehold interest in their properties and as such the Club have asked if the matter of them acquiring the freehold interest could be reconsidered in the light of the changing economic climate.

2.7 It must be pointed out that in order for the Club to continue and for the facility to survive Park Road Stadium needs to be substantially improved and up graded through the use of ‘private investment’. 2.8 It should be noted that a disposal would not be prejudicial to any other

Council ownership in the area, however a covenant ensuring that the site should only be used for sport / leisure activities would form part of the ‘sale documentation’.

3 Recommendation 3.1 It is recommended that further consideration be given to the disposal of

PRIDE IN CHEADLE AWARDS 2011

Report of the Head of Area Governance 1. MATTER FOR CONSIDERATION

The Area Committee is requested to give consideration to holding an awards ceremony in the spring of 2011 to recognise the valuable contribution made in the three wards by volunteers, both young and old. Suggested award categories are as follows:-

Beyond the call of duty at work (for excellent customer service) – This category is for employees of business or organisations in the area who regularly give over and above for their customers, providing an excellent customer service.

Contribution to Sport – This category is for both those who have achieved great things for their clubs or individually, and for the ‘unsung’ contribution to sport, such as those involved in coaching or the person who washes all the dirty kits and drives the players to the match.

Outstanding Young Person’s sporting achievement – This award is to recognise a great sporting achievement by a local young person.

Environment Champion - This award is for those making positive contributions to improving or protecting the environment, over a wide area, or doing something very local such as in the local park.

Keeping Streets Safe - Is there someone who makes your neighbourhood safer, such as a local neighbourhood watch co-ordinator, or your local PCSO?

Most Neighbourly Resident – Does your neighbour go out of their way to help you? Perhaps they pick-up litter from your street, or help older neighbours with their shopping.

Volunteer of the Year – This category is for an individual, or a group, who make n real difference to their community through their volunteering, such as through a residents association or other community group.

Young Volunteer of the Year - This award is for an individual or group of young people under 18 who give up time to help out their community.

The suggestion is to hold an awards ceremony at which the winners, runners up and their guests are invited to meet with Councillors and receive their awards. Refreshments and Entertainment will be provided.

2. RECOMMENDATIONS The Area Committee is requested to consider and comment on the following:-

(a) To make a contribution from the Area Flexibility Fund to support the event. (b) To identify an appropriate venue and possible date. (c) To agree to the award categories suggested or to suggest possible alternatives.

NOMINATION OF AUTHORITY GOVERNORS

Report of Service Director (Learning & Achievement) 1. MATTER FOR CONSIDERATION

Exercise of the Area Committee’s delegated power to provide political nominations for LA governor vacancies in local schools.

2. INFORMATION 1. The arrangements for appointments to school governing bodies are as follows: 1.1. Following the annual elections to the Council, the party groups will each identify a representative Councillor to meet with the Corporate Director, Children & Young People (known collectively as the Governor Representative Group) in order to determine any necessary changes in the allocation of governing body seats, to reflect both in aggregate and, so far as practicable, within the area of each Area Committee, the political balance of the Council as a whole. The Group should aim to avoid unnecessary disruption to individual schools. The allocation of governing body seats by the Governor Representative Group will be subject to the approval of the Executive Councillor (Children & Young People). 1.2. When political vacancies arise, the Corporate Director, Children & Young People will prepare a report for the next practicable meeting of the relevant Area Committee. The report will identify the vacancy and indicate which of the party groups needs to be consulted in order to maintain the agreed political balance. The report will be copied, by the Corporate Director, Children & Young People, to each member of the Governor Representative Group, for information. 1.3. Where the relevant party group has at least one seat on the Area Committee it will be for the group member (or members) to put forward names of appropriate individuals to be considered for nomination by the Area Committee to fill the vacancy (or vacancies). 1.4. Where the group entitled to influence the nomination has no seat on the relevant Area Committee, the Committee will consult, via the Corporate Director, Children & Young People, with the relevant member of the Governor Representative Group. 1.5. Following the meeting of the Area Committee, the nomination, if any, from the Area Committee will be submitted to the Executive Councillor (Children & Young People) who will have regard to that nomination when making an appointment. 1.6. If, for any reason, the Area Committee wishes to make a nomination for appointment that does not accord with the allocations determined by the Governor Representative Group and approved by the Executive Councillor (Children & Young

People), the Area Committee may nominate one of its members to discuss the nomination, and the reasons for it, with the Executive Councillor (Children & Young People). It will be open to the Executive Councillor (Children & Young People) to agree to accept the Area Committee's nomination in exchange for the reallocation of a seat elsewhere in the Borough. 1.7. In the absence of a nomination from the Area Committee following the expiry of four Area Committee cycles from the original notification of the vacancy, the Corporate Director, Children & Young People will refer the matter to the Governor Representative Group, which will have the responsibility of ensuring that a nomination is made, having regard to the principles set out in 1.1 above, and submitted to the Executive Councillor (Children & Young People) for approval. 1.8. In an attempt to reduce the number of Authority vacancies, nominations from Council Employees (other than employees of the Children & Young People's Directorate who are directly involved in support services to schools) will be considered by the Executive Councillor (Children& Young People). In order to maintain the overall political balance, 5% of each party's nominations will be allocated to non party governors (officers) taking into account long standing vacancies. 1.9.
