Tips sought in 2 violent crimesAuthorities are urging the
public to provide informationon two unsolved violentcrimes that took place inToledo.
James Whitiker, 21, was fa-tally shot about 8:39 p.m. Feb.19 as he left 1164 PinebrookPkwy. in South Toledo. Twoother gunshot victims, Don-tayveon Jones, 19, and Jona-thon Shelton, 20, were treated
for injuries, police said.Tips are sought as well in a
separate assault in NorthToledo. Carol Deshetler, 69,was badly beaten this week inthe 300 block of Amber Court.The assault occurred at somepoint between Sunday eve-ning and early Tuesday, po-lice said.
Ms. Deshetler was initiallyin critical condition at Mercy
St. Vincent Medical Center,but is recovering.
Anyone with informationon either incident is asked tocall the Crime Stopper pro-gram. Callers may remainanonymous and could be eli-gible for a cash reward.
Toledo manis chargedwith makingfalse alarms
A Toledo man has beencharged with making falsealarms through repeated911 calls.
Mark Emerine, 57, of the2800 block of Lagrange,faces two counts of the of-fense.
Police allege Mr. Emer-ine on Wednesday madeseveral calls to 911 in whichauthorities responded. Offi-cers met with the defendantand found that he appearedintoxicated, according tocourt documents.
Officers also allege Mr.Emerine called 911 on 10occasions from 10 p.m. Jan.20 to 2 a.m. Jan. 21. Heyelled at dispatchers andspoke with slurred speech,according to police.
Mr. Emerine pleaded notguilty to both chargesThursday in Toledo Munic-ipal Court and was releasedon his own recognizance.
Motion wouldquash appealof ruling on potBLADE STAFF
State and county officialswho successfully challengedthe legality of some portionsof Toledo’s “Sensible Mari-huana Ordinance” say a cityman should not be permittedto appeal a court ruling in thecase.
In a motion filed Friday,Ohio Attorney General MikeDeWine and Lucas CountyProsecutor Julia Bates askedOhio’s 6th District Court ofAppeals to dismiss the appealfiled March 24 by Chad M.Thompson, one of the au-thors of the petition that wasadopted by city voters to de-criminalize marijuana.
“As a nonparty who did notmove for and was notgranted intervenor status un-der Rule 24 of the Ohio Rules
of Civil Procedure, Mr.Thompson has no standingto appeal,” the motion as-serts.
On Feb. 12, Lucas CountyCommon Pleas Judge DeanMandros concluded portionsof Toledo’s newly enactedmarijuana decriminalizationlaw were “unconstitutionaland unenforceable.” Hegranted a preliminary injunc-tion preventing the city fromenforcing the parts of the or-dinance that he found to becontrary to state law.
City Law Director AdamLoukx, who expressed reser-vations about the constitu-tionality of the proposed or-dinance before it went to vot-ers Sept. 15, said this weekthat the city chose not to ap-peal the judge’s decision.
Woman shot in S. Toledo; police find gunA woman was shot late
Thursday in Toledo, authori-ties said.
Christina Daugherty, 20, wastaken to Mercy St. VincentMedical Center, according toLucas County EMS. A hospitalspokesman said she had no in-formation about a person bythat name.
Police responding to a re-port of a shooting arrivedabout 10:20 p.m. and foundthe victim suffering from agunshot wound to her wrist asshe stood with another personat South Avenue and SumnerStreet.
They were outside a car,which had a bullet hole in a
passenger-side window and abullet lodged in the door onthe driver’s side, according to apolice report.
Officers later recovered abullet from the ground outsidethe vehicle and a dry handgunfrom the wet ground near a ga-rage off an alley about 100 feetfrom the car.
