Chairs Opening Remarks

Mane Donovan welcomed everyone to the meeting and intimated that the purpose of the meeting was to discuss the dumping of soil contaminated with PCB material at the Shanks & McEwan landfill. She intimated that an invitation had been give to Shanks & L4cEa.m and this had been declined. Ms Donovan stated that when this news was broken at the %;&end we were unabie to do anything as the local Council offices are closed at the weekend. She also thanked those who had offered accommodation for the meetins had the Hall been unavailable.

Mrs Donovan indicated that all the invited speakers would be given an opportunity to speak and then the meeting would be opened for questions, however those from the village of Greengairs would be given preference over those from other areas when questions were being taken.

Councillor Sandra Cox

Councillor Cox congratulated the Community Council for organising the meeting for getting in touch with SEPA as the local Council had no prior knowledge of this tipping. She had contacted SEPA herself as well as Donald Dewar , Secretary of State for Scotland , all North Lanarkshire MP's and Ken Collins MEP. Correspondence had been received back from Mrs Liddell who had indicated she would be raising the matter with the Scottish Office. Councillor Cox indicated that she was concerned about this issue and would be supporting the village in investigating this matter.

Maria Donovan advised the meeting that the Community Council had contacted Donald Detvar and Helen Liddell MP. A reply had been received from Mrs Liddell indicating that she had asked for the matter to be investigated. She also advised the meeting that the liaison committee had met with Shanks & McEwan on Tuesday. The tipping was raised as part of that meeting. A member of SEPA had also been in attendance as well as the Health & Safety officer for Shanks & McEwan. The PCB materials had been tipped in September and November 1997. Mrs Donovan stated that a matter of deep concern was that no one knew Lyhat damage may be done in 20 - 25 years as a result of this tipping.

iMr MacDonald said that he was pleased to be able to come to the village to give people an opportunity to hear why the decision had been made and to answer any questions people may have.

He indicated that it was SEPA's responsibility to regulate the disposal of \Taste at landfill sites such as Shanks & McEwan. He also sated that sites which regularly receive this type of material have spebifications have specific conditions on their licence however Shanks & McEwan do not regularly take this type of material and so no specific limits are contained in their licence but rather a clause which requires them to consult with SEPA and gain their permission if they wish to deposit materials such as PCB contaminated soil. He gave examples of materials which are specifically banned from the site, these included asbestos and radioactive waste. He then indicated that SEPA had been approached by Shanks 8: McEFvan in September 1997 for permission to dump 164 tonnes of PCB contaminated soil at a level of 200ppm. Both Shanks gi McEwan and SEPA carried out separate risk assessments in relation to the request which both concluded that there was no risk to public health or potential h a m to the environment that would happen as a result of this material being dumped at the site. As a result of these risk assessments, permission was given on a one off basis to Shanks and McEwan to dump the soil. He then indicated that if soil of this nature was brough: into the site without apprc7;al SEP-3, would take swift action against the company. In view of the concerns of the local community about this issue: monitoring of the site and surrounding rivers etc. has been stepped up and there is no evidence to indicated that PCB is seeping into the wider environment. In light of the concerns expressed SEPA were in the process of reviewing the licence and a full consultation process is being carried out which would enable everyone to be involved, especially local people.

Councillor Jim McCabe ( Deputy Leader, Korth Lanarkshire Council)

Councillor McCabe indicated that he was member of the SEP.4 board but tonight he was representing North Lanarkshire Council. The Council would be contacting Calum MacDonald MP at the Scottish Office to raise with him the absence of across the board policy in respect of National Government guidelines on PCB's and to give local authorities some rights to monitor and sample what is happening in sites such as Shanks & McEn.an. He also indicated that he had been to two SEPA board meeting and a conference since this dumping had taken place and the issue hail never been raised with him. Councillor McCabe asked SEPA why the local authority had not been aware that toxic waste was being tipped, and why they had not been allowed to

sample the original site and the site after the dumping. Councillor McCabe indicated that in his opinion Shanks & McEwan had acted outwith the planning permission for the site by not abiding by condition 7 of the planning permission which had been updated by NLC in 1996 and that he would be asking the planning Department to look into this matter urgently. He had been told that 160 tones spread over 700,000 tonnes would have a diluted effect and that would have been taken into account. Shanks & McEwan will be contacted by the Council through the proper channels.

Maria Donovan said that it was a shame that the people of the village had not turned out in such numbers when the original planning permission had been sought as this may have meant that the tip would not have gone ahead in the first place.

Jim Farley (TGWU)

Mr Farley indicated that he had been at a meeting t)n Samrday morning with the Company. He was extremely angry as he had not been aware that material of this nature had been dumped and neither had the Lvorkers who had been putting the material into the ground. He had'written to the Scottish Office to ask why material like this had been brought in 8 lorries, 350 miles in order to be dumped. He indicated that the TGIVL would be sending a motion to the STUC urging them to campaign for a Scotland wide classification on materials such as this. The staff were also concerned about their own health as they had not been aware of the toxic nature of this soil. He would be asking for an independent survey of the tip. He urged the village to remain united on this issue and to work together.

Karen Turnbull ( on behalf Helen Liddell RIP)

Ms Turnbull indicated that Mrs Liddell was extremely concerned about this issue and was keen to work with the local community to have this matter filly investigated. On Monday Mrs Liddell hac! written to SEPA to ask that the licence be amended immediately to bring it into h e with Government recommendations and to ask for a full enquiry to be carried out into this incident. She also indicated that given that there was concern in the village as to the fact that one of the SEPA board members was also a Director at Shanks & McEwan, Mrs Liddell had written to Lord Sewel, the Environment Minister, to ask that an investigation be carried out to ensure that no conflict of interests existed in this decision.

Maria Donovan thanked Ms Turnbull for all the help that she had given her since the incident began.

Mr MacDonald from SEPA indicated that the consultation process n.ould be thorough and would involve people from the village. He also indicated that the Board had not been involved in the decision.

Councillor McCabe indicated that decisions such as this were delegated to officers and were not made by the board of SEPA.

Why have a board if they cannot influence the decision making process ? - SEPA should hold up their hands and say they got it wrong Would these changes to the licence be made if this issue had not come to light ? If there is more brought into the site what would be done ? Why wasn't there an independent risk assessment as those camed out were useless ? Why weren't health & safety brought in ? Had planning permission been breached ? Why had this material been refused by 13 sites in England but had still been accepted in Greengairs ? Why can't the licence be withdrawn immediately ? What are the Council going to do about this ? Why was it not incinerated ? Why was it not acceptable to SEPA East who insist on triple synthetic liners when dumping PCBs contaminated soil?

If any more loads were to be tipped, they would be breaching their licence and SEPA would take action against the company. If the Council believe that planning permission has been breached then they will take action against the company SEPA do not believe that the materials put in: in the quantities that they were put in produce any risk to the environment SEPA would continue to monitor the sight and take readings but could not be covered 24 hours a day. Both Mrs Liddell and Councillor Cox were pursuing the issue of an independent assessment. SEPA were of the opinion that children could continue to play in the bums as there was no risk to public health caused by the dumping of these materials. The planning permission will not be reviewed until 2007 (20 years after start). However the Council would be checking the details of existing permission to check that it had not been broken. Clarification will be given by SEPA to Community Council as to whether or not lead is able to be dumped in the tip. There is not an across Scotland policy implemented by SEPA, it is up to each area and so it is conceivable that SEPA East and SEPA West could have different policies on this issue.

10. PCB contaminated soil is not a special waste, only pure PCB and so this material was not covered by Special waste regulation.

The chairperson ended this part of the meeting by thanking the invited guests for attending. She hoped that some of the issues had been clarified for the people of Greengairs who would now meet to discuss \That further action they would be taking.

Bus Services

Various concerns and complaints were again rec,cived in relation to the bus service. The Secretary is to write to Mr B a n at Kelvin Bus Depot at Mothenvell to ascenain what action has been taken regarding previous complaints and to make him aware of present concerns.

Village History

Ei,oht Trophies have been received by the Community Council. Matters are to be pursued with liorth Lanarkshire Council and others regarding display and preservation.

Spring Clean Initiative

North Lanarkshire Council confirmed they will supply 5 skips over the period 5 to 10 April 1998 at the locations the Community Council requested. Other information regarding the Spring Clean Initiative is awaited.

Meeting with North Lanarkshire Council Administration

Forth Lanarkshire Council confirmed they will meet with representatives of the Community Council on Thursday 19 March 1998. The agenda will consist of items and issues identified at Annex I to the Minutes of the Community Council dated 12 February 1998.

Byelaws

The Community Council received a copy of the Byelaw Map applicable to this area. It is bounded on the north by the M8 Motorway and extends from the B7057 in the east to Craigens Road in the west and encircles all public and populated areas of SaIsburgh and its surrounds.

32 General Business

( 1 ) Finance

Members of the Community Council attended a Budget Information Meeting at the Municipal Buildings at Coatbridge on 26 February 1998.

The aim of the meeting was to demonstrate Sorth Lanarkshire Council corporate strategy with particular regard to services and expenditure in relation to the community i t serves.

Councillor H. McGuigan (Leader of the Council) insisted throughout the meeting the intention to bring democracy nearer to the people. However, it was made clear that a reduction of f 19.5 million pounds was being made to Council spending and it had already been proposed, discussed and in some cases decided where those cuts would fall.

Community Council members were informed that a number of questions they intended to ask at the meeting with regard to environmental, leisure and other spending proposals could not been put due to circumstances which did not allow all North Lanarkshire Council Depanment Budgets to be aired or expounded.

(2) Community Forums

Community Council members attended an Airdne Area (Community Forum) Committee meeting on 3 March 1998. North Lanarkshire Council has stated that community involvement is a key element in contributing to the success of decentralisation proposals. The purpose of the meeting was to take steps towards the development of a Community Forum for the Airdrie Area. Two main questions were tabled:

(a) What could Airdne Community Forum achieve?

(b) Who should be on the Forum and how should it be set up?

Due to the considerable input from those attending the meeting, the plenary session could not come to a decision on the formation of the Forum or the key issues.

Community Council members await with interest future developments with regard to Community Forums.

(3) Leisure Provision

Members noted a letter to H Liddell, MP from N. Turner, the Director of North Lanarkshire Council Leisure Services dated 12 September 1997 regarding leisure facilities in Salsburgh and surrounding environs. namely:-

(a) A Community Centre with regular lets for a doctors' surgery, a Childcare Clinic, a Citizens' Advice Surgery, an Unemployed Club?, a Playgroup that meets three times a week, a Visual Arts Class (children over 8). The centre also doubles for changing facility for George V Football Pitch.

(b) 4 Play Areas located at Bogfoot Road, Blackcroft Terrace, Carvale Avenue and Forest Road (Dew s hill).

(c) A Village Kature Park and additionally a number of Rights of Way.

(d) A Mobile Library Service.

Mention was made of Shotts Leisure Centre, Library and Heritage Lentre, a distance ot 8 miles away and the letter concludes there is quite a variety of leisure pursuits within Salsburgh or within close proximity to it.

(4) M.A.V.S.

A representative of M.A.V.S. is to be invited to the next Community Council Meeting.

( 5 ) Ramblers and Cycle Ways

Members were informed of matters in relation to a Ramblers' Association within the village. Other matters in relation to Cycle Ways and the closure of Rights of Way were also noted.

BUSINESS FROM THE MINUTES

1 BUS SERVICE No reply has been received to concerns and lettys of complaint handed to Mr Barr and Mr Elliot Jnr at the Meeting on 10 February 1998. Members of the public at this present meeting of the Community Council voiced further concerns and were given the telephone number of Mr Barr, Tel No. (01698) 262155, so they could voice their concerns direct.

p Due to the fact and comment made in the Local Press regarding massive amounts of Illegal Rubbish Dumping and the concern of the Elected Representative of Ward 47 in that it is a very serious problem in and around this village, the Secretary is to write to North Lanarkshire Council to ascertain the possibility of placing skips for one day each month at various venues in and around the village.

RAMBLER AND CYCLE WAYS Members noted issue 11 (Spring 1998) of the North Lanarkshire News and the comment on page 11 that over the last two months residents in Airdrie and the surrounding villages have been asked about where they walk and cycle to discover the paths in their area. The Secretary informed members that she has received no notification or correspondence regarding paths or cycle routes in the area even though the Community Council as a body has been pursuing these matters over a long period of time.

DISTRIBUTION OF MINUTES Members noted and concurred in the measure introduced toward improving Channels of Communication between Area Committees and Community Councils in that North Lanarkshire Council have decided that Minutes of Meetings of Community Councils would be submitted to Area Committees and that the Minutes of Area Committees would in turn be forwarded to appropriate Community Councils.

COMMUNITY COUNCIL AUDIT Members were informed that arrangements have not yet been finalised regarding the Annual Audit of the Community Council Records and that negotiations regarding audit are currently being conducted by North Lanarkshire Council with outside Agencies.

MONKLANDS ASSOCIATION FOR VOLUNTARY SERVICES Sharon Houston (co-ordinator M.A.V.S) and Ellen Weldon (Fund-raiser Development Worker M.A.V.S) were introduced to the Meeting and gave a Resume of their Remit and how they could assist the Community Council and other voluntary bodies in the village to address and obtain various support needs. A further meeting is to be arranged with various interested parties in the village to discuss matters in greater detail.

ORDER OF BUSINESS A number of questions were asked and points made and the Chair expressed the following regarding Order of Business at Community Council Meetings. Sederunt, Apologies for Absence, Minutes of Previous Meeting, Matters arising from Previous Minutes, Correspondence, Reports (Chair, Treasurer, Sub-Committee etc.), General Business, Close of Business and Date of next Meeting. Outstanding Business would form part of the Agenda for the next Meeting along with Community Council Minutes and any other competent matters.

It was noted that the Agenda for the next Community Council Meeting would include items noted under Annex 1 of the Community Council Meeting of the 12 February 1998.

MEETING WITH NORTH LANARKSHIRE COUNCIL Members attended a meeting with Representatives of North Lanarkshire Council Department of Administration on 19 March 1998. A comprehensive folder containing an assortment of 25 documents of various issues, letters, synopsis of meetings, Press comment, MAPS, discussion documents etc., were tabled for discussion to highlight various matters of concern to the Local Community which has been brought to the attention of the Community Council in the hope of obtaining response to satisfactory achieve resolution of the concerns and to improve the quality of life of persons in and around the area. , North Lanarkshire Council undertook to write to various departments within the authority in relation to the various issues and a response will be forwarded to the Community Council whom answers are forthcoming.

ALLOWANCE SCHEME The Secretary is to write to North Lanarkshire Council for clarification on funding for a variety of purposes including administration and running costs.

B. 1) The chairman of the Gala Day committee atfended the meeting and informed us that in order to get the Gala Day up and running woilld !ake a committee cf between 12 and 20 dedicated people to make it work. He also infcmec: the meeting that it would take in excess of €4000 pounds. 21 The social worker informed the meeting that there would be no more social work or money advice services after March 31st. due to councii cutbacks.
