As we are all aware house prices have plunged by nearly a third since 2006, and homeownership rates are falling at the fastest pace since the Great Depression. Banks have an overfl ow of property repossessions and are using the agents help to fi nd new buyers, as well as offering favourable terms, see a selection on whats currently on offer in our Hot Properties section on page 38, some with over 60% discounts as well as fi nance available.

The good news? Two key measures now suggest it’s an excellent time to buy a house, either to live in for the long term or for investment income (but not for a quick fl ip). First, the nation’s ratio of house prices to yearly rents is nearly restored to its pre-bubble average. Second, when mort-gage rates are taken into consideration, houses are the most affordable they have been in decades. If you have good credit, a job and a down payment, you can get a mortgage. There’s more paperwork and scrutiny than fi ve years ago, but things are slowly creeping back

Houses aren’t the magic wealth creators they were made out to be during the bubble. But when prices are low, loans are cheap and plump invest-ment yields are scarce, buyers should jump.

Holidaymakers are being urged to cash in on bargain holidays in Europe as the value of the Euro falls to a 15-month low. The pound is now worth 1.21, its best rate since September 2010, which means that holidays to Eurozone destinations will cost British tourists less. Travellers are also ex-pected to buy their spending money now before the Eurozone crisis is resolved and the rate falls again. This could have an ef-fect on domestic tourism for February half term and Easter as holidaying in the UK is likely to cost more.

Oil could well play a part in reviving the economic fortunes of the Canary Islands in 2012 and onwards.Exploration has been a bone of contention for some years and sev-eral companies have already made offi cial requests for permission to carry out tests. Permission has recently been given to an Australian company to search for crude oil 50 miles off the coast of Lanzarote and

Fuerteventura. One of the issues previous-ly raised about oil drilling concerns was ownership if the drills struck lucky would it benefi t Africa or the Canary Islands? The Government of the Canary Islands wants the Ministry of Tourism to start negotia-tions over a claim, something president Paulino Rivero has been concerned with for some time.

Spain’s government is pushing for former savings banks CaixaBank and Bankia to merge as it struggles to shore up the ail-ing sector without pouring in more public money, sources said.

A merger of Madrid-based Bankia and its Barcelona-based counterpart would speed consolidation in a weak sector with scant state funds available to fl ush out toxic property assets, banking and political sources said.

Although Spain will struggle to pull off the merger of the country’s third- and fourth-biggest banks because of the cost of pro-viding state guarantees to encourage them to tie up, the move is seen as the only vi-able option.

The government has rejected ringfencing the billions of euros of unsellable property assets and rotten loans to property devel-opers in a “bad bank” which would cost the government billions to fund at a time when debt levels of peripheral eurozone countries are critical.

“This (the merger) is being discussed, because it’s either merging or having a bad bank, and the government has said it doesn’t want a bad bank,” said one politi-cal source.

But the newly-elected centre-right govern-ment is looking at how to tackle a huge funding gap in its banking system after re-jecting the idea of using public money to bail out the banks.

SECTOR RESTRUCTURING

Spain has shunned an Ireland -style rescue of its banks, because it would push up na-tional debt and further sour euro zone sen-timent.

Madrid-based Bankia and Barcelona-based CaixaBank together make up around 18 percent of the country’s banking system and would create a lender to rival Spain’s two biggest banks, Santander and BBVA.

However, Santander and BBVA have spent years diversifying away from Spain and its sick economy which is on the brink of its second recession in three years, whereas the majority of Bankia and CaixaBank’s business is domestic.

“A deal between CaixaBank and Bankia could hugely advance the cleaning up and restructuring of the sector.” said one sector source.

The major obstacle would be fi nding state funds to compensate CaixaBank -- one of Spain’s strongest banks -- to merge with Bankia which has one of the heaviest ex-posures to real estate in the country. Par-ent BFA has 11 billion euros ($14 billion) in foreclosed property assets on its balance sheet.

“The government couldn’t force CaixaBank to take over Bankia, but it could incentiv-ise it,” said one Spanish banker. “I believe they are carrying out an analysis to see if it’s viable.”

Record Year For Airports Grand Hotel Mencey Reopens

Spanair Closure Sees Vueling Stocks Soar

Airports in the Canaries had their best ever year in 2011, with a record 35 mil-lion passengers. The fi gure is 12% higher than for 2010 but the increase in numbers is even bigger in some cases, particularly Fuerteventura (+18.6%) and Tenerife South (+17.6%). Gran Canaria topped the individ-

ual rankings with 10.5 million passengers, ahead of Tenerife South (8.6m) and Lan-zarote (5.5m). Canarian government sourc-es this week partly atributed the bumper numbers to the effect of the current airport charge discounts offered to airlines that open extra routes to the islands.

Great news from Tenerife, Iberostar has announced the offi cial reopening of the historiMencey Hotel in the Spanish city of Santa Cruz, Tenerife as the latest addi-tion to the brand’s Grand Collection. The Iberostar Grand Hotel Mencey is now fully operational, following an extensive $32 million in improvements. The hotel is located in an exclusive resi-dential area of Santa Cruz, directly in front of the famed Garcia Sanabria bo-tanical gardens. When it opened in 1950, the property attracted such guests as the Spanish Royal Family, Elizabeth Taylor, Sofi a Loren and Joan Miró.

The Spanish Stock Exchange believes that Vueling, the low cost airline owned by Ibe-ria, will be one of the companies to benefi t most from the closure of Spanair, after see-ing them lead the markets with their stocks rising by over 20%.

Spanair had a market share in Barcelona, where they had their headquarters, of around 13%. All eyes are now pointing to Vueling, also based in Barcelona, to be the big benefi ciary following the demise of its former rival, who announced the halt of their business at the weekend.

It was reported that other potential win-ners in business, due to the cessation of

Spanair could be Aer Lingus, which rose 7% on the Irish Stock Exchange, and Rya-nair, which saw an increase of more than 1%.

Vueling, which is 49% owned by IAG, is the most likely candidate to gain a large num-ber of the routes formerly operated by Spa-nair. Some of these have limited profi tabil-ity, but others are of great value, such as the routes to the Scandinavian countries, industry sources explained.

“The most logical approach is that the re-maining routes stay with the low-cost air-lines, since they are the best able to pro-mote them,” said one Spanish broker’s

analyst. It is possible that the new Iberia Express may be interested in some of the routes, but these will be isolated cases, since the new IAG company will be fo-cused on long haul routes.

Vueling announced that it will increase its seating capacity during the summer season by up to 25% over the capacity of the previous year, and by up to 50% in Bar-celona airport. “With this new situation, Vueling will incorporate 33 extra fl ight fre-quencies on already scheduled fl ights, and fi ve new routes; from Barcelona, Berlin and Hamburg, and from Bilbao, Tenerife, Las Palmas and Lanzarote in the Canary Islands

1. How much money do you wish to spend?

The fi rst question is where is your money com-ing from? Is it tucked away in the bank or the building society, will it come from a second mortgage on your home in the UK or will you get it from the sale of your present home? You need to know that it is in place and ready to use before you make any decisions. If you are considering a mortgage in Spain then you need to have all the evidence necessary to show the bank how you will service the mortgage as well as telling your real estate agency so that they can direct you to properties that are mortgage-able. Your budget depends on what you have raised in your own country or the amount that you want to put down as a deposit for the mortgage.

2. Mortgages in Spain

They are more expensive to set up but the in-terest rate is lower than many other European countries so you win in the long-term. “Foreign-ers” usually receive 60 to 65% of the bank valu-ation of the property, or the selling price, which-ever is lower. This means that you have to fi nd 35% to 40% of the price of the property plus the costs of the mortgage: plus a bank valuation ap-proximately 0.1% - 0.15% until 300k euros prop-erty value, Once the valuation exceeds 300.000 euros the base rate increases and the valuers charge more, 1% of the mortgage value for the arrangement fee, 0.3% notary fees for the mort-gage and 0.3% land registry for the mortgage, plus any other lenders fees imposed.

3. Costs for Property Purchase

Generally you should allow 10% of the purchase price to cover the costs of the actual purchase. Here is how this amount breaks down:

Lawyer – the usual charge is 1% of the purchase price of the property to cover conveyancing, searches, contract preparation and the visit to the notary to complete the purchase. Lawyers will often offer other services such as obtain-ing NIE numbers, changing utility services to your name, opening bank accounts etc. Take care though, you do not have to use a lawyer for the extra services and can often fi nd these at less cost elsewhere. Always ask for an itemised quote before you agree to them doing this extra work and check with your estate agent for prices from other suppliers.

Taxes – Transfer taxes for a resale or a newly built property are 5%. These are set by the gov-

ernment and non-negotiable. Land Regis-try – All property transfers have to be reg-istered and this will cost about 0.3% of the purchase price. Notary – In order to be fully legal all contracts for completion of a sale have to be signed in the presence of a No-tary. Costs to the Notary will be about 0.3% of the purchase price, these costs are in ad-dition to the costs of the mortgage stated above, all funds transferred need to have a verifi able paper trail, cash transactions can-not be used.

4. What kind of a property would you like?

Start with two columns, “must have” and “would like to have”. The “must have” list will include the number of bedrooms, out-side space and other things you need for your family including proximity to schools, shops or public transport. The “would like to have” list may include things like en-suite bathroom or extra bathroom, another terrace or patio, a garage or parking area, Jacuzzi, swimming pool, tennis court etc. Would you consider renovation? If so, you would need to have two separate budgets – one to buy the house and one for the work. Alternatively, put your renovation and pur-chase budget together and buy something that needs little or no work. Make this a joint/family discussion so that everyone has the opportunity to put something on the list and little or nothing is missed out.

5. What do you want to use the prop-erty for?

If it is a holiday home you will probably want easy access and therefore will want the property within reasonable distance of the airport. If it is a permanent home then other considerations might be more impor-tant like views, size and scope to improve. If you are buying as an investment to let, you need to think about the kind of rental, i.e. Long term or holiday as again the area is important for your potential guests. You should also keep in mind that if you are buying a property that needs renovation you should try and factor in the costs for an architect and builders etc. think about the period of renovation when there will be no income from the property. 7. What legal requirements are neces-sary for foreigners?

The most important is an NIE number, this is a national identifi cation number and is nec-essary for most things you will want to do in Spain but essential for buying a house. If you are coming to live permanently in Spain you need to think about transport. Residents of Spain are legally obliged to drive a Spanish registered car with a Spanish driving licence. Although you can import your car from the UK this can be expensive and a right hand drive car is not the best thing to use on Span-ish roads, we think it is far better to sell your car in the UK and buy one in Spain. The Spanish licence is exchanged for your UK li-cence, there is no test to take. If you are in re-ceipt of a UK state pension you will be eligi-ble for free health care in Spain if not you will need to have private health insurance if you are not paying into the system by working in Spain. Once you have purchased your prop-erty you really should make a Spanish Will, whilst you are not governed by the Spanish Laws for disposal of your assets there will be untold problems for your descendants if a Spanish Will is not in place. If you still have interests in the UK you will need an English Will too, with the Wills in each country refer-ring to the other. There are many companies in Spain that will prepare both English and Spanish Wills together and give you them in both languages.

8. Taxes and Insurance?

There will be annual tax to pay on your property in Spain whether you live here per-manently or have a holiday home. These charges are MUCH less than in the UK, as an example 50 to 250 euros PA is normal to cover refuse collection and other council provided services. If you live here perma-nently you are responsible for paying taxes on your world wide assets so you need to ensure that you are not paying in the UK as well. If you own property in Spain although you are not subject to Spanish Inheritance law if non resident, it makes life easier for your descendants if you have a Spanish will.

9. What else is important?

Find an estate agent you can trust, that will offer many more services than just selling you a house. Beware of advertisements of-fering you free or low-cost inspection trips, you could pay dearly for them in the end. Reputable agents double check everything when viewing properties and when talk-ing to lawyers. Always use an English and Spanish speaking lawyer to handle your sale, there are many in Spain and although it may cost more money, it is well worth the small additional cost if only to make all the necessary checks prior to signing a contract at the notary. Please be aware, there is no such thing as a private contract in Spain, this is distinct from the one you use at the start of your offi cial purchase. In order to correctly and legally purchase a property, contracts

are signed in front of a public notary. Never accept contracts given to you that have not been checked by a lawyer, many illegal hous-es are sold that way. Don´t forget that there are also standing charges for utilities, try and budget for all of these along with your other outgoings.

10. Get Title Insurance

In order to have complete security against problems that may occur in the future when purchasing overseas it is possible to receive comprehensive title Insurance. Although a rare occurrence, this protects the buyer against any losses arising out of title relat-ed defects, it is valid for the total time that they own the property. Some examples of covered risks include: claims by third par-ties such as undisclosed heirs, unrecorded tax liens, errors and omissions in the public registry, alteration or loss of title documen-tation, fraud, forgery, and clerical or typo-graphical errors affecting ones title, thus affecting their investment or holiday home. Title Insurance can enable you to purchase a property for a permanent home, holiday home or investment with absolute peace of mind, It even includes payment for Legal Fees to defend a claim.

Economic uncertainty in Europe has made the role of currency specialists increasingly important to anyone mov-ing money overseas. They are no longer just relevant to businesses but also for individuals due to the signifi cant costs incurred when transferring money inter-nationally.

Those who need to move large sums between currencies can not only reduce risk by em-ploying a foreign exchange expert but actual-ly make currency work to their advantage. As the amount of the transfer goes up, every lit-tle movement in the market is magnifi ed. For example, if you were transferring £100,000 in to Euros in July last year you would only have received 110,000. Just six months later the same amount would have purchased you 121,000 – a difference of 11,000.

One common mistake made by people pur-chasing overseas property is to leave their

currency transfer to the last minute. A prod-uct, known as a Forward Contract, enables cli-ents to lock in to a favourable rate of exchange anywhere up to 12 months in advance.

Last year Sterling weakened against the Euro between winter and summer. Had a client been completing on their property in late June and decided to buy currency Forward in January, they could have secured an ex-change rate of around 1.1950. At the same time they could have made the decision to hedge their impending mortgage payments at the same rate. By doing so, a client would have given themselves the assurances they needed to aid their budgeting process. With the Pound currently strong against the Euro, largely due to the ongoing Eurozone debt cri-sis, now could be the right time to think about doing the same.

Traditionally, private individuals have used their bank for such payments but there has

been an increase in the use of specialist cur-rency brokers. Nat Davison is Head of Private Clients at Personal FX. He explains why peo-ple are seeking expert currency guidance: “Foreign exchange can appear very daunting. Our aim is to demystify the currency markets by providing an easy-to-use, proactive, mar-ket monitoring service”.

Furthermore, he highlights an issue which has particularly affected individuals: “Over the past 3 years banking institutions have had reduced revenue streams and are using for-eign exchange as a viable replacement to lost revenues. Unfortunately, the private client and the individual investor have had to bear the brunt of these charges. As such it is in the bank’s interest to make a substantial margin to justify undertaking the transaction. We only deal in physical foreign exchange delivery for our clients and consequently our overheads are far lower. This enables us to pass on far more attractive prices to our clients”.

This issue we talk to Brian and Janet Davies from Cheltanham, who have recently purchased property in Costa Teguise, Lanzarote. So de-lighted were they with the help and services of Location Properties owned by John Walsh and his wife Stephanie as well as sales consultant Laura Sweeney that they also took a step fur-ther and decided to buy the one next door.

Janet is 63 and a retired Speech specialist and teacher, she is married to Brian aged 73, a Space Engineer. The couple fi rst came to Lanzarote separately with their late spouses back in 2000. They returned to the Island together as a cou-ple in September 2010, where they fell in love with the Island and fi rst started talking of buying a property here. Although they had traveled to other Islands it was Lanzarote where they chose as a place to make a second home. Both enjoy the laid back feel the Island provides as well as the Cesar Manrique inspired style. Anyone who knows Lanzarote will agree that it lacks high-rise hotels, thus maintaining the Islands charm, wonderful light and landscape. It was these at-tributes that made Janet & Brian want to make enjoyable holidays to this magical Island more lengthy and permanent. Purchasing a property made sense, they were in the fortunate position of not needing a mortgage and loathe leaving the money diminishing in the bank with low in-terest rates. A wise property investment, which would fulfi ll their lifestyle, seemed the sensible way forward.

Janet and Brian decided to come to Lanzarote for a weeks visit to fi nd a property, they arrived on a Thursday and within just 48 hours walked into an apartment on Los Molinos complex and found exactly what they were looking for. They thought about it overnight, put in an offer on

Sunday, by Monday it was accepted and the process was in motion. Janet continues in her own words ¨We came upon Location Properties by chance and thank goodness we did! . I believe things happen for a rea-son and having not had much luck with other agents we saw a For Sale sign at Los Molinos from Location Properties and as we liked the look of the area we went into the offi ce and met John Walsh and his love-ly wife Stephanie who couldn’t have been more helpful. Prior to their visit, naturally the couple was a little anxious about buying over-seas in a county where they did not speak the language. They had heard that buying overseas was not always plain sailing and had their doubts. However, this was where Location and especially John were marve-lous. They explained the entire purchase process in terms they could understand and helped them every step of the way and beyond, thus eliminating any doubt.

All the fi nances and paperwork went through like clockwork due to an excellent Lawyer and John as intermediary. So stress free was the purchase, that when the prop-erty next door came up for sale, it was John they chose again and decided to buy a sec-ond one. plication. They have chosen to use the fi rst property for themselves and family to enjoy and the second as a rental investment.

There really were no surprises, we were told we would need to account for 10% expenses, including taxes and notary fees on top of the asking price and pleasantly it worked out slightly less. Stephanie dealt with all the wa-ter and electricity connections, all paperwork was put into our name, and we were given copies of everything through out the proce-dure. Buying a property overseas with the help of an excellent agent, made it far less diffi cult than we could have imagined.

Since they bought last year they have al-ready been out several times and at present they have been here since mid December and are retuning back home in February, with another trip to look forward to in May. Janet continues ´We already feel part of the los Molinos community as there is a local on site pub ´The Mill´ which has been so wel-coming together with the Terrace cafe so

it feels like a home from home. We love it and plan to spend as much time here as we can. Friends and family will join them when they can and share the enjoyment and hope-fully the second rental property will pay its way. ¨We love the Island and people and it is amazing to think we are only 4 hours from the U.K to sunshine says Brian

With the market in 2011 driven by the ongo-ing economic crisis and political unrest some property owners have benefi tted while oth-ers have been left out.

A common feeling amongst those asked is that of impotence: an inability to predict what 2012 will be like, uncertainty as to where to market their property, and a sense that the ‘old style’ tourism market has changed for ever.

With future tourists reporting a desire to ‘do something different’, to get ‘more for their money’, and “not just sit around on the beach” on their next holidays, the Face of Tourism is without doubt changing.

Traditionally we have seen holiday property owners renting out their properties to what we would all recognise as ‘traditional tour-ism’: two weeks of sun, sea and sangria. Many have taken the time to furnish and equip their properties to enhance the holidays of these tourists, but with the changing face of tourism that we are expecting to see in 2012 that may not be enough to make your property stand out attract the more niche minded tourist.

The concept of Sustainable Tourism is not new with the World Tourism Organisation defi ning it as when development meets the needs of present tourists and host regions while protecting and enhancing opportunities for the future.

Perhaps the most recognisable form of Sus-tainable Tourism to emerge in recent years is that of Cultural Tourism the subset of tourism concerned with a country or region’s culture, specifi cally the lifestyle of the people in those geographical areas, the history of those peo-

ple, their art, architecture, religion(s), and other elements (Wikipedia).

Cultural Tourism gives visitors the opportuni-ty to understand and appreciate the essential character of a place and it’s culture. A far cry from two weeks on the beach doing nothing, but a signifi cant opportunity for the holiday property owner.

Culture and tourism were two of the major growth industries of the 20th century, and to-wards the end of the century the combination of these two sectors into ’cultural tourism’ had become one of the most desirable de-velopment options for countries and regions around the world.”

Likewise Residential Tourism, a new term for many, which fi rst started to achieve promi-nence online as far back as 2006. At the time it was used generally to describe the thousands of families who moved away from their home country each year, but it quickly became the term used to describe second property own-ers who used the second property for a holi-day.

Tempting as it may be to assume that this relates to foreign visitors, it in fact describes equally well those nationals who have a sec-ond property.

It is common place for a young Spaniard to purchase their fi rst property in the location that they intend to spend their annual vaca-tions and eventually retire. They will rent properties throughout their careers as and where their jobs take them, returning for pub-lic holidays, August, long weekends and the like to their second property.

These are as much a residential tourist as the British person who has bought their ‘holiday’ home in the sun for frequent visits through-out the year, and eventual retirement.

Sustainable Tourism is generally grouped into three types of tourism (Green, Eco and Rural), and comprises:

1. Research where your property is located with a view to identifying the varying types of tourism it will attract.

2. Include the relevant keywords in the de-scription for your property.

3. Consider the age profi le of future tourists as those with the disposable income AND an interest in a specifi c niche are more likely to be the older generation (the Natural and Cul-tural Heritage Report predicts a decline in the under 50 age group and an increase in the over 50 age group by the year 2020)

4. Consider equipping your property with amenities and information relating to specifi c types of tourism.

Have you ever withdrawn money from an ATM at a Spanish bank and been asked whether you want to be charged in Pounds or Euros? This is a common practise at many banks which confuses tourists. Many select “Pounds” when forced to choose but this is in fact the wrong choice. Always choose Euros!

This is a very sneaky manoeuvre known as “dynamic currency exchange” which allows overseas retailers to get away with adding fees to foreign credit card holders by using a terrible exchange rate. Selecting Euros as the charging currency means that you’ll get the exchange rate used by your UK card issuer which will be a lot better.

And whilst we’re on the subject, what card do you use to make these withdrawals from the

ATM? It seems to be fairly common knowl-edge that using a credit card to withdraw cash from an ATM incurs a commission. However, few tourists seem to realise that they’ll often be charged the same commission of around 2.5% for making cash withdrawals abroad with their debit card!

To add insult to injury most of the UK’s big-gest high street banks then add on an ad-ditional charge of around £1.50 every time you withdraw cash from an ATM abroad us-ing your standard debit card. These banks include Halifax, Lloyds, NatWest, RBS and Santander. Using your debit card directly for

purchases whilst abroad is another expensive mistake as such transactions will incur the same “loading fee” of around 2.75% which applies to credit cards. You won’t necessar-ily notice this fee as it’s hidden within the ex-change rate.

So what’s the best way to minimise these hidden charges?

The best solution is to get yourself a Euro Currency Card which you load up before trav-elling then use abroad.

These cards help you avoid unnecessary charges and offer some of the best exchange rates around. Specialist companies such as Fairfx and Caxton offer better terms on their currency cards than the likes of Thomas Cook who tend to offer a worse exchange rate when loading up your card.

We all have an opinion about the value of a property, especially when it’s ours, and that’s the problem! It’s the value that a prudent, knowledgeable buyer will put on it that’s important.

Homeowners, mixing emotion and ego (and sometimes desperation) plus the money they have spent on it, into the equation, will fa-mously tend to overvalue their property. An agent may go along with this to get the list-ing, but reality strikes when the buyer’s list what can be bought elsewhere and the bank won’t give a big enough mortgage at that price.

Therefore, it is important to bring in an inde-pendent, experienced professional specifi cal-ly trained to accurately value individual

Bearing in mind that cost does not equal value, a starting point can be the cost of land plus construction plus charges for taxes, per-missions, professional fees and, often forgot-ten, the cost of fi nancing the land and con-struction when it’s being built.

Obviously in practice these factors are vari-able depending on the market and the indi-vidual property.

Land cost – if this can be registered for uses other than merely residential, the value may be greater

Desirability of the location and technicalities such as ease of access and availability of ser-vices will also affect the price.

Construction – the cost of this can vary con-

siderably. At times of high demand the cost of materials and labour charges will increase. However, during periods of economic crisis the cost of getting work done will be notice-ably lower.

Permissions – these should be relatively constant.

Recompense for the hassle and risk of con-struction – it takes a long time between buy-ing the land and getting the permission to oc-cupy the property and there has to be some recompense for that.

However, if there is a similar property that is being offered at a lower price, the ‘builder’ has two choices – either drop the price and accept less recompense or hold on and hope that the cheaper properties will be sold, demand con-tinues and thus the house becomes the best that that price can buy. In a falling market, as we’ve had for a few years in Spain, many have been caught out and ended up chasing the market down, dropping their price even-tually, but always fi nding somebody willing to sell a similar property at a lower price.

As with choosing a life partner, the attractive-ness of any given property is in the eye of the beholder! That is why property (we do not ‘value’ life partners!) can only be valued on a comparative basis, with the valuer judging, from experience, how the average buyer and seller, the ‘market’, will react at the time of the valuation. The Royal Institution of Chartered Surveyors’ (RICS) defi nition of market value is: ‘The estimated amount for which a prop-erty should exchange on the date of valuation

between a willing buyer and a willing seller in an arm’s-length transaction after proper marketing wherein the parties had each acted knowledgeably, prudently and without com-pulsion.’

A professional valuer forms an opinion of value based on what else the buyer could do with the money; what other property could be acquired for the same investment and how does this particular property relate to all the others on the market? If there are more buy-ers with fi nance and willingness to purchase than there is available real estate, there will be strong competition, with the ‘winner’ be-ing the one who offers the highest price.
