The ambient impact from Permit #112006-005 is being converted to daily production limits. This change reflects the Air Pollution Control Program's updated construction industry policy "Ceasing the Use of Nomographs" dated May 1, 2016. According to Department of Natural Resources Air Pollution Control Program's database, the only other portable plant that has been permitted to operate at the Hwy 63N Quarry (Site ID 019-0050) is PORT- 0505, and it is being amended (Project 2019-10-013) to change from a NAAQS limit to a daily production limit as well. Both PORT-0505 and PORT-0565 are both portable rock crushers and typically do not operate at this quarry at the same time. The following scenarios includes that option. PORT-0565 is permitted to operate with other plants located at the Hwy 63N Quarry (Site ID O 19-0050) as long as the following scenarios are maintained. These scenarios are also summarized in the table below. When operating by itself, referred to as solitary operation, that does not have a NAAQS daily limit, PORT-0565 has a daily production limitation of 13,127 tons per day. Dear Mr. Thiltgen:

On October 8, 2019, Air Pollution Control Program received your request to amend Permit# 112006-005 by changing Special Condition 2 (for Hwy 63N Quarry only) from a National Ambient Air Quality Standards (NAAQS) Limitation for particulate matter less the ten microns in diameter (PM10) to a daily throughput limitation.

The permittee is authorized to construct and operate subject to the following special conditions:

The special conditions listed in this permit were included based on the authority granted the Missouri Air Pollution Control Program by the Missouri Air Conservation Law (specifically 643.075) and by the Missouri Rules listed in Title 10, Division 10 of the Code of State Regulations (specifically 10 CSR 10-6.060). For specific details regarding conditions, see 10 CSR 10-6.060 paragraph (3)(E). "Conditions required by permitting authority."

1. Superseding Condition The conditions of this permit supersede Special Conditions 1 through 11 for only the Hwy 63N Quarry site found in the previously issued Construction Permit 112006-005 issued by the Air Pollution Control Program.

2. Best Management Practices Capital Quarries Co. Portable Plant PORT-0565 shall control fugitive emissions from all of the haul roads and stockpiles at this site by performing Best Management Practices, which include the usage of paving, chemical dust suppressants, or documented watering. These practices are defined in Attachment AA.

3. Daily Production Limit For PORT-0565 Capital Quarries PORT-0565 plant shall limit its daily production based on the table below using Attachment A, or another equivalent form, that has been approved by the Air Pollution Control Program, including electronic forms.

SPECIAL CONDITIONS:

The permittee is authorized to construct and operate subject to the following special conditions:

4. Annual Emission Limit of Particulate Matter Less Than Ten Microns in Diameter (PM10) A. The operator(s) shall ensure that Capital Quarries Co. Portable Plant PORT-

0565 emits less than 50 tons of PM10 into the atmosphere in any 12-month period.

8. To demonstrate compliance, the operator(s) shall maintain a daily record of material processed and PM10. Attachment 8, Monthly PM10 Emissions Tracking Record (attached with Permit 112006-005), or other equivalent form(s), will be used for this purpose.

5. Annual Emission Limit of Nitrogen Oxides (NOx) A. The operator(s) shall ensure that Capital Quarries Co. Portable Plant PORT-

0565 emits less than 100 tons of NOx into the atmosphere in any 12-month period .

8. To demonstrate compliance, the operator(s) shall maintain a daily record of material processed and NOx. Attachment C, Monthly Nitrogen Oxide (NOx) Emissions Tracking Record, (attached with Permit 112006-005), or other equivalent forms, will be used for this purpose.

6. Moisture Content Testing Requirement A. Capital Quarries PORT-0565 shall verify that the moisture content of the

processed rock is greater than or equal to 1.5 percent by weight.

8. Testing shall be conducted according to the method prescribed by the American Society for Testing Materials (ASTM) D-2216, C-566 or another method approved by the Director.

C. The initial test shall be conducted no later than 45 days after the start of operation. A second test shall be performed the calendar year following the initial test during the months of July or August.

D. The test samples shall be taken from rock that has been processed by the plant or from each source of aggregate (e.g. quarry).

E. The written analytical report shall include the raw data and moisture content of each sample, the test date and the original signature of the individual performing the test. The report shall be filed on-site or at the Installation main office within 30 days of completion of the required test.

SPECIAL CONDITIONS:

The permittee is authorized to construct and operate subject to the following special conditions:

F. If the moisture content of either of the two tests is less than the moisture content in Special Condition 6.A, another test may be performed within 15 days of the noncompliant test. If the results of that test is less than the moisture content in Special Condition 6.A, Installation shall either: 1.) Apply for a new permit to account for the revised information, or 2.) Submit a plan for the installation of wet spray devices to the

Compliance/Enforcement Section of the Air Pollution Control Program within 10 days of the second noncompliant test. Plans may be sent by mail to P.O. Box 176, Jefferson City, MO 65102 or by email at [email protected]. The wet spray devices shall be installed and operational within 40 days of the second noncompliant test.

7. Restriction on Process Configuration of Primary Emission Point(s) The maximum hourly design rate of the plant is equal to the sum of the design rate(s) of the primary emission point(s). Capital Quarries Co. Portable Plant PORT-0565 has designated the following unit(s) as the primary emission point(s) of the rock crushing plant: primary crusher (EP-01 ). Bypassing the primary emission point(s) for processing is prohibited.

8. Restriction on Minimum Distance to Nearest Property Boundary The primary emission point of the rock crushing plant, which is the primary crusher (EP-01 ), shall be located not less than 1,000 feet from the nearest property boundary whenever it is operating at the Highway 63N Quarry site.

9. Recordkeeping Requirement Capital Quarries Company, Inc. PORT-0565 shall maintain all records required by this permit for not less than five years and make them available to any Missouri Department of Natural Resources' personnel upon request.

10. Report Requirement Capital Quarries Company, Inc. PORT-0565 shall report to the Air Pollution Control Program, Compliance/Enforcement Section by either email at [email protected] or by mail at P.O. Box 176, Jefferson City MO 65102, no later than ten days after any exceedances of the limitations imposed by this permit.
