    3.4 73RD

    AMENDMENT

    The constitution (73rd amendment) Act 1992 has added a new part IX

    consisting of 16 articles and 11 schedules to the constitution. The 73rd Amendment Act

    envisages the gram sabha as the foundation of the panchayat raj system to perform

    functions and powers entrusted to the state legislation. The Amendment provides a

    three tier panchayat raj system in the village and intermediate district level.

    Act 243, 243 A to 243 O would have described the features of the Amendment act 243

    definition such as district gram sabha, intermediate level panchayat area, population

    village etc.

    243 A the functions and powers of Gram Sabha.

    243 B deals with the constitution of the panchayat.

    243 C relates to the composition of the panchayat.

    243 D reservation for the schedule cast and schedule tribes and women of schedule

    cast.

    243 E it stress to the duration of the panchayat such as the period of five years and

    election as mandatory in this period.

    243 F disqualification of the membership of the panchayat.

    243 G- deals with the powers, authorities and responsibilities of the panchayats.

    243 H the legislature of a state may by law authorize a panchayat to impose taxes

    and funds of the panchayat.

    243 I it deals with the constitution of finance commission to financial position.

    243 J maintenance of the accounts by the panchayat and the auditing of such

    accounts.

    243 K deals with preparation of electoral rules for the conduct of all election to the

    panchayats.

    243 L the provision of the part shall apply to the union territory Meghalaya and

    Mizoram and hill area of Manipur.

    243 M this part not to apply to certain areas such as Meghalaya and Mizoram hill

    area of Manipur, hill area of Darjling in west Bengal state etc.

    243 O this part refers to the inference by the court and the electoral matters.

    3.4 74TH

    AMENDMENT

    part IX A has been added to the constitution by the constitution 74 th

    amendment act 1992. This amendment has added 18 new articles and a new twelfth

    schedules relating to the urban local bodies in the constitution Act 243 P to 243 Z G

    of part IX A have been declared below.

    243 P this part deals with the definition such as committee, district metropolitan

    area, municipal area, municipality, panchayat at population etc.

    243 Q constitution of municipalities such as nagar panchayat municipal council and

    Municipal Corporation.

    243 R composition of municipalities.

    243 S deals with the constitution and composition of ward and committee etc.

    243 T deals with the reservation of seats to the schedule cast/tribes and woman

    belong to that cast.

    243 U deals with the duration of municipalities.

    243 V deals with the disqualification of the membership.

    243 W this part deals with the power and authorities of the municipalities.

    243 X this part refer to the power to impose taxes by and funds of the municipalities.

    243 Y deals with the financial commission constitutes to review the financial positionof the municipalities.

    243 Z this part deals the audit of accounts of municipalities.

    243 ZA deals with the election of the municipalities.

    243 ZB this part of act shall be applied on the union territory.

    243 ZC this part not to apply to certain schedule areas.

    243 ZD this part deals with the constitution committee for district planning to

    consolidated the plans prepared by the panchayat and the municipalities in the district

    and to prepare a draft development plan for the district as a whole.

    243 ZE deals with the constitution of metropolitan planning committee.

    243 ZF deals with the continuation of existing laws municipalities in force.

    243 ZG this part deals with the interference by court in electoral matter.
