New Federal Log 300 Rules Don’t Yet Apply in California; Change ComingIn 2016, the federal Occupational Safety and Health Administration (federal OSHA) issued a final rule relating to the tracking and reporting of workplace injuries. The final rule requires electronic submission of injury and illness data, also known as the Log 300, that employers currently report on paper forms. This rule also requires strict anti-retaliation protections for employees who report work-related injuries or illnesses.
The federal electronic reporting rule took effect on January 1, 2017, for states that federal OSHAregulates, and they had to start electronically submitting records.However, federal OSHA has given states that operate their own safety and health programs, such as California, extra time to implement the new requirements.
According to Cal/OSHA, California employers are not required to follow the new federal requirements and will not be required to do so until “substantially similar” state regulations go through the formal rulemaking, adoption and approval process.
Cal/OSHA drafted a proposed rulemaking package to conform to the revised federal OSHA regulations. The package is being reviewed internally before the formal rulemaking process and public comment period begins.
Until Cal/OSHA implements the federal changes here in California, the federal rules will not be enforced. Employers should be on the lookout for California’s implementation of these federal rules.

California Supreme Court Set to Address Fate of Independent ContractingThe Future of Work: A Surging Demand for Independent ContractorsRecent years have seen tremendous growth in the sharing economy, aka, the “gig economy,” which reflects the technological ability to quickly summon goods or services through a smart phone. While the new economy has grown rapidly, the relevant legal standards have not. Yet business owners continue to invest heavily into business models that have created tens of thousands of flexible jobs for workers classified as independent contractors. In the absence of legislative guidance tailored to the realities of the new economy, California courts and administrative agencies have struggled to apply the law developed during an earlier age.The new economy is a powerful fact of life. According to Seyfarth’s “Future of Work” Outlook Survey,45% of respondents expect their company’s demand for independent contractors to grow in the next five years. Companies in the areas of information technology and telecommunications are among those most likely to experience these developments, as opposed to companies in the areas of real estate and consumer staples. Minor Home Repair Program
Habitat for Humanity Monterey Bay
Habitat for Humanity Monterey Bay (HMB) is a local affiliate of Habitat for Humanity International. We build and repair homes for low-income households in the Santa Cruz and Monterey County area. HMB has been active in the community for 27 years. HMB is starting a Minor Home Repair program in the community of Pajaro located in north Monterey County across the Pajaro River from Watsonville. Monterey County has awarded HMB funds to finance the Minor Home Repair Program. HMB will be hiring a part-time Repair Foreman to manage this program. The Repair Foreman must be bilingual (speak Spanish and English) and will be responsible for running the many different aspects of the program. This will include outreach work in the community to encourage residents to apply to the program, site visits to determine the home repair needs of the applicants, preparing a cost estimate for the work to be done, and overseeing the actual repair work to be completed. Some repair jobs will need to be completed by the Repair Foreman, but whenever possible we will involve volunteers to assist in the repair work. The supervision of the volunteers will be the responsibility of the Repair Foreman. Minor home repairs will primarily be on the exterior of homes and may include: landscaping, yard clean-up, repairs to fences, porches, constructing wheel chair ramps, painting the exterior of homes and more. If there are critical repairs to be made to the inside of the house, the Repair Foreman may have to make those repairs him/herself, without volunteer assistance, or refer the work to private subcontractors.
We plan on assisting a minimum of 18 homeowners (not rentals) in the community of Pajaro, during a twelve-month period between July 1, 2017 and June 30, 2018. The program is initially funded for only one year of operation. We are hopeful that additional funding will allow us to continue and expand the program. We anticipate that the program will require 16 hours per week or 2 to 2 ½ days of work each week. Working on Saturdays is a requirement of the job because that is the best day for the participation of volunteers. A work truck and construction tools will be provided for use on the job.

Now you see it, now you don’t? What’s the real news on business names and advertising? I will ‘synthesize’ the answer for a painting contractor, another gets the recipe for ‘proof’ pudding, and we ‘tear down’ the walls to expose the answer on a remediation contractor’s question…
Q: I was told that contractors did not have to put signs on their trucks if they don’t advertise, since a sign constitutes an advertisement. And plumbers, well drillers, and electrical sign installers had to also include their complete address on their truck sign. Your thoughts please?
A: Thank you for contacting Capitol Services. According to B&P Code Section 7029.5, every Plumbing contractor, Sign contractor, and drill rig used for drilling water wells, assuming the vehicle is used in their business and a commercial vehicle registration has been paid, must have his or her business name, permanent business address, and contractor’s license number, all in letters and numerals not less than 1 1/2 inches high, displayed on both sides of their vehicle.
All other contractors not mentioned above shall display their business name and license number in a clearly visible location on the vehicle in print type of at least 72-point font or three-quarters of an inch in height and width. This only applies if the contractor is using the vehicle for their construction business and a commercial vehicle registration fee has been paid.
So in your case, the key would be whether your vehicle(s) are registered as commercial.
Q: I am a Painting contractor with a “C-33” license. Can I install Fiberglass Reinforced Plastic (FRP) panels or do I need a different license?
A: The “C-33” Painting classification would not be appropriate to install FRP’s, the “C-61”/”D12” (Synthetic Products) would be most appropriate.
Q: I am applying for a second contractor’s license in Nevada and when I called the NV Board they informed me that in-order for me to be the Qualifier on more than one license I would need to document
I own at least 25% of each entity. I own 30% of each, but when they say “document”, what should I provide to show my ownership? The certificates of good standing from the Secretary of State don’t mention ownership.
A: For proof of ownership you can provide Stock Certificates, Secretarial Certificates, or the Operating Agreements (assuming they mention ownership). Typically, these are internal documents and not “filed” with any State agencies. I hope this was helpful.
Q: My husband has been working for a water remediation contractor for the past 10 years and wants to obtain his own license for removing drywall from water damaged properties. What type of license is required for removing the drywall only?
A: The “C-61”/”D-64” Non-Specialized classification for Water Remediation is required when water damaged drywall, flooring, baseboard, cabinets, or other wet material is removed from a structure.

Today we are going to talk about protective footwear. You may or may not have given this much thought. Dressing right for work is similar to dressing right for sports -- no professional football player would take the field wearing dress shoes. Wearing the right shoes will help you do a better job; and do it more safely. The first thing to think about is the type of foot protection you are going to need. Construction work requires you to walk, stand, bend, stoop and climb; therefore it is imperative that you wear sturdy, comfortable footwear. Leather shoes and boots provide the best protection. Tennis shoes, sandals and flip-flops are not acceptable footwear on a construction site. Remember, your feet and toes are made up of many small bones, and just one object dropped on your foot can cause a serious, painful injury.
Another potential jobsite injury ran occur by stepping on a nail or other sharp object. A protruding nail YAII puncture the top, side or sole of your boot in a split second I you are not careful. Safety boots come equipped with steel toes, heavy duty leather uppers and steel shanks to help prevent puncture wounds. Your footwear should fit your feet snugly and give your ankles adequate support. Good support will help prevent you from turning or twisting an ankle while moving around the job site.
Take a look at your feet right now. Are you wearing the right footwear for the job you are doing today? If you are working around protruding nails or other sharp objects, you should be wearing leather work boots with good soles. Are you working in concrete? If so, you need to be wearing rubber boots. Wet concrete on your feet will cause concrete turns. Make sure you wash your feet and put on a pair of clean socks if your feet come in contact with wet concrete. In cold weather it is important to keep your feet warm. Wear a comfortable pair of warm socks and keep a second pair available in case your feet get wet during the day. Get the message? Your feet take a beating every day. Make their job a little easier by wearing the right footwear
