Cape Environmental Assessment Practitioners (Cape EAPrac) have been appointed by the Applicant, Knysna Municipality, to ensure compliance with the regulations contained in the National Environmental Management Act (NEMA, No 107 of 1998 as amended) for the proposed relocation and construction of the Sedgefield water supply pipeline between the Ruigtevlei Water Treatment Works and the Sedgefield Reservoir.
As a key stakeholder, neighbouring property owner, community representative, ratepayers association or relevant authority, you are hereby notified of the submission of an Application for Exemption to the national Department of Environmental Affairs (DEA). Exemptions from the regulations pertaining to the Consideration of Alternatives and Advertising the Environmental Authorisation have been applied for. The regulations and reasons for exemption are as follows:
1. GN R543 Regulation 22(h) – a description of any identified alternatives to the proposed activity that are feasible and reasonable, including the advantages and disadvantages that the proposed activity or alternatives will have on the environment and on the community that may be affected by the activity.
The proposed alignment for the relocation of the existing water supply pipeline was authorised by DEA on 7 May 2008 as part of an overall application for the upgrade of the water supply infrastructure for Sedgefield. This EA has lapsed and an application was resubmitted and accepted by DEA for the pipeline relocation only (Reference as above). During the previous EIA process, several alternatives for the pipeline alignment were presented and the preferred alternative was authorised. Given that this alternative is exactly the same as the one currently being applied for, this office feels that there are no other reasonable and feasible alternatives that could be considered, as these were shown to be unfeasible during the previous EIA process.
We therefore apply for Exemption from assessing any other alternatives except the preferred alternative and the no-go option.

2. GN R543 Regulation 10(2)(d) – publish a notice in the newspapers contemplated in regulation 54(2)(c) and (d) and which newspaper was used for the placing of advertisements as part of the public participation process.
We hereby apply for exemption from advertising any authorisation issued in any of the newspapers to be used for the public participation process. All registered I&APs, key stakeholders and authorities identified in the previous EIA process have been approached during this process. These and any new stakeholders will be provided with notification of and a copy of the EA once it is issued. Since this application deals directly with municipal infrastructure and has been previously authorised, not advertising the decision will not affect the rights of any members of the public, nor of any residents outside of the Sedgefield area.

Cape Environmental Assessment Practitioners (Cape EAPrac) have been appointed by the Applicant, Knysna Municipality, to ensure compliance with the regulations contained in the National Environmental Management Act (NEMA, No 107 of 1998 as amended) for the proposed relocation and construction of the Sedgefield water supply pipeline between the Ruigtevlei Water Treatment Works and the Sedgefield Reservoir.
The existing pipeline is aligned across a floodplain of the Karatara River which is a problem for maintenance and sustainability. An Environmental Authorisation for the pipeline upgrade as well as for the upgrade of the existing Ruigtevlei WTW pumpstation and relocation of the WTW was issued on 7th May 2008 but due to the lapsing of the EA before commencement of construction, a new Basic Assessment in terms of NEMA is required. This assessment only considers the relocation and reconstruction of approximately 1.9kms of the pipeline and differs from the original EA in that regard.
A Basic Assessment process is required in terms of NEMA for the construction of the proposed pipeline. The listed activities associated with the proposed development, as stipulated in Regulation 544 & 546 are as follows:
R544 - Activities 11(xi) for the construction of the proposed pipeline within 32m of any watercourses.
R546 - Activities 16(iv), (d)(i) & (ii), (ff), and (hh) for construction activities associated with the relocation and upgrade of the water supply pipeline between the Ruigtevlei Water Treatment Works and the storage reservoir adjacent to the Karatara River, within 10kms of a National Park, within an area identified as a CBA according to the Garden Route CBA maps.
An Application Form has been submitted to and approved by the national Department Environmental Affairs (DEA), Reference No: 14/12/16/3/3/1/959, authorising Cape EAPrac to commence with the public participation phase of the environmental process. An advertisement calling for Registration of Interested & Affected Parties (I&APs), informing the public of the proposed development and the opportunity to become involved in the environmental process was placed in the Knysna / Plett Herald newspaper (issue of 8th August 2013). On-line registration forms are available on the Cape EAPrac website at www.cape-eaprac.co.za.

Cape EAPrac 2 DBAR Notification
Assessment Report (DBAR). Stakeholders identified during the 2007 / 2008 EIA process are being included in this notification. The DBAR is available for comment for a period of 40 days before being submitted to the national Department of Environmental Affairs (DEA) for decision making. Any comment must be submitted, in writing, within the specified 40-day comment period extending from Thursday 8th August to Monday 16th September 2013, to Cape EAPrac.
Hard copies of the DBAR are available at the Sedgefield Town Library (Flamingo Street, Sedgefield) and the Sedgefield Municipal office (Flamingo Street, Sedgefield), and in a digital format on the website at www.cape-eaprac.co.za.
Only those parties that formally register during the EIA process will remain informed of documents available for public review.
