Building regulations are minimum standards for design, construction and alterations to virtually every building. The regulations are developed by the UK government and approved by Parliament.

The Building Regulations 2010 cover the construction and extension of buildings and these regulations are supported by Approved Documents. Approved Documents set out detailed practical guidance on compliance with the regulations.

Building regulations approval is different from planning permission and you might need both for your project.

Northern Ireland In Ireland, ministers are responsible for making building standards (equivalent to the building regulations in England) and the associated technical guidance documents.

The Northern Ireland Building Regulations are legal requirements made by the Department of Finance and Personnel and administered by 26 District Councils.

The Regulations are intended to ensure the safety, health, welfare and convenience of people in and around buildings. They are also designed to further the conservation of fuel and energy.

The Building Regulation - UK

Scottish building standards In Scotland, ministers are responsible for making building standards (equivalent to the building regulations in England) and the associated technical guidance documents.

The Building (Scotland) Act 2003 grants this power.The 32 Scottish Local Authorities act as verifiers administering the building standards system, granting permissions (building warrants) and completion certificates.

The main purpose of the standards is to ensure that buildings are safe, efficient and sustainable. They do not control the building process, but outline the essential standards that are to be met during building works or conversions

The Welsh Building Regulations are legal requirements made by Welsh Government Under section 14(5) of the Building Act 1984 the Welsh Ministers appointed a Building Regulations Advisory Committee (BRACW).

The Regulations are intended to ensure the safety, health, welfare and convenience of people in and around buildings. They are also designed to further the conservation of fuel and energy.

0.1.4 Status of Technical Handbooks

There are a further three guidance documents that have the same standing as the Technical Handbooks. Scottish Ministers have issued these under Section 4(1) of the Building (Scotland) Act 2003. They are:

Guide for practitioners 7: Fire Safety Management in Traditional Buildings, published by Historic Scotland, and

The Scottish Building Standards - Technical Handbook –Conservatories, published by the Building Standards Division.

• Standard 0.8 - completely re-written for the CPR.

Building Regulations Wales

Building Regulations that previously applied to England and Wales continue to apply, but from 1 January 2012, any revisions to the English regulations apply to England only.

Under section 14(5) of the Building Act 1984 the Welsh Ministers have a duty to appoint a Building Regulations Advisory Committee (BRACW).

New regulations and guidance are the responsibility of the Welsh government.

This included most of the powers in:

• the Building Act 1984

• the Sustainable and Secure Buildings Act 2004

• the Climate Change and Sustainable Energy Act 2006.

Fire safety information

38. (1) This regulation applies where building work—

(a) consists of or includes the erection or extension of a relevantbuilding; or

(b) is carried out in connection with a relevant change of use of abuilding, and Part B of Schedule 1 imposes a requirement in relationto the work.

(2) The person carrying out the work shall give fire safety information to theresponsible person not later than the date of completion of the work, orthe date of occupation of the building or extension, whichever is theearlier.

Regulation 38 Continued

(3) In this regulation—

(a) “fire safety information” means information relating to the design andconstruction of the building or extension, and the services, fittings and equipment provided in or in connection with the building or extension which will assist the responsible person to operate and maintain the building or extension with reasonable safety;

(b) a “relevant building” is a building to which the Regulatory Reform (Fire Safety) Order 2005 applies, or will apply after the completion of building work;

(c) a “relevant change of use” is a material change of use where, after the change of use takes place, the Regulatory Reform (Fire Safety) Order 2005 will apply, or continue to apply, to the building; and

(d) “responsible person” has the meaning given by article 3 of the Regulatory Reform (Fire Safety) Order 2005.

BUILDING REGULATIONS

Building Control approval is no guarantee that the building complies with the building regulations.

The Building Regulations documentation submitted to either an LABC or AI is only available to the applicant and his agent. If you are not listed on the application you have no right of access to the information.

Should you wish to obtain any information in a dispute, you will need to get permission from the applicant and agent.Obtain a letter of authorisation during the Tender or Prior to commissioning the design or the Contract.

It remains the duty of the Principal Contractor (D&B projects) or the Architect and the Contractor (traditional contracts) to demonstrate compliance.
