progressive development of the rules relating to succession of States in respect of

security in international relations,

GE3EXAL PROVISIONS

Article 1

Scope qf the presenc Convention

The present Convention applies to che effects of a succession or Scacas in

respect of State property, archives and debts.

Article 2

Jse of teraa

1. For the purposes of the present Convention:

(a) "succession of States" means the replacement of one Staca by merrier in

2. The provisions of paragraph 1 regarding the use oc terms in the prasenc

The present Convention applies only to the effects of a succession of States

occurring in conformity with international law and, in particular, with che

principles of international law embodied in che Charter of the United Nations.

Article 4

TeitiDora 1 ao^licatiou of the present Convent ion

1. Without prejudice to the application of any of Che rules set forth in Che

present Convention to which the effects of a succession of States would be subject

under international law independently of the Convention, che Convention applies

only in respect of a succession of States which has occurred after the antry into

force of the Convention except aa may be otherwise agreed.

Rights and obligations af natural or juridical persons

Nothing in the present Convention shall be considered as prejudging in any

STATE PROPERTY

SECTION 1. INTRODUCTION

Article 7

Scoce of the present Part

The articles in the present Part apply to the effects o£ a succession of

States in respect of State property of the predecessor State.

For the purposes of the articles in the present Part, "Scate property of the

redecessor State'1 means orooerty rights and interests w'nich, at the dace of the

uccession of States, were, according to the internal law of the predecessor State

Effects of che passing o£ 5tata property

The passing of State property of che predecessor Scats entails the extinction

of the rights of that State and the arising of the rights of che successor State to

Che State property which passes to Che successor State, subject co the provisions

of the articles in the present Part.

which, at che dace of the succession of Stacas, are situated in the territory of

the predecessor State and which, at that dace, are owned by a chird State according

to che internal law of the predecessor Stace.

Preservation and safety of State property

For the purpose of the implementation of the provisions of the articles in the

present Part, ;he predecessor State shall take all measures to prevent damage or

destruction to State property which passes to the successor State in accordance

vich those provisions.

SECTION 2. PROVISIONS CONCERNING SPECIFIC CATEGORIES

OF SUCCESSION OF STATES

2. When a newly independent Stace is formed from cuo or more dependent

to the newly independent State shall be determined in accordance with che

provisions of paragraph 1.

3. When a dependent cerritory becomes part of the territory of a State, other

than che Stats which vas responsible for ics international relations, the passing,

of che State property of che predecessor Stace to the successor Stats shall be

determined in accordance wich che provisions of paragraph 1.

4. Agreements concluded between the predecessor Scate and che newly independent

State co decermine succession to SCace property of. che predecessor Scace otherwise

chan by che application of paragraphs 1 co 3 shall not infringe the principle of

the permanent sovereignty of every people over its wealth and natural resources.

Uniting of States

When cwo or raore States unice and so £orm one successor State, the State

property of the predecessor States shall pass to che successor State.

Article 17

1. When part or parts of the territory of a State separate from chat Stata and

font a successor State, and unless the predecessor State and the successor State

otherwise agree:

(a) immovable State property or the predecessor Stats situated in the

territory to which the succession of States relates shall pass to che successor

State;

(b) movable State property of the predecessor State connected with the

activity of che predecessor State in respect of the territory co which Che

succession of States relates shall pass to the successor State;

(c) movable State property of che predecessor State, other Chan that

mentioned in subparagraph (b) , shall pass to the successor St3te is an equitable

proportion.

2. Paragraph 1 applies when part of che territory of a State separates from that

State and unites with another State.

3. The provisions of paragraphs 1 and 2 are without prejudice to any question o;

equitable compensation as between the predecessor State and the successor State

For Che purposes of che articles in Che present Part, "State archives of Che

predecessor Stace" means all documents of whatever data and kind, produced or

received by the predecessor SCaca in the exercise or its functions which, at the

date at che succession of States, belonged co Che predecessor State according to

ics internal law and wera preserved by it directly or under its control as archive

for whatever purpose.

Effects of the passing of Scaca archives

of a third State

A succession of States shall not as such affect archives which, at the date of

and which, at that date, are owned by a third State according to che internal law

of the predecessor Stats.

Article 25

Preservation of the integral character of groups of State archives

Nothing in the present Part shall be considered as prejudging in any respecc

available evidence from its State archives which bears upon title to the territory

Nothing in articles 42 Co 45 shall affact the rights or obligations of Che

Parties to the present Convention under any provisions in force binding then with

regard to the settlement of disputes.

FINAL PROVISIONS

The present Convention shall be open for signature by all Scatas until

31 December 1983 at Che Federal Ministry for joreign Affairs of the Republic of

Austria, and subsequently, until 30 June 1984, at United Nations Headquarters in

New York.

The present Convention shall remain open for accession by any State, the

instruments of accession shall be deposited with che Secretary-Oanerai of the

United Nations.

1. The present Convention shall enter into force on che thirtieth day =n'lowing

the date of deposit of the fifteenth instrument of ratification or accession.

2. For each 5tate ratifying or acceding to the Convention afctr :?.« deposit at

L. A lisc of conciliators consisting of qualified jurists shall be drawn up and

maintained by Che Secretary-General of the United Mations. To this and, every

State which is a Member of tile United Sations or a Party Co the present Convention

shall be invited to nominate rwo conciliators, and the names of the persons so

nominated shall constitute the lisc. The term of a conciliator, including chat of

any conciliator nominated to fill a casual vacancy, shall be five years and may be

renewed. A conciliator whose cerm expires shall continue to fulfil any function

for which he shall have been chosen under the following paragraph.

2. When a request has been made to the Secretary-General under article 43, Che

Secretary-General shall bring the dispute before a conciliation commission

constituted as follows;

The State or States zonsticuting one of che parties to the dispute shall

appoint:

(a) one conciliator of che nationality of that State or of one of those

States, who may or may not be chosen from the list referred to in paragraph 1; and

(b) one conciliator not of the nationality of that State or of any of chose

States, who shall be chosen from the list.

The State or States constituting the other party to the dispute shall appoint

two conciliators in the same way. The four conciliators chosen by the parties

shall be appointed within sixty days following the date on which che

1. Aux tins de la prgsente Convention :

La prSsente Convention s'applique uniquement aux eftets d'une succession

d'Etats se produisant conformement au droit international et, plus

particulierement, aux principes du droit international incorpore's dans la Charte

des Nations Ur.ies.

Application dans le temps de la presente Convention

1. Sans prejudice de I1application de toutes regies enonceea dans la prSsente

disposiciones del parrafo 1.

Cuando dos o ma's Estados se unan y foraen de ese modo un Estado sucesor,

los bienes de EsCado de los Estados predecesores pasarin al Escado aucesor.

Conservacid'n y seguridad de los archivos de EsCado

A los efeccos de la aplicacidn de las disposiciones de los artlculos de

la presence parte, el Estado predecesor tomara codas laa medidas para impedir

el dafio o la desCrucciiSn de loa archivos de Estado que pasen al Estado sucesor

de conformidad con esas disposiciones.

SECCION 2: DISPOSICIONES RELATIVAS A CATEGORIAS ESPECIFICAS

DE SUCESION DE ESTADOS

Art£culo 27

Transferencia de una parte del

1. Cuando una parte del Cerritorio de un Escado sea Cransferida por

adoptar4n por raayoria de votoa de sus cinco miembros.

4. La Comision podri seflalar a la atenciiSn de las partes en la concroversia

todas las tnedidas que puedan facilitar una solucidn antistosa.
