8.0. 1994(E).-Whereas the proposals to fix theminimum rates of wages per day payable to the employeesengaged in the scheduled employment of "Employment ofSweeping and Cleaning excluding activities prohibitedunder the Employment of Manual Scavengers andConstruction of Dry Latrines (Prohibition) Act, 1993", waspublished i!1the Gazette of India, Extraordinary; Part II,Section 3, sub-section (ii), as required by clause (b) ofsub-section (I) of Section 5 of the Minimum Wages Act,1948 (I I of (948), vide Notification of the Government of

dated the 24th April, 2008 for information of and invitingobjections and suggestions from all persons likely to beaffectedthereby,tilJthe expiry of the period of two months,fromthe date on which copies of Gazette notificationweremadeavailableto thepublic; .

And, whereas, no objections or suggestions havebeen received on the said proposals by the CentralGovernment;

Now, therefore, in exercise of the powers conferredby clause (a) of sub-section (l) of Section 3 read withclause(i) of sub-section(I) of Section4 and sub-section(2)of Section 5 of the said Act, the Central Gc venunentafterconsultingthe Advisory Board, hereby fixes the minimumrates of wages payable to the employees employed in thisScheduled employment.

The minimumrates of wages,which willbe effectivefrom the date of this notification shall consist of-

(a) basic rates of wages as set out in column (2) ofPart-Iof the Scheduleannexedherewith andpayable to theemployees working in areas mentioned in column (1)thereof; and

(b) a special allowance, hereinafter referred to asVariable DearnessAllowance,Part-II of the said Scheduleshall be adjusted by the Chief Labour Commissioner(Central) at an interval of six months commencingon theIst October and Ist April on the basis of averageConsumerPrice Index Number for Industrial Workers forthe each preceding period.of six months ending on 30thJune and 31st December every year respectively, at therate mentioned in column(2) of Part-II oftheSchedule.

Explanation: For the purpose of this notification

I. Area 'A' and Area 'B' as indicated in Annexure tothis notification shalJ respectively comprise alJ theplaces as specified in the said annexure as suchareas, and include all places within a distance offifteenkilometersfromthe periphery of a MunicipalCorporation or Municipality or Cantonment Boardor NotifiedArea Committeeor a particularplace andArea 'C' shall comprise of all the other places notmentioned in the Annexure and to which the

Minimum Wages Act, ]948 extends. The placesadded or upgraded fromtime to time by theMinistryof Finance for the purpose of payment of HouseRent Allowance to Central Government employeesshall be taken to. be added from the date of suchaddition or up-gradation for the purposes of classification specified in Annexure to this draft proposal.

2. Where the existing rates of wages of any employee,based on contract or agreement or otherwise, arehigher than the rates notified herein, the higher ratesshall be protected and treated as minimum rates ofwages, applicable for the purpose of this notifica-tion to such employee.

3. TheMinimum rates of wages include also the wagesfor weekly day of rest.

4. The minimum rates of wages are applicable toemployees employed by contractors also.

5. The minimum rates of wage!. for disabled personsshall be same as payabie to the workers ofappropri-ate category.

6. The men and women employees shall get the samerates of wages for the same work or work of similarnature.

7. Theminimumrates of wages and Variable DearnessAllowance both constitute the minimum rates of

wages to be enforceable under the Minimum WagesAct, 1948(II of] 948).
