SOLID WASTE MANAGEMENT

17-1 DEFINITIONS.

As used in this chapter:

Authorized private receptacles for collection shall meancontainers made of metal, plastic, rubber or other similarmaterial which are waterproof and are fitted with awaterproof cover which fits on the receptacle in such amanner so as to discourage birds, animals and childrenfrom removing the same. Such lid or cover shall not bepermanently affixed to the receptacle and must be capableof being totally removed when being emptied. The capacityof such container/receptacle shall not exceed thirty-two (32)gallons liquid and/or fifty (50) pounds.

Exceptions for recyclables shall mean any item declared orfound to be a recyclable item by the laws of the UnitedStates, the laws of the State of New Jersey, any ordinanceor resolution of the Ocean County Board of Freeholders orany ordinance or regulation adopted by the Borough shallnot be included in the foregoing definitions and shall bedealt with as a recyclable item in accordance withregulations of the Department of Sanitation and Recycling.

Garbage shall mean putrescible animal and vegetablewastes resulting from the handling, preparation, cookingand consumption of food.

Refuse shall mean all nonputrescible solid wastes (exceptbody wastes) including garbage, rubbish, ashes, streetcleanings, dead animals, abandoned automobiles, and solidmarket and industrial wastes.

Rubbish shall mean nonputrescible solid wastes consistingof both combustible and noncombustible wastes, such aspaper, wrappings, cigarettes, cardboard, tin cans, yardclippings, leaves, wood, glass, bedding, crockery andsimilar materials.

17-2 RECEPTACLES.

17-2.1 Requirements. The owner or person in control ofany private property shall at all times maintain on thepremises at least one (1) authorized private receptacle of notless than twenty (20) gallon capacity liquid nor more thanthirty-two (32) gallon capacity liquid for each two (2) occupantsof each dwelling unit located on the property. 17-2.2 Overflowing Waste Disposal Bins. Any open oroverflowing commercial, industrial. or residential wastedisposal dumpster and/or refuse container is prohibited. TheBorough of Surf City prohibits the spilling, dumping, leaking orotherwise discharge of liquids, semi-solids or solids from thecontainers onto the ground or into the municipal storm sewersystem or into any waters of the Municipality, County or State.(Ord. 17-3 RECYCLING.

17-3.1 Short Title. This section shall be known and maybe cited as "The Recycling Regulations of the Borough of SurfCity." (Ord. No. 88-16 § 1)

17-3.2 Definitions. As used in this section:

Aluminum cans shall mean empty all-aluminum beverageand food containers.

Commercial establishments shall mean those propertiesused primarily for commercial purposes and those

multiple dwelling residential buildings containing morethan four (4) dwelling units.

Ferrous containers shall mean empty steel or tin food orbeverage containers.

Glass containers shall mean bottles and jars made ofclear, green or brown glass. Expressly excluded arenoncontainer glass, plate glass, blue glass and porcelainand ceramic products.

Institutional establishments shall mean those facilitiesthat house or serve groups of people, including but notlimited to, hospitals, schools, nursing homes, librariesand governmental offices.

Newspapers shall mean paper of the type commonlyreferred to as newsprint and distribution at fixedintervals, having printed thereon news and opinions andcontaining advertisements and other matters of publicinterest. Expressly excluded, however are newspaperswhich have been soiled. Newspapers shall be deemedsoiled if they have been exposed to substances orconditions rendering them unusable for recycling.

Paint cans shall mean all cans which once contained oilbased or water based paint. In order to be collectible thecan must be either empty and/or remaining paint must bedried.

Person shall mean every owner, lessee and occupant of aresidence, commercial or institutional establishmentwithin the boundaries of the Borough.

Recyclable materials shall mean those materials whichwould otherwise become municipal solid waste, andwhich may be collected, separated or processed, andreturned to the economic mainstream in the form of rawmaterials or products.

Residence shall mean any occupied single ormultifamily dwelling having up to four (4) dwelling

units per structure from which a municipal or privatehauler collects solid waste.

Solid waste shall mean garbage, refuse, and otherdiscarded solid material normally collected by amunicipal or private hauler.(Ord. No. 88-16 § 1; Ord. No. 93-3 § 1)

17-3.3 Establishment of Program. There is herebyestablished a program for the mandatory separation of thefollowing recyclable materials from the Municipal solidwaste stream by all persons within the Borough of Surf City,hereinafter referred to as the "Municipality."

17-3.4 Separation of Recyclables and Placement forDisposal.

a. The recyclable materials designated in subsection 17-3.3of this section, excluding newspapers, shall be put in asuitable container, separate from other solid waste andplaced at the curb or such other designated area forcollection at such times and dates as may be hereinafterestablished in the Municipality's recycling regulations.The container for recycling materials shall be clearlylabeled and placed at the curb or such other designatedarea for each collection, regardless of whether anyrecyclable materials are available for collection.

b. Newspapers and cardboard may be bundled and tiedwith twine and placed at the curb or other designatedarea for collection at such times and dates as areestablished in the Municipality's recycling regulations.The maximum weight of each bundle shall not exceedthirty (30) pounds (approximately twelve (12") incheshigh). Alternatively, newspapers and cardboard may beplaced in a closed container marked so as to indicatenewspaper recycling and placed at the curb or otherdesignated area for collection at such times and dates asare established in the Municipality's recyclingregulations. The closed container may not exceed thirty-two (32) gallon capacity and may not exceed thirty (30)pounds in weight.

c. Paint cans shall be recycled in the manner as set forthin the recycling rules and regulations as adopted byresolution of the Borough Council.

1. Residential paint can disposal shall be monitoredso as to control and prohibit paint cans beingimported into the Municipality for disposal byeither residents or nonresidents. Residents arestrictly prohibited from bringing empty paint cansinto the Municipality from another residence orbusiness outside of the Borough. Failure to complywith this will subject person/resident to a penaltyin accordance with subsection 17-3.10.

2. Failure to dispose of paint cans properly andlorpersons disposing of or allowing for the disposal ofcans which are not used by a resident of theBorough will be subject to penalty in accordancewith subsection 17-3.10.(Ord. No. 88-16 § 1; Ord. No. 93-3 § 1; Ord. No.2008-04 § I)

17-3.5 Separation of Leaves and Placement forDisposal. All persons within the Municipality shall separateleaves from other solid waste generated at their premises and,

unless the leaves are stored or recycled for composting ormulching on the premises, place the leaves at the curb or otherdesignated area for collection at such times and dates and inthe manner established by the Municipality's recyclingregulations. Said leaves are to be placed inside closedcontainers or recycling bags prior to placement at the curb,which containers shall be placed curbside no sooner than seven(7) days before a scheduled pickup and shall be no closer thanten (10) feet from any storm drain inlet. 17-3.6 Alternative Collection of Recyclable Materials.Any person may donate or sell recyclable materials toindividuals or organizations authorized by the Municipalityin its recycling regulations. These materials may either bedelivered to the individual's or organization's site or theymay be placed at the curb for collection by the individual ororganization on days not designated as recyclable materialcollection days in the Municipality's recycling regulations.The individuals or organizations may not collect recyclablematerials on or within the twenty-four (24) hoursimmediately preceding a regularly scheduled curbsidecollection day and shall, prior to June 1 of each year, providewritten documentation to the Municipality of the total amountof material recycled during the preceding calendar year.(Ord. 17-3.7 Collection by Unauthorized Persons. It shall be aviolation of this section for any unauthorized person ororganization to collect, pick up or cause to be collected orpicked up within the boundaries of the Municipality any of therecyclable materials designated in subsection 17-3.3 of thissection. Each such collection in violation of this section shallconstitute a separate and distinct offense punishable ashereinafter provided. (Ord. No. 88-16 § 1)

17-3.8 Enforcement and Administration. The RecyclingCoordinator is hereby authorized and directed to establish andpromulgate reasonable regulations detailing the manner,days and times for the collection of the recyclable materialsdesignated in subsection 17-3.3 of this section and such othermatters as are required to implement this section. Suchregulations shall take effect only upon the approval of theBorough Council by adoption of a resolution implementingsame. The Recycling Coordinator and/or Superintendent ofPublic Works is hereby authorized and directed to enforce theprovisions of this section and any implementing regulationsadopted hereunder. (Ord. 17-3.9 Exemptions.

a. Commercial and Industrial Establishments. TheBorough Council may exempt persons occupyingcommercial and institutional establishments from thesource separation requirements of subsection 17-3.4 ofthis section if those persons have otherwise provided forthe recycling of recyclable materials designated insubsection 17-3.3 of this section. To be eligible for anexemption under this section the person seeking thesame shall, prior to June 1 of each year, provide writtendocumentation to the municipality of the total amountof materials recycled during the preceding calendaryear.

b. Exemptions to Curbside Placement Requirements.Notwithstanding any curbside placementrequirements set forth in the section and any rules andregulations promulgated under such ordinances, thereis hereby established application procedures forexemption therefrom.

1. By written application on a form supplied by theBorough, any person may apply to the governingbody for an exemption from the curbsideplacement requirements of the ordinances of theBorough for the pick up of garbage, litter, refuse,rubbish, trash and recyclable materials. Thegoverning body shall consider the application atthe next regular governing body meetingfollowing the filing of the application form withthe Municipal Clerk except that the governingbody may defer consideration of the application tothe following regular governing body meeting ifthe form is filed less than one (1) week prior to thenext scheduled regular governing body meeting.

2. The governing body shall render its decision onthe proofs provided with the written applicationand may in its discretion consider oral represen-

tations by the applicant and other interestedparties at the meeting.

3. The governing body may in its discretion grantan exemption from curbside placementrequirements on a case by case basis if theapplicant proves that complying with thoserequirements would result in undue hardship tothe applicant because, (a) of physical handicap,illness, age, infirmity or the like, or (b) that thephysical conditions of the premises are notconducive to curbside placement because of thelack of curbing or other specific conditions thatwould result in unsightly and potentially litterproducing situations, such that the health, safetyand welfare of the Borough, its inhabitants and theapplicant would be materially adversely affectedby curbside placement requirements in thespecific instance set forth by the applicant.

4. Any grant or partial grant of an exemption by thegoverning body shall be conditioned upon theapplicant paying to the Borough the amount of onehundred fifty-six ($156.00) dollars per year basedupon one dollar and fifty ($1.50) cents per pick uptogether with the current payment of any feesestablished by rules, regulations and schedulesadopted from time to time by the Borough. Thegoverning body may, but need not, reduce and pro-rate the additional exemption fee for exemptionsgranted for less than a full year.

5. The governing body may in its discretion modifythe exemption applied for or otherwise mold thegranting of the exemption to the specific situationas it deems fit including without limitationexemptions only for particular types of garbage orrecyclables, or exemptions for particular pick upsor periods of time. The exemption may be revokedat any time by the governing body upon a showing

of changed circumstances indicating theexemption is no longer justified. In all cases, anyexemption granted is a temporarily licensedprivilege and not a right.

6. The governing body's decision as to theapplication, whether the application is granted,partially granted or denied, shall be final and noappeals shall be taken therefrom by any person.The applicant agrees, as a condition of thegoverning body considering the application, totake no appeals from the decision of the governingbody.

7. Any decision made by the governing body as toany such application shall not be considered aprecedent for other applicants presenting similarsituations, nor for purposes of a renewalapplication by the same applicant.

8. Any exemption provided under this section shallapply to curbside placement only and any and allapplicants must comply in all other respects withthe ordinances of the Borough.

9. Under the direction and supervision of theBorough Superintendent, the Department ofSanitation and Recycling may prescribe rulesand regulations pertaining to the exemptionsprovided for herein, upon approval of the BoroughCouncil.

10. As a condition of any exemption, the applicantagrees, and the executed application form shall soprovide, that the applicant expressly, voluntarilyand with full understanding:

(a) Grants full invitation and license to allauthorized municipal personnel for theentering upon the lands and premises of the

applicant for the purposes of picking upnoncurbside placed containers;

(b) To fully indemnify and hold harmless theBorough of Surf City for any injuries thatmay occur as a result of such pick up, to anyperson or property;

(c) Releases the Borough from, andrelinquishes all claims against the Boroughof Surf City for any injury to the applicant orapplicant's premises or to any other personor property arising from the noncurbsidepick up.(Ord. No. 88-16 § 1; Ord. No. 91-15 § 2)

17-3.10 Violations and Penalties.

a. Any person violating the provisions of subsection 17-3.7 of this section shall be subject to a fine of not lessthan one hundred ($100.00) dollars nor more than fivehundred ($500.00) dollars for each offense.

b. Any person violating any provision of this sectionother than subsection 17-3.7, or any regulations adoptedhereunder, shall be liable, upon conviction, to thepenalties established in Chapter I, Section 1-5.

c. Each and every day in which a violation of any of theprovisions of this section exists' shall constitute aseparate offense.(Ord. No. 88-16 § 1)

17-4 TRANSPORTATION OF REFUSE FROM OUTSIDETHE BOROUGH.

17-4.1 Transportation from Outside Borough. No personshall bring, cart, remove, transport or collect any litter, trashor recyclable materials from outside the Borough, or into the
