na hrvatski način

U javnosti je slabo poznatokako se pred svakog mladogliječnika, doktora medicine,koji ima sreću na javnomnatječaju biti izabran kaonajbolji kandidat za željenuspecijalizaciju, osim Ugovora oradu stavlja i poseban Ugovoro reguliranju međusobnihodnosa tj. novčanih tražbina(praksa koja nije poznata nitiu jednoj drugoj profesiji u RH). Tim se ugovorom deniraobveza kojom se mladog
specijalista po polaganjuspecijalističkog ispita vežeobvezom rada u istoj ustanovi(koja mu je poslodavac) istibroj godina koliko je trajalai specijalizacija. Kako ponovim programima oko 95%specijalizacija ima trajanjeu trajanju od 5 godina - tiugovori su poznati kolokvijalnokao “5 + 5”. A generacijeprije nastupanja Pravilnika ospecijalističkom usavršavanjuiz 2011., obvezni su ustanovina dvostruko duži rok.Njima se u praksi liječnikeveže za određenu ustanovupod prijetnjom plaćanja štete
danoj ustanovi ako za vrijemeili nakon specijalizacije odlučepromijeniti ustanovu (bilo uzemlji ili izvan nje). Zanimljivotakvi ugovori ne denirajuunaprijed iznos odštete, većih kalkulira poslodavac uslučaju iskaza želje liječnika
za prekid ugovora – takoliječnik ne može niti procijenitikolika će se odšteta od njegaočekivati ili ocijeniti isplatili mu se promjena radnogmjesta. Na takav načinustanove, pod prešutnimblagoslovom HZZO-a i sudovakoji presuđuju redovito ukorist ustanova, pokušavajuzaustaviti odlazak hrvatskihliječnika u drugu ustanovuunutar istog sustava ili uinozemstvo. U samoj suštini
to su nepovoljni ugovori, aponuđene alternative nema.
Odlazak mladih liječnika je od ulaska u EU, iznimnopopularno upravo zbogproblema vezanih uz dobivanje
specijalizacija i ugovornihobveza unutar hrvatskogzdravstvenog sustava.Postavljeni sustav djelujedemotivirajuće na mlade dase odluče na studij medicine,kao i dodatno stimulira mladeliječnike potražiti mogućnosti
napretka karijere van granica(što produbljuje problemhipoprodukcije zdravstvenihdjelatnika u Hrvatskoj).U drugim državama EUvisokokvalicirani stručnjacise zadržavaju povećanjemplaće, plaćenim edukacijama,poboljšavanjem radnih uvjetai sredine, tj. stimulacijom - uusporedbi, hrvatski model jeondje potpuna nepoznanicai kojeg s nevjericom mogushvatiti, model praktički
robovlasničkog ugovora.
Naime, navodna šteta kojuustanova zahtjeva od liječnikakoji želi promijeniti poslodavcasastoji se od vračanja ustanovi
punog bruto iznosa svihmjesečnih plaća od početkado prekida ugovora (iznosiod oko 120.000,00 kn/god),zajedno sa svim doprinosima,prekovremenim radom idežurstvima, te kamatom.Prvi problem jest vračanje
novca za sav odrađeni redovnii prekovremeni rad u punomtrajanju ugovora – čime jeliječnik doslovno besplatnoradio godinama za instituciju(doslovno kao rob), a drugiproblem jest što ustanova kojaodštetu naplaćuje nije uopćesubjekt koji je plaću isplatio sasvim doprinosima, davanjimai porezom (jer je plaća kaotakva isplaćivana iz proračunaa ne iz glavarine ustanovedo 2015. god.). Na taj način
ustanova dolazi do novcakojim nikad nije raspolagalau ime „nanesene štete“koju je odlaskom prouzročioliječnik, koji tako vrijemeprovedeno „edukacijomkroz rad“ za specijalizacije ipo specijalističkom ispitu upunom iznosu vrača ustanovi.Poznatom problemu sporostinašeg pravosudnog sustavaustanove su doskočile praksomu slučaju naplate (kako se nebi vodili dugogodišnji sudskisporovi), te se od liječnikatraži potpisani ugovor o svomtrošku solemnizira kod javnogbilježnika. Na taj se način
u slučaju potrebe preskačesud, te ustanova možedirektno ugovor – ovršnuispravu poslati na FINU-u naprovođenje ovrhe. U kratkomroku mladi liječnik se nalaziu bezizlaznoj situaciji, tj. podovrhom (najčešće se radi o
sumama od oko 600.000,00kn). Iz prakse se do sad vidjeloda sudski sporovi redovnozavršavaju u korist ustanova(bez obzira na dokazivanjeliječnika o kršenju stavkaugovora od strane ustanoveprije osobne odluke za prekidugovora), a iznosi isplateštete nisu standardizirani narazini države ili ustanova, tese u nekim slučajevima radiloi višemilijunskim iznosima.
World Medical Association(čije su naša Komora i Zborčlanovi) je također jasnogstava o pravima liječnikaglede migracije i odluke podkojim uvjetima će prakticiratimedicinu. Hrvatska liječničkakomora predlaže reformusustava specijalizacija, tečlanovima nudi pravnesavjete kad se nađu u opisanojsituaciji. Ulaskom u EU kojapraksu takvih ugovora nepoznaje, Hrvatska je obveznapreuzeti pravnu stečevinu iugovora o slobodi kretanjaroba i usluga. Neke zemlje,poput Češke, imale su slične
mjere na snazi, no iste suproglašavane neustavnim.Stoga ostaje nada da ćeuskoro takvi ugovori postatistvar prošlosti i u Hrvatskoj.

Osnovni je cilj državnogosiguravatelja,Hrvatskog zavoda zazdravstveno osiguranje,što ekasnija alokacijanamjenski prikupljenihsredstava građana izkojih isti nadoknađujeugovornim ustanovama
trošak pruženihzdravstvenih usluga iprocedura. Odnos izmeđukorisnika, pružatelja iZavoda baziran je naBismarckovom modelunanciranja zdravstvenihsustava, koji se u svijetuširoko primjenjuje. Uposljednje se vrijemehrvatski sustavnanciranja odmaknuood navedenog modela. Tako u prvom planuumjesto nanciranjazdravstvenih uslugaza građane, zapravo
biva nanciranjesamih zdravstvenihustanova. Sustav ukojem čvrsto određenipaušalni mjesečni iznosiustanovama služe kao„polog” (bez obzirana broj obrađenihpacijenata) dovodi
do paradoksalnogfenomena u kojem jevodstvima ustanovapragmatično izvršiti štomanje zahvata i obraditimanji broj pacijenata,tako smanjujućitroškove ustanova, neprodubljujući minus i neprodužujući liste čekanja.
Od osnutka RH je prošlakroz mnoge promjenei reforme zdravstva inanciranja sustava. Trenutačna Vlada je ponudila rješenje
problema vezanih uznanciranja izlaskomHZZO-a iz Državneriznice, koje je na snaziod početka ove godine (ukojoj je Zavod od davne2002. godine). Stav je, daHZZO unutar proračunanije raspolagao sa svim
sredstvima koja su mubila izvor prihoda, jerse prikupljeni novactrošio samo dijelom zazdravstvo, ali i na drugeproračunske stavke (tzv.“rupe u proračunu”,socijalna davanja i sl.)– zbog čega je sustavkonstantno bio u manjku.Raspoloživa pravagrađana u zdravstvenomsustavu sada oviseizravno o razini sredstavakoja se namjenskiizdvajaju samo u tusvrhu. Iznos za 2015. se
procjenjuje na direktnih22,1 milijardu kn. Zausporedbu, HZZO je u2013. raspolagao s 23,5milijarde kn, a u 2014.godini s 23,1 milijardikuna, no premisa je,budući HZZO nije ranijeiznose u potpunosti
kontrolirao, u ovoj godinibi se s manje novcamoglo učiniti više negoranijih godina. Na taj senačin pokušava armiratinovi sustav - jer tkorazuman može biti protivtolike uštede? Još je ranoi dokaz za tu tvrdnjuostaje nam tek vidjeti.
Pretpostavljase eksibilnijimraspolaganjemsredstvima (uključujućiinformatizacijom,intenzivnijim kontrolama
bolovanja, objedinjenomnabavkom i sl.) povećatiopseg besplatnihusluga za građane, kojise kroz godine stalnosmanjivao. Odnosno,više novca za plaćanjelijekova, posebno skupihlijekova za hematološke,
onkološke, imunološkei degenerativne bolesti,ortopedska pomagala,kirurške i dijagnostičkezahvate, liječenjestare populacije, ali istimulaciju kvalitetnograda zdravstvenihdjelatnika, što bi trebaloolakšati rad.
Sustav je prevelik i tromda bi se u njega stalnozadiralo. Ranije ideje(npr. smanjenjem stopeobveznih doprinosa s15% na 13% u 2012.,
pa naknadno vraćanjebez osiguravanjaalternativnih izvorananciranja zdravstvaiz novih poreza) bile suneodlučne, s upitnomekonomskom logikom, tenisu pokazale rezultate.Dapače, sustav je bio
neodrživ bez sanacijskihintervencija u proračun.Ostaje vidjeti hoće li iovo biti jedna polovičnai nedorađena reformakoja ide na ruku tržištu iprivatnom zdravstvu, iliće stvarno donijeti većepogodnosti građanimakoji trebaju univerzalnui kvalitetnu zdravstvenuzaštitu.
