CATEGORICAL EXCLUSION TO ALL INTERESTED AGENCIES AND PUBLIC GROUPS: As provided by the state environmental review process adopted in the rules of the Texas Water Development Board (TWDB), 31 Texas Administrative Code (TAC) § 371.41, for projects to be funded through the Drinking Water State Revolving Fund (DWSRF) Program and consistent with the National Environmental Policy Act, 42 United States Code § 4321, et seq., the TWDB staff has determined that the proposed action identified below may be exempted from formal environmental review requirements:
Eagle Pass Water Works System, Maverick County, Texas TWDB DWSRF Project No. 62882 New Systemwide AMI Meters Project Total Financing Amount: $3,997,286 (L1001074, LF1001155)
The Eagle Pass Water Works System (EPWWS) is proposing to use $3,997,286 in financing from the DWSRF Program to upgrade its metering system from automatic meter reading (AMR) to advanced metering infrastructure (AMI). Approximately 14,500 AMR meters throughout the system will be upgraded to AMI meters; three base stations/antenna will be installed at Brown, Chula Vista, and Seco Mines elevated storage tanks (EST); and 13 repeaters will be installed at existing ESTs and existing and abandoned lift stations. The proposed project will improve the accuracy of billing, ensure leaks are quickly identified and corrected, and increase water conservation and accountability in the system. Implementation of the proposed project would be highly localized and would occur at existing meter locations, in existing rights-of-way and easements, and at EPWWS facilities. Environmental impacts should be similar to rehabilitation activities and limited to meter system upgrades. Implementation of the proposed project at existing facilities and in existing rights-of-way and easements is not expected to impact previously recorded significant or potentially significant sites or protected areas surrounding a historic cemetery, structure, or district, as identified in the Texas Historical Commissions Archeological Sites Atlas. The proposed project will not adversely impact potential waters of the United States, including wetlands. In addition, implementation of the proposed project at previously disturbed sites is not expected to impact threatened or endangered species or habitat. The decision to grant a Categorical Exclusion is allowed because the specified project elements should not cause significant adverse impacts to the quality of the environment. Documentation supporting this determination is on file at the TWDB.

(1) the project no longer meets the requirements for a Categorical Exclusion as a result of changes in the project;
(2) the project involves extraordinary circumstances as described in 31 TAC § 371.41; or
(3) the project may violate or has violated federal, state, local, or tribal laws.
The project also must comply with the following conditions: • Standard emergency condition for the discovery of cultural resources • Standard emergency condition for the discovery of threatened and endangered
species Comments regarding this determination may be submitted to the Director of Regional Water Project Development, Texas Water Development Board, P.O. Box 13231, Austin, Texas 78711-3231.
