PURPOSE OF THESE BYLAWS

Purpose

These are the Bylaws of the South Australian Baseball League (SABL) Incorporated and are produced as Regulations pursuant to clause 10.4(b) of the SABL Incorporated’s Constitution.

These Bylaws establish minimum requirements for the operation of baseball competitions within South Australia and are binding on all Individual Members of the SABL in accordance with the SABL Constitution clause 5.11 and 10.4(c).

Any matters not dealt with or provided for in these Bylaws of the SABL may be dealt with in such manner as the Board may deem fit.

DEFINITIONS AND INTERPRETATIONS

Definitions

In these Bylaws, unless the contrary intention appears:

ABL means the Australian Baseball League.

Age Matrix means the Little League Baseball® organisation’s age brackets that specify which

Junior Grade a Junior Player is eligible to compete in and is contained in the SABL’s Local Paying

Rules & Conditions.

Association means South Australian Baseball League Incorporated, SABL, Baseball SA or BSA.

Australian Baseball League means a professional baseball league in Australia that is governed by

the Australian Baseball Federation.

Baseball means the game as played under the latest edition of the Official Baseball Rules, subject to

Local Playing Rules which have been determined by the SABL.

Baseball Australia means Australian Baseball Federation Limited, sometimes referred to as Baseball Australia, ABF, ABL or BA.

Baseball SA means the South Australian Baseball League Incorporated, sometimes referred to as

SABL, the League or BSA.

Board means the body consisting of the Directors.

Bylaws means any regulations or bylaws made by the Board under clause 10.4 of the Constitution.

Charter means the tournament aligned with the Little League® International organisation.

Club means a Club that enters teams in a baseball competition which is a Member of, or is otherwise

affiliated with, the SABL.

Constitution means the constitution of the SABL Incorporated.

Directors means a member of the Board.

Finals Series means post-minor round games played to determine the winner of the season.

General Manager means the General Manager of the SABL for the time being appointed under the

Constitution.

General Meeting means any general meeting of Members and includes the Annual General Meeting

or any Special General Meeting.

Grand Final means the final game of the Finals Series to determine the winner of the season.

Individual Member means a registered member of a Club who is otherwise recognised by the SABL

as an individual member.

Intermediate League means the name of the Junior Grade run for the age group specified in the Age

Matrix.

Junior Competition is the collective reference given to the competition combining all Junior Grades.

Junior Division refers to the level of teams in one particular Junior Grade, where Division 1 is the

highest ranked level of a particular Junior Grade.

Junior Grade refers to the Grade a Junior Player may be eligible to participate in, including, but not

limited to, Pee Wee League, Minor League, Little League, Intermediate League, Junior League,

Senior League and Big League.

Junior League means the name of the Junior Grade run for the age group specified in the Age

Matrix.

Junior Player means any player whose age qualifies them to be eligible to play Junior baseball

according to the Age Matrix.

Little League means the name of the Junior Grade run for the age group specified in the Age Matrix.

Little League Baseball® means a competition structure run in accordance with the rules of Little

League Baseball® which may, from time to time, be referred to as “The Green Book” as its Rule

Book is a green covered book.

Little League® International means the organisation responsible for Charter baseball. More

information can be found on their website www.littleleague.org.

Local Playing Rules & Conditions means the local rules of baseball published by Baseball SA that

govern all SABL competitions together with the Official Baseball Rules published by the Office of the

Commissioner of Baseball.

Masters means a Senior competition Division for Senior Players over a determined age.

Member means a member for the time being of the SABL under the Membership section of the

Constitution.

Minor Round means the games played to determine if a team qualifies to play in the Finals Series.

Minor League means the name of the Junior Grade run for the age group specified in the Age Matrix.

Notice means any form of communication the SABL and its Board deems fit to use to advise its

Members, Clubs and Affiliates.

Objects means the objects of the SABL in clause 3 of the Constitution.

Official means a designated role within the game of baseball that includes scorers, coaches,

officiates or manages at a game.

Official Baseball Rules means the official rules of baseball published by the Office of the

Commissioner of Baseball that Baseball SA’s competitions are governed by, together with the SABL

Local Playing Rules & Conditions.

Pee Wee League means the name of the Junior Grade run for the age group specified in the Age

Matrix.

Regulations means any regulations or bylaws made by the Board under clause 10.4 of the

Constitution.

Region means the geographical area for which the SABL is responsible and as recognised by the

SABL (which is typically the State).

Regional Baseball Organisation means a regional/country organisation that conducts and manages

competitions in regional South Australia in the Sport (and which may have Clubs and Individual

Members as part of its own membership).

Senior Competition means the collective reference given to the competition combining all Senior

Grades, including Women’s League.

Senior Divisions refers to the teams that make up the Senior Competition which includes Women’s

League.

Senior League means the name of the Junior Grade run for the age group specified in the Age

Matrix.

Senior Player means any player who is not eligible to play Junior baseball according to the Age

Matrix.

Sport means the sport of baseball, Baseball5 and t-ball.

Interpretation

In these Bylaws:

a reference to a function includes a reference to a power, authority and duty;

a reference to the exercise of a function includes, where the function is a power, authority or duty, a reference to the exercise of the power or authority of the performance of the duty;

words importing the singular include the plural and vice versa;

words importing any gender include other genders;

references to persons include corporations and bodies politic;

references to a person include the legal personal representatives, successors and permitted assigns of that person;

a reference to a statute, ordinance, code or other law includes regulations and other statutory instruments under it and consolidations, amendments, re-enactments or replacements of any of them (whether of the same or any legislative authority having jurisdiction);

a reference to ‘writing’ shall, unless the contrary intention appears, be construed as including references to printing, lithography, photography and other modes of representing or reproducing words in a visible form, including messages sent by electronic mail; and

any doubt arising as to the application or meaning of any clause or wording therein shall be decided by the Disputes & Incident Reports Panel, whose decision shall be final and conclusive.

FORMULATION, ALTERATION AND APPROVAL OF THESE BYLAWS

Formulation of Bylaws

The Board shall have the power to formulate, issue, adopt, interpret and amend these Bylaws, or, in accordance with the SABL Constitution clause 8.25 and 10.4(b), create, establish or appoint special committees, individual officers and consultants to carry out such duties and functions for which the SABL’s Constitution and Bylaws require.

Alteration of Bylaws

The Board or delegated special committees, individual officers and consultants, by instrument of writing, shall, in accordance with the procedures for delegated entities of the SABL (Constitution clause 8.25(d)), have the power to provide the Board with proposals for amendment of these Bylaws.

Alteration proposals may also be submitted to Baseball SA’s Competitions & Member Services Manager, in writing, by any Individual Member of the SABL for submission to a Board delegated special committee, individual officer or consultant.

Approval or Repeal of Bylaw Alteration Proposals

The Board shall have the power to approve all alteration proposals at a meeting of the Board which shall be decided by resolution of the Directors by a simple majority of votes of those entitled to exercise a vote.

Any such approved Bylaw may only be repealed by a majority of not less than seventy-five percent (75%) of votes exercised at any Board or General Meeting.

Communication of Approved Bylaw Alterations

Approved amendments or other changes shall be advised to Club Members and Affiliates by means of a written bulletin prepared, issued and signed by Baseball SA and updated throughout this document accordingly.

Clubs shall take reasonable steps to distribute information in the bulletins to their Individual Members. The matters in the bulletins are binding on all Members.

SPECIAL COMMITTEES

Special Committee Delegation

The Board shall, at its first meeting after the Annual General Meeting in each year, by instrument in writing, create or establish or appoint special committees, individual officers and consultants to carry out such duties and functions for which these Bylaws provide.

Formed special committees shall have a Terms of Reference document approved by the Board that includes, but is not limited to, the special committee’s purpose, term, membership, responsibilities and agreed meeting frequency.

Formed special committees shall be listed on Baseball SA’s website along with a membership list, contact details and Terms of Reference. www.baseballsa.com.au

Special Committee Responsibilities, Powers and Categories

The Board will determine what powers special committees are given.

The procedures for any entity exercising delegated power shall, subject to the Constitution and with any necessary or incidental amendment, be the same as that applicable to meetings of the Board unless otherwise noted in the special committee’s Terms of Reference document. The entity exercising delegated powers shall make decisions in accordance with the Constitution Objects and these Bylaws.

Special committees, will, from time to time, report to differing bodies, however, all special committees shall promptly provide the Board, via Baseball SA, with details of all material decisions and shall provide any other reports, minutes and information as Baseball SA or the Board may require from time to time.

Special committee requests for resolution must be submitted via Baseball SA’s General Manager to the Board in writing using the Recommendation to the Board of Director’s Form which is located with Baseball SA’s General Manager.

Special committees fall into three categories; Audit, Competitions & Pathway.

Audit Committees

Audit Committees are established to:

(i) examine areas of the SABL and conduct investigations, enquiries and research so as to assist the growth of the sport;

(ii) advise the Board of any law, event, matter or thing which in its opinion represents a breach, or possible breach, of the Constitution, these Bylaws or other Regulations;

(iii) review and audit the procedures governing the SABL’s Tribunal;

(iv) examine, review and document historical data of the SABL;

(v) examine and review player performances for award selections in line with Bylaw 15;

(vi) report any irregularity it may detect that requires refinement.

An Audit Committee’s role is to report to the Board and not to communicate opinions or findings direct to other Members of the SABL.

The Board will appoint, in line with clause 4.1(a), but not limited to, the following Audit Committees:

• Bylaw Review Committee

• Finance Audit Committee

• Competition Review Committee

• Baseball SA Awards & Trophies Selection Panel

• History/Heritage Committee

Competitions Committees

Competitions Committees are established to:

(i) interpret the Official Rules of Baseball regarding the conduct of Baseball SA competitions;

(ii) design, manage and implement procedures, issue directions and make resolutions, as far as practical, to promote a workable competition structure and a coherent set of rules across all Baseball SA competitions;

(iii) design, manage and implement procedures, issue directions and make resolutions, as far as practical, for handling disputes and incident reports submitted to Baseball SA;

(iv) design, manage and implement procedures and programs for the development and training of umpires and scorers;

(v) consider and implement any national policies as devised by Baseball Australia or any Government body.

A Competitions Committee’s role is to perform their duties in a cooperative manner with the Board, other special committees, Baseball SA, their Members and Affiliations and provide information and reports as required or instructed by the Board or Baseball SA’s General Manager.

The Board will appoint, in line with clause 4.1(a), but not limited to, the following Competitions Committees:

• Permits Committee

• Disputes & Incident Reports Panel

• SABL Tribunal

• Baseball Umpire Development Committee

• Scorer’s Development Committee

• Baseball SA Senior Competitions Committee

• Baseball SA Junior Competitions Committee

Pathway Committees

Pathway Committees are established to:

(i) develop players and coaches for the sport of baseball that are trained, accredited and experienced to the highest level possible;

(ii) develop a consistent policy regarding equipment and rules such that the best possible level of duty of care for maximising performance and minimising injury is maintained;

(iii) provide specialist knowledge to Audit and Competitions Committees regarding rules for the protection of athletes and the prevention of injury (for example, pitch counts);

(iv) select Coaches and Executive Officers for representative teams;

(v) develop and maintain pathway academies, competitions or leagues that the Board or Baseball SA may deem necessary for implementation.

A Pathway Committee’s role is to perform their duties in a cooperative manner with the Board, other special committees and Baseball SA and provide information and reports as required or instructed by the Board or Baseball SA’s General Manager.

Pathway Committee membership shall consist of not less than one (1) Baseball SA staff member.

The Board will appoint, in line with clause 4.1(a), but not limited to, the following Pathway Committees:

• State and Charter Coaching Selection Panel

• High Performance Academy Selection Panel

• Super League Task Force

• Women’s & Girls Baseball Advisory Group

RULES FOR SABL COMPETITIONS

Competition Composition

Division One Club

For a Club to participate, and maintain participation, in the SABL Division One competition it is required to fulfill the following teams:

(i) at least four (4) Senior teams which must include Division One, Division Two and Division Three; and

(ii) at least one (1) female team; and

(iii) at least four (4) teams in Junior Grades.

A Club that cannot fulfill the Division One Club team requirements in clause 5.1.1(a) will be subjected to a possible relegation to Division Four under clause 5.1.4.

Composite Teams

A maximum of one composite team in Junior, Masters, Women’s and Senior Division Four and below Grades, may be counted as one (1) team for each Club forming the composite team.

To be recognised as a composite team and be eligible under this requirement, a Club must have a minimum of four (4) players participating for a minimum of four (4) games in the current season.

Club Promotion to Division One

To be eligible to apply to the Board for promotion from a Division Four Club to a Division One Club, for a minimum of two (2) seasons prior to the application, a Club must:

(i) have had a Senior playing roster of at least thirty (30) registered players between the ages of 16 and 35;

(ii) have participated in Division Four finals series;

(iii) not have submitted any requests for Division Four Permits other than extraordinary circumstances;

(iv) have had a published sound Junior Development Plan;

(v) have had not less than twenty (20) BSA registered Tballers participating in a Club Tball Program; and

(vi) have passed Baseball SA conducted ground and facility audits.

Applications must be submitted in writing, addressed to the Baseball SA General Manager, within thirty (30) days after the scheduled Division One Grand Final and signed by the President, Secretary and Senior Coordinator of the applying Club.

On application, further selection criteria set by the League and approved by the Board, may be issued to the applying Club and be required to be met.

The Board will undertake the assessment of the Club meeting the criteria and will make the final determination.

Non-compliance

Notwithstanding any other promotion and relegation bylaws, any currently approved Division One Club not able to fulfill its team requirements listed at clause 5.1.1 at the date of assessment will be afforded a probationary period of twelve (12) months to rectify the non-compliance.

(i) Should the Club show no positive growth in its participation numbers (defined specifically as an increase in registered players) during this probationary period, the club shall be relegated at season’s end to Division Four.

(ii) Should a Club in this initial probationary period show positive growth in its participation numbers (defined specifically as an increase in registered players) but still not meet the team requirements under clause 5.1.1, the Club will be afforded a second probationary period of 12 months to meet the team requirements by the following season.

(iii) Should a Club not reach the team requirements after this second probationary period, the Club shall be relegated at season’s end to Division Four.

(iv) Any probationary period ends when the Club is assessed as meeting the required criteria.

Competition Structure & Fixtures

Baseball SA, in accordance with the SABL Constitutional Objects, these Bylaws and the recommendations of applicable special committees, shall:

(i) have the authority to determine the structure, number and organisation of Grades, Divisions and teams in each competition;

(ii) prepare a fixture of games to be conducted by the League for submission to Clubs;

(iii) recommend at which times and dates, and on which grounds such games will be played;

(iv) have the power to cancel, postpone or transfer games;

(v) make, alter or repeal local rules of baseball that govern all SABL competitions, published by Baseball SA in the Local Playing Rules & Conditions, for the conduct of games.

Calendar of Events

Baseball SA may publish a Calendar of Events each year outlining important deadlines Clubs must provide certain forms and information to Baseball SA by.

The Calendar of Events will be published on the Baseball SA website no later than 30th of June each year.

Clubs will be required to meet the published deadlines.

Failure to meet these deadlines may result in penalties and/or fines which are listed in the Fees, Fines and Penalties Section of these Bylaws.

Teams Nomination Process

Clubs may nominate teams in any Grade, subject to clause 5.1, however it is the preference of the SABL that Senior and Junior Grades are filled from Division One down.

In the event that a Club believes it cannot fill subsequent Senior Divisions or Junior Division One teams as its first preference, information pertaining to reasons why must be included with the Club’s team nominations.

Nominations must be sent to the Baseball SA Competitions & Member Services Manager in writing on the prescribed Baseball SA Teams Nomination Form available on the Baseball SA website and received by the specified due date.

Baseball SA may use discretion to:

(i) accept or reject team nominations made after the stipulated nomination date and impose a penalty or fine in accordance with the Fees, Fines and Penalties Section of these Bylaws;

(ii) reject team nominations where a Club has insufficient registered players on the approved database to field the relevant teams;

(iii) promote or relegate any team before or during the season where it is appropriate to do so having regard to the competitiveness or structure of the relevant competition.

Baseball SA may, in line with the Fees, Fines and Penalties section:

(i) specify a Teams Nomination Fee;

(ii) fine or penalise a Club for late submission of their Teams Nomination Form;

(iii) fine or penalise a Club for withdrawal of a team or teams.

Uniform

Uniform Application Process

Once a Club is approved by the Board for membership into the SABL by means of Constitution clause 5, any amendments of the Club or a certain Club’s team’s colours, uniform items or font styles must be approved by the Board via written application to Baseball SA’s Competitions & Member Services Manager and signed by the President and Secretary of the Club and should include a list of the amendments along with coloured diagrams or photographs.

Uniform Approval Process

Each application must be approved by the Board and no amendments will be allowed without prior approval.

Priority of registration shall determine the exclusive right of a Club to such colours and design.

Game Day Uniform Expectations

All Players must wear full Club uniform. Newly registered players have a maximum of three (3) Minor Round games after their date of registration to obtain the correct uniform. However, Senior Division One, Two, Three and Four players must always present in full uniform.

Breaching the Game Day Uniform Bylaws

Each Coach and the Officiating Umpire shall enforce the game day uniform expectations and any infringements shall be noted on the Official Results Sheet.

The Officiating Umpire may refuse to allow any participants infringing the uniform Bylaws to take part in a game until the participant conforms to the Bylaws.

Further penalties and fines for breaching game day uniform bylaws are set out in the Fees, Fines and Penalties Section of these Bylaws.

Baseball SA may, if it deems a Club is not conforming to the game day uniform bylaws in a serious and professional manner, escalate a case to the Disputes & Incident Reports Panel.

College Players Returning to Local Club During College Break

Players attending College in a SABL season who return to South Australia from overseas during College break may participate in a maximum of three (3) games in any Grade for the Club they were last registered with under a casual player registration payment class.

A player wishing to play under clause 7.3(a) may only do so once a Permit under clause 9.1(x) is approved by Baseball SA.

Temporary Recruit Definition, Exemption & Registration Bylaws

Temporary Recruit Definition

A Temporary Recruit (TR) is any player over the age of 18 years (on October 1st) who:

(i) is not an Australian citizen; and

(ii) has not been exempted under clause 7.4.2.1.

Temporary Recruit Exemption

A player who is not an Australian citizen will be exempted from the restrictions imposed by the Bylaws relating to Temporary Recruits if either:

he or she can satisfy the Disputes & Incident Reports Panel that:

(i) he or she is not in Australia primarily for the purpose of playing baseball; and

(ii) he or she is not being, and will not be, remunerated to play baseball in Australia; or

the Disputes & Incident Reports Panel resolves that it is in the interests of the SABL’s competition that the player should be exempt.

The Disputes & Incident Reports Panel may grant an exemption under clause 7.4.2.1 on such conditions as it thinks appropriate

and may review an exemption if, at any time, it considers that there are reasonable grounds for it to do so.

On a review, the onus lies on the player to satisfy the Disputes & Incident Reports Panel that he or she should be exempted as before. If the Disputes & Incident Reports Panel is not so satisfied, it may revoke or vary the conditions of the exemption.

For the purposes of clause 7.4.2.1(a)(ii), remuneration may be in cash or kind and includes the provision of employment as a condition or incident of the player’s agreement to play in Australia.

Rules for Temporary Recruits

A Temporary Recruit may only play in Division One.

A Club may only have one Temporary Recruit registered to it at any one time.

To be eligible to play in a season, a Temporary Recruit must be registered and be present in Australia by the 31st of December in that season.

A Temporary Recruit will not be taken to be present in Australia by the 31st of December unless, by that date, they present in person to Baseball SA’s General Manager or their nominee and produce a copy of their entry visa.

If a Temporary Recruit leaves a Club, the Club must immediately inform Baseball SA and deregister the player.

A Temporary Recruit may not be reregistered for thirty (30) days after deregistration.

A Temporary Recruit who wants to reregister must comply again with clause 7.4.3(c) and (d) above and, if they want to reregister with another Club, obtain a transfer under clause 8.1(a).

Recruit Definition & Exemption Bylaws

Recruit Definition

A Recruit is any player who:

transfers their registration to a SABL metropolitan Club from:

(i) another metropolitan SABL Club;

(ii) a South Australian regional Club; or

(iii) an interstate regional or interstate metropolitan Club affiliated with Baseball Australia.

is granted a Temporary Recruit exemption under clause 7.4.2;

is an Australian citizen who has not played baseball for a Club in Australia but has played baseball overseas or for an Australian Baseball League team in the last three (3) SABL seasons.

Recruit Exemption

A player will be exempted from the restrictions imposed by the Bylaws relating to Recruits if the player:

(i) is granted a permit of the kind referred to in clause 9.1(d); or

(ii) is an Australian citizen who has not played baseball for the SABL, ABL or a Baseball Australia affiliated Club within the three (3) SABL seasons prior to the Recruit’s application to transfer.

The Disputes & Incident Reports Panel may exempt a player from the restrictions imposed by the Bylaws relating to Recruits if the Panel is satisfied that it would be fair and in the interests of the competition to allow an exemption.

An exemption granted under clause 7.5.2.2 may be limited in time and it may be granted on conditions.

If an exemption is granted on conditions, the Panel may withdraw the exemption if a condition is not met.

Australian Baseball League Players

Subject to paragraph (b) below, an SABL registered player who is also on the roster of an ABL team for an ABL current Regular Series or Finals Series game is ineligible to play:

(i) in any SABL game or games on the weekend that corresponds with the ABL game; or

(ii) in any SABL Senior Competition Grade other than Division 1 or Division 2 for the remainder of the season.

Despite clause 7.6(a), player to whom that clause applies may play in a Division 1 or Division 2 SABL game on any day other than the day of an ABL game for which they are rostered if, and only if, either:

(i) the player is on the ABL team roster as a development player; or

(ii) the ABL club requests the SABL to permit them to play and certifies to the SABL, in writing and in advance of the SABL game, that the player has been or will be underutilised by the ABL team in the relevant ABL Series and is in need of match practice.

Penalties for breaching clause 7.6 are listed in the Fees, Fines and Penalties Section.

Short-term International Invitational Players

This clause 7.7 applies if, at any time, the League or the ABL’s South Australian team’s owner hosts international invitational non-professional development players (International Invitation Players), with the expectation of the international body that sponsors the players, that some or all of them will play SABL Division 1 baseball while they are here.

When International Invitational Players become available, the League must conduct a draft among Division 1 Clubs, by which the Clubs can select players by rotation starting with the previous season’s last placed Club in Division 1, followed by the second last Club and so on until each player is selected by a Club. Each International

Invitational Player selected must register with the League and pay the appropriate fee.

Before conducting a draft, the League must provide the Division 1 Clubs with all the information it has concerning each International Invitational player’s profile and all the requirements needing to be filled by a Club to host that player.

Financial Inducements

The SABL does not condone any financial inducement or coercing of any type.

Breaching the Registration Bylaws

Baseball SA shall forward its findings to the Disputes & Incident Reports Panel for investigation and final resolution if it considers a Club is:

(i) seeking to take an unfair advantage of the interpretation of any Bylaw in the Registration Section; or

(ii) considers a Club is in breach of any Bylaws in the Registration Section.

Penalties and fines for breaches of the Registrations Bylaws are found in the Fees, Fines and Penalties Section of these Bylaws.

TRANSFERS

Transfers

A transfer is required for;

(i) a Recruit as defined in clause 7.5.1.1(a); or

(ii) a non-playing registered official with a regional or metropolitan SABL Club who wishes to relocate Clubs in a non-playing capacity.

To obtain a transfer, the Recruit or official must;

(i) obtain the consent of the Club from whom the player or official is transferring (Transferor Club), the Club to whom the player or official is transferring (Transferee Club) and Baseball SA; and

(ii) pay the transfer fee prescribed in Table 1: Recruit Transfer Fees Table.

Neither the Transferor Club, nor Baseball SA, may refuse its consent to a transfer unless it is owed money by the Recruit or official, or in the case of the Transferor Club, the Recruit has not returned its property.

A Recruit, an official or a Transferee Club aggrieved by the refusal by either the Transferor Club or Baseball SA to consent to the transfer may initiate dispute proceedings at the Disputes & Incident Reports Panel.

Transfer Fees

Baseball SA will:

(i) determine the fee Recruits will be charged based on the Grade the majority of games the Recruit played in during the last season the player competed. Please refer to the table listed at Table 1: Recruit Transfer Fees Table; and

(ii) determine if a Recruit is exempted from being charged a fee as defined in clause 8.2(b).

Recruits will be deemed exempt from transfer fees if the player:

(i) has not played baseball for the SABL, ABL or a Baseball Australia affiliated Club within the three (3) SABL seasons prior to the Recruit’s application to transfer;

(ii) has played the majority of their games in SABL Junior Grades Tball or Pee Wee League;

Non-playing officials will be exempt from transfer fees.

Breaching the Transfer Bylaws

Baseball SA shall forward its findings to the Disputes & Incident Reports Panel for investigation and final resolution if it considers a Club is:

(i) seeking to take an unfair advantage of the interpretation of any transfer Bylaw; or

(ii) considers a Club is in breach of any transfer Bylaws.

Penalties and fines for breaches of the transfer Bylaws are found in the Fees, Fines and Penalties Section of these Bylaws.

PERMITS

Permit Definition

Unless stated in clause 9.1(b), a Club requires a permit;

(i) subject to clause 8.1(a)(ii), to start a Senior player in a second or subsequent game on any one weekend (which, for this purpose, includes the Friday night);

(ii) to play a player (Senior or Junior) more than one Senior Division lower than the Senior Division in which he or she last played;

(iii) to move a player sideways in a Grade where the Club has more than one team in that Grade;

(iv) to play a Division One starting player in the next Round of games in Division Two when the Division One team has a scheduled bye Round;

(v) to play a Junior player in a Junior Division Two Grade after the 1st of January when the Junior player has played the majority of their games in the Division One Grade;

(vi) to play a Junior player in a Grade below their appropriate age group;

(vii) to play a Junior player who is registered to play for another Club that does not have a team in the Junior Grade for the Age Matrix applicable to the player;

(viii) for a South Australian regional player to play up to three (3) games in the SABL metropolitan Junior or Women’s competition or in Senior Division Three or lower;

(ix) for a female Senior player to play Women’s League for another Club if the player’s Senior Club does not offer a Women’s League team; or

(x) for a player registered as a casual, to play games in Senior Division Two or Three, or, in the case of a returning College student under clause 7.3, Division One;

Over one weekend, a permit is not required;

(i) for a player to start in both games of a Division One double-header or Division One Finals Series (best of three (3) games);

(ii) for a Junior player to start in two (2) Junior games or one (1) Senior game and one (1) Junior game;

(iii) for a Junior female player to start in one (1) Women’s League game and one (1) Junior game; or

(iv) for a Senior female player to start in one (1) Women’s League game and one (1) Senior Division game.

A permit may be granted under this clause for a specific number of games, a specific period or indefinitely. An indefinite permit may be withdrawn by the Permit Committee if it considers that the circumstances that warrant the Permit have changed.

Where a permit granted under clause 9.1(a) authorises a player registered with one Club to play for another, the player will not be classified as a Recruit and will resume as a registered player of the first Club once the Permit has expired.

Permit Application

An application for a weekly permit must be completed using the Permit Application Form and emailed by a Club delegate to the Baseball SA office using the email address [email protected] by 12:00PM on the Friday prior to the permit being required for a weekend game (weekend encompassing Friday night, Saturday and Sunday games) or 4:30PM on the day of a twilight game.

An application for an indefinite permit, that is a permit request for the full upcoming or current season, must be completed using the Permit Application Form, or, if the request is for a junior player to play lower than their natural age group, the PONAG Playing Down Exemption Form must be completed and emailed by a Club delegate to the Baseball SA office using the email address [email protected] no later than two weeks prior to the permit being required.

Permit Committee

All permit applications will be dealt with by the Permit Committee, consisting of:

• Baseball SA’s Competitions & Member Services Manager;

• SABL’s Operations Board Director; and

• SABL’s Youth Director.

The Permit Committee membership shall be published on Baseball SA’s website as under clause 4.1(c).

The Permit Committee shall, in accordance with these Bylaws, have the power to enquire into a player’s skill level, movement or similar and grant or refuse permit applications based on a set of criteria established by the Permit Committee.

The Permit Committee may escalate a decision to the Disputes & Incident Reports Panel if it deems the case:

(i) is not provided for in these Bylaws: or

(ii) warrants an escalation.

Permit Notification and Communication

Where practicable, the weekly permit application will be dealt with by 5:00PM on the Friday for a weekend game or 5:00PM on the day of a twilight game.

Once a permit application has been dealt with the Club will be informed of the result by email to the Club’s Baseball SA email address. The Club may not assume approval of a permit until it has been notified to that effect by email.

Where practicable, granted weekend permits for all Clubs will be uploaded to the Baseball SA website on Friday afternoons. Clubs wishing to know what permits have been granted for twilight games are encouraged to ask at the Plate Meeting in the event the office is unable to make these permits public on the Baseball SA website.

All permit players must have a ‘P’ written next to their name on the Team Sheet and Official Results Sheet.

Playing a Player Without a Granted Permit

A Club may play a player without an approved permit in extenuating circumstances arising from last minute injury or player unavailability, but does so at their own peril and must;

(i) advise the opposition of the decision to play the unapproved permit player at the Plate Meeting;

(ii) write a “P” next to the player’s name on the Team Sheet and Official Results Sheet;

(iii) write “permit under extenuating circumstances” in the comments section of the Official Results Sheet, and;

(iv) communicate the decision and the extenuating circumstances to Baseball SA via an email to [email protected] by 12:00PM the day after the game.

A Club cannot presume in any way that their decision to play an unapproved permit player absolves them from any penalty resulting from its actions.

Breaching the Permit Bylaws

Along with clause 9.3(d), the Permit Committee shall forward any findings to the Disputes & Incident Reports Panel for investigation and final resolution if it considers a Club is:

(i) seeking to take an unfair advantage of the interpretation of any Permit Bylaw, or;

(ii) considers a Club is in breach of the Permit Bylaws.

PRESCRIBED POINTS

Prescribed Points General Rule

The total number of Prescribed Points attributable to the players who are listed on the official Team Sheet of a game in a Prescribed Grade must not exceed the Ceiling for that Grade.

Application of the Prescribed Points Clause 10

The clause applies only to Prescribed Grades.

Prescribed Points Clause Definitions

For the purpose of this clause 10:

Prescribed Points are the points assigned to players under clause 10.7.

Incentive Prescribed Points are Prescribed Points allocated to a Division One team under clause 10.5.

The Ceiling applicable to any match is the ceiling set under clause 10.4.

Each of Divisions One and Two, Women’s League Division One and the Junior Grades excluding Tball and Pee Wee League is a Prescribed Grade.

A Recruit is defined in clause 7.5.

A Temporary Recruit is defined in clause 7.4.

A Year of Service is defined in clause 10.7(c).

Prescribed Points Ceilings

For a Division One team, the Ceiling for each game in a season is:

(i) nine (9) Prescribed Points for each team that qualifies to participate in finals in the preceding season and fourteen (14) Prescribed Points for each of the other teams; plus

(ii) any Incentive Prescribed Points allocated to the team for that season; less

(iii) any reduction imposed under clause 10.9.

For a Division Two team, the Ceiling for each game in a season is eighteen (18) Prescribed Points.

For a Women’s League Division One team, the Ceiling for each game in a season is twelve (12) Prescribed Points.

For a team in a Junior Grade, the Ceiling for each game in a season is twelve (12) Prescribed Points.

Incentive Prescribed Points

The purpose of Incentive Prescribed Points is to reward a Club in one season for its commitment to Baseball SA across all of its competitions in the preceding season.

To that end, the Board may prescribe criteria for the allocation of Incentive Prescribed Points for a future season.

Incentive Prescribed Points may be earned by a Division One Club for a future season by meeting the criteria prescribed by the Board for the season which preceded it.

Notification of Prescribed Points

Not later than thirty (30) days after the Division One Grand Final in each year, Baseball SA must:

(i) notify Division One Clubs of the criteria for the allocation of Incentive Prescribed Points at the end of the next season for the season after the next; and

(ii) notify each Division One Club of its Ceiling for the next season.

Attribution of Prescribed Points

Subject to paragraph (b) below, Prescribed Points are assigned to Recruits and Temporary Recruits according to the following table.

A Temporary Recruit who transfers to a new club during the season will be assigned an extra four (4) Prescribed Points (making a total of nine (9) points) for the rest of that season and for the next season will be reclassified as a Temporary Recruit with zero years of service.

To achieve a Year of Service for a Club, a player must have played a number of Minor Round games for that Club in a season that is not less than half of the number of Minor Round games played by the Club in that season in the highest Division or Grade in which the player participated. For this purpose, games played by the player in any Division or Grade will be counted.

The Years of Service do not have to be consecutive but if a player changes Clubs, the player will start again at zero Years of Service.

Baseball SA must maintain on the website an up to date record of current players to whom Prescribed Points have been assigned and the number of Prescribed Points assigned to each of them.

Recording the Prescribed Points Tally

Each team that participates in a game in a Prescribed Grade must list on the official Team Sheet, and transpose to Baseball SA’s Official Results Sheet, the Prescribed Points assigned to each Recruit and Temporary Recruit on its team.

Breaching the Prescribed Points Bylaws

In addition to any other penalty authorised by these Bylaws, a Club that breaches the Ceiling in any game may also, at the discretion of the Disputes & Incident Reports Panel, have its Ceiling reduced for the immediate future and/or for the following season.

DISPUTES & INCIDENT REPORTS (EJECTIONS & PROTESTS)

Disputes & Incident Reports Panel

The Disputes & Incident Reports Panel shall be appointed by the Board at their first Meeting after the Annual General Meeting and shall consist of a maximum of three (3) members who do not hold a position on a Club Board or are a Club Coach.

If a Panel member is directly involved with a Club or player being represented in a dispute or incident, the Panel member must relieve themselves of their duties and the Board shall appoint another member as a replacement.

Baseball SA’s Competitions & Member Services Manager shall only have administrative responsibility in the dispute resolution process for the Disputes & Incident Reports Panel. The Baseball SA Competitions & Member Services Manager shall:

(i) abide by the procedures of the special committee;

(ii) be the point of contact for all dispute administration;

(iii) issue penalty and fee or fine notices to relevant parties;

(iv) publish on the Baseball SA website player suspension details; and

(v) enforce the penalties where appropriate.

Disputes & Incident Reports Panel Powers and Decision Making

The Disputes & Incident Reports Panel shall:

(i) abide by the procedures of the special committee;

(ii) hear disputes and incident reports;

(iii) abide by the procedures for decision making outlined in Baseball SA’s Standard Operating Procedures;

(iv) review the arguments and evidence;

(v) seek extra guidance or evidence from Baseball SA, the Board or an external source where it deems appropriate;

(vi) provide advisory opinions on disputes and incidents to the Tribunal or Board where necessary; and

(vii) make recommendations, determinations and offer penalties and fines to Baseball SA’s Competitions & Member Services Manager as required based on the recommended penalties and fines set out in these Bylaws.

Disputes & Incident Report Definitions & Examples

A dispute or an incident may be a breach of any of the following regulations:

(i) SABL Bylaws;

(ii) SABL Constitution;

(iii) Official Baseball Rules;

(iv) Baseball SA Local Playing Rules & Conditions; or

(v) Baseball SA Policies.

A dispute not provided for under Section 6 (Discipline and Dispute Resolution) of the SABL’s Constitution.

Dispute Examples (Regulation Breaches)

A dispute refers to the alleged breach of an administrative law pertaining to the regulations listed under clause 11.3(a) that relates to activities or processes outside of ‘game day’ for which a dispute arises and a Dispute Report is submitted to Baseball SA by a Club (the Complainant).

The Permit Committee, under clause 9.3(d), may escalate a permit application, which, for the purpose of clause 11.2(a)(ii), will be defined as a dispute, to the Disputes & Incident Reports Panel for a recommendation or determination.

Incident Report Examples (Ejections & Protests)

An incident refers to:

the alleged breach of a rule or regulation that occurs at a Baseball SA sanctioned game for which an Incident Report is submitted to Baseball SA by an Umpire or a Club (the Complainant) where:

(i) team personnel (the Reported Person(s)) have been reported, ejected or removed by an Umpire for allegedly breaching a rule listed under clause 11.3; or

(ii) the alleged breach of the game day rule or regulation was officially protested at the game to the Umpire by team personnel.

an alleged breach of a rule or regulation that occurs at a Baseball SA sanctioned game that has been discovered or comes to the attention of Baseball SA’s Competitions & Member Services Manager after the event for which an Incident Report is submitted by a Club.

Complainant Dispute & Incident Reporting Procedures & Fees

A dispute or incident shall only be heard by the Disputes & Incident Reports Panel if the Complainant adheres to the Disputes & Incident Reporting Standard Operating Procedures for submitting a Dispute or Incident Report Form found on Baseball SA’s website.

Fees may be applicable for a report submission and are listed in the Fees, Fines and Penalties Section of these Bylaws.

Appealing a Disputes & Incident Reports Panel Decision

A Reported Person may appeal a decision of the Disputes & Incident Reports Panel to the Baseball SA Tribunal on the basis that they:

(i) plead guilty to a charge but contest the penalty offer; or

(ii) plead not guilty to a charge.

A Complainant may appeal a decision of the Disputes & Incident Reports Panel to the Baseball SA Tribunal based on at least one of the following grounds:

(i) a denial of natural justice;

(ii) a denial of procedural fairness;

(iii) an error in the exercise of a discretion (including acting on a wrong principle, relying on extraneous or irrelevant matters, mistake of fact, failing to take a material consideration into account or the decision was otherwise unreasonable or plainly unjust); or

(iv) the penalty imposed was manifestly excessive or manifestly inadequate.

An appeal must be made by the Club Secretary (or their nominee) to the Baseball SA Competitions & Member Services Manager no later than twenty-four (24) hours after the original decision was communicated to the parties.

Baseball SA’s Competitions & Member Service Manager will advise all parties of the appeal and Tribunal details.

BEHAVIOUR MANAGEMENT

Member Protection Policy & Codes of Conduct

Baseball SA, its employees, all Members (as defined in the Constitution), the Board, spectators, parents and any other people to whom the policy may apply are bound by the Baseball Australia Member Protection Policy which aims to assist Baseball SA in upholding its core values and create a safe, fair and inclusive environment for everyone associated with our Sport.

The Member Protection Policy refers to specific Codes of Conduct for certain standards of behaviour for Baseball SA players, coaches, officials, administrators, parents/guardians and spectators to adhere to.

Prohibited Substances

The consumption of any illegal drug, tobacco product, including electronic cigarettes, and alcoholic products by an umpire, official or player listed on the official Team Sheet is prohibited within the on-field confines, including, but not limited to, the playing area, dugouts, scorer’s area and bullpens, of any baseball facility.

Furthermore, the consumption of all smoking products is banned within 10 metres of viewing and playing areas, public seating at the grounds and any other area reserved for use by the players and officials at all SABL endorsed games. The ban also applies during training and at any intervals or breaks in play.

Breaching the Prohibited Substances Bylaws

A player shall be ejected from a game, and an umpire or official reported, if deemed in breach of this Bylaw.

An individual reporting the suspected breach and/or ejection shall follow the Incident Reporting Policy found on Baseball SA’s website and report the incident to Baseball SA using the appropriate Form.

The Disputes & Incident Reports Panel will examine the report and make a determination, applying an appropriate penalty and fine.

State and Charter Coaches & Executive Officer Selection Panel

The State and Charter Coaching Selection Panel will consist of:

• Baseball SA’s Performance Pathways Manager;

• Baseball SA’s Pathway & Development Manager;

• SABL’s High Performance Director; and

• SABL’s Youth Director.

The State and Charter Coaching Selection Panel shall be responsible for:

(i) the consideration of the nominations for the positions of Head Coach, Assistant Coach, Pitching Coach and Executive Officer for each team; and

(ii) the selection of each position for final ratification by the Board.

The State and Charter Coaching Selection Panel shall be empowered to seek further nominations if there are insufficient nominations.

State and Charter Coaches & Executive Officer Nomination &

Appointment

Position vacancies for all Head Coach, Assistant Coach, Pitching Coach and Executive Officer roles shall be advertised via Baseball SA’s website.

Nominations for all South Australian State team positions and Charter team positions shall be lodged using the State/Charter Coaching & EO Expression of Interest Form.

The Board shall appoint each position for one year.

The State and Charter Coaching Selection Panel shall monitor all appointee’s actions and behaviour and report their findings to Baseball SA’s General Manager.

The Board shall have the power to terminate any appointment at any time.

State and Charter Team Uniform and Logos

State Team Colours and Logo

The colours of the South Australian State teams shall be red, yellow and navy blue.

The logo of the South Australian State teams will be determined by the Board and published on the Baseball SA website.

Charter Team Colours and Logo

The colours and logos of all Charter teams will be determined by Baseball SA, approved by the Board and published on Baseball SA’s website.

FEES, FINES & PENALTIES

Teams Nomination Fees, Fines & Penalties

Each Club may pay a team nomination fee of $100.00 plus GST (total of $110.00) per team on or before a date stipulated on Baseball SA’s Calendar of Events. Unless alterations are requested by the Club, the fee will be credited back to the Club against its umpiring fee obligations.

A Club will be fined $200.00 plus GST (total $220.00) if Baseball SA does not receive a Club’s Team Nomination Form and team nomination fee by the team nomination submission date.

If after the team nomination submission date but before Round 1 of the SABL competition, a Club adds a team, removes a team or transfers a team from one Grade to another, the Club will be fined $200.00 plus GST (total $220.00) for each team added, removed or transferred.

Thereafter, if a Club adds a team, removes a team or transfers a team from one Grade to another, the Club will be fined $500.00 plus GST (total $550.00) for each team added, removed or transferred.

Disputes & Incident Reporting Fees

A Club submitting a dispute or incident report pertaining to clause 11.3.1(a) , 11.3.2.1(a)(ii) or 11.3.2.1(b) will be subject to a fee of $115.00 inclusive of GST and transaction fees which is payable within seven (7) days of receipt of the dispute.

Australian Baseball League Player Breach Fine

A Club found guilty of a breach of clause 7.6 will be subject to an suitable fine and penalty to be determined by the Disputes & Incident Reports Panel.

Tribunal Hearing Fees

A Reported Person or Complainant, defined in clause 11.3.2.1, instigating tribunal proceedings, will be subject to a fee of $115.00 inclusive of GST and transaction fees which is payable within seven (7) days of receipt of appealing a resolution handed down by the Disputes & Incident Reports Panel.

AWARDS & TROPHIES

Premiership Awards

Each Grade and Division that is awarded a premiership within the SABL competition will receive a pennant to keep along with a perpetual shield to be returned engraved to the Baseball SA office when requested.

Division One Premiership players and officials will receive Premiership medallions. One player will be awarded the SABL Division One Grand Final Series Most Valuable Player medallion chosen by a Baseball SA delegated panel.

Women’s Division One players and officials will receive Premiership medallions. One player will be awarded the SABL Women’s Division One Grand Final Most Valuable Player medallion chosen by a Baseball SA delegated panel.

To be eligible for consideration of these awards, a player must not have been found guilty of an offence whereby the charge is one or more game(s) suspension.

(i) The win/loss ratio is calculated by adding all the Minor Round winning games for each team listed above and dividing that total by the total number of games scheduled for each of the Grades listed above.

In the event of a tie, the total number of Minor Round runs against will be calculated for each Club’s teams included in the list at clause 17.3(a). The Club with the lowest number of runs against will be declared the winner.

SABL Senior Club of the Year Award

The SABL Senior Club of the Year award is named the SABL Ohlstrom Shield and is awarded to the Club with the highest Minor Round win/loss ratio total calculated using its highest ranked team in Senior Divisions 1, 2 and 3.

(i) The Minor Round win/loss ratio is calculated by adding all the winning games for Divisions 1, 2 and 3 and dividing that total by the total number of games scheduled for each of the Divisions.

Division One Outstanding Achievement Awards

Baseball SA Division One Individual Award Player Nominations

All Division One coaches, or their nominees, shall submit nominations for each award listed in clause 17 to Baseball SA’s Competitions & Member Services Manager using the Baseball SA Division One Outstanding Achievement Awards Nomination Form found on Baseball SA’s website. Nominations must arrive to the Baseball SA office no later than seven (7) days following the last Minor Round game.

Baseball SA Awards & Trophies Selection Panel

Members of the Baseball SA Awards & Trophies Selection Panel shall be selected by Baseball SA’s Competitions & Member Services Manager and ratified by Baseball SA’s General Manager.

The role of the Baseball SA Awards & Trophies Selection Panel shall be to examine Division One player statistics and submitted nomination forms and determine award recipients for each award listed in clause 17.

Final selections must be submitted to Baseball SA’s Competition & Member Services Manager for ratification by Baseball SA’s General Manager no later than eight (8) days following the last Minor Round game.

Division One Batting Champion

The Division One Batting Champion shall be awarded to the Division One player with the highest batting average for the Minor Round calculated by dividing the total number of safe hits by the total times at bat as defined in the Official Baseball Rules Determining Percentage Records.

To be eligible for this award, a player must be credited with as many or more total appearances at the plate as the number of games scheduled for Division One multiplied by 2.7. Total appearances at the plate shall include official times at bat plus bases on ball, times hit by pitcher, sacrifice flies and times awarded first base because of interference or obstruction.

Division One RBI (Runs Batted In) Champion

The Division One RBI (Runs Batted In) Champion shall be awarded to the Division One player who records the most runs batted in for the Minor Round.

Division One ERA (Earned Run Average) Pitching Champion

The Division One ERA (Earned Run Average) Pitching Champion shall be awarded to the Division One player with the lowest Minor Round earned run average calculated by multiplying the total earned runs charged against the player by 9 and dividing the result by the total number of innings pitched.

To be eligible for this award, a player must have pitched in at least as many innings as the number of Minor Round games scheduled for Division One.

Division One Gordon Ross Memorial Golden Glove Infielder

The Division One Gordon Ross Memorial Golden Glove Infielder shall be awarded to the Division One player with the highest Minor Round fielding average calculated by dividing the total put outs and assists by the total of put outs, assists and errors.

To be eligible for this award, an infielder must have participated in not less than 80% of the scheduled Division One Minor Round game’s innings in the position of Second Base, Third Base or Short Stop.

Division One Gordon Ross Memorial Golden Glove Outfielder

The Division One Gordon Ross Memorial Golden Glove Outfielder shall be awarded to the Division One player with the highest Minor Round fielding average calculated by dividing the total put outs and assists by the total of put outs, assists and errors.

To be eligible for this award, an outfielder must have participated in not less than 80% of the scheduled Division One Minor Round games innings in the position of Left Field, Centre Field or Right Field.

Division One Rookie of the Year

The Division One Rookie of the Year shall be awarded to the Division 1 player who has displayed outstanding performance in their rookie season.

To be eligible for this award, the player, in the season prior, must have had fewer than twenty five times at bat in Division One, must have pitched fewer than fifteen Division One innings and must not be a Temporary Recruit or International Invitational player.

Division One Team of the Year

The SABL Team of the Year is chosen using the principle that the team would be played against an opposition, therefore the criteria for fielding positions Catcher, First Base, Second Base, Third Base, Short Stop, Left Field, Centre Field and Right Field will take into consideration a player’s fielding statistics and batting statistics. The Pitching roster will be chosen based purely on pitching statistics and a Designated Hitter will be chosen based on batting statistics.

For a player to be eligible for nomination for Team of the Year, the player must have played in not less than 80% of the scheduled Division One Minor Round innings. For a player to be eligible for a specific infield position, the player must have played in that infield position for 80% of the total innings scheduled in the Division One Minor Round. Regarding outfielders, the three best outfielders, regardless of whether they generally play at one specific position, will be eligible for any of the three outfield positions.

The following trophies are awarded to participants in each age group representing South Australia at the annual Australian Youth Championship tournament. The recipients are chosen by their respective team coaches.

• Greatrex Sporting Award for the Most Improved Player

One participant from all South Australian Youth representative teams is chosen as the State’s most consistent player by a panel of respective coaching staff, using specific criteria stipulated by Baseball SA and ratified by Baseball SA’s High Performance Manager, and is awarded the following trophy:

• Don Klaebe Memorial Award for the Youth State Team’s Most Consistent Player

One Junior Coach will be awarded the following Youth Coaching Award who has displayed outstanding performance and commitment to the role of coach in a high performance youth team. The recipient will be chosen using specific criteria by a panel delegated by Baseball SA and facilitated and ratified by the Baseball SA High Performance Manager.

• Harvey/Kobayashi Youth Coaching Award

The Baseball SA High Performance Manager will choose recipients for the following awards based on the commitment and performance of athletes during attendances at High Performance academies, courses or programs.

• Max Puckett Memorial Female High Performance Athlete of the Year

• Max Puckett Memorial Male High Performance Athlete of the Year

One participant from all Open Senior South Australian representative teams is chosen as the State’s most consistent player by the coaching staff, using specific criteria stipulated by Baseball SA, and is awarded the following trophy:

The following award is presented for recognition of an individual’s contribution and commitment to baseball in a volunteer capacity within a SABL Club or the League itself. At the request of Baseball SA, and using the forms provided, each Club is given
