Revision of pension of pre-2006 pensioners

The government issued instructions to revise the pension of pre-2006 retirees, in the face of

large number of resentments expressed by the pensioners and the court cases pending in this

respect. The Ministry of P P G & P OM dated 28-01-2013,( published in our issue of

February,2013),gave effect to the decision in respect of pre-2006 pensioners, to grant them

modified parity, as demanded by various pensioners organizations, and revise their pension, in

terms of para 4.1 & 4.2 of their OM No 38/37/08-P&PW(A) dated 01-09-2008, with reference to the

fitment tables annexed to Ministry of Finance OM No 1/1/2008-1c dated 30-08-2008.The effective

date for the revision is, however, 24 sept, 2012, and no arrears for the period 01-01-2006 to 23-09-

2012 are payable. The next date of hearing regarding the CAT case is 29 April, 2013, where the

case will now rest regarding the arrears for the period 01-01-2006 to 23-09-2012.

Earlier, the government had issued similar instructions to revise the pension of pre-2006 Defence

Services Officers on 17 Jan, 2013 on similar conditions. ( also published in our issue of

February,2013)

Seventh Pay Commissionth th Notwithstanding the anomalies created by the 6 CPC report, the time to form 7 Central Pay

Commission has come. Various groups are already gathering information on various socio-

economic conditions affecting the retired personnel. In the meanwhile, Minister of State for Finance

Shri.Namo Narain Meena said in the Lok Sabha (on 05-03-2013) in a written reply to a question that

"at present no proposal to constitute the 7th Central Pay Commission is under consideration of the

Government. There have been some demands received for setting up of the 7th Central Pay

Commission. In the past, there has generally been a gap of a minimum 10 years between two

successive Pay Commissions. The recommendations of the previous Central Pay Commission,

viz., 6th Central Pay Commission were given effect to from 1.1.2006. Therefore, at present there is

no proposal to constitute the 7th Central Pay Commission under consideration of the

Government". thIn the meanwhile, one of the central ministers, Ajay maken, has advocated the setting up of 7

central pay commission. Related article may be perused in this issue.

Ministry of Pl,PG & P (Dept of P & P' W) O M F.No.38/37/08-P&PW(A) dated 13 Feb,2013Sub; Revision of pension of pre-2006 pensioners- reg.1. The undersigned is directed to say that in pursuance of Government's decision on the

recommendations of Sixth Central Pay Commission, orders were issued for revision of pension/family pension vide this Department's OM No.38/37/08-P&PW(A) dated 1.9.2008, as amended from time to time.

2. The pension/family pension of pre-2006 pensioners was stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.l/l/2008-IC dated 30th August, 2008 with effect from 24.9.12 vide this Department OM of even number dated 28th January, 2013.

3. In regard to disbursement of revised pension/family pension, while Head of Departments are responsible for sanctioning of pension/family pension, in cases where revision has already been done by PAOs consequent to 6th CPC, the revision may be effected at the level of PAOs. A copy of the revised authority may be sent to HOD/DDO for record. In cases where no revision has been effected, Head of Offices may follow normal procedure for revision of pension/family pension. Even in cases where there is no change in pension/family pension as a result of the issue of this OM, a revised authority for no change may be issued by the PAOs. The finalized authority will be sent to CPAO for further necessary action.

4. A suitable entry regarding the revised pension/family pension shall be recorded by the Pension Disbursing Authority in both halves of the Pension Payment Order.

5. In case the pension/family pension in respect of pre-2006 pensioners/family pensioners has not already been revised w.e.f. 1.1.2006, the same may also be revised for the period up to 23.9.2012 in terms of order dated 1.9.2008 and subsequent orders thereto and for the period from 24.9.12 in terms of order of even number dated 28.1.2013.

6. CGNCPAO/Ministry of Defence/Ministry of Railways/Department of Posts/Department of Telecom will devise their own monitoring mechanism to ensure that enhanced pension and arrears are disbursed to all civil pensioners/family pensioners expeditiously.

The undersigned is directed to refer to this Department's OM of even number, dated 16.12.2011,

2.11.2012 and 14.11.2012 and OM No. 1/23/2012-P&PW(E), dated 13.09.2012 and 27.09.2012 on an extremely important issue, i.e. revision of the Pension Payment Order (PPOs) of pensioners/family pensioners who retired/died before 2006. The revision has to be done on priority because the pensioners are suffering harassment due to non-revision of their PPOs. .

2. A number of initiatives were taken in the last quarter of 2012 such as allowing change in date of birth of spouse, use of certain documents for revision of PPOs, inclusion of present postal address and mobile and telephone number in the life certificate and use of e-scroll for extracting information from banks' database. In order to further streamline the process, it has been decided to allow revision of PPOs even in those cases where date of birth/age of spouse is not given in the PPO or this information is not available in the office records. Such PPOs may be revised again when age/date of birth becomes available. It has also been decided that only live cases in which pension/family pension is being disbursed will be included in the pendency statement of the Central Pension Accounting Office (CPAO) and for this purpose scroll alone will be relied upon by the CPAO.

3. A copy of the advertisement previously circulated to all Ministries/Departments vide this Department's OM of even number, dated 16.12.2011 for use by them for eliciting information from pensioners/family pensioners is enclosed. It is requested that the advertisement may be posted on the website and if desired get it published in the leading news papers.

The undersigned is directed to refer to this Department's O.M. of even number, dated 15 November and 22nd November, 2011 circulating the minutes of the meeting concerning revision of Pension Payment Orders (PPOs) in respect of pre-2006 Pensioners, which was chaired by Secretary (Pension) on 3/11/11. It was decided, vide para 9 of the minutes, that the Department of Pension and PW would bring out a model advertisement spelling out the utility of the revision of PPO to the individual pensioner/family pensioner, which may be used by administrative Ministries/ Departments for eliciting responses from the pensioners/ family pensioners belonging to them. It was also agreed that the advertisement shall also be posted on the web-site of respective Ministry /Department.

2. In pursuance of the minutes as indicated above, a copy each of Hindi and English versions of the model advertisement is enclosed. It is requested that the administrative Ministries/ Departments may consider publishing the advertisement in the leading newspapers in English and Indian languages so that maximum number of pensioners/family pensioners come to know about the benefits of getting their PPOs revised. As per software developed for monitoring of Pension related grievances, all on-line grievances of pensioners are being fed through web application CPENGRAMS available in the Pensioners' Portal maintained by Department of Pension & Pensioners' Welfare and the same are forwarded online to the concerned Ministries/Departments/Organizations for their redressal. It has, however, been felt that timely action is not being taken by various Ministries/ Departments/ Organizations for redressal of grievances and same remain pending for unduly long periods. There is thus need to emphasis upon the concerned officers dealing with these grievances in your Department for taking timely action on the grievances of pensioners so that unnecessary delays could be avoided. The regional offices and field officers, wherever they exist also need to be sensitized in this regard accordingly.2. Any grievance redress system would be failing in its primary purpose of the minimum courtesy of acknowledging receipt of a complaint is not observed. As per the guidelines issued by Administrative Reforms and Public Grievances vide its Office Memorandum No. K 15011/l/2006-PG, dated 22nd May, 2006, an acknowledgement has to be sent immediately and at the most within a period of three days of the receipt of the grievance and the grievance itself should be redressed within a maximum period of two months of its receipt. Cases where it is not possible to give immediate reply, an interim reply should be given to the applicant. An immediate action by the concerned Ministries/ Departments/ Organizations will be steps towards pensioners' welfare and will go a long way in ameliorating the hardships of Pensioners. Further, in case it is not feasible to accede to the request made in the petition a reasoned reply may be issued to the aggrieved citizen within this stipulated time limit. 3. As already requested earlier vide this Department's letters No. 41130/2011-P&PW(C) dated 13.01.2012 and 15.10.2012, you are once again requested to fix the time-line for timely redressal of grievances as per the guidelines issued by Department of AR&PG (copy enclosed).A detailed report on the action taken for implementation of these guidelines may also please be sent to this Department.

Ministry of P, P G & P (Dept of P & P W) O M No.38/6/2010-P&PW(A)Pt.) dated 18th March, 2013Sub: - Revision of provisional pension sanctioned under Rule 69 of the CCS (Pension) Rules, 1972.The undersigned is directed to say that in pursuance of Government's decision on the recommendations of Sixth Pay Commission, orders for revision of pension of pre-2006 pensioners' w.e.f. 1.1.2006 have been issued on 1.9.2008.The following categories of pensioners were entitled to provisional pension as in the pre 2006 pay-scale:-a) Employees suspended before 2006 and also retired before 1.1.2006b) Employees suspended before 2006 but retired after 1.1.2006c) Employees who retired before 1.1.2006 and against whom departmental / judicial proceedings were pending at the lime of retirement.It has been decided that in all the above cases, the provisional pension sanctioned under Rule 69 of CCS (Pension) Rules, 1972 will be revised in terms of this Department's OM No.No.38/37/08-P&PW(A) dated 1st September, 2008 as clarified/modified from time to time. An illustration regarding revision of provisional pension sanctioned under Rule 69 of CCS (Pension) Rules 1972 before 1.1.1996 is enclosed.As regards revision of provisional pension in case of employees who are drawing provisional pension in 4th CPC scales, their provisional pension would be brought over to 5th CPC and thereafter to the 6th Central Pay Commission and their provisional pension would be revised in accordance with the instructions contained in DoP&PW OM No.38/37/08-P&PW(A) dated 1st September, 2008 as clarified/modified from time to time.

ACTION TAKEN REPORT ON THE DECISIONS OF THE 21st MEETING OF SCOVA HELD ON

27th SEPTEMBER. 2012

1 .1 and 19 of ATR of Para 5Issue of revised PPO for Pre-2006 retirees and also to communicate the amount of pension as well as Family Pension to be revised consequent to the 6th Central Pay Commission to Pre 1.1.2006 pensioners.

i) Central Pension Accounting Office has indicated that out of 6.67 lakh cases of pre-2006 pensioners/family pensioners revised PPOs in respect of 3.06 lakh cases have been issued. CPAO informed that they are sending e-scrolls of Pensioners to all Ministries/Departments, which will solve the problem of non receipt of Annexure-III.ii) As final figures were not available, Dept ofTelecom and Dept of Posts were asked to compile data for their revision by 31st March, 2013.iii) Ministry of Railways informed that they have requested pensioners to apply for revision of PPO by making all the data available to them. Theyinformed that they have revised 4.7 lakh PPOs on receipt of these applications and 6.00 lakh are pending. The Ministry has been asked to complete the task of issuing revised PPOs by March 2013 where applications have been received. Simultaneously they should ascertain a mechanism of getting data of the remaining cases and revising PPOs of those who have not applied for revision of PPOs.iv) Ministry of Defence informed that they have to cater to the requirement of more than 11 lakh pre2006 Pensioners. They have revised PPOs of about 5.7 lakh out of them. They also informed that In approx 8.0 lakh cases, the revision has to be done manually and they have to take additional action for capturing all the data which is available only in physical form. The Ministry was asked to deploy additional manpower for capturing of data and complete the revision exercise by 30th Sepr, 2013. Secretary (P&PW) requested all the organizations/Dept/ Ministries to expedite the same without further delay and update the latest status with the Dept of Pension & Pensioners' Welfare.( Action: CPA0, M o Railways, M o Defence)

DOP&PW and CPAOa) A number of initiatives were taken in the last quarter of 2012 such as allowing change in date of birth of spouse, use of certain documents for revision of PPOs, inclusion of present postal address and mobile and telephone number III the life certificate and use of e-scroll for extracting information from banks database. It has also been decided in January,2013 to revise PPO without the Date of Birth of spouse where it is not readily available and revise the PPO again when Date of Birth becomes available. A reconciliation exercise is underway in the CPAO. The future course of action may be chalked out after receiving further inputs from the CPAO.b) CPAO has also requested all the pensioners through advertisement published in one leading daily National Hindi, English, Regional newspaper of State/ UT's each, on 21/10/2012 to furnish additional information like present address, Telephone/Mobile Number while appearing for life certificate or submitting it to banks in November every year. Banks Association has also b~en requested to give it wide publicity through advertisements.c) Civil Ministries' pre-2006 pendency has been reduced to 23% and pre-1990 pendency has been reduced to 75% as on 31.01.2013. Further, about 18,000 cases are at various stages in the PAOs and CPAO. Department of Postsl(a) Revision of pension and PPOs of Pr-2006 Pensioners :- The work regarding revision of Pension and payment of arrear has been completed in respect of almost all pre 2006 pensioners. The progress up to 30.11.2012 in respect of revision of PPOs of pre 2006 pensioners is 45.18%. All the Head of Circles/ Postal Accounts offices have been requested to get the work completed by target date.l(b) Revision of Pension and PPOs of Post-2006 Pensioners:-The work regarding revision of Pension and PPOs in respect of Post-2006 Pensioners has been completed almost cent percentMinistry of Railways:(i)The position of revision of Pre-2006 and Post- 2006 PPOs to the end of December/2012 is given below:-

(ii) Instructions have been issued by Railway Board to chalk out a comprehensive action plan and gear up machinery to complete the work of revision of all remaining pre-2006 cases by the stipulated date of 31/03/2013(AM/F's letter No. 2010/AC-II/2I/4 dtd. 07-11-12 and 07-12-12). Railways have also been asked to complete. The remaining work in the time bound manner by 31-03-2013. Railway have been asked to give wide publicity of revision of pension by issuing advertisements in the newspaper cal1ing for the applications from pensioners and making suitable arrangement in Personnel and Accounts Offices for processing the pension revision cases.(iii) It is pertinent to mention that Accounts Dept Issues revised PPO on receipt of sanction of revision of pension from the Pension Sanctioning Authority (Personnel Branch).Personnel Department had been issuing advertisements in the newspapers calling for the details: Current residential address, updated bank account no. (post core-banking system) etc. from the pensioners for processing and according sanction the same before being forwarded to the Accounts Department for revision of pension.(iv) To facilitate receipt of applications from pensioners, RBI on request of Railway Board issued instructions to all the pension disbursing bank branches to ask pensioners to fill pension revision applications forms along with Life Certificate. The same would be collected by Railways units for according sanction and to issue revised PPOs to the pensioners.D o TelecommunicationThe cases for revision of pension of pre-2006 pensioners are in progress. Efforts are being made to complete the task of finalization the pre-2006 pension revision cases within the time frame as per(i)The position of revision of Pre-2006 and Post- 2006 PPOs to the end of December/2012 is given below:-

It was informed that the issue was taken up with the concerned ministries and the decision to merge 19 dispensaries in 12 cities has been taken in principle. He will also take up the matter with the Health Minister regarding opening of one new CGHS at Mohali / Panchkula / Chandigarh. issue of RELHS, It was decided that the Ministry of Railways may discuss the issue with the members.(Action : Ministry of Railways)

Court of Kerala vide their order dt.22-11-2002 in O.P No.17280/2002 prescribing for criterion of 2.5 Kms. This order of Kerala High Court has been upheld by Hon'ble Supreme Court. Once the issue has been settled by the Apex Court no further action in the matter is feasible. It is relevant to point out that in respect of Non-Railway civil pensioners FMA is not admissible if residing in area covered by CGHS dispensary/Hospital. Thus, the criterion of residing beyond 2.5 kms of RailwayHospital/ Dispensary is analogous to the position existing with reference to Non-Railway civil pensioners. As such, this Ministry cannot take any unilateral decision on this issue. Regarding issues relating to RELHS, the position has been explained against S1.No.4 & S1.No. 14 of the ATR by Ministry of Railways

6 Dept. of Telecom:The proposal for rectification of anomaly in pension of BSNL employees retired within ten months of their absorption in BSNL w.e.f. 1.10.2000. was examined in consultation with the Internal “Finance Wing and referred to Department of Pension and Pensioners' Welfare as well as Department of Expenditure. While Department of Pension and Pensioners' Welfare agreed with our proposal, Department of Expenditure did not agree to the same. However, DOP&PW opined that "since the Govt. had decided and implemented the formula for full minimum pension of all pensioners irrespective of their date of retirement as not to be less than 50 of the minimum pay in the revised scale. Therefore, the absorbees who are entitled for combined service pension as per Rule 37A are also entitled for minimum of pension, irrespective of their date of retirement at the rate not less than 50 of the minimum pay in the scale of pay held by them at the time of their retirement. This being the rule position, the pensioners of this class retiring even after 1.8.2001 are entitled far minimum pension at the rate not less than 50% of the minimum pay in the scale of pay held by them at the time of retirement. Accordingly, the issue was examined and it has been decided that the absorbees in BSNL who are entitled for combined service pension as per Rule 37 A are also entitled for minimum of pension, irrespective of their date of retirement, at the rate not less than 50% of the minimum pay in the scale of pay held by them at the time of retirement. This decision was conveyed to BSNL vide letter No. 40-10/2005-Pen(T) dated 27th September, 2011. In cases it was not possible to give immediate reply, an interim reply should be given to the applicant, DOP&PW will reiterate these instructionsThe Railway association pointed out that direct cases which go to Ministry of Railways should give acknowledgement on the same lines as in respect of cases coming through DoP&PW. 12 6.8 of Para 6a) Grievances Committee at the Additional Director (CGHS) level at DelhiAdvisory Committees have been constituted at Wellness Centre level which meets regularly to settle the issues at local level itself. Claim day once in a month and Claim Adalat from time to time are held in each zone to settle outstanding reimbursement claims. Detailed instructions tostreamline and expeditedisposal of Medical Reimbursement Claims have also been issued andthe position IS being monitored at all levels regularly. As a result of the initiatives taken by the Ministry in this regard, the pendency has been brought down drastically. MOHFWintends to further bring it down through computerisation and administrative actions. 6.12 &6.13 of Para 6: 6.12 : i) RELHS facilities to dependent parents

Ministry of Railways: 6.12:(i) A Committee had been constituted by Railway Board to make recommendations with respect to modalities for implementation of the scheme for extension of medical facilities to both dependent father and mother of railway employees. The Committee has submitted its report which is under consideration of the Board.(ii) A memorandum of Understanding was signed between Ministry of Railways and Ministry of Health & Family Welfare on 05.02.2010, regarding opening of OPD cum Diagnostic Centres, Secondary Level General Speciality Hospitals and Tertiary Level Multi-specialities Hospital on land, which is not immediately operationally required, to provide quality healthcare to Railway passengers, General public and Railway beneficiaries. It is planned to set up 381 OPD & Diagnostic Centres (200 sq.m.), 101 Secondary Level General Speciality Hospital (5 acres) and 40 Tertiary Level Multi-speciality hospital (20 acres). To translate the MOU into action, a High Power Working Group under the Chairmanship of Minister of State for Health and Family Welfare has been formed with senior officials of both the Ministries as members thereof.Three meetings of of the Working Group have so far been held in which about 91 locations htlve been identified for developing the healthcare facilities as pilot project. Out of these 91 locations, 50 locations have been identified for development of Diagnostics/OPD facilities, 25 locations stations have been identified for setting up of Secondary Level General Speciality Hospitals and another 16 locations have been identified for development of Tertiary care hospitals. OPD & DiagnosticCentres have been decided to be developed on priority basis as it will have a shorter gestation period and also it will require lesser amount of investment. Therefore, to test the model, the Ministry of Health & Family Welfare has identified 11 locations VIZ. Kathua, Udhampur, Dhakuria, Bongaon, Barrckpore, Naihati, Bagnan, Khardah, Hasnabad, Erode and Tanuku for setting up of OPD & Diagnostic Centres.Centres have been decided to be developed on priority basis as it will have a shorter gestation period and also it will require lesser amount of investment. Therefore, to test the model, the Ministry of Health & Family Welfare has identified 11 locations VIZ. (iv) There IS provision of Hospital Advisory Committees in Railway Hospitals to assist patient and their family members. The committee shall consist entirely of ladies. MINUTES OF THE 22ND MEETING OF SCOVA HELD ON 19.2.2013 AT VIGYAN BHAWAN ANNEXE, NEW DELHI.

At the outset Secretary (P&PW) welcomed Hon'ble MOS(PP), representatives of Pensioners Associations and the participating officers of various Ministries/Departments. He mentioned that SCOVA has been successful in achieving the objective for which it was started in 1986. Secretary (P&PW) added that the serving officers should be considerate to the pensioners as they will also join the ranks of pensioners after retirement. He praised the contributions made by the Pensioners as officers during their tenure in the Government and also applauded for their present contributions as Senior Citizens. Referring to the issue of revision of PPOs, he mentioned that a lot of work had been done. However, still a lot remained to be done. Efforts were on to make the procedures simple and uncomplicated.3. Welcoming the participants, Hon'ble MOS (PP) stated that as promised last time, the SCOVA meeting was being held for the second time in a year. He mentioned that Department of P&PW is coordinating with several other Ministries/Departments to redress the grievances. The pensioner's portal is very user friendly. CGHS still remains a contentious issue. He also referred to the problem of Ministry of Defence where pensioners' data was available manually. He urged them to switch over to the computerised system of data maintenance and calculating pension to overcome the problem of delay in sanction/revision of pension.4. Thereafter, the Action Taken Report (ATR) of 21st SCOVA meeting and Agenda items of 22nd SCOVA meeting were taken up for discussion.5. Action Taken Report (ATR) on the points raised in the 21? meeting of SCOVA.i) SL No. 1 and 19 of ATR or para 5:Issue of revised PPO for Pre-2006 retirees and also to communicate the amount of pension as well as Family Pension to be revised consequent to the 6th Central Pay Commission to Pre 1.1.2006 pensioners.a) CPAO, Ministry of Railways, Department of Posts were told to complete the work by 31st March, 2013.b) Department of Telecommunication informed that they had not received the latest update on revision of PPOs from BSNL and therefore the data was not up to date. The Hon'ble MOS (PP) desired that the representative who attended the meeting should be able to give the requisite information. The representative of the Department of Telecom agreed to comply with the same.c) Ministry of Defence informed that 6 Lakh PPOs had been revised. Efforts were on to adhere to the deadline of 30.09.2013. However, slippages could not be ruled out in view of the fresh revision of pension mandated by the Cabinet decision of 24.9.2012. Some of the Associations desired that outside agencies should be involved. They also desired that the Pension Regulation should be revised in tune with changes recommended by 6th CPC and accepted by Government. The revision of PPOs pre-1990 should also be completed by 30.09.2013. Secretary (Pension) also pointed out that there were number of grievances of PCDA Allahabad in this regard and asked organization of CGDA to specifically look into this.d) Some Associations pointed out the long delay in the revision of PPOs after 6th CPC should be taken up urgently and requested MOS (PP) to intervene at his level to get the work completed without further delay. For this purpose they proposed that additional staff and honorarium may be considered.( Action : CPAO, All Ministries, DOP&PW, Desk-E)ii) SI. Arbitrary orders dated 01/08/1996 and 01/09/1996 issued by Ministry of Health and Director of CGHS may be withdrawn and the benefit of CGHS facilities be allowed to the pensioners of Department of Post and Department of Telecom as specially provided in the order of the Department of Personnel and Pension.(16)-(i) The existing Pensioners of Department of Posts and Telecom covered by P& T Dispensaries are neither considered for treatment of hospitalization facilities nor for Fixed Medical Allowance & (ii)Pensioners falling within the limit of P& T Dispensaries /CGHS Hospitals may be allowed to opt for P&T Dispensaries or drawal of FMA.Ministry of Health informed that the matter regarding withdrawal of OMs dated 1.8.1996 and 1.9.1996 (which provide that the P&T pensioners not participating in CGHS while in service may not be extended this facility) is subjudice. Regarding merger of 19 P&T dispensaries in 12 cities with CGHS, representatives of Ministry of Health and Ministry of Finance informed that the matter is at advanced stage of consideration and a decision is expected shortly. Department of Posts need to pursue it vigorously.The Ministry of Health informed that the proposal for opening of new dispensaries at Mohali/Panchkula/Chandigarh could not be agreed to due to severe resource crunch with CGHS. Ministry of Health was requested to agree to at least opening of a new dispensary at Panchkula as the Chandigarh dispensary is over burdened with 23500 beneficiaries. MOS (PP) mentioned that he would take up the matter with Minister of Health and Family Welfare.On the question of computerization of CGHS dispensary at Jammu, Ministry of Health informed that the same would be done.(Action: Ministry of Health & FW, Department of Posts, Department of Telecom, DoP&PW, Desk-D)iv) SL No. 17 of ATR of Para 5: Inclusion of Representatives of AIRRF and SCOVA in Railway Hospital Advisory Committees.Ministry of Railways informed that the Members/representatives in Hospital Advisory Committee are appointed by Chief Personnel Officers of each Zonal Railway with the approval of General Manager of the respective Railway as a welfare measure. In view of the position explained by Ministry of Railways the matter has been treated as closed.v) Si. No. 23(11) of ATR of Para 5Fixed Medical Allowance. to pensioner residing beyond 2.5 kms from dispensary.The position regarding entitlement of FMA to non-railway civil pensioners was explained in the last meeting. It was explained that those residing within the jurisdiction of CGHS dispensary were not entitled to FMA. Hence the item was closed.vi) SL No. 26 of ATR of Para 5:Anomaly in fixation of pension to DoT employees absorbed in BSNL, who retired between 1.10.2000 and 31.7.2001Department of Telecommunication informed that the order were issued on 27.9.2011 to the effect that the absorbees in BSNL are also entitled for minimum of pension at not less than 50% of the minimum of the pay in the scale of pay held by them at the time of retirement. However, the DOT is still getting representations from BSNL retirees on this subject. The matter is under examination with DoT. It was decided that DoT will take final decision in the matter by 31st March, 2013.(Action : Department of Telecommunication)vii) Sl. No. 28 of ATR of Para 5:Payment of pension to postal retirees through banks.Department of Post has finalized and issued a scheme for Payment of Pension to postal retirees through Banks. Hence, the task has been completed. In view of the position explained by Department of Posts the matter has been treated as closed.viii) 6.1 of Para 6Time bound grievance redressal & real time dissemination of information are the two main ingredients of this novel venture for the welfare of pensionersIn view of the position explained by the various ministries the item has been dropped.ix) 6.2 of Para 6 Dissemination of information in real time:MOS (PP) reiterated that the DR orders of this department should be immediately implemented by all the Ministries. Department of Posts was asked to find out the same.x) 6.3 of Para 6 Simplification of submission of Life Certificate.The orders relating to submission of life certificate to any branch of a bank authorized for transacting government business has since been issued by the CPAO and hence the matter has been treated as closed.xi) 6.5 of Para 6 Nomination facility for Family Pensioners drawing Life Time Arrears:The Department of Legal Affairs has examined the provisions contained in this department OM dated 30.10.1995 and stated that the stand taken vide that OM appears to be in accordance with the intention of the makers of the extant rules and are legally in order. Hence the nomination facility for family pensioners' drawing life time arrears has not been agreed to.xii) 6.7 of Para 6 : Medical Insurance coverage to Pensioners.Ministry of Health informed that the matter would be processed further after finalization of the 12 Five Year Plan which is in its final stages. In view of this the item may be treated as closed.xiii) 6.8 of Para 6a) Grievances Committees at the Additional Director (CGHS) Level at Delhi.b) A similar grievance committee at national level may also be constituted.Instructions have been issued to all Additional Directors of CGHS cities/zones to fix a time slot of 11.00 AM to 01.00 PM on every Wednesday for hearing and redressal of grievances of CGHS beneficiaries including pensioners.There is no need to constitute a separate Grievance Committee at National level. FRESH AGENDA ITEMS FOR 22ND SCOVA MEETING.6. Same fitment benefit to Pre-2006 pensioners as recommended and implemented in respect of serving employees by the VI CPC. The implementation of orders dated 01.09.2008 read with the orders dated 14.10.08 is not correct for fixation of pension.All these issues were part of the agenda of the National Anomaly Committee and hence it was felt that we should await the decision of National Anomaly Committee. The associations were informed that w.r.t. stepping up of pension & Family Pension, the Cabinet vide its decision dated 24.9.2012 has already

Disposal of disciplinary cases against the Retired Officials:DoP&T informed that reforms were being implemented to ensure expeditious conclusion of disciplinary/vigilance proceedings against government servants. Though decisions on a few recommendations contained in Hota Committee report have been taken, some recommendations are still under the consideration of Committee of Secretaries. Hon'ble MOS (PP) said the issue had been taken up by him on priority for both serving employees and pensioners. In view of the position explained the matter may be treated as closed.8. Merger of 78.2% IDA with basic pension benefit to the absorbed BSNL Pensioners:DoT informed that the decision to merge 68.8% IDA with pension was inline with the decision taken for revision of pay in respect of serving employees of BSNL. They informed that if at any stage the benefit of merger of 78.2% IDA with pay of serving employees is given, this benefit would also be extended to absorbee pensioners of BSNL. Extension of life CGHS membership to P&T Pensioners:Ministry of Health informed that extension of CGHS benefit to P&T pensioners on payment of subscription on yearly basis was allowed on the basis of a court decision. It would not be possible for them to extend the benefit of life membership to such P&T pensioners. Ministry of Health also mentioned that the problem will be solved to a large extent after the merger of 19 dispensaries in 12 cities with CGHS. Nomination for reimbursement in CGHS:The Ministry of Health informed that nomination for reimbursement in CGHS would not be advisable as it would create legal complications. CGHS Plastic Smart Cards:The work has been assigned to NICSI and they are in the process of issuing orders to private agencies for making plastic cards in other cities after following due tender process. Sub: Railway Services (Revised Pay) Rules, 2008 — The re-exercise of option under Rule 6 of the Railway Services (Revised Pay) Rules, 2008 in the case of employees covered under letter dated 23.03.2012.

As per provisions contained in Rules 5 & 6 of the Railway Services (Revised Pay) Rules, 2008, the railway employee had an option to elect to come over to the revised pay structure either from 01.01.2006 or from the date of his next increment or from the date of promotion, up gradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of Railway Services (Revised Pay) Rules, 2008. The rule also provides that the option once exercised shall be final.2 .This Ministry issued instructions vide letter of even No dated 23.03.2012 providing that those Railway employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 01.01:2006 in the pre-revised pay scale as a onetime measure and, thereafter, they will get the next increment in the Revised Pay structure on 01.7.2006 as per Rule 10 of the Railway Services (Revised Pay) Rules, 2008.3 .In view of the benefit extended to the employees as per the aforesaid letter dated 23.03.2012 the issue relating to according of a fresh opportunity to the employees to re-exercise their option to come over to the revised pay scale as per Revised Pay Rules, 2008 was raised by the Staff Side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.4. The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid letter dated 23.03.2012 bring about a material change in the basis for exercise of option to come over to the revised pay structure in terms of the Railway Services (Revised Pay) Rules, 2008 in respect of employees who are covered under the said letter dated 23.03.2012, the President is pleased to decide that all those employees who are covered under the provisions of aforesaid letter dated 23.03.2012 may once again be permitted to re-exercise their option to come over to the Revised Pay Structure5. The benefit under these orders for re-exercise of option shall be available for a period upto 31.03.2013. The revised option shall be intimated to the head of the office by the concerned employees in accordance with the provision of Rule 6(2) of Railway Services (Revised Pay) Rules, 2008.6. All the Zonal Railways/Production Units etc. are requested to bring the content of this letter to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.7. *****'No proposal to set-up 7th Central Pay Commission for Central Govt Employees at

present' - says MinisterMinister of State for Finance Shri.Namo Narain Meena said in the Lok Sabha in a written reply to a question that "at present no proposal to constitute the 7th Central Pay Commission is under consideration of the Government". "There have been some demands received for setting up of the 7th Central Pay Commission. In the past, there has generally been a gap of a minimum 10 years between two successive Pay Commissions. The recommendations of the previous Central Pay Commission, viz., 6th Central Pay Commission were given effect to from 1.1.2006. Therefore, at present there is no proposal to constitute the 7th Central Pay Commission under consideration of the Government".

*****SEVENTH PAY COMMISSION MUST BE SET UP FORTHWITH( Shri Harchandan Singh, Secretary General RSCWS, Chandigarh)

The recent statement of the Minister concerned in the Parliament, that the Govt does not propose to set up the seventh Pay Commission at this stage is most unjustified and frustrating for the Govt employees. Fifth Pay Commission had recommended for a Pay Revision after every five years instead of the past practice to set it up after 10 to 13 years. But the Govt did not accept this

recommendation. The Fifth Pay Commission also recommended for Merger of DA after it crossed 50%. Govt

accepted the same and belatedly implemented it from April 2004.But the Sixth Pay Commission did not favour even the Merger of DA after it crossed 50% and the Govt obvious followed suit and did not Merge the same when it crossed 50% in 1-1-2011 - in spite of the demand by all concerned.

As such, the existing Pay and Pension structure have lost all the relevance and is continuously eroding due to heavy inflation and defective system of compilation of Price Index - which itself is out dated due to the changed economic scenario and requirements of the Industrial Worker of the Country.

All this makes it essential that the Seventh Pay Commission be set up early to compensate for the erosion of real wages and to remove the serious Anomalies of Sixth CPC Report - which the Govt and the Anomalies Committee have failed to address as well as to bridge the vast gap of wages between the Government employees and those of the Corporate Sector etc. all which are having a very demoralising effect amongst the Govt employees and Pensioners.

The entire Trade Union Movement and the Pensioners Fraternity should equivocally raise the demand forcefully for early setting up of the Seventh Pay Commission forthwith and its recommendations should be made effective from 1-1-2011.

Ajay Maken backs cry for seventh pay panel With a little over a year to go before the next general election, the demand for a Seventh Pay Commission has started to gather momentum. Union housing and urban poverty alleviation minister Ajay Maken has taken the lead in endorsing the Central government employees' request for setting up of the new pay panel, citing the erosion of real wages due to high inflation since implementation of the Sixth Pay Commission's recommendations.In a letter addressed to Prime Minister Manmohan Singh, Maken underlined how every pay panel since the Second Pay Commission, barring the Sixth Pay Commission, were set up in the third year of the decade. "We are again in the third year of the ongoing decade and Central government employees are justifiably looking forward to the Seventh Pay Commission," he said.Recalling that it was under Singh that the last pay panel was set up in 2005, after the NDA government failed to do so in 2003, Maken, in the communication dated March 14, requested that a decision be "taken on priority" for constitution of the Seventh Pay Commission. A notification for constitution of the 7th Central Pay Commission is the need of the hour, which is bound to have bearing upon about 20 million employees," he said.

*****DISCRIMINATION CAUSED IN THE HOMOGENOUS GROUP OF PRE-2006 PENSIONERS BY

STEPPING UP OF PENSION FROM AN ARBITRARY EFFECTIVE DATE OF 24-9-2012 AS PER DoP OM DATED 28-1-2013

(Shri N P Mohan, Chief Engineer (Retd) Rlys)In the OM dated 28-1-2013 issued by DoP, the stepping up of pension has been made effective from 24-9-2012 thereby denying the rightful dues for a period of about seven years from 1-1-2006. This is arbitrary, discriminative and unlawful for the following reasons:The revised pension of pre-2006 pensioners retiring from various pre revised scales now stepped up by resorting to the formula of “50% of the sum of minimum of the pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No. l/l/2008-IC dated 30th August, 2008” is the same as notified in the Resolution dated 29-8-2008. In fact it is not the stepping up of pension but fixing the same belatedly at the correct level now, by implementing the accepted

threcommendations of 6 CPC in the true manner but still denying the benefit from the due date of 1-1-2006 to which the pensioners are entitled to.The arbitrary date of 24-9-2012 has given rise to discrimination and a divide between a homogenous group of Pre-2006 pensioners.

th( In a similar case, where the govt of Uttaranchal had granted the benefits of 6 CPC wef 12-12-2011 instead of 01-01-2006 , the High Court of Uttaranchal has quashed the impugned order, and directed the govt to give the benefits wef 01-01-2006. Dear Sir,

I attended the meeting of SCOVA as president of P&T / BSNL pensioners assn chaired by you in

the month of Sept, 2012 at New Delhi. You will kindly recall that I raised the case for opening CGHS

dispensary at Panchkula. I briefly reiterate the same as under;

The CGHS was introduced at Chandigarh in 2000 for providing healthcare needs to the central govt

pensioners residing at Chandigarh, Panchkula, Mohali and states of Punjab, Haryana and Himachal

Pradesh. Initially one dispensary was opened and justified paramedical staff and infrastructure was

posted / created, to look after the healthcare of five to six thousand beneficiaries only. But soon the CGHS

earned the reputation of a most patient friendly wellness center thanks to the holistic approach, total

commitment dedication and missionary zeal on the part of team of doctors headed by chief medical

officer and additional director posted at Chandigarh. Stirred by the wonderful performance by CGHS,

every eligible central govt pensioner of surrounding area started enrolling themselves as CGHS as

beneficiaries and as on date this number has swelled to 23500, which justifies the opening of three more

dispensaries. This huge increase in the number of beneficiaries has brought the existing system under

enormous pressure. This is as to why, I pleaded that opening of dispensary at Panchkula is very very

imperative. Your goodself gave me patient hearing and instructed the official from Health Ministry

attending the meeting for finding out via media to meet that demand. But nothing concrete has emerged

in this regard even 4 months after the SCOVA meeting.

I may also add that Panchkula is a part of Ambala parliamentary constituency which is contagious to

Chandigarh and Patiala parliamentary constituencies. The elderly pensioners of this area have been

reposing their faith and trust by electing MPs of the ruling party at the center from one term to another, All

the three MPs of this area are holding important portfolios in the cabinet of ministers at the center, Elderly

people love them take pride being their proud electorates and expect from the ruling party in return a

small favour in the form of opening a CGHS dispensary at Panchkula.

CCCGPA once again make a ferment appeal to yourgoodself to meet the demand, which will not only

ensure to elders better healthcare service but also lend a positive message down the line conveying that

govt of India care for the elders.

HEALTHCARE / CGHSContinuous empanelment of Private hospitals & diagnostic Centre under CGHSMinistry of H &FW (Dept of H & FW) OM No. S. 11011/23/2009-CGHS D.II/ Hospital Cell (Part IX) dated the 14th February 2013.Subject: Revival of 'Continuous Empanelment Scheme', for private hospitals and diagnostic centres under CGHS.

With a view to ensuring comprehensive health care to CGHS beneficiaries, CGHS has been, apart from the Government Hospitals, empanelling private hospitals and diagnostic centres by floating tenders periodically. The latest tender process in this context commenced in the second half of 2009. Even the already empanelled hospitals (including dental clinics and eye centres) / diagnostic centres under CGHS were required to submit the bids under this tender process. Through this process, package rates for different treatment procedures and investigations were notified in 2010. As a part of this process, certain hospitals and diagnostic centres which accepted these rates and also signed MOAs with CGHS were notified in CGHS covered cities. Subsequently, with a view to empanel more hospitals and diagnostic centers , continuous empanelment scheme was initiated in December 2010 and was in operation till July 2011 in some cities & till 26th December 2011 in some other cities.2. However, it has been noticed that the number of hospitals and diagnostic centres notified as empanelled under CGHS is not adequate to provide a satisfactory level of health care to CGHS beneficiaries in all areas of CGHS covered cities.3. Accordingly, it has become necessary to revive 'Continuous Empanelment Scheme', to empanel more hospitals and diagnostic centres to take care of existing inadequacy. In this background, it has been decided to invite private hospitals and diagnostic centers to come forward and apply for empanelment under CGHS if, they are willing to accept the rates notified by CGHS in 2010 & as per OM No.Misc.1002/2006/CGHS(R&H)/CGHS (P) dated 6/2/2013 and fulfill the same terms and conditions as notified earlier under 'Continuous Empanelment Scheme' except for the following modifications:- a) Hospitals / Diagnostic centres shall be empanelled for all facilities in all specialties available in the hospitals including those listed under super specialties. Existing hospitals already on panel of CGHS shall not be allowed to add selective specialties/super specialties and will have to offer all available facilities (Undertaking shall be submitted on Rs.100/- non-Judicial Stamp paper attested by Notary Public by hospitals already on panel of CGHS that such hospital shall abide by the terms and conditions of empanelment for the additional facilities and would provide facilities to CGHS beneficiaries in all available specialties/Super specialties (list all the facilities available ) in addition to the agreement signed earlier by such hospitals). The empanelled hospitals will not be permitted to add new specialties or discontinue some specialties subsequently without the approval of the Government. b) Application under Super Specialty category or change of category to Super Specialty from already empanelled and other eligible hospitals will be considered only if all facilities available in the hospital are offered as per applicable CGHS rates.. c) The scrutiny of the applications and finalization of the lists of eligible hospitals and diagnostic centres of a particular city shall be done by a committee under the chairmanship of AD/JD, CGHS of concerned city with two senior most CMOs of that city as members. d) Addl. Director / Joint Director of concerned CGHS city may inform the eligible hospitals / diagnostic centres to submit the letters of acceptance of the terms and conditions of the empanelment process. ADs/JDs shall send the details of eligible hospitals / diagnostic centres to Director, CGHS after signing MOA with eligible hospitals/ diagnostic centres and obtaining Performance Bank Guarantee so that the eligible hospitals /diagnostic centres shall be notified by Ministry of Health & Family Welfare as empanelled hospitals / diagnostic centres under CGHS.4. Empanelment shall be for a period of one year from the date of notification or till new empanelment process, whichever is earlier. All the empanelled hospitals / diagnostic centres shall however, have to participate in the new empanelment process, as and when initiated in order to continue their empanelment under CGHS. 5. The continuous empanelment scheme would be in force till next empanelment.6. Further, the undersigned is directed to refer to the Office Memorandum of even number dated 15.12.2012 and to state that it has been decided to extend the validity of empanelment of presently empanelled hospitals, diagnostic laboratories and imaging Centers on the same terms and conditions under which they were empanelled for one year or till next empanelment, whichever is earlier.

Reimbursement to beneficiaries / empanelled hospitals shall be allowed subject to the ceiling rates or

actuals, whichever are lower.

2 Coronary stents shall be permitted on the advice of govt specialist of which not more than two

shall be of Drug eluting Stents ( in any of the coronary stents as per the decision of treating specialist) .

permission shall be granted as per laid down procedure. If more than two drug eluting stents are

implanted in an empanelled hospital and no written informed consent was obtained from the beneficiary

that he / she would bear the difference in cost between the DES and Bare Metal Stent,and the hospital

has charged this amount from the beneficiary, the additional amount shall be paid to the beneficiary and

shall be deducted from the pending bills of the hospital.

3 It is esential for the empanelled hospitals to quote the batch number when a coronary / vascular

stent of any type is implanted in the case of a CGHS / CS(MA) benefiiary and also enclose a copy of the

relevant invoices pertaining to the procurement of the stent by the hospitals. In addition to this, the outer

pouch of the stent packet along with the sticker on it on which details of the stent are printed shall also be

enclosed with the medical bill for claiming reimbursement from the govt. In case of a treatment from a

private non-empanelled hospital, where the treatment was taken in an emergency, it is the responsibility

of the beneficiary to obtain the batch number, invoice and outer pouch of the stent(s) before the

submission of the medical claim to CGHS /concerned dept,as the case may be.

4 The empanelled hospital shall submit a self certified undertaking that the hospital has not

charged the CGHS / CS(MA) beneficiary more than the rate at which the stent has been procured by the

hospital and in case of any detection and establishment that the hospital has overcharged, the hospital

shall be removed from the list of hospitals empanelled under CGHS without any further notice.

5 UTI-ITSL , while processing the hospital bills of coronary / vascular stents shall ensure that the

hospitals have enclosed copies of the relevant invoices pertaing to the procurement of the stents by the

hospitals and the outer pouch of the stent packet along with the sticker on it on which details of the stent

are printed and the prescribed rates and the guidelines have been followed, before making provisional

payments to the hospitals.

6 The revised rates and guidelines shall come into force from the date of issue and shall be in force

till they are revised.

7 This issues with the concurrence of integrated finance division vide note dated 20-12-2012 of

AS&FA , Min of H & F W.

As Liver Transplant Surgery is a planned surgery and therefore, prior permission has to be obtained before the surgery is undertaken. However, if for some reason it is done in emergency to save the life of the patient,the Standing Committee shall consider the cases referred to it for recommending grant of ex-post-facto permission on a case to case basis.VII Submission of Application

CGHS / CS(MA) beneficiaries will submit their request for permission for Liver Transplant to the Standing Committee, through their respective departments in case of serving employees and Additional director, CGHS of the concerned zone or city, in case of pensioner CGHS beneficiaries. The dept concerned will refer the cases to the office of Director, CGHS in case of a CGHS beneficiaries and to te Medical Services Division of dept of Health & family Welfare in case of CS(MA) beneficiaries for processing the case and its submission before the Standing committee for their consideration and recommendation.VIII. Ceiling Rate for reimbursement for Liver Transplant surgery under CGHS / CS(MA) Rules(a) The package rate for Liver Transplant surgery involving live donor shall be as follows :

Rs 11,50,000/- ( Rupees Eleven lakh fifty thousand only) + pre transplant evaluation of the donor and recipient. Rs 2,50,000/- ( rupees two lakh fifty thousand only)

(b) The package rate for Liver transplant surgery involving a deceased donor shall be :Rs 11,00,000/- ( Rupees eleven Lakh only)This includes, the cost of consumables during the organ retrieval and the cost of preservative solution. etc.

i) The package charges include the following1. 30 days stay of the recipient and 15 days for the donor stay one day prior to transplant surgery2. Charges for medical and Surgical Consummables surgical procedure charges, Operation theatre

charges, Anescethetic charges, Pharmacy, investigations and in house consultation for both donor and recipient during the period. This also includes all post operative investigations procedures during the above mentioned period.

ii) The package excludes:1. Charges for drugs like Basiliximab / daclizumab, HE peg, Interferon.2. Cross matcking charges for Blood and blood products.

Note :-1. The extra stay if any may be reimbursed after justification by the treating

specialists for the reason of additional stay and only as per CGHS guidelines.2. The drugs mentioned above would be reimbursed as per CGHS rates or actual

Ministy of H & FW no.S.11031/CGHS/(HEC)2012-13-CGHS(P) dated 13-02-2013Subject: Removal / suspension of Escorts Heart Institute & Research Center, Max Super specialty Hospital and Max Devki Heart & Vascular Institute, New Delhi- regarding

With reference to the above mentioned matter, the undersigned is directed to draw attention to the office Memorandum No. S.11011/23/2009/CGHS DII/Hospital Cell (Part 1) dated 7-10-2010 vide which Escorts Heart & Vascular Centre, Max Super Specialty Hospital and Max Devki Heart & vascular Institute, New Delhi were empanelled under CGHS Delhi and that Escorts Heart Institute & Research Centre and Max Super Specialty Hospital, New Delhi have conveyed their unwillingness to continue their empanelment under CGHS. It is also stated that Max Devki Heart & Vascular Institute, New Delhi informed that the hospital shall not provide credit facility to CGHS beneficiaries. The matter has been examined by the ministry and it has been decided that Escorts Heart Institute & Research Centre, and Max super specialty Hospital, New Delhi shall stand removed from the list of empanelled hospitals under CGHS Delhi with immediate effect.2 It is further stated that the empanelment of Max Devki Heart & Vascular Institute, New Delhi is suspeNDed from the list of empanelled hospitals under CGHS with immediate effect till further orders. The Board has reviewed the dental treatment facilities being provided to the Railway beneficiaries at present and it has been decided to expand the list of dental procedures including all the procedures listed under CGHS list ( S.No 174 to 231 of CGHS/Delhi list) and expenditure on them be reimbursed as per CGHS / Non-NABL (city specific rates) as the case may be for another two years from 12-09-2012 to 11-09-2014. Welcome Address: Dr. Ashwani Kumar Seniaray, CMO (NFSG) In-charge CGHS Wellness Center No 1, welcomed

the members of the Advisory Committee. He informed the members of the Advisory committee about the latest instructions issued by higher CGHS authority / Ministry of Health & Family Welfare regarding investigations at private hospitals / diagnostic laboratories /imaging centres empanelled under CGHS, on the advice of Medical Officers of CGHS or Govt specialists vide Ministry's O M No S-11045/40/2012/CGHS/HEC/CGHS(P) dated 01 Jan,2013 and of even No dated 15 Jan,2013, without separate reference (permission) from the CGHS wellness center.

During the meeting, Dr S C Anand, Add Director CGHS also dropped in, and the members of the advisory committee got an opportunity to exchange some points with him also. He also clarified that a Govt specialist means a medical officers of the rank of minimum Asstt Professor (as in PGI etc) and not the resident doctors or senior resident doctors.MRC status/Pendency of claims: As per the information from Addl Director CGHS Office,, Chandigarh the Medical Reimbursement Bills of the CGHS pensioner beneficiaries have been cleared up to November, 2012, whereas the MRC bills of December,2012 are under process. Performance of Local Chemist:

Shri Ravi Kumar, representative of the authorized chemist, was advised to ensure timely and correct supply of LP medicines and drugs. There was case of late supply of L P medicines earlier in the month, for which the local Chemist had been issued warning by the Add Director. CMO advised the representative to ensure timely supply of L P medicines to avoid inconvenience to CGHS beneficiaries.Availability of Drugs in the WC:

As per records, there are 15 Generic items and 168 Proprietary items available in the WC. Amenities for the beneficiaries:

He also clarified that tests like ECG, Echo, TMT and Holter are still not approved. The Add Director CGHS intimated that he has already taken up case with higher authorities but no specific approval has been received so far. On a query from Sh P S Bedi, regarding the implication of the latest instructions from higher authorities dated 01-01-2013 and 15-01-2013,, the CMO clarified that for any investigation / diagnostic tests the specific advice of a govt specialist is a must. It does not include the specialists of empanelled private hospitals The members of the advisory Committee requested the Add Director to speak to concerned officers in Delhi as also to take up case demi-officially for early empanelment of suitable diagnostic labs for these important tests.

With reference to the point regarding treatment in hospitals empanelled under ECHS or CCS (MA) Rules 1944, as per CGHS instructions issued vide No S-11011/7/99-CGHS(P) dated 27 April,2011, the CMO clarified that for any planned / elective surgery, the CGHS beneficiary has to obtain specific prior approval of CMO I/C Wellness Center. He dis-approved obtaining approval on telephone or by other means due the problem of verifying the identity of the CGHS beneficiary. On pointing out the difficulties of CGHS beneficiaries residing at far off places or in other cities where the CGHS wellness center is not located (e.g. Amritsar or other cities in Punjab / Himachal/ Haryana etc), from where the elderly and aged pensioner CGHS card holders face difficulty in coming all the way to Chandigarh to obtain prior approval of the CMO, it was clarified that only in emergency; a medical procedure can be conducted in such hospitals without prior approval. The Add Director CGHS was also requested to point out this problem of aged CGHS beneficiaries residing at far off places with higher HQs to resolve this problem of elderly CGHS beneficiaries. It was pointed by Sh P S Bedi, that while issuing sanction for empanelment of private hospitals under CS (MA) Rules 1944, the Ministry of H&FW is specifically issuing instructions to these hospitals to extend medical cover to CGHS bonafide Card holders.

Shri G S Bhogal raised the point about Ayurvedic and Homeopathy CGHS dispensaries in

Chandigarh region. The Add Director CGHS was requested to take up this issue also.On a query by Shri D D Sharma, the representative of serving employees, the CMO drew the

attention to the latest instructions issued by Ministry of H & F W OMs dated 01 Jan,2013 and 15 Jan,2013, wherein Para 3 clarifies : “ The serving beneficiaries will not require any permission from their dept for getting the diagnostic tests / investigations carried out in a CGHS empanelled private hospital / diagnostic laboratory / imaging centre in respect of investigations for which CGHS rates are available. They will get the prescribed tests done on payment basis and claim reimbursement from their office.” However, they have to keep other instructions issued in the above O Ms in mind.Staff Punctuality & Behavior:

The conduct and behavior of the staff of the Wellness Center has been good. They are courteous and helpful to the senior/aged CGHS beneficiaries. Cleanliness & Maintenance of Wellness Centre: The rush of large number of OPD patients at the Wellness Center continues to pose problem for proper maintenance and cleanliness of the Wellness Center. Add Director CGHS was requested to personally look into the aspect of additional CGHS Wellness Center in the Chandigarh region. Grievance Redressal:The complaint box was opened by Shri D D Sharma. One letter from Shri J S Bhalla, H. No 241 Sector 46 A, Chandigarh ( holding Plastic Card Id No 898731, issued by CGHS Wellness Center No 54,Delhi) , pointed out the following : (i)As per instructions issued by DG(CGHS), vide No 11030/51/2010-CGHS S (F) dated 20-11-2010, the aged cardiac patients may be permitted to have preferential consultation at the CGHS Wellness Centers to avoid long waiting period , and to be allowed 'out of queue treatment', and,(ii)For repeat medicines, all MOs apart from CMO I/c of Wellness Centre be permitted to authorize the issue of such medicines [which is also as per instructions issued by DG (CGHS)] The CMO I /c indicated that these suggestions would look into. Welcome Address: Dr. Ashwani Kumar Seniaray, CMO (NFSG) In-charge CGHS Wellness Center No 1, welcomed

the members of the Advisory Committee. He intimated that he could not be present at the meeting held by the Add Director, CGHS Chandigarh on 22 February, 2013, as he was not in station. Shri P S Bedi and Shri S R Bhardwaj, who attended the meeting on 22 Feb, 2013, expressed their satisfaction with the discussion held in that meeting.MRC status/Pendency of claims: As per the information from Addl Director CGHS Office, Chandigarh, the Medical Reimbursement claim Bills of the CGHS pensioner beneficiaries have been passed for the months of November and December,2012, but awaiting payment for want of budget allotment. The reimbursement claims for the month of January, 2013 are under scrutiny. Performance of Local Chemist:

Shri Raj Kumar, representative of the authorized chemist, was advised to ensure timely and correct supply of LP medicines and drugs..Availability of Drugs in the WC:

The CMO intimated that with the opening of continuance empanelment of private hospitals and diagnostic centres, we expect diagnostic centres to offer services for conducting diagnostics tests like

hospitals is very essential to prevent frauds and misuse of CGHS cover. Shri D D Sharma, representative of the serving employees, expressed his satisfaction with the

clarification regarding conducting diagnostic tests on the advice of govt specialist, as recorded in the minutes of the Advisory Committee in January,2013.Staff Punctuality & Behavior:

The conduct and behavior of the staff of the Wellness Center continues to be good. They are courteous and helpful to the senior/aged CGHS beneficiaries. Cleanliness & Maintenance of Wellness Centre: On the issue of establishing an extension counter of the CGHS wellness center, Sector 45, Chandigarh, in some govt quarters in Sector 46, Chandigarh, as intimated by the Add Director CGHS, Shri Raghubir Singh pointed out that unless additional MOs with supporting paramedical staff is approved, as per the norms to maintain the Patient : Doctor ratio, the problem of heavy rushes faced as at present will not be adequately addressed. There is full justification for additional staff for this extension counter as per the large number of beneficiaries registered against this Wellness Center.

*****Gist of the minutes of the meeting held on 22 Feb, 2013 at the office of Additional Director,

CGHS, ChandigarhThe Additional Director, CGHS, Chandigarh called a meeting of the representatives of Senior

Citizens and the Central Govt Pensioners Welfare associations on 22 February, 2013. Brief details of the points discussed at the meeting are given below.(i) Empanelment of Hospitals / Diagnostic Centers. The AD CGHS informed that the restriction on the empanelment of private hospitals / Diagnostic centres under CGHS has been revoked, but the process of empanelment is restricted to the Tricity of Chandigarh, Mohali and Panchkula.The members requested him to consider the extension of empanelment to other cities of Punjab, Haryana and Himachal Pradesh. The AD assured them to take up case with higher CGHS authorities in Delhi. He also intimated that e-tendering for empanelment of local chemists, is under process at CGHS HQs, New Delhi. On a reference by the representatives, it was intimated that as the empanelment process has started, any Diagnostic Center may apply for coverage of such important diagnostic procedures as ECG, Echo, TMT etc.(ii) Laparoscopic surgery The Fortis Hospital, Mohali, has consented to undertake Laparoscopic Surgery at CGHS rates.(iii) Claims Adalat Claims Adalat will be held shortly in Chandigarh as per instructions from higher CGHS authorities. An Advertisement will soon be issued. Members requested him to also consider claims, rejected earlier in this Claims Adalat.(iv) Extension Counter in Sector 46 A proposal to have an extension counter for CGHS Wellness center in Sector 46, has been taken up with higher CGHS HQs, New Delhi.(v) Allotment of land for CGHS ChandigarhThe case for allotment of land in Sector 41 for construction of CGHS office and Wellness Center is under active consideration with U T Chandigarh Administration. A reference in this respect has been received from CGHS higher authorities, New Delhi.(vi) Issue of Plastic cardsCGHS Chandigarh is in the process of early issue of Plastic cards to pensioners / serving employees. A reference in this regard has also been received from higher CGHS authorities, New Delhi.(vii) Status of MRCsMRC claims have been processed up to January, 2013, but payments have been made till Oct, 2012. Remaining payments will be cleared on receipt of budget funds.(viii) Revised rates of various procedures / implantsAs per instructions from higher CGHS authorities, the rates of various procedures / implants have been revised.

in CGHS was distributed to the representatives of pensioners for dissemination of information.

3 The representatives requested the Add Director to hold such meetings in each quarter,

which the Add Director assured to consider subject to availability of time. He also assured to hold

a meeting with empanelled Hospitals to sort out difficulties of CGHS beneficiaries. The

representatives also requested the Add Director to consider relaxation for switch over from OPD /

IPD facility for pensioners which is, at present is restricted to one time option in entire life for the

pensioners. A request to enclose the 'Calculation Sheet' with the MRC along with the

disbursement of cheques for the satisfaction of the pensioners was also made.

Subject : Clarification regarding CD regard for Coronary Angiography and Coronary Angioplasty

for CGHS beneficiaries.

With reference to the above mentioned subject the undersigned is directed to draw attention to

the Office Memorandum of even Number dated 6/2/2013 and Office memorandum No.S.11011/23/2009 /

Hospital Cell dated 17.08.2010 and other Office Memoranda issued subsequently whereby the CGHS

package rates for Coronary Angiography and Coronary NCR and other CGHS cities and to clarify that the

package rate for Coronary Angiography and Coronary Angioplasty include the cost of CD record and the

medical report for the Coronary Angiography and Coronary Angioplasty performed.

NEW TIMINGS FOR CGHS WELLNESS CENTERS

CGHS has revised the timings of the CGHS Wellness Centers throughout the country

w.e.f 01 April, 2013 vide Ministry of H & FW( Dept of H &FW) No S-11030/55/2012- CGHS(P)

dated 26 March,2013 as under :

(a) All CGHS Wellness centers will function from 8.00 a.m to 3.00 p.m.

(b) These timings will be applicable to all CGHS cities in the country

(c) There will be Lunch break from 1.00 p.m.to 1.30 p.m.

2 .It is also informed that Ministry of Health & Family Welfare has approved the revised rates for

health check-up, i.e. Rs. 2000/- for men and Rs. 2200/- for women in respect of AIS Officers at par with

Group 'A' officers of CCS.

Timely intimation about payment of additional fee under RTI Act 2005

Subject: Timely intimation about payment of additional fee under RTI Act 2005.

It has been brought to the notice of the Central Information Commission that some CPIOs inform the

information seeker about the additional fee under sub section 7(3) of the RTI Act at the fag end of the thirty

days period prescribed for providing the information under sub-section 7(1) of the RTI Act.

2. The Central Information Commission in one of its orders has mentioned that while there cannot

be any hard and fast rule about when exactly the intimation about the photocopying charges should be

conveyed to the information seeker, it is implied in the prescribed time limit that the demand for the

photocopying charges must be made soon after the RTI application is received so that the information

seeker has time to deposit the fees and receive the information within the prescribed thirty days period. If

the information sought is not voluminous or is not dispersed over o large number of files, computation of

the photocopying charges should not be a time consuming task. As soon as the RTI application is

received, the holder of the information should decide about how much information to disclose and then

calculate the photocopying charges so that the CPIO can immediately write to the information seeker

demanding such fees.

3. This may be brought to the notice of all concerned for compliance.

HIGH COURT TO THE RESCUE OF RETIRED GOVT EMPLOYEE

In a judgment with far reaching consequences, the Punjab & Haryana High Court, has made it clear that in

case the government authorities do not initiate proceedings against an employee in a case against him

prior to his retirement and hold no enquiry , they cannot make deductions on the basis of a report after his

retirement.

The directions came from the Bench headed by Justice A N Jindal on a petition filed by Brij Mohan

Sondhi, a retired engineer from Haryana Vidhyut Prasaran Nigam.

The petitioner had sought quashing of the orders for deduction of Rs 4.11 lakh from his

pensionary benefits.

The department had alleged that the pensioner being a junior Engineer had conducted

irregularity in the accounts and not submitted the details for the period before 1975-76.

The petitioner submitted that he was never charge sheeted and no enquiry was held against him

for the allegations till he retired on 30-4-1997.

Later, in 1998, a committee while observing that there was a discrepancy for around Rs 4 lakh,

issued notice to him for deduction of money. He said no deduction could be made from the pensionary

benefits payable to him. The bench stated that the dept came up with such allegations against sondhi for

the first time in 1998. “ No such charge sheet was issued against him prior to his retirement, as such the

entire proceedings are liable to be quashed”, held the Bench. The Bench said that the petitioner was

entitled to the refund of the deductions made out of his pensionary benefits, along with interest @ 12% per

annum with effect from 1-5-1997 to the actual date of payment.

Activities –CCCGPA & affiliatesCCCGPA, CHANDIGARH MANAGING COMMITTEE MEETING- 21 MARCH, 2013

Meeting of Managing Committee of CCCGPA was held on 21 March, 2013 at Khukhrain Bhawan, Sector 35. Chandigarh. Shri M L Panghotra, chairman welcomed the delegates and briefly intimated the initiatives taken by the CCCGPA. Shri Rajpal Sharma, Secretary General, read out the minutes of the last meeting of the managing committee, which were passed unanimously. He gave the details of the SCOVA meeting in New Delhi, which he had attended. There was a discussion regarding CGHS cover to the Tricity, and various procedures for treatment. The Secretary General explained that there was a strong case for a CGHS dispensary for Panchkula. Sh Didar Singh suggested holding a Press Conference followed by agitation in support of Pensioner's demands for strengthening the CGHS infrastructure in Chandigarh region. Y.P. Doshi while referring to the empanelment of Reffel Hospital Panchkula under CS (MA) Rules 1944 suggested that case for cashless treatment to the central Govt. Pensioners may be taken with MOH. Sh. M.S. Multani wanted the CCCGPA to demand one post/one pension on the lines of one Rank/one pension in defence forces. Sh. M.S. Toor pointed out the unsatisfactory delivery of the magazine in Sector-48-C, PUDA Complex residents. He demanded stream lining the dispatch system. The chairman apprised the delegates that editorial board of pensioner's coordinator is seized of the situation and the issue of delayed / non receipt of magazine has been sorted out to a large extent. However efforts are being made to bring such complaints to the minimum possible. He also assured the delegates action on the points raised by them at the earliest.PARAMILITARY FORCES RETIRED OFFICERS ASSOCIATION, CHANDIGARH

The officers of the Central Armed Police Forces (CAPF) have filed Writ Petitions (WP) in the Hon'ble High Court of Delhi for application of the Non-functional Up gradation in accordance with instructions issued by the Govt. of India vide P P G & P ( Dept of P&T) O M No AB 14017/64/2008-estt (RR) dated 24.04.2009, which, inter alia, indicates that whenever an IAS Officer of the State of Joint Cadre is posted at the Centre to a particular grade carrying a specific grade pay in Pay Band 3 or Pay Band 4, the officers belong to batches of Organised Group A Services that are senior by two years or more and have not so far been promoted to that particular grade would be granted the same grade on nonfunctional basis from the date of posting of the IAS Officers in that particular grade at the Centre.The instructions have been applied to almost all central govt employees, except the uniformed services like CAPFs and defence services. In respect of CAPFs, the MHA has denied the extension of these instructions to the CAPFs on the ground that their services have not been notified as Organized Cadres by the Govt. It was blatant denial of benefit, the govt had granted to the officersl to compensate them for not getting timely promotions due to management bottlenecks in their respective cadres. So far six writ petitions have been filed by BSF, CRPF and ITBP officers, serving officers as well as retired officers. CGPWS held its AGM on 17 March, 2013 at Sood Bhawan, sector 44, Chandigarh. Shri MS Toor, Chairman welcomed the delegates, and narrated the achievements of the society. He indicated that the term of the present governing body has ended and there is requirement for holding elections for a new governing body as per constitution of the society. Shri MMS 'Walia read out the provisions / rules wherein , a governing body can have maximum of two terms, making it mandatory to hold elections for a new governing body as the present incumbents have completed two tenures. However, the delegates proposed an amendment in the rules to enable the present governing body to continue as their performance has been excellent. The proposal was unanimously passed to amend the relevant provision of the by-laws, and it was decided to allow the present governing body to continue.The Society will be completing ten years of its establishment in 2015. It was decided to publish a souvenir to commemorate the occasion.DEFENCE ACCOUNTS PENSIONERS WELFARE ASSOCIATION, CHANDIGARH (DAPWS)

The DAPWS has taken up a case with the Defence Minister, Shri A K Anthony, seeking his help in their demand for extension of CSD facilities to the defence civil pensioners. In a letter dated 20-03-2013, addressed to the Hon'ble Minister, Shri S R Bhardwaj, Senior Vice President of the association reiterated the fact that the CSD facilities are authorized to them during their services, which are abruptly withdrawn on their retirement, thereby giving an impression that Defence services are neglecting their own personnel in their advanced age. These civil defence personnel had served the nation through defence establishment to the best of their ability commensurate with other defence personnel, but at the fag end of their life, their parent dept has blatantly abandoned them. *****

Regarding Income Tax, there has been no

change either in the Basic Exemption or in

the rates of Income tax for various slabs.

These remain the same as for last year.

However, in the case of super rich (having

income more than one crore) a surcharge of

10% of the tax payable has been levied.

In the case of those in the lower income

bracket, having income up to Rs 5 Lakh per

annum, will get a discount of Rs 2000/- from

their final Tax liability
