The term intellectual property rights is directly related to the progress of human civilisation and cultural refinements. As individuals explored their inner resources and dedicated their time, perhaps a large and productive part of it, to creating new and unique works merely by the strength of their imagination, the need to protect their title of ownership to such works came to be felt more and more, both for the name and fame they entailed and any material reward that they would bring. Since these works are basically produced only by unusual vision and fertile imagination, the rights concerning them came to be grouped under the blanket term “intellectual property rights” or IPR for short.

The origin and evolution of IPR is a relatively modern phenomenon though the need for its application is being made widely popular only in the current century. Historically, the roots of the modern legislation can be traced to the Statute of Monopolies, 1623 and the Statute of Anne, 1609 of the British Empire. Later on, going through a series of changes, and repeals and reconstruction, the Act evolved into the comprehensive protective shield that it is today. The British Statute is the basic model for most of the European countries as well as the US, and other segments of the British Commonwealth.

The IPR framework in India is stable and well established legally, judicially and administratively. It is fully compliant with the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). India is a member of several international treaties and conventions on intellectual property rights such as the Paris Convention, Berne Convention, Nairobi Treaty and the Madrid Protocol. The Indian Patent Office is recognised as an International Searching Authority and an International Preliminary Examining Authority (ISA/IPEA) by the World Intellectual Property Organization under the Patent Cooperation Treaty, thus joining an elite group of 17 countries.

The IPO website provides a separate gateway for e-filing the trademark applications, and facilities for free on-line search of identical/similar trademarks. A trademark e-journal is published weekly, giving the details of applications accepted for trademark registration and other information.

While majority of the countries are implementing strong IPR protection strategies for strengthening their industries and trades, Indian industries, particularly the MSMEs, are lagging behind in recognising the importance of IPR as a business strategy for enhancing their competitiveness. The Union Ministry of MSME makes provision for programmes for awareness creation and sensitisation of MSMEs on IPR. The programme specifically endeavours to raise the level of awareness and interest about the need to: integrate IP in their innovation strategies and business planning; protect IP achievements through registration of rights and use of non-registered protection methods; protect and enforce IPR from infringements; enhance capacity to fight counterfeiting.

The Ministry of MSME, Govt. of India also has a scheme of assistance for setting up IP facilitation centres. These Centres will work in close association with the National Patent Offices/ Regional Patent Offices and other national/international agencies administering the implementation of IPR related matters. The IPFC programme has a target of 40 centres, of which 20 are already put in place by the DST under TIFAC. The IPFCs will guide the MSMEs on all IPR related issues including commercialisation/transfer of technology. IPFCs may also be established for the identified need-based MSME clusters.

One such IPFC is functioning at ni-msme too. Among its spectrum of activities awareness creation/sensitisation training for MSMEs occupies a significant place. The training is conducted both on-campus and on-site, so as to suit the convenience of the clients. The Centre also offers membership facility, and extends help in filing the claims with national and international agencies, patent searching, etc.

As part of the Centre’s activities, seminars/workshops are also organised at intervals on IPR related themes, with broad sector-wise focus. In this context it would be relevant to mention that during this month our IPFC had organised a one-week training in IPR, and a workshop on Standards and Benchmarking for MSMEs which received a heartening response.

We invite the MSMEs, through this column, to make use of our IPFC services to safeguard their IPR and commercialise it to best advantage.

Visit to Pochampally Handloom Park

field visit was arranged to Pochampally Handloom Park on 12th Feb 2015 for A

the IPRIS international delegates in order to facilitate in-plant study and give exposure to operational aspects as well as provide practical insights.

The visit gave the delegates the opportunity to see traditional hand-weaving at first-hand. Pochampally has both silk and cotton weaving units. The artisans do a great deal of ikkat/double ikkat weaving – a method involving resist dyeing, similar to tie-n-dye on the warp and/or weft. The dye is applied before the threads are woven together, creating a “feathered” looking final pattern on the fabric. For this unique and distinctive method, the Pochampally weaving has been granted a Geographical Indication (GI) registration.

The delegates were very much impressed with the grace and beauty of the products and the knowledge about their production methods. They made purchases of a variety of items with delight. They felt that they had learned far more about the process of hand-weaving through this visit; to see it in action was truly amazing, they said.
