Late Sh. Balbir Singh that in discharge of your legally recoverable debt towards the complainant Sh. Gaurav

Malik you issued a cheque bearing no. 038175 dated 22.12.2014 for Rs. 12,000/- drawn upon Allahabad

Bank, A-3/32, Janakpuri, New Delhi-110058 in favour of the complainant which was returned unpaid for the

reasons “Insufficient Fund” vide cheque returning memo dated 21.03.2015 and despite notice of demand

dated 08.04.2015 served upon you, you failed to make the payment of the said cheque amount within the

stipulated time and thereby you committed an offence punishable under section 138 Negotiable Instruments

Act, 1881 and within my cognizance. I hereby direct that you be tried by this court on the above said notice.

With judicial intervention, we state that we have settled six complaints

bearing CC Nos. 369/1/15, 368/1/15, 372/1/15, 371/1/15, 376/1/15 and 377/1/15

jointly for Rs. 7,43,000/- towards full and final settlement. The said amount shall be

divided between the complainants as per their respective cheque amount. The

accused has paid Rs. 80,000/- in cash to the complainants today in the court and

the said amount will be divided between the complainants equally and mutually. The

remaining amount of Rs. 6,63,000/- will be paid by the accused within one year from

today i.e. 23.03.2017. The parties have also agreed that the accused will pay a

minimum of Rs. 1,00,000/- every quarter starting from June, 2016.

It is also agreed that after the entire payment is received, the complainants

shall withdraw all the six complaints. Further, if the accused defaults in making the

payment, the complainants shall be at liberty to impose interest at the rate of 2 %

per month on the default amount and if there are more than two consecutive

defaults, the complainants shall be at liberty to proceed with the present matter on

merits.
