PLANNINGWe work at the forefront of urban planning on a wide range of planning applications, development management matters, compulsory purchase and planning appeals. We support the preparation of Local Plans, Neighbourhood Plans, Local Development Orders and Supplementary Planning Documents. We work collaboratively with our clients at all stages of the statutory planning process from initial pre-application or scheme appraisal advice through to the preparation of outline, hybrid and detailed applications, listed building and conservation area consents, prior-approval notifications for permitted development right schemes and as expert planning witness for hearings, public inquiries and examinations. We lead and manage the negotiation of planning conditions, S106 and S278 agreements and contributions within the CIL regulations. Our portfolio of planning services encompasses strategic applications through to work on individual listed buildings, certificates of lawfulness and variation or removal of restrictive conditions.

RESIDENTIAL AND MIXED USE DEVELOPMENT AT LEAMOUTH SOUTH, TOWER HAMLETSClient: Clearstorm Ltd. (Ballymore Group)

SUCCESS STORIESROLE CCL was instructed to prepare detailed employment land and economic impact analyses in support of the proposed 920 residential unit and commercial employment scheme at Leamouth South adjacent to Trinity Buoy Wharf. The development forms the next element in the wider regeneration of Leamouth that is being spearheaded by Ballymore Group.

OUTCOMES

CCL’s work on the employment land and economic case helped to secure the Greater London Assembly and LB Tower Hamlets support for the proposed scheme in terms of the positive economic benefits arising and strengthen the case for planning permission to be granted to release the land from its current and former employment uses.

The planning application was submitted in December 2014 and an outcome is awaited.

ADDED VALUE

CCL have added value to the planning application through swift work deploying senior professional resources to build the evidential base and case.

CCL’s work provided the underlying case for the regeneration of the site from an employment and economic growth perspective and assisted the Client to engage positively and proactively with the GLA and Tower Hamlets as the relevant planning authorities; and with neighbouring site owners and occupiers.

MEDINA YARD, ISLE OF WIGHT: REGENERATION – EMPLOYMENT AND HOUSING DEVELOPMENT INSTRUCTION

Client: The Harrison Trust

Date: March 2014 - Ongoing Strategic

Chilmark Consulting was commissioned by The Harrison Trust, a major landowner in the Isle of Wight, to prepare the employment land and housing development case in support of a 520 residential and 9,000 sq.m B Use Class regeneration scheme on Cowes town centre waterfront.

The site (Medina Yard) is currently a collection of largely under-used industrial and marine activity premises with significant waterside access but limited public accessibility. The current employment floorspace and facilities are of very poor quality and very dated.

The regeneration proposals see new Grade A employment floorspace together with incubation workspaces, a maritime museum and a substantial level and mix of new housing.

A detailed masterplan has been prepared aligned to the Council’s adopted Core Strategy and emerging Area Action Plan. The Project Team is currently finalising a hybrid outline and detailed planning application for the development.

ROLE

CCL’s role has been to act as employment land, commercial, housing and spatial planning adviser to the Trust, working as part of a wider project team involving a lead planning consultant, architect, legal advisors and viability/delivery specialists.

CCL has provided employment land and housing market evidence over a period from 2010 onwards. In addition CCL has represented the Trust at the Core Strategy Examination in Public and in various formal

representations and submissions to the local authority concerning employment land review, SHMA update, SHLAA and policy review consultations. Work has involved regular client and project team briefings as well as conference with Counsel as the application process has progressed.

OUTCOMES

CCL’s work has been instrumental in shaping the scale, mix and form of the employment land and commercial floorspace offer on the Medina Yard site. Our analysis has ensured that the development scheme proposals are consistent with the NPPF’s policy requirements seeking sustainable development including economic prosperity.

The outcomes have also ensured alignment to employment and housing needs and site surveys set out in the National Planning Practice Guidance.

ADDED VALUE CCL have added value throughout the commission, offering clear, direct and objective evidence and advice to the project team, client.

Testing and evaluation of the economic and housing impacts of various development scheme mixes and related sensitivity analysis have allowed the Harrison Trust to consider an extensive range of options matched to changing commercial market dynamics and at all times related back to a core planning case.

In addition, CCL has been involved in direct briefing of senior Council officers and members throughout the work and has prepared specific employment land and economic growth assessments to support public consultation and engagement.

SUCCESS STORIES

SUSTAINABLE URBAN EXTENSION ON LAND AT FLEET MARSTON, AYLESBURYClient: Barwood Land and Estates Ltd.

Date: October 2011 - ongoing

ROLE CCL was instructed to lead the preparation of an outline planning application for 2,745 dwellings and 30,000 sq.m of commercial floorspace in a new sustainable urban extension on land at Fleet Marston in Aylesbury Vale.

The work involved leading the addendum planning application, the review, critique and drafting of supporting technical documentation and involvement in the discussion and negotiation of planning conditions and S106 obligations.

CCL appeared as the expert housing, employment and planning witness at three public inquiries, and at the Local Plan examination as part of the work to promote and support the development scheme. Work has also included the preparation of detailed housing needs analysis and evidence to support the proposed scheme and to object to the emerging Local Plan position.

OUTCOMES CCL helped to secure the withdrawal of the emerging Vale of Aylesbury Plan which was found to be unlawful and unsound at Examination. CCL remain engaged with Barwood Land to support the ongoing promotion of Fleet Marston following an appeal decision against the scheme by the Secretary of State in January 2015.

ADDED VALUE CCL have added value to the project through dedicated time and resources to monitor, evaluate and respond to emerging planning policies and evidential work and through the effective preparation of representations, submissions and advisory briefings both to the Client Team and also leading Counsel.

FORMER RAF BRAMPTON, HUNTINGDON, EMPLOYMENT LAND AND DEVELOPMENT CASE

Client: Campbell Buchanan and Lochailort Investments

Date: December 2014 – April 2015

INSTRUCTION

Chilmark Consulting was instructed to prepare an Employment Land and Economic Case for the regeneration and development of a former RAF military base to the south of Huntingdon (RAF Brampton). The site was declared surplus

to operational requirements with existing employees transferred to other nearby operating bases. Our client has advanced masterplan and planning application proposals for a residential and mixed commercial uses regeneration set within the wider context of Brampton village, strategic growth proposals for Huntingdonshire and

the economic role of Alconbury Enterprise Zone to the north. The regeneration proposals see new Grade A employment floorspace together with incubation workspaces, a maritime museum and a substantial level and mix of new housing.

OUTCOMES The key output and outcome of the project was the preparation of an objective evidential report by CCL to support a number of outline, hybrid and alternative planning applications.

CCL added value to the instruction through the speed and effectiveness of our work.

All analyses, site visits and report preparation was completed within a three week period following client instructions in order to meet a challenging timetable for the submission of new planning applications and to support ongoing community and business consultations.

SUCCESS STORIES

OACHEN HOUSING REQUIREMENTS AND EMPLOYMENT NEEDS STUDY AND LOCAL PLAN EXAMINATIONClient: Crawley Borough Council

Date: January – April 2015

ROLE

CCL was commissioned to prepare new, updated housing requirements, employment land requirements and sensitivity modelling of future housing and employment land needs for Crawley Borough within the Northern West Sussex Housing Market Area.

The work was undertaken using existing data and information coupled with new analysis in accordance with the National Planning Policy Framework and National Planning Practice Guidance. CCL supported the Council as expert witness at the Local Plan EiP including appearances at the Housing and Employment hearing sessions.

OUTCOMES

The work was set out in a comprehensive report and technical appendices. CCL also prepared supplementary evidence for the Council’s Examination Topic Papers and in response to matters raised by the Local Plan Inspector up to and

during the Examination held in March 2015. The Interim Inspector’s Report (May 2015) indicated that he believes the housing figure and the OACHEN housing needs evidence prepared by CCL for the Council is sound.

ADDED VALUE

CCL have added value throughout the commission offering objective and direct advice on housing and economic needs evidence and drawing on experience gained working with other local authorities and on Local Plan preparation elsewhere.

CCL was involved in briefing and advising senior Council officers throughout the work and in wider discussions on matters including unmet housing needs arising and the implications for the Duty to Co-operate with surrounding authorities in Northern West Sussex.

BURGESS HILL SCIENCE & TECHNOLOGY PARK AND EMPLOYMENT LAND - MID SUSSEX DISTRICT COUNCIL AND WEST SUSSEX COUNTY COUNCIL

Client: Mid Sussex District Council and West Sussex County Council

Date: January 2015 - Ongoing

INSTRUCTION

Preparation of comprehensive strategic employment land demand and supply and economic effects analysis for new 30 Ha employment site in Burgess Hill. Phase 2 work is to prepare a feasibility study and delivery framework for a new 100,000 sq.m Science & Technology Park supported by

Coast to Capital LEP, Greater Brighton City Deal and West Sussex County Council.

ROLE Chilmark Consulting Chilmark Consulting was the lead consultant with project leadership, management and contractual responsibility for the commission.

We led all aspects of the economic development, projection modelling and town planning work. CCL was responsible for two specialist sub-consultants working collaboratively within the project team. CCL’s role involved direct client liaison and management of all aspects of the quality of the project.

OUTCOMES

The key outputs and outcomes of the project have been a robust, objective assessment in accordance with the NPPF and NPPG of the potential for a further 30 Ha of employment land to be allocated in the Draft Local Plan for an area to the west of Burgess Hill.

The work has ensured that the Plan is effectively supported by current evidence of market demand, sites survey, economic growth prospects and a detailed analysis of the proposed location (including the extent, scale and mix of B Use Class uses).

The work outcomes have given confidence to the Council to identify the site allocation within the Local Plan and to move forward

into the second phase of work to consider the feasibility and concept for the proposed Science & Technology Park in greater detail.

ADDED VALUE

CCL added value to the study through extensive stakeholder engagement with business occupiers and landowners in order to build-up further evidence and support for the new employment land allocation and to obtain a greater level of information on future (hidden) market demand for B Use Class floorspace across a range of sectors.

Value was further added through additional discussions and alignment of the Study with the broader objectives and agenda of the Coast to Capital LEP, Greater Brighton City Deal and of the Gatwick Diamond economic sub-region.

Finally, the work undertaken was interlinked to various other consultancy studies being undertaken in Mid Sussex and across the City Deal area more widely including cross-boundary planning and housing requirements.

NORTHERN WEST SUSSEX HMA: AFFORDABLE HOUSING NEEDS UPDATEClient: Crawley Borough Council, Horsham District

Council and Mid Sussex District Council

Date: May – October 2014

ROLE

CCL was instructed to prepare a comprehensive update of the affordable housing needs analysis for three local authorities in the Northern West Sussex HMA (Crawley, Horsham and Mid Sussex). The work encompassed all elements in calculating affordable housing needs, market signals and included detailed conclusions and recommendations on the level, type and mix of affordable housing needs across the HMA area.

OUTCOMES

The Affordable Housing Needs Update report prepared by CCL was completed to time and in accordance with the client parties requirements. The work has been used successfully at two Local Plan Examinations (Crawley and Horsham) during late 2014 and 2015; and found to be a sound part of the overall evidence base in both cases.

ADDED VALUE

CCL added value to the commission through the close and collaborative nature of the work, the high level, strategic and detailed nature of the advice and recommendations offered in translating and updating the existing evidence of affordable housing needs into an NPPG compliant resource across all three local authority areas.

Additional value was offered through specific work looking in detail at the definition of the housing market boundaries and the changing nature of the HMA’s interactions with London, Gatwick Airport and other neighbouring housing market areas.
