MEMORANDUM OF LAW IN SUPPORT OF MOTION TO REMAND

Remarkably, the Notice of Removal in this case is conspicuous for its failure

to identify the state of citizenship of either the plaintiff or General Electric Capital

Corp. This memorandum begins, and could easily also end, with these essential

facts, because these two parties on opposite sides of this case are both citizens of the

same state.

Ryan Michael Murphy was a citizen of Connecticut on his date of death and a

Connecticut probate court has appointed his mother, Donna Hayes Murphy, as the

personal representative of his estate. Epstein Mf., ~ 3, and Ex. 1 attached thereto.

28 U.S.C. § 1332(c)(2) directly addresses this situation: "the legal representative of

the estate of a decedent shall be deemed to be a citizen onlyof the same State as the


decedent." Emphasis added. Therefore, § 1332 mandates that the plaintiff be

deemed a citizen of Connecticut for purposes of this motion1.

General Electric Capital Corp.'s headquarters and principal place of business

is as located at 901 Main Avenue, Norwalk, Connecticut 06851. Epstein Aff., 'If 4,

Ex. 2. Therefore, for diversity purposes, this defendant is also a citizen of

Connecticut. E.g. 28 U.S.C. 1332(c)(1). See also Hertz Corp. v. Friend, 130 U.S.

1181, 1185-1186 (2010).

The removing defendants have not and cannot allege that General Electric

Capital Corp was not properly joined in this case. Instead, the removing defendants

allege that the plaintiff has "failed to plead the basis for naming General Electric

Capital Corp." Notice of Removal, Par. 5. This is simply not the case. The complaint

alleges that each of the five defendants including General Electric Capital Corp.

"owned, operated, leased, maintained or controlled" the Illinois licensed tractor-

trailer combination rig involved in this case. Ex. A to Notice of Removal, 'If'lf 4-5.

More specifically the substantive allegations against General Electric Capital Corp.

state:

It was the duty of the defendants, and each of them,[including General Electric Capital Corp.] to exercisereasonable care under the circumstances in operatingtheir commercial motor vehicle to protect the safety of theplaintiffs decedent and other people on the highway yet,notwithstanding and in violation of this duty, thedefendants, acting through agents, servants, employees orapparent agents:

a. Negligently and carelessly did notproperly manage the fuel supply on

the tractor trailer;

b. Negligently, carelessly and improperlyran out of fuel;

c. Negligently, carelessly and improperlydid not place warning cones;

d. Negligently, carelessly and improperlydid not place warning triangles;

e. Negligently, carelessly and improperlydid not activate the flashers on thetractor trailer; or

f. Negligently carelessly and improperlyfailed to provide warnings or adequatewarnings of the dangers presented bythe disabled tractor trailer.

Additionally, the complaint alleges that the driver of the tractor-trailer was

acting as the agent, servant, employee or apparent agent of General Electric Capital

Corp. (and the other defendants) at the time of the crash. Complaint Pg. 2, ,;,; 4-7.

Under the law, at this stage of the proceedings, these allegations must be taken as

true. Thus, the notice of removal does not come close to establishing there was

anything improper about including General Electric Capital Corp. as a defendant in

this case.

The party seeking to invoke federal jurisdiction in a diversity case has "the

burden of demonstrating that the requirements for diversity are met." Smart v.

Local 702 Inn Bhd. ofElec. Workers, 562 F.3d 798, 802-803 (7th Cir. 2009). Here,

the removmg defendants have failed to prove this Court has subject matter

jurisdiction and remand is required on that basis alone.

What is more, the notice of removal is riddled with other legal deficiencies in

that it: 1) does not establish that it was timely filedz; 2) does not reveal that all

defendants who were properly joined and served at the time the case was removed

either consented to or joined in remova13; 3) does not state Nitza Gonzalez is a

Florida citizen or satisfactorily allege facts supporting the claim that Nitza

Gonzalez is no longer an Illinois citizen4; and 4) does not address Illinois defendant

Jose Angel Garay, Inc.'s avoidance of service ofprocess.5

For all of these reasons the plaintiff respectfully requests an order remanding

this case to the Circuit Court of Cook County, Illinois and requiring payment of just

5 Plaintiff is cognizant that defendant Garay has not been served, however, Garay's registered agentappears to be actively evading service of process. The state court issued summons for Garay on June7, 2012. Plaintiff placed that summons with the sheriff, who attempted but failed to serve Garay onJune 20, 2012. Plaintiff brought a Routine Motion to Appoint Special Process Server which wasgranted on July 10, 2012 with issuance of a first alias summons. Plaintiff then hired a specialprocess server who attempted to serve Garay on July 12, 2012 at the home of the defendant'sprincipal Jose Angel Garay. The special process server was told by a man claiming to be "Tony" thatMr. Garay had moved away. When the special process server returned on July 15, 2012, a neighborexplained Mr. Garay still lived at the home and described Mr. Garay's physical appearance, whichmatched the description of "Tony." The special process server returned to Mr. Garay's home on July21, 2012, and again attempted service on four more occasions. Ex. A (Affidavit, Par. 9-17, Ex. 7-15).Under these circumstances, in law the removing parties should be estopped from arguing Garay wasnot served at the time of removal.

1. On June 7, 2012 plaintiff filed a wrongfcu death suit against the above-

To date, the d"felldallt has 1I0t been served. We have attempted to serve the defendant at herlast-knowll address, 5100 West Grace Street, Chicago, IL 60641, on Wednesday, July 11, 2012,at 11:15 a,m. We fOllnd this to be a single·family home, having two entran"es, one for aconvertedapartlllent on the secolldfloor, and one for an apartment on the east side of thebuilding.

When entering the building then; is an apartment leading downstairs which belongs to thebuilding owner, Angelo Vasos.

The defendant's name is not on either of the doorbells or mailboxes, and when we spoke AngeloVasos he stated lhat the defendant had moved to Florida approximately two years agoabandoning the apartment, and he has not seen her sine".

Since that attempt we have developed new information and believe tbal the defendant may residein Massachusetts, ami does have a vehicle that has been registered at the 5100 West Grace Streetaddress the last few months.

JOSE ANGEL GARAY, INC.

To date, the defendant cOlporation has not heen served. 1237 Jericho Road, Aurora, IL 60506, isthe residence ofJose Angel Garay, and when we ilrst went to it on Thursday, July 2012, at

8:00 a.m., we spoke with an individual who identified himself only as "Tony", and he stated thatMr. Garay had moved from there approximately two years ago and he did not know to where hemoved.

We did find three vehicles parked there, and one of them is registered to Jose Angel Garay.

Consequently, we have returned there on Sunday, July 15,2012, at 8:40 a.m., and spoke with anext-door neighbor (east), and he stated that the Jose Angel Garay still resides there, and hisdescription that ofamale Latin, in his mid 50's, and being approximately 5' 1I" tall, andweighing over 200 Ibs., coincides with the description of the person who identified himself as"Tony". We waited there for approximately 1 'Iz hours and no one came in or out of the building.

We returned there on Saturday, July 21, 2012, at 1:00 p.m.; and, Wednesday, July 25, 2012, at9:05 a.m., and on the first attempt all three of the vehicles that were there originally were there,and only the vehicle registered to Jose Angel Garay was there on the second attempt.

On neither of these attempts was thcrc any answer at the door, and our investigator waited in thearea for 3 hours on the attempt of Saturday, July 21, 2012, at 1:00 p.m., and 45 minutes on theattempt of Wednesday, July 25, 2012, at 9:05 a.m., and there was no activity either in 01' ont ofthe home at these times.

CONCLUDING REMARKS:

We will continue in our investigation by locating and serving both defendants. Our furtherreports will follow.
