REPORT QF BOARD

FINDINGS AND ORDER

1. This Sx pplemental Order is entered by the Board sua sponte in theform authorised by the Board at its hearing held at 9:00 a.m. on October 20,1992, Board of !upervisors Room, Courthouse, Grundy, Virginia, and pursuantto authority gxanted to the Board's Chairman at the hearing of the Vlrf .niaGas and Oil Board on June 16, 1992 at 9x00 a .m. at the RhododendronRestaurant at the Breaks Interstate Park, Breaks, Virginia; and IhisSupplemental Orf er is being recorded for the purpose of (1) complying i iththe requirements of 8 7.c of the Virginia Gas and Oil Board Regulations VR480-05-22.2 by supplementing the Order previously issued by the Board forthe sub]ect Docket on May 31, 1991 and recorded in Deed Book 375, Page 473in the Office of the Clerk of the Circuit Court, Buchanan County, Virg I niaon June 19, 1991. The Board Order pools& all interests in Sub]ect Dril'. ingUnit including those of the Respondents more particularly set forth andidentified by the Designated Operator in the affidavits attached hereto andmade a part hereof. The Board finds it has Jurisdiction over the sub'ectmatter pursuant to the provisions of the Virginia Gas and Oil Act, 8 4', .1-361.1 et ~se ., Six'ginia Code, 1950 as amended.

2. Findinas: The Board finds that:

(a) The Board Order directed Oxy USA, Inc. (herein :he"Designated Operator" ) ~ to mail copies of the Board Order to all Respondentswhose interests, if any, were pooled by said Board Order;

(b) The Designated Operator filed its affidavit of mal;.ingdated July 16, 1991 disclosing that it had mailed a true and correct copl ofthe Board's Order to all Respondents whose interests, if any, were pools', bysaid Board Order;

(c) The Board Order required each Respondent whose interests, ifany, were poolsd by the terms of said Board Order to make his or ierelection within thirty (30) days after the date of mailing or recording, asapplicable, of s xid Order; the Designated Operator has filed its affida xitdatx)d May 6, 1993 in accoxdance with 7.c of the Virginia Gas and Oil BeardRegulations and '(R 480-05-22.2 (herein "Affidavit of Election" ), whereix. ithas, for each Respondent whose interests, if any, were pooled by said Bc xrdOrder, statedi ( .) whether each Respondent has made or failed to ma) . atimely electixn; (ii) the nature of the election made, if any; () ii)whether, by xeason of a failure to elect or to timely elect one or s )reRespondents are deemed, under the terms of the Board's Order, to have leo xed

3. ~i By this Order, the Board orders the Designated Operats totender, consistsnt with and in accordance with the findings set fort, atparagraph 2. above and the annexed affidavits, any funds sub)ect to eel.rowand instructs t se Escrow hgent, Tazewell National Bank, P. 0. Box i09,Tasewell, Virg..nia 24651, or any successor named by the Board to estat ishinterest-bearing escrow account(s), IRS Tax Identification Number 54-1629506, in accordance with the information set forth in said hffldavlt toreceive such furds and account to the Board therefore.

4. Mailln s of Order and Filina of affidavit: The Designated Operatorunder the captic aed order or its httorney shall file an affidavit with theSecretary of t)ie Board within ten (10) days after the date of receipl ofthis Order statiag that a true and correct copy of this Order was ma. ledwithin seven (7) days from the date of receipt of this Order to each pei sonwhose interest or claim is sub]ect to escrow and whose address is known.
