    A Cambridge University librarian has been left devastated after the Home Office labelled his marriage asham and forced his wife to remain in China.

    David Rushmer, 48, met Wang Xiang online in June 2012. She was in Britain on a dependant visa withher ex-husband but that marriage fell apart six months after their arrival.

    The 39-year-old Chinese national applied for a new visa and was told it would take up to three months toprocess - but was still waiting more than a year later.

    Forced to live apart: David Rushme r, 48, met 39-year-old Chinese national Wang Xiang

    online in June 2012

    During that time she met Mr Rushmer and five months later they decided to move in together. But inApril last year they were left heartbroken when Miss Xiangs visa application was refused.

    Mr Rushmer decided to propose and they tied the knot two months later in China and prepared to moveback to the UK as a married couple.

    'Devastating': Mr Rushm er has launched a campaign to over turn the Home Office's

    decision after going six months without seeing his new wife

    But their dreams were shattered when the Home Office blocked Miss Xiangs move for a second time -allegedly saying they did not believe they were in love.

    Mr Rushmer has launched a campaign to overturn their decision after going six months without seeinghis new wife.

    He said: It's devastating. We are newlyweds and we are being treated like criminals. That is the bottomline. They are suggesting my wife has attached herself to me with the sole intention to gain a UK visa.

    'The excessively harsh new UK spouse visa rules have recently torn thousands of families apart. TheHome Office confirmed that we do meet these requirements, but we were stunned that after a four-monthwait and an interview, my wife has had her visa refused.

    They are saying the love we have shared over the past year or so is not genuine. Therefore we areliars, criminals, and so are my parents and all our friends who testified that we are very genuine, and soall our plans for our future happiness are on hold again.

    Mr Rushmer claimed Miss Xiang attended an interview in Beijing - 1,000 miles away from her home inChina - where she was questioned about the relationship.

    She also had to submit wedding photos, records of phone calls, bills and pictures of their engraved ringsto Home Office officials.

    The couple launched a petition which attracted almost 1,000 signatures in ten days as part of theirappeal but they have received no indication the decision will be overturned.

    The Home Office has not yet responded to a request for comment.

    The UK government does all i t can to give you hard time if you wish to marry a none EU citizen it cost me over 7000

    when I married my american accountant wife I and her were forced to leave this country to marry in the USA as we told

    she could not change uk visa to a dependant visa here so were foced to spend six months in the states waiting for a UK

    dependant visa.

    It is very difficult for a foreigner to get a work permit in China unless you have an employer to hire u & support your visa.

    China never has shortage of librarians. Chinese embass y will give David a 6 month tourist visa wi th multiple entries

    that's the bes t Mr Rushmer can get. Hope this ans wer those think David should go to China. Moreover, I know this

    couple. David and Xiang both are audiences to our festival. They came to our event when Xiang gave talks about Chines e

    ind documentary films,literature and social issue. Xiang is a writer and columnist of a few Chinese news paper on film

    and literature. She wrote a 200 year anniversary long article about Charles Dickens and publis hed in a famous Chinese

    news paper last year. She has alsopublished a few books. She is talent that UK should welcome. David and Xiang are

    soul mate and true love. My colleagues and I all remember this lovely couple who have so many things in common.

    Home office is very wrong on handling this case.

    be able to teach Mandarin in schools. (Investing in her at her age would be cost effective) We are short of experienced

    teachers in that language. It is a language the government is trying to develop as China wil l be an important trading

    partner, while at the same time doing nothing to stop immigration by those who will contribute very little to the economy.

    I am an Immigration lawyer of 10 years and would love to take up some of these unsuccessful cases!! I would have a

    field day in court with the Home Office, who obviously cannot recognize genuine cases from fake ones.

    My colleagues and I know David and Xiang. We shown a documentary film made by her in our fes tival and invited Xiang

    to give talks at our event in Freeworld Centre, King's College London and Goldsmith College. She is a wonderful writer,

    film critics and made two films. David came to our events with her. My colleagues and I can see the love between them.

    Xiang told us her happiness of meeting David. They have so m any things in common that both love books, reading and

    writing. They are soul mates and true love. I was shocked and sad when I rang David asking if Xiang and him would like

    to come to our event, but was only to find Xiang was forced to leave UK. The way Home Office treats this lovely coupleand the case is totally wrong.

    To all the people saying "why not go and live in China?', do you know how stupid and unfair that sounds . 1. I imagine his

    Chinese wife speaks English and he doesn't speak Chinese. How easy do you think it would be for him to find work in

    China? Eh? 2. Imagine China also became as s trict and discriminatory about family migration as the UK currently is, in

    its pandering to intellectually challenged voters. Why should one country have to accept them because the other country

    won't? 3. Finally, did you know that the UK allows EU citizens with non-EU spouses into the UK with no income

    requirement of 18600, no life in the UK test, no citizenship test? Rather, it punishes its own citizens - UK citizens - by

    barring their non-EU spouses , while allowing in any other EU citizen with their non-EU spous es. I'm jus t glad I live

    abroad now. Let the UK be full of romaniams who have no ties to the UK, while forcing educated UK citizens with non-EU

    spouses to get out and use their skills elsewhere.

    recently, a major clearance was done of some very corrupt individuals . Because of these individuals, some of my very

    hard working friends had to resubmit applications at considerable cos t, having already done so previously, and which

    I am Australian, I could not get a spous e visa despite my husband being someone who works 50+ hours a week,

    despite me having worked in the UK previously, despite having paid taxes here, despite us never claiming a penny of

    benefits, despite his daughter living in the UK, we were forced to move to Europe. Spent thousands of euros there to do

    so and paid into their tax system rather than Britain's. We moved back under EU law, this was the only way for us to s tay

    together as a family. Did I mention we saved thousands of pounds in visa fees? This isn't about immigrants being a

    drain on the public purse, it is plain discrimination against British citizens! We would have moved to Australia in a heart

    beat if it were not for his daughter as it's not fair for her to be without a dad. I feel for David and his wife, I hope someone

    sees sense soon and they get the outcome they deserve. How dare the UKBA say that they are not genuine! I would be

    absolutely livid.

    The problem for this couple, amongs t many others in "genuine" relationships, is that there are countless fake marriages

    or partnerships out there and this fact spoils it for anyone else in a real relationship. The sad thing is that the fakes get

    away with it and genuine couples have difficulties proving they are not fake. This is a systemic problem that needs to be

    addressed, intelligently, but that's probably asking too much.

    The rules are more interesting: any EU national can come and live in Britain and get a free visa for his wife, no matter

    where she is from. UK nationals cannot do that, unless we move to another EU country and live there. If we bring a wife

    to the UK who was born outside the EU, we have to pay around 100 a year for a visa, and the visa process can take

    months as well as being highly intrusive. This can go on forever if the wife does not learn English better than the average

    15 year old Britain, even after the couple have a family born and raised in the UK. Unfortunately many countries, including

    China, Russia and Nigeria make it imposs ible for Brits to get passports, so one has an indefinite number of annual

    visas even if one goes and l ives there. A real mess , but one where non-Brits from the EU get a much better deal than

    Brits.

    My wife also Chinese is not allowed into the UK despite from her previous marriage to a Brit she had residency which

    was revoked after her divorce after 7 years marriage. We live in China now. Some pos ters here miss the point when

    asking why doesn't he go to China - he's British and should have a right to marry who he wants and live in his own

    UK but God help a Brit who marries a foreigner. If he transferred his as sets to China the UK will confiscate them until he

    proves why he should have them as the UK considers China a security risk

    My wife is chinese and we had no problem getting a visa for her. We had an engl ish wedding and attended the visa office

    together, while we didn't do anything different from normal, i think it was obvious that we were a couple to them. A few

    seats down from us, was a mid 50s man with a 22 year old Thai bride, didn't touch, kiss , hold hands or talk much. Kinda

    obvious i t was a sham marriage. If he is s till here and she isn't, then i don't think it's a real marriage, otherwise he would

    have moved over to China, they are always eager to hire english workers.

    Who did she marry in order to gain access the first time round? I'd hardly call s ix months in the UK a long marriage, so I

    can understand scepticism here. Why doesn't he go and live in China and get a job there?

    Have they considered that UK authorities confiscate and put into holding accounts any money you try to transfer to China

    - because you then become a possible enemy of the UK for marrying a Chinese women and then going to live there.

    This is what happened to me so don't think it is easy going to China as your own country then treats you as a traitor.

    My wife is Guyanese. We met in the UK in 1974, married after three years and didn't worry about the pass port nonsens e

    for 16 years. Then matters 'Hong Kong' forced a change in the law and we had to apply for British Nationality. Whilst we

    had no problem s getting that [by this time three children] the Home Office took their time processing the application,

    hanging on to our passports and other important papers for over two years. I agree that the authorities need to curb

    sham marriages but they don't half have a funny way of doing it. Good Luck to Mr Rushmer; I think his wife is a stunner.

    When I applied for my passport 19 years ago after marrying my English husband, an Indian woman, by her strong

    accent, told me to go back to China. My English was far better than hers and I struggled to understand her, but there shewas urging me to go back to China and refusing me the passport. My husband filed a complaint with her manager

    immediately and passport arrived within a week. There are some crazy immigrants working at the Border agency have

    very little skills and yet they are employed to deal with complicated is sues due to positive discrimination for them. They

    would issue passports to their own people with a drop of a hat while refusing legitimate applications from other foreign

    nationalities. To this day, we still wonder how the Indian woman has got the job or the British pass port in the first place.

    My husband paid a fortune for his visa etc to come and live in the UK with me. Had the marriage not las ted and he met

    som eone els e over here, why should he have expected to stay in the UK? Same for applies for me if it was the other way

    around. The rules are there for a reas on. Too m.any people in the past have cheated the system. If you don't like it, live inthe country of your spouse or don't marry a foreign national.

    Unfortunately, brides from countries such as Thailand, China and the like have a lot of women desperate to settle in the

    West and who will latch on to the 1st Western male usual ly past his best and desperate. Some marriages work but

    som e break down once the women has achieved her objective of a British passport or permanent residency. In thiscase, I can see why the Home Office is s uspicious as the lady in question seems to move on rather quickly from one

    man to the other in a very short space of time - red flags up for sure. If the man is truly in love, I'm sure a few months in

    China would help convince the authorities that this is a genuine relationship.

    We certainly don't look after our own do we? This new ruling for Brits wanting to return to UK with their wives is a disgrace

    especially when others are being allowed in wi lly nilly. If you are a UK citizen you have NO RIGHTS. Abolish this stupid

    rule for British citizens now. Could it be classed as dis crimination I wonder?

    Immigration authorities can make decisions which seem bizarre. Thirty years ago, my wife was barred from the UK, and

    her passport s tamped to that effect, because she truthfully stated that we intended to get married. The senior officer

    stated that he needed to keep out economic migrants. At the time, England was in financial s traits and Switzerland ( my

    wife's native land ) was the richest in the world. She was s hipped back to the Continent between two burly police officers,

    and I was barred from taking the same ship back.

    Is there som ething stopping him from relocating to China to be with his wife? Have they looked in to relocating to a 3rd

    country. She is not trapped in China. She is just barred from entering the UK. Neither is bring branded a criminal - they

    jus t do not qualify for her to come to the UK at this time. If he loved her that much and wanted to make a go of the

    marriage then he would move to China to be with her, or take a job with the FCO or some other NGO overseas in a

    country where they could be living together. Give the immigration staff good reas on to believe that this is a committed

    relationship. At present - not having seen his wife in 6 months does seem rather suspicious - If I loved som eone enough

    to marry them so quickly, and they were barred from entering the UK, I sure wouldn't wait 6months, I'd be upping s ticks to

    relocate so I could be with them. Otherwise what's the point in committing to a marriage?

    Play by the rules and don't expect an imm ediate decis ion. If your application has all the requirements then there is no

    reason for a refusal. The case in the DM article does give rise for the Home Office to question how genuine the marriage

    is based on the brides history.Perfectly understandable. The groom is pursuing the case as entitled

    fro no apparent reason. I spent thousands of pounds on lawyers trying to overturn the decision, to no avail. She obtained

    Spanish residency where we lived for over she two years, but still could not get a UK visa! We now live in Thailand, and

    although my daughter and grandchildren live in the UK where I was born, I NEVER want to set foot in the UK again! I

    hope the country is totally swam ped with Romanians and Bulgarians!

    This is nothing new, even for a partner to vis it on tourist visa, I have been with my Philippine partner for 5 years travelling

    3 - 4 times a year to the Philippines since meeting, And spending. Half my life there. Yet border agency say we do not

    have a relationship. (Photos together over 5 years are believed faked!). Wanted partner to vis it UK to meet my family and

    seriously ill mother was refused, Border agency say they dont believe we have genuine relationship and my partner just

    wishes to remain and work in the UK. I am a disabled war pensioner and as a result of this decision am forced to make

    this regular long and painful journey to be with my partner.

    I don't mean to be harsh but we often read about people being duped jus t to obtain a visa. It happens to both men and

    women and normally involves older people and younger brides / husbands . So it begs the ques tion, how old is your

    partner? She just wants to remain and work in the UK? I bet that she does .

    Aye, the UK Border Force (Farce) really know how to foul things up. Rules are rules they say, like my wife of 12 years stil l

    has to do the compulsory 2 years s pouse visa because we have not lived in the UK during the period of marriage, dolts.Now if the chap in the s tory just moves to another EU country his wife, no matter what her nationality, will have automatic

    residency rights there. Might as well jus t do it and then commute afterwards.

    The Border Agency only applies the rules as laid down in Parliament. It is MPs who make the law. Blame them and not

    the hard pressed Border Agency staff who are blamed if they do and are blamed if they don't.
