    Duties of the EmployerThe Employer shall:

    supply a safe place of work

    supply a safe system of work supply safe plant and equipment

    supply safe access and egress

    Supply competent staff and supervision

    This is the employers Duty of Care

    You are agents of the employer!!

    Some specifics People must be competent for the work you give them

    Equipment must meet specs & standards

    All equipment must be regularly inspected, servicedand maintained

    Access and egress, eg. ladders, ramps, stairs, roadsetc. must be maintained in a safe condition

    PPE must be supplied, maintained, and policed toensure it is being worn correctly

    These are the duties of the employer and his agents

    Judgement Serious injury = prima facie evidence of

    negligence

    The employer has to provide a defence Ignorance is no defence

    Defence = injured at fault; reasonable man test

    Pre Start / Toolbox talks, JHAs, workplace

    inspections and work pre-planning, etc all maybe tendered as evidence

    JHA process Job Hazard (or Safety) Analysis

    Working at Height The 2x2 metre rule:- over 2 metres high and within 2

    metres of the edge, persons must be restrained

    If working on a roof: either an edge hand rail erected, or

    constantly restrained by a securely anchored lanyard &

    harness, or

    A flagging barricade to indicate the two metres from the

    edge point, along each edge of the roof if persons are to

    work unrestrained
