CAN MY SPOUSE DENY VISITATION IF I AM NOT PAYING

CHILD SUPPORT?

I cannot pay child support but I want to see my child!

My ex-spouse refuses to let me see my child because I am behind on child

support payments

What can I do?

Kentucky Child Custody

If parents cannot agree on a custody arrangement, the family court will make

the decision or them

Family Court Judges decide child custody by using several factors

outlined in Kentucky Revised Statutes 403.270

The overriding factor is what will be in the best interest of the child

Visitation Orders

It is important for the child to maintain a close relationship with

both parents after the divorce

This is in the child’s best interest with very few exceptions (i.e.

abuse)

If the court awards sole custody to one parent, the court will order visitation for the non-custodial

parent

This ensures that both parents continue to play and active role in

the child’s life

Kentucky Child Support

In addition to maintaining a close personal relationship with their

child, both parents have an obligation to support their child

financially

Child support is calculated based on the Kentucky Child Support Guidelines

This provides statutory guidelines for calculating the amount of child support each parent should contribute based on his or her

income

The non-custodial parent pays the custodial parent the amount of child support calculated using the Kentucky Child Support Guidelines

Three Separate Issues

Child support, custody and visitation are viewed as three separate issues by the family

court

Non-payment of child support and denial of visitation are both detrimental to the child

The court will not permit the custodial parent to deny visitation based on non-

payment of child support

Failing to pay child support and failing to abide by the terms of a visitation order are both acts that could result in sanctions by

the court
