Note from the Editor
Here
Published Since April 1997 Well here it is April 10 and I am just getting this month’s newsletter
finished. It seems that I am super busy with a lot of my County
Committees and new neighbors moving in. My list that I got from
Urban Utilities this month has 8 new residents, so I will be getting
the Welcome Packages ready and out to the appropriate Block
Captain as soon as I can. Page 3 is a list of Block Captains and you
will notice that there are three vacancies. If anyone is interested
please contact me and I will get you set up. We are now trying to
have Block Captain meetings every 4 months, our next one will be
in May. I will send out information to the Block Captains once I
know for sure what our topic will be.
I am looking forward to April finally warming up, but it may be a
few more days yet. I don’t recall previous Aprils that were as cold
as it has been this year. I guess we have just always been lucky.
We had a really nice Easter with our kids, grandkids, and 3 great
grandkids. It is more exciting with the little kids. Our older
grandkids aren’t as excited about getting goodies on holidays.
I can’t believe how close it is to the schools being out for the
summer. If I am reading the Plattsmouth school calendar correctly
the last day of school will be around May 24, depending on how
many snow days were used. There are several other schools in our
area as well and their final days may be different than the
Plattsmouth calendar.
When May rolls around there will be elections for several offices,
local towns and villages, county, state, federal, and schools to name
a few. Bay Hills Clubhouse will be the poling place for just
Buccaneer Bay this year. The population at Buccaneer Bay has
grown so much that other areas that used to come to Buccaneer Bay
to vote will have a new precinct to go to for their voting location.
More and more voters elect to have their ballot mailed to them and
mail it back to the Cass County Election Office or drop it off at
their location, which is at 201 Main St. There is a secure mail slot
on the outside of that building.
Another annual event that has been going on in Buccaneer Bay for
about 20 years now is the Garage Sales. Page 27 of the newsletter
has a sign-up sheet. Jaisa Poppleton will be keeping track of your
sign-up sheets. You also may need to put a sign up in your yard or
on corners to direct the shoppers to your area. The Garage Sales
have always had a good turnout. If you participate on these days,
even if you do not send in your list of items, please have the
curtesy to contribute $5.00 for the advertising. The cost for ads
can be pretty high and by not paying you are getting the benefit
of the other neighbors who did pay to help with the advertising.

Tuesday, April 24 – “George Lininger: The Man”
Speaker: Doug Lewis
Mr. Lewis has researched the life of George Lininger, who
was instrumental in the establishment of the Nebraska Masonic
Home in Plattsmouth. You might have read the recent article in
the Omaha World Herald about the Lininger family Bible that
recently made its way back to Nebraska. Mr. Lewis will talk a
little about the Bible, but also about the amazing man, George
Lininger!
Tuesday, May 8 – “Recent Acquisitions”
Speaker: Margo Prentis
“New” items that relate to the history of Cass County are
always being donated to the collection. The Museum Curator
will show and talk about some of the items that have been
donated recently.
Tuesday, June 12 - “Remembering Merritt Beach”
In conjunction with our exhibit, we will show the interview
conducted in 2013 with Kenneth Johnson and Lyle Wood about
their experiences at Merritt Beach.

World Press Freedom Day
World Press Freedom Day is a United Nations
holiday celebrated annually on May 3rd. Originally established
by the General Assembly in 1993, the holiday is now run by
the United Nations Educational, Scientific and Cultural
Organization (UNESCO). World Press Freedom Day
emphasizes universal rights as set forth in Article 19 of the
Universal Declaration on Human Rights, which was written
and adopted in 1948. This section of the Declaration states
that everyone has the right to seek and relay information,
regardless of their location or circumstances.
In the information age, we often take our access to
news and events for granted in the United States. While
freedom of the press is protected in the U.S. under the First
Amendment of the Constitution, there are still some inherent
obstacles in the ability to report information. This can lead to
withheld information, as well as that of which is not correct.
The situation is even direr in other nations, where the
reporters may lose their lives over their jobs. World Press
Freedom Day is not only set in place to protect the press, but
it is also utilized as a tool to promote freedom of expression
across all borders.
Cinco De Mayo
Cinco de Mayo is celebrated every year on May 5th.
While the holiday has deep political roots, observations of
Cinco de Mayo in the United States tend to be more about
celebrating Mexican-American culture. Mexican-Americans
utilize the day to celebrate how far they have come as a
culture through recognition and festive parties. At the same
time, this holiday has been commercialized so that people
from varying cultural backgrounds can have the opportunity
to partake in the celebrations.
Armed Forces Day Armed Forces Day is on May 19th, it is a holiday that
highlights the services of men and women in the armed forces
of the United States. This includes the Air Force, Army, Coast
Guard, Marines and Navy. Armed Forces Day is celebrated on
every third Saturday of May as a part of Armed Forces Week
that takes place the week prior. This special day is designed as
an opportunity for U.S. citizens to pay tribute to the dedicated
members of the military.
The first Armed Forces Day was celebrated on
Saturday, May 20, 1950. The theme for that day was “Teamed
for Defense”, which expressed the unification of all military
forces under one government department. According to the
U.S. Department of Defense, the day was designed to expand
public understanding of what type of job was performed and
the role of the military in civilian life.

David Jordan – Register of Deeds
I am running for reelection for the Register of Deeds, have served 3 terms “12 years”.
I first started working for the County back in 1980 for the surveyor’s office, learned to do research when we needed
to stake center lines of county roads, bridges, culverts, for ditch clean outs for any land bought or easements.
Worked for this office 16 years back in 1996 I switched over to the Register of Deeds.
I worked for this office “Register of Deeds” updating all cadastral books by drafting, new subdivisions in all cities,
towns and villages. Also did any updates of corporate limits, any ordinances to vacate streets and alleys, changing
names of streets on all maps. In 200 GIS came along I worked on that, had to do a lot of research for the rail roads,
state highways, interstate so all land owned by the state was accounted for and drawing in. After doing that I put all
parcel numbers in for all parcels of ground in the county.
After being elected I started scanning not only the records of this office but the Surveyors too, so these records can
be accessed easy thru our intranet system to be shared with the public and other offices.
We now have our own GIS site. Records from 2005 forward are there now, so I am going back and scanning all
older records, deeds, misc., also plan to go back 30 years on mortgages to put on this site! They will then be
available for access thru our intranet system to be shared with the public and other offices.
With all my time here I have the most experience that is needed, very dedicated and qualified for this office. With
my re-elected this process will go on!
Also, I was chairman for the Cass County Merit Commission, serving 9 years on that board, and now have the
support of the FOP from the Sheriff’s Office.
I joined the Plattsmouth Rotary Club, and I have been a member for12 years, and chaired the grant for the body
cams for the Plattsmouth Police Dept. We were able to purchase 7 of body cams.
I joined Teammates, a mentoring program 2 years ago, we do need more people to join up as there are students who
can use a mentor. Call your local school for more information!
I would very much appreciate your confidence in me by voting for me in the May primary.

MINUTES OF THE MEETING OF
SANITARY AND IMPROVEMENT DISTRICT NO. 5,
CASS COUNTY, NEBRASKA
Meeting convened at 6:00 p.m. on March 28, 2018 at Plattsmouth State Bank, second floor community room, 446 Main Street,
Plattsmouth Nebraska. Attached hereto are: the agenda for the meeting; the Affidavit of Printer regarding publication of notice of the
meeting, which communicated the availability of the agenda, in the Plattsmouth Journal, Plattsmouth, Nebraska; advance notice of the
meeting as provided to the County Clerk of Cass County and all Trustees; and the Trustees’ acknowledgment of receipt of said notice
and agenda. All proceedings were taken while convened with attendance open to the public.
ITEM 1
Meeting called to by order by the Chair, David Martin, at 6:00 p.m.

The locations of the Open Meetings Act and the documents related to the agenda were announced.

Motion by Grotrian, seconded by Petersen, to approve the Master Services Agreement for Ehrhart Griffin & Associates, engineers, for
general engineering services on a continuing basis pursuant to task orders for work. On roll call those voting aye: Walker, Petersen,
Kula, Martin and Grotrian. Voting nay: none. Absent: none. Abstaining: None. The Chair declared the resolution adopted.

The Chair advised that he was continuing to seek proposals for a contract to provide utility locating services to the District.

Motion by Martin, seconded by Grotrian, to approve and authorize the Chair to execute a right of way agreement with Spiral
Communications, LLC for the placement of fiber optic cable and other related improvements in relationship to Spiral’s communications
business offered to the general public conditioned upon approval of plans calling for an adequate depth of the fiber installed to avoid
conflicts with water and sanitary sewer utilities and the submission to the District of as built plans upon completion of the installation.

adopted.

Motion by Grotrian, seconded by Walker, to recommend approval to the County’s zoning administrator, the Cass County Planning
Commission and the Cass County Board of Commissioners regarding the replat of Lots 4 and 5, Block 18, Buccaneer Bay Subdivision,
Cass County, Nebraska to create Lot 5-R, Block 18, Buccaneer Bay Subdivision, Cass County, Nebraska and authorize the Chair and
Clerk to sign the mylar. On roll call those voting aye: Walker, Petersen, Kula, Martin and Grotrian. Voting nay: none. Absent: none.
Abstaining: None. The Chair declared the resolution adopted.

Motion by Grotrian, seconded by Walker, to terminate and discontinue all efforts to submit a request to the Federal Emergency
Management Agency for FEMA funds to receive reimbursement for the costs associated with the June 16, 2017 storm. On roll call
those voting aye: Walker, Petersen, Kula, Martin and Grotrian. Voting nay: none. Absent: none. Abstaining: None. The Chair
declared the resolution adopted.

Trustee Kula provided a general report regarding roads, advising that for snow removal $23,200 of the $25,000 budgeted was used.

The Chair laid over discussion of additional speed tables on Buccaneer Bay Blvd and Fairway Drive at the request of Trustee Kula.

At the request of Trustee Kula, the Chair laid over consideration of approving the repair of pot holes until the reconstruction plans were
used to identify those that would be repaired as part of the reconstruction project.

Motion by Walker, seconded by Kula, to authorize the Cass County Sheriff’s office to place its portable speed trailer on District property
at locations throughout the District. On roll call those voting aye: Walker, Petersen, Kula, Martin and Grotrian. Voting nay: none.

Trustee Kula advised that the road reconstruction phase of the 2017 Road and Storm Water Management Reconstruction Project adopted
September 27, 2017 should commence approximately May 1, 2018.

Management Reconstruction Project adopted September 27, 2017.

Motion by Martin, seconded by Kula, to direct the attorney for the District to prepare and publish a notice of public hearing for the April
meeting to consider amending the Resolution of Necessity adopted September 27, 2017 for the addition of streets to the street
reconstruction phase of the project and to have the attorney obtain the approval of plans for the reconstruction of the additional streets
by the Board of County Commissioners for Cass County, Nebraska. On roll call those voting aye: Walker, Petersen, Kula, Martin and
Grotrian. Voting nay: none. Absent: none. Abstaining: None. The Chair declared the resolution adopted.

Trustee Grotrian presented the attached finance report and reiterated that since the general fund is diminished by the approximately
$35,000 as a result of the June 16, 2017 storm, the District would be registering general fund warrants for the time being.
ITEM 13a
Ms. Nelson of Urban Utilities presented the attached reports from Urban Utilities for the water and wastewater systems and for water
billing.

The Chair advised that there was no general Committee Report.
ITEM 13c
The Chair advised that the remaining balance due on the Bond obtained from the Nebraska Department of Environmental Quality for
the construction of the wastewater treatment plant is $529,476.01 following the December 15, 2017 payment and which is scheduled
for payoff on December 15, 2025.
ITEM 13d
The Chair laid over to the next meeting consideration of a contract to clear dumped trees and debris, and to cut trees, on Outlot 1, Block
29 to provide access to water and/or sanitary sewer lines until it is determined whether and to what extent the same will be resolved by
some work that is required as part of the 2017 Road and Storm Water Management Reconstruction Project adopted September 27, 2017.
ITEM 13e
The Chair laid over consideration of a contract with Kerns Excavating Company to grout manholes and laterals throughout Phase VI
development.

Motion by Grotrian, seconded by Martin, to approve the attached contract with Ehrhart Griffin & Associates for two water main
connections and one sanitary sewer main connection for the lots east of 3200 Buccaneer Blvd. On roll call those voting aye: Walker,

Wastewater Systems Service Agreement effective September 30, 2018. On roll call those voting aye: Walker, Petersen, Kula, Martin
and Grotrian. Voting nay: none. Absent: none. Abstaining: None. The Chair restated that the Trustees would enter closed session at
7:49 p.m. for the purpose of discussing the request of Urban Utilities to terminate the Water and Wastewater Systems Service Agreement
effective September 30, 2018.
Motion by Martin, seconded by Kula, to reconvene in open session at 8:23 p.m. On roll call those voting aye: Walker, Petersen, Kula,

Motion by Kula, seconded by Walker, to appoint Trustees Martin and Grotrain as a committee to seek a solution to the request of Urban
Utilities to terminate the Water and Wastewater Systems Service Agreement effective September 30, 2018.
ITEM 13i
No action was taken following general discussion regarding amendments to the ordinance setting water and sanitary sewer rates and
charges.
ITEM 14
The Chair laid over action until additional revenues were received to pay for the work necessary to resolve the issues to obtain recorded
easements necessary for storm water drainage and/or for water and sewer infrastructure:
a. Lot 9, Blk 1- drainage Buccaneer Blvd. and Becker Court. Drainage flows to the Golf Course property and could be
a potential problem in the future
b. Lots 2 & 3, Block 18 - on Becker Court and has a sewer force main requiring an easement if not located within the
side yard lot line easement
c. Lot 17, Block 5 - drains Cypress Court
d. Lot 16, Block 3 - a lift station and storm water drainage from Rainey Court to the golf course which may result in a
potential problem in the future
e. Lot 10, Block 17 - drainage from Ewel Court which could become an issue
f. Lots 26 & 27, Block 17 - a sewer line which may or may not be located in the side yard lot line easements and feeds
a lift station at the bottom of the hill between Ewel & Becker Court

Notice to Residents Of Buccaneer Bay
Please do not flush trash down your toilets. "Trash" is anything except what passes through the human digestive tract.
Specifically, do not flush:
> Condoms
> Tampons and Sanitary Napkins
> Diapers
> Cosmetic Paraphernalia
> Sponges and products for cleaning toilets
> Wrappers for candy, cough drops and other medications
> Plastic Bags
> Latex or Rubber Gloves
> Small Animals, whether dead or alive
Do not flush "disposable” and "biodegradable" products. These products do not decompose before they arrive at the sewage treatment
plant.
The waste water treatment plant does not have a filter system like the large cities do to catch un-dissolvable products and chop them
up before they hit the pumps. On a daily basis Urban Utilities has to remove 1-3 gallons of cotton products, such as wet-wipes, cleaning wipes,
feminine products, and diapers to name a few. With this much trash going through the plant the wet well pumps plug and have to be pulled out
of the pit to be cleared. The pictures below show what had gotten through to the pumps and clogged the propellers causing the pumps
to stop operating.
If this continues this could be very costly to repair and end up costing all residents an extra charge on their water bill. The cost of a
filter system is over $250,000.
