This addendum consists of this three-page transmittal and 2 attachments of 8 pages. Bidders are hereby notified of the following changes: I. MODIFICATIONS TO BID PROPOSAL: 1. ADD to the Bid Proposal Part I, Page 1-13 entitled “PROPOSED/SELECTED UV NaOCl AOP INFORMATION SHEET” (1 page). Provide the Proposed/ Selected UV NaOCl AOP in the aforementioned Information Sheet (see attached Page 1-13). Must be submitted with the Bid Proposal. the general arrangement, model number, number of duty, number of standby for 100% redundancy, number of lamps, and number of ballasts. The two pre-approved manufacturers are Trojan Technologies and Wedeco-Xylem, Inc. The information submitted shall also explicitly state the total number of lamps (duty plus standby), power per lamp (W), total power input (kW) for the system (duty plus standby), and total number of ballasts for the system (duty plus standby). The information shall be submitted to the CITY by October 31, 2014. UV NaOCl AOP MANUFACTURERS whose UV AOP system cannot be validated to meet the maximum design requirements will be disqualified and will not be allowed to be used by the Design-Build entity as their selected UV NaOCl AOP MANUFACTURER. Based upon acceptable proof of validation, the CITY will issue an Addendum stating which UV NaOCl AOP MANUFACTURERS and corresponding UV system sizing are acceptable a minimum of 7 days prior to the opening of the bid. This information is then to be included on the revised Schedule of Work and Prices form which has been modified as part of this Addendum.”

III. QUESTIONS FROM BIDDERS (Q) AND ANSWERS FROM CITY (A): (Q1): From the first look at the documents it appears that the team consisting of Engineer and Contractor at its discretion may or may not use an OEM. I am feeling a little puzzled at this situation as each of the three qualified teams were qualified with an OEM. This leaves the issue of OEM participation wide open. The GCs can change the OEM or not use the OEM and complicate the spirit of working as a team. I have not raised this issue with the team. I plan on attending the pre-bid meeting tomorrow and do not intend to raise this issue. I would appreciate your comments.

As you may know, in the original project the specifications required that all work related to the RO system must be performed by qualified OEM and we executed the contract on a turnkey basis.

(A1): Prequalified are DB Teams; Contractor and its subcontractor the Design Engineer and the OEM packager. Clarification provided in this Addendum. (Q2): Thank you very much for clarifying the OEM participation issue during the prebid meeting. I think the next step would be to make sure that the team assigns the scope of work to the OEM with which the City feels comfortable with. If left to the GCs the GCs would like to do a great majority of work in house. For the existing system the specifications were very clear and they required the entire system similar to section 11960 to be procured and installed by qualified OEM. The GC and H2O Innovation complied with it in its entirety. No exceptions or deviations were sought. The specifications issued for the expansion have no such requirement. My suggestion is that GCs should be required to procure a certain minimum scope of work from an OEM so the integrity of the system is maintained and OEMs who are in the business of providing membrane systems are responsible for that scope of work. Having said that I would think with the exception of the following items that GCs can take upon themselves the rest of the equipment in Section 11960 should be provided by an OEM. OEM to include supervision of installation and commissioning services in its scope. In addition OEM should be required to provide supervision of installation and be responsible for process and secure the specified membrane warranty.

These are high value items that are integral to the RO system and OEM can assist in the procurement process. I think the proposed scope split would be acceptable to the qualified teams. It will also result in the level plain field for all three teams. But I have not discussed it with our team. (A2): General Contractor is responsible to comply with contract documents and the division of work with its subcontractors. (Q3): During our last meeting we had with the City, which we discussed the parameters of the Honeywell Contract, we also discussed an appropriate bid window for the bidding of the Terminal Island Project. My recollection of that specific conversation was that the City would afford the DB teams a 10 to 12 week bidding period for Terminal Island AWTP, with the aforementioned project bidding sometime after the Thanksgiving holiday weekend. Currently, we are being afforded approximately a six plus week window for bidding the project, which puts the bid date prior to the Thanksgiving day holiday weekend. Is there a specific reason why the bid schedule has accelerated? The revised bidding window is very aggressive for a DB Contract. (A3): No change to Bid Opening date.

IV. MISCELLANEOUS: Attached are the Sign-In sheets for the Mandatory Pre-Bid Meeting on October 7, 2014 at 1:00 p.m., at Public Works Building, 1149 S. Broadway, Sub-Basement Conference Room 6, Los Angeles, CA 90015. (7 pages).

CONTRACTOR shall include on this form the proposed/selected UV NaOCl AOP MANUFACTURER. The information included on this form shall match the submittal provided by the CONTRACTOR by October 31st and as validated by the City.
