    A summary of the Capital Committee Meeting of March 1,2007 is as follows. Attendance:Carol Rieg, John Norris, Walter Woodford via conference call, Ron Freeland, Geoffrey Kolberg,Keith Duerling, Joe Waggoner, Sam Triandos, Deborah Donohue, Curt Esposito, DennisSimpson, Glen Smith, Melissa Williams, Doug Novocin, Nick Corda (URS), Nick Deros (URS),Jennifer Rohrer (WTB) and Shawn Burnett (WTB). Susan Affleck Bauer joined the meeting atapproximately 11 am.MEETING SUMMARY: The meeting summary for the January 4,2007 Capital Committeemeeting were approved.Geoff Kolberg started the meeting by emphasizing his Division's renewed effort to get thepackage out in a timely manner. He also discussed the new format of the meeting agenda. JohnNorris requested that the most significant item should be placed first on the agenda. Geoff alsodiscussed the occasional need to contact the Members in between meetings. The Membersagreed that e-mail is the easiest and fastest way to be reached.NICE BRIDGE IMPROVEMENT STUDY:

    Preliminary Alternates - Sam Triandos provided a quick overview of public outreach that has previously occurredon this project, including the formation of a focus group, informational presentations tovarious groups, and upcoming public workshops which were announced via newsletter.

    The newsletter was mailed in February 2007 announcing the public workshop scheduledfor March 2007; however, this workshop has since been postponed due to memberconcerns of the preliminary alternates. The study team was told to hold off on re-scheduling any public workshops until the issues are resolved.

    Members John Norris and Walter Woodford expressed concern about presentinginfeasible or improbable alternates, notably the crossover alternates, to the public. Joe Waggoner stated that the study team must follow the planning process for NEP A andMEPA.

    Melissa Williams noted that as part of the Alternatives Retained for Detailed Study(ARDS) stage of the planning process, pros and cons of each alternative will bedocumented and explanations must be provided for all alternates, even those that weredropped from further study.

    Mr. Woodford expressed concern about the required distance between the existingstructure and a new structure, and ifthere may be an agency that may have an issuepermitting a distance less than a required minimum. He would also like to know whatextent the Coast Guard and Corps of Engineers have had input to the process.

    Glen Smith mentioned that there were two issues raised during his recent presentation tothe Southern MD Delegation:o Why retain the existing bridge?o Why not consider a drawbridge? WTB and URS answered that the existing navigational channel is verywide at 800-feet, and would require a structure that is too long, leaves too

    large of a footprint, is expensive, and could cause delays associated withits opening. A question raised by Mr. Woodford was what are the clearance requirements?o Requirements are that the new structure meet current vertical and horizontalclearances (135' and 800', respectively) Shawn Burnett noted that the existing structure has a 3.75% grade, which affect truckspeeds and a proposed vertical grade of3.0% would reduce this effect. Shawn Burnett provided a description of the preliminary alternates (2A, 2B, 2 C, 3, 4, and5) to the group.Morgantown Plant - MlRANT The Morgantown Power plant is required to make alterations to meet the Healthy Air Act

    by adding scrubbers to their plant. Maryland Department of Natural Resources (MDNR) is the regulatory agency for thePlant operations. The possibility of vapor clouds being produced from the scrubbers can negatively affect

    the ability of motorists to cross the bridge. The "CALPUFF" model results show that there is no indication of potential future

    fogging on the bridge as a result of the added scrubbers DNR ran another model (model name unknown) to verify the results. This model's

    results showed occurrences of fogging on the bridge would happen eight times in the nextfive years; however, none of these incidents would occur during times of year that wouldcause ice to form on the bridge. Itwas noted that coal delivery is going to change in the near future from train (CSX)delivery to delivery by barge up the Potomac.

    Follow-Ups: Dennis Simpson will provide Mr. Woodford responses to his questions raised regardingthe Nice Bridge Improvement Project. Melissa Wiliams will provide an overview of the planning process to the members at thenext Capital Committee meeting, scheduled for April 5, 2007.

    The study team will present the alternates to the Capital Committee in more detail at thenext Capital Committee meeting (4/5/07). Dennis Simpson and Glen Smith are meeting with MDNR on March 2, 2007 to discuss

    potential solutions to the fogging issue. Glen Smith will provide Mr. Norris a copy of the letter to the Southern Maryland

    Delegation that includes responses to their questions from the February 16th briefing.

    1-95 CORRIDOR IMPROVEMENTS WORKSHOPBaltimore and Harford CountiesMelissa Williams explained that the purpose of the 1-95 Corridor ImprovementsWorkshop is to provide the public with an update on the 1-95 projects in Baltimore andHarford Counties. The format of the Workshop will be an open house with displaystations for the various projects. Agency and consultant staff will be at the displaystations to answer questions. There will not be a formal presentation. The Workshopsare anticipated for June 19 and 21,2007. The display stations will include: 1-95 Express Toll Lanes Project Section 200 Project Planning Study 1-95/MD 24/MD 924 Interchange Improvements Maryland House & Chesapeake House Improvements Hatem Bridge Redecking E-Z Pass Information How to stay involvedJohn Norris suggested adding other Authority contract such as ICC, ETC violations andother 1-95,1-895 projects; maybe convert to "Road Show". Walter Woodford felt that thescope is good the way it is now. He doesn't see any public interest in expanding it. RonFreeland would like to tie it into the annual CTP Tour. Melissa suggested focusing onthe display stations, with the last display having "other MdTA initiatives" but with not asmuch detail. The Members agreed with Melissa's approach. Discussions would be one-on-one about the projects. A list of difficult questions will be provided to staff. JoeWaggoner explained that policy issues will be avoided. Melissa will check intolocations. The Members agreed to move forward with this item. Melissa will keep theCapital Committee updated.Capital Planning 2007 Capital Committee ScheduleMelissa Williams also provided a Capital Planning upcoming issues list for the CapitalCommittee. Walter suggested that the Members review the list.

    ETC GAP CONTRACT (Contract No. MA 2099-000-001/6)Keith Duerling requested approval to award a sole-source contract to ACS State and LocalSolutions (ACS) for continuation of operations of the current ETC system from April 21, 2007until change over to the new Next Generation system. Transition to the new system is currentlyscheduled for January 11, 200S. The current ETC contract is operating under sole source. Aone year contract with a second option year was negotiated with ACS. At this time, Keithdoesn't see a need for 2nd year, it's "just in case", on a month-to-month basis. The rates are thesame as current rates. John Norris asked Keith what the answer would be if the BPW askedwhat we could have done to prevent the one year delay. Keith answered that one of theproposals had to be rejected, and that decision was appealed to the Maryland State Board ofContract Appeals. The Authority should be in a position to respond to these types of questions atthe BPW.Ron Freeland requested a list of liquidated damages in the contract. He recommended letting thefull Authority know that we are working with BPW and AG's office.Curt Esposito stated that the Next Generation contract is moving along, but ACS typically fallsbehind. Walter Woodford asked why it's a separate contract. Keith responded that the BPW andAG determined that it's not appropriate to extend the contract. Does the Next Generationcontract have liquidated damages for late performance? Yes. The Members approved takingthis item to the full Authority meeting on March 14, 2007.

    AlE CONSULTANT CONTRACT MdTA 2006-01Keith Duerling provided an explanation of the Selections for these AlE Consultant contracts.There were eight firms invited to submit technical proposals. Three firms were selected. Thesethree were the most qualified and do not currently have a lot of Authority business. Keith alsoexplained the scope. Walter Woodford had no problems with the contract. The maximumoverhead and profit are typical. Keith explained that joint ventures are encouraged as a meansfor small firms to obtain contracts with the Authority. The Members approved. Itwill not bepresented to the full Authority until the contracts have been negotiated and are ready for award.The Members acknowledged the presentation.

    EWA No 2.- CONTRACT LB-37S-000-006R2 - Deck Replacement Westbound Suspension andThrough- Truss Spans and Miscellaneous Repairs, Williams Preston Lane, Jr., Memorial BridgeGeoff Kolberg requested approval of an Extra Work Authorization in the amount of$60 1,53S.25, an increase of 1.16% from the original contract amount. EWA No.2 exceeds thedollar limit ($500,000) delegated by the Authority to the Executive Secretary. It is necessary tocompensate the contractor for the additional work to flood coat and seal cracks in existing latexmodified concrete overlay to prevent moisture penetration, to repair delaminated areas in theexisting concrete overlay from spalling, and to provide a Surety Bond for the additional work.

    Walter Woodford asked about the Surety Bonds? The surety is based on the cost of work. Howmuch quantity needs repairs? 1 to 2% of the Phase I overlay. The Members approved this itemfor presentation to the full Authority.ICC PROJECT

    CONSULTANT CONTRACT LISTGeoff Kolberg updated the Committee on the ICC Consultant Contract list. TheMembers approved.CONTRACT B - ACCESS ROAD - Geotechnical Investigations - Construction of a DrillRig Access PathGeoff Kolberg stated that access road is a critical path in advancing the ICC. The date ofSHA memo should be 2/9/07 (it was incorrectly typed as 2006).Mr. Norris is concerned about moving forward if the project may be delayed. He statedthat the financing issue is critical. There needs to be a meeting of the minds with SHA.Mr. Norris wants a financing plan in place.Mr. Woodford explained that the issue is what would be the effect of not moving forwardon the existing financial plan. He suggested moving to the full Authority. It is okayfrom an Engineering standpoint. This item was approved to move forward to the fullAuthority for discussion only (not approval).The Members want to meet with the Chairman and SHA Administrator beforeproceeding. The Contract may be presented to the Authority but construction cannotproceed.

    QUARANTINE ROAD (Update Item)Doug Novocin updated the Committee on the 695/Quarantine Road Interchange andTruck Weigh and Inspection Facility Project. This project was planned to be advertisedin February 2006. Due to Right-of-way issues, the Truck Weigh Station was taken outthe project and postponed to a later stage. As a result, redesign of Ramp P and othercomponents was required.Contract A, which is primarily interchange improvements, was Advertised March 13,2007. Contract A includes revised Ramp P with a new signal, widening of Ramps A andM and the removal of Ramp R. The mainline of eastbound 695 will be realigned and theCSX overpass on EB 695 will be reconstructed.

    Contract B, which will be primarily the Truck Weigh Station, will be advertised in March2008. Contract B will remain contingent on ROW acquisition and relocating existingproperty owners. Update on relocation costs will be presented in April or May.Contract C will be a Best Value RFP for the truck weigh scale system, which is aspecialized system. Advertisement of Contract C will be coordinated with Contract B.Mr. Norris asked if a roundabout was examined for the Ramp A and M intersection. Isthere a need for truck parking? He would like an examination to determine if a needexists. Mr. Woodford is happy that the project is moving forward.

    HATEM BRIDGE PROJECTGeoffprovided a report on the US 40/MD 155 intersection improvements. The onlyfeasible improvement to the intersection are modifications to the signal timing that SHA will

    perform.STRATEGIC DEVELOPMENT

    Walter Woodford would like follow up on the Strategic Development contract. Walterwill discuss with Bruce Gartner.

    The next Capital Committee will be held on Thursday, AprilS, 2007 in the Members ConferenceRoom at Point Breeze.
