    OTHER PERTINENT INFORMATION: 1. A Negative Declaration was prepared

    by the Commission's staff pursuant to CEQA and implementing regulations.

    2. This project is situated pn land identified as posses·si ng environmen· ral values in that the State Lands Commission stated 411 waterways under the Commission's jurisdiction have envi~onmental signifi-cance• Staff finds this project to be .compat;ible with Commission policy.

    3. In response to Negative Declaration No. 255 the c,lifornia Department of Fish and Game maintained that the base of the subject bulkhead be situa~ed at or above the Mea~ Higher High Water line to mi~igate impacts upon intertidal habitat an,d benthic organtsms. Commission staff, based on it~ assessment of Huntington Harbor as a highly developed residential, area, finds the proposed imposition~ on the project to be inconsistent with surrounding development; and is recommending that the project proceed as originally proposed.

    4. The applicant has obtait.?r! a permit for Lhe proposed project fro~ the Coastal Commission.

    2. CERTIFY THAT THE NEGATIVE DECLARATION NO. 256 HAS BEEN COMPLETED IN COMPLIANCE WITH THE CEQA OF 1970, AS AMENDED, AND THE STATE EIR GUIDELINES, AND THAT THE COMMTSSION HAS REVIEWED AND CONSIDERED THE INFORMATION C01H'AINED TH~REIN.
