INTRODUCTIONThemissionoftheOregonDepartmentofAgriculture(ODA)NaturalResourcesProgramAreaistoconserveandprotectagriculturalnaturalresourcessothatagriculturecanbeproductive,economicallyviableandmaintaincompliancewithenvironmentalrulesinOregon.AspartofprotectingOregon’snaturalresources,theOregonLegislatureestablishedaspecialregulatoryprogramforConfinedAnimalFeedingOperations(CAFO)in1989.ThelegislationrequiredtheOregonDepartmentofEnvironmentalQuality(DEQ)toissueCAFOpermitsanddirectedODAtoinspectCAFOfacilities.In1993,theCAFOstatuteswereamendedtodirecttheEnvironmentalQualityCommission(EQC)andODAtoenterintoaformalmemorandumofunderstanding(MOU).TheMOUauthorizesODAtoperformtheCAFOrelatedfunctionsofDEQandtheEQC.ODAhascontinuedtooperatetheCAFOPrograminconcertwithDEQunderthisMOU.ThemostcurrentCAFOProgramMOUwassignedonDecember23,2015andexpiresDecember31,2020.ThisreporthasbeenpreparedasrequiredbytheMOU.The2016CAFOProgramAnnualReportdescribestheCAFOProgram’sactivitiesthathaveoccurredoverthelastyear.Thereportincludes:

InspectionTypeTheCAFOProgramconductsmultipletypesofinspectionsonpermittedandnon-permittedfacilities.Thevastmajorityoftheinspectionsconductedareroutineinspectionsofpermittedfacilities.Routineinspectionsareusedtoassessthefacility’scompliancewithpermitconditionsandstatewaterqualitylaws.In2016,thefifteenthyearofperformance-basedinspections,CAFOProgramstaffcompleted765inspectionsofalltypes.Theseinspectionstookplaceonbothpermittedandnon-permittedoperations.53complaintswerereceivedin2016,39ofthesecomplaintsresultedincomplaintinspections(CI)withvariousoutcomes.The14complaintsnotresultinginaninspectionweretransferredtootherprogramsoragenciesortheyweresolvedoverthephone.Belowisalist,anddescriptions,oftheinspectiontypescompletedbytheCAFOProgram.Table4alsoprovidesasummaryofthenumberofinspections,bytype,completedduring2016.

• Administrative(ADMS):Businesstransactioncompletedintheoffice.• CloseOut:Afinalfacilityinspectionconductedtoassessifthepermittedfacilityisappropriately

preparedtopreventdischargeduringapermittransferorpermitcancellation.• Complaint(CI):Complaintinvestigationsforwaterqualityconcernsonpermittedandnon-

permittedanimalagriculturefacilities.• DriveBy:Avisualinspectionofafacility(permittedornon-permitted)frompublicaccess.Contact

isnottypicallymadewithlandownerofthefacility.Typicallyusedwhentheprogramreceivesacomplaint.Thedrive-byallowsforaquickassessmenttodeterminenextsteps.

• EducationalReview(EDR):RequestedbypermittedCAFOoperators,LWQSdiscussesperformancestandardsandbestmanagementpracticesforenablingproducerstoattainpermitcompliance.LWQSmayalsoevaluatenewproposalsfromproducers.AnEDRisnotaformalinspectionandgenerallywillnotresultinenforcementaction.

WaterSamplingCollectingwatersamplesisanothertoolthatisutilizedbytheCAFOPrograminordertoassesstheoperator'scompliancewiththeCAFOpermit.WatersamplesaretypicallycollectedwhenCAFOProgramstaffvisuallyobserveanactivedischargeorsuspectsarecentdischarge.In2016,therewereatotalof17samplingeventswithnineofthesamplingeventstakingplaceduringcomplaintinspections,oneoccurringduringaeducationreviewinspection,twocollectedduringfollow-upinspectionsandfivecollectedduringroutineinspections.Atotalof43sampleswerecollectedinthe17samplingevents.13ofthe17watersamplingeventswereconductedonpermittedCAFOfacilities.SeeTable12onpg15forNon-Permitted.SeeTable9forasummaryofthewatersamplingeventsthatoccurredonpermittedfacilitiesbyarea.

CAFOAdvisoryCommitteeEachyeartheCAFOProgramholdsthreeregularlyscheduledCAFOAdvisoryCommittee(CAC)meetings.TheCACwascreatedtoprovidefeedbacktothedepartmentabouttheCAFOProgram.ThemembershipofthecommitteeiscomprisedofpermittedCAFOoperators,technicaladvisors,stakeholderrepresentatives,andthepublic.

NewCAFOProgramActivitiesTheagricultural communitycontinues toembraceand incorporatenewtechnology into theiroperations.Technologies that impact nutrient management, include, but are not limited to, low-pressure manureapplication systems, manure digesters with off-farm feed stocks, and robotic milking equipment.Whenthesetechnologiesareincorporated,itrequirestheCAFOpermitregistrant’sAWMPtoberevisedtoreflectthese changes and additions. Staff must review these AWMP updates to ensure that the technology isaccuratelyrepresentedandintegratedintowastesystemcalculations. SubstantialchangestoAWMPs,asdefinedinthepermitshavepublicnoticeandparticipationrequirements.

Historically,theCAFOProgramhasreceivedtheoccasionalodorcomplaintgenerallyfromnon-agriculturalneighborsregardingCAFOoperationsandpractices,bothonpermittedandnon-permittedoperations.In2016,odorseemedtobealargerconcernforaspecificagriculturalcommunity.AlthoughtheCAFOProgramdoesnothavetheauthoritytoregulatenuisanceimpactssuchasodor,theprogramwillrespondtotheconcernstoensurethatCAFOoperationsarecompliantwithPermitrequirementsandwaterqualityisnotbeingimpacted.

ODAsCitizenAdvocateandLiaison,ChristinaHigby,startedwiththeDepartmentin2016.Partofherrollistoserveastheagency’sEnvironmentalJusticeCitizenAdvocateandisresponsibleforencouragingpublicparticipation,ensuringthattheagencyconsidersenvironmentaljusticeissues,andinformstheagencyoftheeffectordecisionsoncommunitiestraditionallyunderrepresentedinpublicprocesses.EnvironmentalJustice(EJ)advocatesforthefairtreatmentandmeaningfulinvolvementofallpeopleregardlessof,race,color,nationalorigin,orincome,withrespecttothedevelopment,implementation,andenforcementofenvironmentallaws,regulations,andpolicies.EJCommunitiesincludeminority,lowincome,linguisticallyisolatedpopulations,populationsunder5andover64.TheCAFOProgramissuedapublicnoticeforaproposednewCAFOinMorrowCounty.Inresponsetothisnotice,theEnvironmentalJusticeTaskForcerequestedthatODAandDEQextendthepublicnoticeperiodtoconductenhancedoutreachtoEJcommunitiesinsurroundingareasoftheproposednewCAFO.ODAandDEQdevelopedandfollowedthroughwithanoutreachplantoassistwiththeenhancedoutreachtoEJcommunities.Severalsupportingdocumentswerealsocreatedanddistributedincludingabilingual(English/Spanish)publicnoticeandFAQflyer,bilingualpresentationsweregiven,radiointerviewsconductedandapressreleasewasprovidedtoseverallocalnewspapers.Basedonthisexperience,ODAincorporatedadditionaloutreachmethodsintoitscurrentpublicnoticeprocesstoencouragepublicparticipation,particularlytoEJcommunities.
