IInnttrroodduuccttiioonn ThisisthefourthannualreportpreparedbytheDCChildandFamilyServicesAgency(CFSA).ThereportreflectsthefindingsandresolutionofconcernsreceivedbytheOfficeoftheOmbudsman(orthe“Office”)fromyouthinfostercareorbyaconcernedparty(“constituents”)onbehalfoffosteryouth.TheDistrict’sFosterYouthStatementofRightsandResponsibilitiesAmendmentActof2012requiresthesubmissionofthisannualreport,whichmustinclude:thenumberoffosteryouthandconstituentcontactsmadetotheAgency,thenumberofconcernsreportedbyfosteryouthandconstituents,thenumberofinvestigationsconducted,thenumberofpendingconcernsthatareawaitingresolution,thetrendsandissuesthatarose,andtheoutcomesoftheinvestigations. RReeppoorrtt HHiigghhlliigghhttss InCalendarYear(CY)2016,742contactsweremadetotheOfficebyfosteryouthorconstituentsonbehalfoffosteryouth.Ofthe742contacts,238ofthosecontactsconcernedcurrentandformerDistrictfosteryouth.Thosecontactsincluded:

● 192fosteryouth-relatedcontacts(youthages0to20yearsold),ofwhichsevenarependingfinalresolution;and

● 46contactsregardingformerfosteryouthwhoachievedpermanencyoragedoutofCFSA’scare.

Ofthe742contacts,421generalinquiriesand83inquiriesregardingyouthwhowereneverinCFSA’scarewerereceived.

AA.. MMiissssiioonn CFSAestablishedtheYouthOmbudsmanpositioninJanuary2013,recognizingthatyouthmightnotfeelcomfortableaddressingconcernsdirectlytosocialworkers,orthattheymaynotknowwheretogoiftheyhadquestionsorencounteredproblemsconcerningtheirfostercaregiver.TheYouthOmbudsmanwasimplementedpursuanttotheDistrictofColumbia’sFosterYouthStatementofRightsandResponsibilitiesAmendmentActof2012.In2016,theYouthOmbudsmanjoinedCFSA’sOmbudsmanintheOfficeoftheOmbudsman.ThisledtoasignificantincreaseinthenumberofconcernsandinquiresreportedbyCFSAforCY2016.1

11.. TThhee OOffffiiccee ooff tthhee OOmmbbuuddssmmaann

TheOfficeprovidesimpartialconsultationtochildren,youth,birthparents,fosterparents,kinshipcaregivers,guardians,adoptiveparentsandotherexternalpartieswhohaveconcernstheywouldlikeaddressedbyCFSA.TheOfficerespondstoinquiriesbyprovidinginformationandeducation;communicatingthepolicyandpracticeofCFSA;workingwiththeclinicalteamand/orinvestigatingconcernsbycompletingafact-findingreview;workingwithandprovidingrecommendationsforresolutiontothechainofcommand;advisingonpracticeissues;referringfosteryouthandconstituentstotheappropriateinternalandexternalentitiesforassistance;orbybringingpartiestogethertodiscussconcernsultimatelyforresolution.TheOfficeidentifiessystemicissuesthroughanalysisofconcernsand 1TheCY2015YouthOmbudsmanReportaddressedconcernsandinquiriesregardingfosteryouthages15to20.InCY2015,theYouthOmbudsmanreceived42complaintsand32generalinquiriesfromfosteryouthages15to20.ThisreportaddressesconcernsreceivedbyCFSAregardingfosteryouthages0to20yearsold.

inquiresreceived,educatesconstituentsaboutthechildwelfareprocess,andrefersthemtoresourcesasappropriate.TheOfficealsoengagesinoutreacheffortstoensurethatallyouthincareareawareoftheirrightsandthatCFSAhasdedicatedstaffavailabletoaddressfosteryouthconcernsandinquiries.Allfosteryouthandconstituentsareencouragedtocommunicatetheirconcernstotheirsocialworker,legalrepresentative,orthroughthesocialworkersupervisorychainofcommandtoresolveissues.Ifthisprocessisunsuccessful,ortheyouthorconstituentsarenotcomfortableaddressingtheirconcernswiththesocialworkerortheirlegalrepresentative,theymayseekhelpfromtheOffice.TheOfficereceivesyouthconcernsandinquiriesregardingfosteryouthincarethroughthefollowingpathways:

Ofthe238contactsreceivedinCY2016,192–or81%–wereregardingfosteryouthincarewhile46–or19%–wereregardingformerfosteryouthwhoachievedpermanencyoragedoutoffostercare.Ofthe192contactsregardingfosteryouthincare,136–or71%–resultedininvestigations;6–or3%–wereresearchedandclosedduetolackofresponsivenessoftheconcernedpartyasadditionalinformationwasrequiredtoresearchandreviewtheconcerns;8–or4%–wereduplicateconcernsalreadybeinghandledbytheOffice;and42–or22%–wereresolvedinformallythrougheducating,researching,linking,alertingand/orreferringfosteryouthandconstituentstointernalorexternalparties.The192contactsrepresentconcernsaboutfosteryouthfrom120familiesthatwereservicedbyCFSA.ItiscommonforfosteryouthandconstituentswhocontactedtheOfficetopresentmultipleconcerns.Fosteryouth-relatedconcernswerereportedtoCFSAthroughanumberofdifferentsources(Table2).

11.. UUnnddeerrssttaannddiinngg ooff CChhiilldd WWeellffaarree Finding: CFSA’s jurisdiction and authority is not always understood or communicated appropriately internally and externally.

AsignificantnumberofconcernsthatwerereportedtoCFSAwereduetoalackofunderstatingofchildwelfare,itslimitations,anditsvariouspartnershipsintheDistrictofColumbia.Themisunderstandingofchildwelfarewasfurthercomplicatedbyinconsistentandinaccuratecommunicationbyexternalandinternalpartiestofosteryouthandconstituentsnavigatingthechildwelfaresystem.AgencyrepresentativeswhoarehighlyspecializedinareasofpracticesometimeslackeduniversalknowledgeofCFSA’sjurisdictionandauthority,whichsometimesledtoroleconfusionasitrelatedtotheconstituent’slegalrole;theyouth’slegalstatus;thelegalrequirementsofmandatedreporters–individualswhofrequentlyworkwithchildren,suchasteachersandphysicians,whoarelegallymandatedtoreportchildabuseandneglect;andCFSA’sadministrativerole.TheOfficeresearchedandeducatedpartiesasappropriate. Anumberoffosteryouthandconstituents2raisedconcernsaboutCFSA’sresponsivenessthattheybelieveddidnotadheretotheDistrict-widecustomerservicestandards.Theyviewedthemselvesasbeinganactiveteammemberandsharedtheirdesireformoretimely,clear,conciseandconsistentcommunicationfromtheclinicalteamregardingcasemanagementandbeingkeptinformedofclinicaldecisionsaffectingthefosteryouth,evenifthatmeantengagingindifficultconversations.Sometimestherewasahesitancytoengageindifficultconversationsinregardtoclinicaldecisionsthatweremadeaboutconstituent’spersonallivesoutofconcernforthefosteryouth’spersonalwellbeing.TheOfficeresolvedthoseconcernsbysharingpolicyandprocedurewithconstituentsandrecommendedthattheclinicalteamscontacttheconstituentsdirectlytodiscusscasemanagementandclinicaldecisions.TheOfficealsorecommendedrefreshertrainingtoreinforceDistrictcustomerservicestandardsasnecessary. Finding: Roles, Rights, and Responsibilities of stakeholders were not always clearly defined or understood.

Attimes,therightsandresponsibilitiesofvariouspartiessuchasthefosterparents,biologicalparents,fosteryouthandCFSAoverlapwhenitcomestoconsent,confidentiality,records,decisionandactions.Thepartiesdidnotalwaysunderstandtheirrespectiveroles,rightsandresponsibilities.Forexample, 2Theconstituentswhoraisedtheseconcernsincluded,butwerenotlimitedto,fosteryouth,fosterparents,biologicalparents,caregiversandlegalrepresentatives.

whenitcametomedicalconcerns,involvedpartieswerenotclearaboutthelegallimitationsoftheAgencyasthe“legalcustodian,”residualparentalrightsandresponsibilities,andthefosteryouth’srighttoconsenttomedicalcareindependentofthecaregiver.Asaresultofthisconfusion,concernswereraisedwhenpartiesunintentionallywithheldorreleasedinformationthatdirectlyimpactedthefosteryouth’srighttoconfidentiality,diagnosis,treatmentandmanagementofmedicalneeds.TheOfficewasabletoresolvemanyofthoseconcernsbyeducatingpartiesastoCFSA’spolicy,reviewingfosteryouthcasefilesandprovidingrecommendationstotheclinicalteam. Reviewpolicyandtrainingtodetermineifthereisaneedformoreguidancewithrespecttotheparties’roles,rights,responsibilitiesandrolelimitations.

awareofmedicalconsentlimitations. 33.. SSaaffeettyy aanndd RRiisskk

Finding: Inconsistent reporting of abuse and neglect allegations by mandated reporters was found.

TheOfficeresolvednumerousconcernsaboutimmediatesafety,removalofchildrenfromthebiologicalhomeorfosterhome,custodyordersandinadequateorimpropersafetyplans.Manyofthoseconcernsweretheresultofdifferingdefinitionsandtheunderstandingofwhatwasmeantbysafetyandrisk.Asaresultofthedifferingdefinitionsandunderstandingofsafetyandrisk,whenafosterparentincorrectlybelievesamereriskissueisasafetyconcern,theyexpectanurgentresponsefromCFSAandmayescalatethesituation.Conversely,sometimestruesafetyconcernsareviewedasonlyariskandtheappropriateactionisnottaken.Forexample,afosterparentmaynotreportthatayouththreatenedseriousviolenceagainsthimorherselfuntilthefollowingmorning.Thiswouldbeconsideredasafetyconcernandthefosterparentwouldbeexpectedtohaveimmediatelycontactedthesocialworkteam,ChildandAdolescentMobilePsychiatricService(CHAMPS)and/ortakentheyouthtothehospitalforanevaluation.Thescenariopresentedinthisexamplecanalsobecomplicatedifthesocialworkteamincorrectlyviewsthatsameissueasariskanddoesnotprovidecrisissupportormakeasafetyplan.TheOfficewasabletoresolvemanyofthesekindsofconcernsthrougheducationtoensurethatthepartieshadthesameunderstandingofsafetyandrisktosupportthesafetyoftheyouththroughappropriatepoliciesandprocedures. Physicaldisciplinewasanotherconcernthatfellunderthecategoryofsafetyandrisk.IntheDistrict,physicaldisciplineisnotillegal.However,itisillegaltosubjectafosteryouthtophysicaldiscipline.TheOfficereported22abuseandneglectconcernstoCFSA’sHotlineat202-671-SAFEor7233,remindedstakeholdersoftheirmandatedreporterobligationsandprovidedmandatedreportertrainingwhennecessary. TheOfficealsoreceivedconcernsaboutagencyresponsivenessregardingsevenissuesaboutallegedassaultsandthreeissuesaboutbullyingoffosteryouth.TheOfficeworkedwithpartiestoensurethatthefosteryouthreceivedpropermedicaltreatment,theincidentsweredocumented,notificationsoftheunusualincidentreportwerereceivedandreferralsweremade.

reporters,ensuringthatallrepresentativesunderstandthatclinicalrelationshipsdonotsupersedecivilandcriminalinvestigationsofabuseandneglect.

ReportsuspicionandallegationsofknownabuseorneglecttotheCFSAHotlineat202-671-SAFE.

ReportallegationsofanassaulttotheHotlinetoalerttheMetropolitanPoliceDepartment(MPD)astheappropriateinvestigatoryauthorityalongwithanunusualincident/criticaleventreport.

44.. CCaassee MMaannaaggeemmeenntt

Finding: Discrepancies were found regarding allowance disbursement procedures and lack of documentation when allowance is withheld. Finding: Records were not always released in a manner that is consistent with CFSA policy.

Allowanceandstipendissuescontinuedtobeatrendin2016.DuringCY2016,approximately447fosteryouthwereeligibletoreceiveallowancesorstipends.3TheOfficehandled26concernsthatdealtwithfosteryouthfinancialissues.Ofthe26,11involvedallowanceandstipendconcerns.Allowanceconcernsfellwithinthreeprimaryareas:discrepancyintheallowancerequirementswithfosterhomes,grouphomes,andindependentlivingprograms(ILPs),thedistributionofallowancestofosteryouth,andtheenforcementoftheallowancepolicywhenfundsarewithheld.TeenparentsalsoraisedconcernsbecausestipendssometimesvariedgreatlybetweenfosterhomesandILPs.Extendedvisitationwiththebiologicalparentpriortoprotectivesupervisionalsoledtodialogueaboutthedisbursementoffundsfortheyouth’sfood,personalitems,transportation,clothingand/orallowance.TheOfficefoundthatthereisnoclearoversightorsystemthattrackswhenafosterhome,grouphomeorILP4withholdsthefosteryouth’sallowance.Atrackingsystemwouldensuretheproperdistributionofallowanceduringtheplacementandwouldalsoensurethereleaseofallwithheldallowancefundsuponreplacement,achievingpermanencyoremancipation.TheOfficeworkedwiththepartiestoresolveallowancediscrepanciesandrecommendedtothechainofcommandthattheagencies,fosterhomes,grouphomesandILPscreateandmaintainaformaltrackingsystem.TheOfficerecommendedthatclearcasemanagementsupportshouldaddressanyfinancialobstacles. 55.. PPllaacceemmeenntt aanndd PPeerrmmaanneennccyy Finding: At times, kin were not always vetted.

Placementandvettingofkinissuesaroseasaresultofremovals,placementorthereplacementofyouthwhenaplacementchangewasnecessary.Achangeinthepermanencygoalisatimeduringwhichknownandunknownrelativesmaypresentthemselvesasitbecomesclearthatthecustodialrelativeisunableorunwillingtosatisfythecourtorderforreunification.TheOfficeworkedwithconstituentsandthecasemanagementteamsin31casestoshareinformationthatpermittedthepromptvettingandthecompletionofthecomprehensiveclinicalassessmentsofkinwhocouldpotentiallyserveasaproperplacementoptionforrelatedyouthincare. Asyouthhavebecomemorevocalregardingtheirplacementpreferences,concernsarosewhenanidentifiedplacementdidnotmeetthefosteryouth’spreference.TheOfficedeterminedthatinanumberofinstances,thefosteryouth’splacementpreferencewasdirectlyrelatedtotherulesregardingcurfew,passes,restrictionsandviolationsinthevaryingfosterhomes,grouphomesandILPs.Thelackofuniversalrulesledtoconfusion,distress,and/ornon-compliancebythefosteryouth,especiallyduringtimesoftransition.TheOfficeworkedwiththepartiestohelpsupportandstabilizetheyouth.TheOfficeresearchedconflictresolutiontrainingsforyouthandagencyrepresentativesandrecommendedthatCFSAexploreincorporatingconflictresolutiontrainingforitsclinicalteam,fosterparentsandagencyrepresentatives. Reviewandre-engageeffortstoidentifyandvetkinwhengoalschange.

FF.. OOuuttrreeaacchh TheOfficeservesasaresourcetothecommunitytofieldandanswerquestionsabouthowchildwelfarefunctionswithinthecommunityandinpartnershipwithothergovernmententitiesandcommunityresources.Thisisaccomplishedthroughansweringinquiries,educationandengaginginyouthoutreach.

11.. GGeenneerraall IInnqquuiirriieess Whenappropriate,theOfficewillcommunicatewithayouthorconstituentthatestablishescontactregardinganygeneralinquiry.In2016,theOfficereceived421generalinquiries.Theinquiriesprimarilyoriginatedfromfivegeneralsources:agencyrepresentatives,constituents,governmentrepresentatives,mandatedreportersandorganizationrepresentatives.Whenageneralinquirywasreceived,theOfficeeducatedtherequestorand/orreferredthemtotheappropriateresponsiveentityortheCFSAHotlinewhenappropriate.

entities.TheOfficecontinuestoengageyouththroughPeerPlug,theYouthOmbudsman’speer-to-peermentorshipinitiative.Itsmissionistoserveasavehicleforpeer-to-peermentorshipaswellasaplatformforyouthtoadvocateforthemselvesandfortheirvoicestobeheardthroughouttheAgencyandthegreatercommunity.InitscollaborationwithCFSA’sAlumniBoard,PeerPlugservesinanadvisorycapacityfortheYouthOmbudsmantocreaterecommendationsforAgencyimprovement. TheOfficehasparticipatedinseveraleventsthroughout2016.TheOfficeorganizedayouthvoterregistrationevent.TheYouthOmbudsmanhelpedplanandparticipatedin“WeMatter,”arelationship-buildingeventthatbroughttogetheryouthfromPeerPlug,currentandpotentialfosterandadoptiveparents,communitystakeholdersandCFSAstaffinasuccessfulefforttoprovidetheopportunityforperspectivesharingandgenuinedialogueregardinglifeinandoutoffostercare.TheOfficeandPeerPlugparticipatedintheCFSAPlacementAdministration’slocalradioeventwithWPGC95.5,whichprovidedanopportunitytospreadawarenessaboutchildwelfare.Alsoin2016,PeerPlugmemberactivelyvolunteeredandparticipatedinseveralAgencyinitiatives.TheYouthOmbudsmanhasfacilitatedyouthfocusgroups,servedasaguestfacilitatorinCFSAtrainings,andsupportedtherecentyouthblockpartyattheOfficeofYouthEmpowerment(OYE)5,whichwasanopportunityforyouthtoindulgeinfunwhileexploringtheireducationalandvocationalinterests.TheYouthOmbudsmanhasassistedyouthinpreparingforvariousspeakingengagements,includingtheyouthpanelthatprovidedtestimonyinsupportofCFSA’sworkwithyouthbeforetheDCCouncilatCFSA’s2016PerformanceOversightHearing.Inaddition,theYouthOmbudsmanservedasamemberoftherecentWhiteHousePresidentialInnovationFellowsworkgroup.Thechiefgoaloftheeventwastoensurethatyouthhadaframeworktoassisttheminsuccessfullynavigatingthechildwelfaresystem. Finally,andinthespiritoftheDecember2016holidayseason,theYouthOmbudsmanparticipatedintheFosterandAdoptiveParentAdvocacyCenter(FAPAC)CirclesofLovesharedparentingholidayeventbydressingasSantaClausforthechildrenandfamiliesinattendance.
