Petitioner alleges that he has learned thatSr. Faure died in the month of April,. 1726; thathe left a widow and ohildren and some property,and that,. as'a niece of said Dame La Solaye, widowof said Faure, petitioner's wife has an interestin said property under the provisions of the mutual donation oontained in their marriage oontractpassed before Raguet, Notary, on July 2nd, 1714.
Wherefore petitioner prays that the portionof property which belonged to said Dame La Solaye,wife of Faure, at the time of his death, and which

The oontraoting parties, with the advioeand oounsel of their friends hereinafter named,promise to take each other in lawful marriage,to be solemnized in the Holy Catholio Churoh assoon as praotioable and advisable.
The parties agree to the oommunity ofproperty aooording to the Custom of Paris. Theymake to eaoh other an irrevooable mutual donationinter vivos of all their movable property, immovable aoquets and gains, to be enjoyed by thesurvivor and his or her heirs and assigns innaked ownership. Differences between Sieur Lavigne and Sieur Sabannieplante!; at Chantilly, about the roads which runthrough the sown fields of Lavigne; and, as hisfences are left open by those who pass by, considerable damage is done to Lavigne's fields bycattle, etc. Lavigne offers to have a bridgebuilt for public accomodation, suggesting to collecta certain amount from each resident, Lavigne agreeing to furnish a day's work with negro laborers forconstruction of said bridge.
If Sabannie does not partioipate in oonstructionof said bridge, Lavigne will block up his fences.
