Course Objectives and Description:
The primary objective of this course is to provide students with a firm grounding in the
fundamentals of Canadian criminal law, both substantive and procedural, as preparation for
practice. The course will examine the role of counsel, how a prosecution unfolds, and the core
legislation and common law relevant to each stage. Students will learn to identify the elements of
a criminal offence and common defences, and burdens and presumptions relevant to their
application. Students will also explore how courts apply the Canadian Charter of Rights and
Freedoms to strike down law, exclude evidence, or provide for other remedies.
