At 9:00 AM, on Tuesday, August 18, 2020, the Board of Brown County Commissioners met in Regular Session in Law Enforcement Center Training Room of the Brown County Courthouse/Law Enforcement Center located in New Ulm, Minnesota 56073. Commissioners present were David Borchert, Anton Berg, Scott Windschitl, Dean Simonsen, and Jeff Veerkamp, along with County Administrator Sam Hansen, and County Attorney Charles Hanson (via WebEx). NUCAT staff was present and Media Representative Fritz Busch (via WebEx) of the Journal was also present.
______________________________ Chairman Borchert convened the Regular Meeting at 9:00 AM, at which time the printed agenda was accepted along with the following addenda: 17a. 2020 General Election Canvass; C-3. Building Blocks for Regional Resilience; C-4. Commissioner Berg report on Public Health meeting, Planning and Zoning meeting, and a DH performance evaluation; C-5. Commissioner Simonsen report on the Election Canvass; C-6. Commissioner Windschitl report on the SCHA compliance meeting, and the SCHA Joint Powers Board meeting; C-7. Commissioner Veerkamp report on the RCRCA meeting, Planning and Zoning meeting, and the Election Canvass; C-8. Commissioner Borchert report on a DH performance evaluation.
______________________________ A motion was offered by Commissioner Veerkamp, and was seconded by Commissioner Berg, to accept the Minutes of 08-04-2020 and authorize publication of the Synopsis of same. This motion carried unanimously.
______________________________ At 9:04 AM, Chief Deputy Steve Depew met with the County Board. A motion was offered by Commissioner Simonsen, and was seconded by Commissioner Windschitl, to accept and order filed the July 2020 Monthly Report of Activity for the Brown County Sheriff’s Department. This motion carried unanimously.
______________________________ At 9:08 AM, Auditor/Treasurer Jean Prochniak met with the County Board. BROWN COUNTY AUDITOR'S NOTICE OF SALE OF LANDS 2020 FORFEITED TO THE STATE FOR NON-PAYMENT OF TAXES NOTICE OF PUBLIC SALE OF TAX FORFEITED LANDS
Notice is hereby given, that I shall sell to the highest bidders at my office located in the Brown County Courthouse LEC Training Room, in the City of New Ulm, commencing at 10 o'clock a.m. on the 17th day of September 2020, the following described parcels of land forfeited to the State of Minnesota for non-payment of real estate taxes, which have been classified and appraised as provided by law. Said sale will be governed, as to terms, by the resolution of the Brown Cou nty Board of Commissioners, appearing at the end of this notice.

CERTIFICATE OF BROWN COUNTY COMMISSIONERS OF LIST OF TAX FORFEITED LANDS TO BE SOLD
BE IT HEREBY RESOLVED, that the County Board of Commissioners of Brown County, Minnesota, having classified and appraised all lands in said County forfeited to the State of Minnesota for non-payment of real estate taxes, considering the present use of adjacent lands, accessibility to established roads, schools, and other public services and the effect of their sale and occupancy on the public burdens, does hereby determine that it is advisable to order the sale of the following described parcels of land at Public Auction, pursuant to Minnesota Statutes Sections 282.0 et seq.:
BE IT FURTHER RESOLVED, that the Brown County Board of Commissioners does hereby authorize its County Auditor-Treasurer to conduct the sale of tax forfeited lands on the 17th day of September 2020 commencing at 10 o'clock a.m. pursuant to Minnesota Law. The sale will be governed by the terms approved by the County Board. Detailed terms of this sale are on file with the County Auditor-Treasurer's office or on our web site at www.co.brown.mn.us. At 9:24 AM, Highway Engineer Wayne Stevens met with the County Board. The County Board considered the sponsorship of the City of Springfield for Federal Funds for a Project to Move & Erect the Historic Kern Bridge as a Pedestrian Bridge over the Cottonwood River. After discussion, a motion was made by Commissioner Simonsen, seconded by Commissioner Borchert, to support the sponsorship to move and erect the historic Kern Bridge as a pedestrian bridge over the Cottonwood River, provided that the City of Springfield be responsible to attain the local matching funds on the project. This motion passed unanimously.
______________________________ At 9:31 AM, Jail Administrator Steve Appel and Facilities Manager Jesse Kral met with the County Board. A motion was offered by Commissioner Berg, and was seconded by Commissioner Windschitl, to accept the elevator repair proposal from MCI Total Elevator Solutions, Mankato, MN in the amount of $25,863 for repairs and updates to the jail elevator; noting that funding from Capital Building Fund 37-200-0000-0000-6600 will used for said project. This motion carried unanimously.
______________________________ At 9:35 AM, Public Health Director Karen Moritz met with the County Board. A motion was offered by Commissioner Veerkamp, and was seconded by Commissioner Berg, to approve Brown County Public Health’s Agreement for Child Care Consultation Services with Martin Luther College Early Childhood Learning Center effective 7-28-2020 through 7-28-2021; with Kid’s Xcel Center effective 7-28-2020 through 7-28-2021. The motion carried unanimously.
______________________________ A motion was offered by Commissioner Berg, and was seconded by Commissioner Simonsen, to approve the School Health Nursing Service Agreement for 2020-21 school year for Sleepy Eye School District #84. This motion carried unanimously.
______________________________ A motion was offered by Commissioner Windschitl, and was seconded by Commissioner Simonsen, to accept and order filed the report on the update to the COVID-19 virus. This motion carried unanimously.
______________________________ At 10:07 AM, Zoning Administrator Laine Sletta presented the Planning Commission recommendations of 8-11-2020. A motion was offered by Commissioner Berg, and was seconded by Commissioner Windschitl, to approve Conditional Use Permit Application APP-C-0105 by Timothy Miller of TJ Turkeys LLP on property owned by TJ Turkeys described as part of Sublot A of Government Lot B, all in Section 11, Township 108 North, Range 31 West, Lake Hanska Township, Brown County, Minnesota. Application is to continue to renew and amend an existing Conditional Use Permit to allow 1124 AU from the previously permitted 1,022 AU (77,000 Turkeys) in a brooder and finishing operation all located in the A-1 Agricultural Protection Zoning District, with the following conditions:
1. The feedlot operator must comply with MPCA standards and regulations regarding feedlot facility construction and operation, including application of manure generated at the facility to cropland at rates which do not exceed the recommended crop nutrient requirements.

2. Dead turkeys are to be composted or incinerated. In an emergency situation, dead turkeys may be buried on site and must be covered with earth the day of disposal unless frozen soil conditions exist, at which time dead turkeys must be stored in a nuisance-free manner until soil conditions allow proper burial.
3. Manure application records and any soil or manure analysis records shall be retained on file for a period of at least three (3) years and shall be available to the County Planning & Zoning Office upon request.
4. CUP # C-00260 is null and void. This motion carried unanimously.
______________________________ A motion was offered by Commissioner Veerkamp, and was seconded by Commissioner Borchert, to approve Conditional Use Permit Application APP-C-0106 by Leah Reiner of Reiner Farms LLC on property owned by John & Lisa Reiner and Leah Reiner described as part of the NW ¼ of the NW ¼ of the SW ¼ and W 1250’ of the N 710’ of the NW ¼ of the SW ¼, except the NW ¼ of the NW ¼ of the SW ¼, all in Section 10, Township 108 North, Range 34 West, Bashaw Township, Brown County, Minnesota. Application is to amend an existing Conditional Use Permit to allow construction of a new 300’ X 235’ X 12’ deep earthen manure storage basin and an increase from 304.5 AU to 437 AU in a dairy operation and to continue to allow use of an existing 90’ X 180’ X 8’ deep earthen manure storage basin, all located in the A-1 Agricultural Protection Zoning District, with the following conditions:
1. The feedlot operator must comply with MPCA standards and regulations regarding feedlot facility construction and operation, including application of manure generated at the facility to cropland at rates which do not exceed the recommended crop nutrient requirements.
2. A perimeter tile line access port must be installed & maintained within twenty (20) feet down-gradient of the barns in order to allow drawing a tile line water sample for water analysis as may be desired in the future.
3. Liquid manure applied to farm fields must be injected into soil, or may be spread on fields with incorporation into the soil within twelve (12) hours of spreading.
4. Field application of liquid manure from barns with 12 months storage capacity shall not exceed two (2) times per year. The County Planning & Zoning Office shall be informed prior to any field application of liquid manure in an emergency which would require application in excess of two (2) times per year.
5. Manure application records and any soil or manure analysis records shall be retained on file for a period of at least three (3) years and shall be available to the County Planning & Zoning Office upon request.
6. CUP # C-00310 is null and void. This motion carried unanimously.
______________________________ A motion was offered by Commissioner Berg, and was seconded by Commissioner Simonsen, to approve Conditional Use Permit Application APP-C-0107 by Jeanne Schaefer of Hoffman Construction on property owned by JMLP Inc. described as property located in the SE ¼ of the SE ¼, all in Section 34, Township 110 North, Range 32 West, Home Township, Brown County, Minnesota. Application is to renew and continue to allow use of property as a demolition landfill site compliant with MPCA rules for disposal of demolition & earthen material, all located in the A-1 Agricultural Protection Zoning District, with the following conditions:
1. The demolition landfill owner and operator must comply with Minnesota Pollution Control Agency standards and regulations for the facility.
2. On days when demolition waste is being accepted at the site, the demolition landfill operator must operate a magnet over the quarter mile of township road between County Road #10 and the demolition landfill entrance.
3. The CUP is effective for a five (5) year period from the date of issuance. If there is a change of ownership at any time the new owner must apply for a new CUP.
4. CUP # C-00257is null & void. This motion carried unanimously.

Application is to split existing building site off from tillable land, all located in the A-1 Agricultural Protection Zoning District. This motion carried unanimously.

Application is to split of existing building site off from the tillable land, all located in the A-1 Agricultural Protection Zoning District. This motion carried unanimously.
______________________________ At 10:21 AM, HR Director Ruth Schaefer met with the County Board. A motion was offered by Commissioner Berg, and was seconded by Commissioner Simonsen, to ratify the appointment of Kerry Paarmann as a temporary intermittent part-time Public Health Nurse to assist with COVID-19 related case investigation and contact tracing duties and other COVID 19 response activities as they arise up to 12-31-2020 at the hourly rate of $28.62, Grade XVI, Step 2, with a start date of 8-17-2020. This motion carried unanimously.
______________________________ A motion was offered by Commissioner Veerkamp, and was seconded by Commissioner Borchert, to ratify the appointment of Erika Alvarez as a temporary intermittent part-time Public Health Account technician to assist with COVID-19 related case investigation and contact tracing duties and other COVID 19 response activities as they arise up to 12-31-2020 at the hourly rate of $20.76, Grade XI, Entry, with a start date of 8-17-2020. This motion carried unanimously.

PAUL A. JOHNSON TO THE
RED ROCK RURAL WATER SYSTEM BOARD OF COMMISSIONERS
The following Resolution was offered by Commissioner Windschitl and moved for adoption at a Regular Meeting held on August 18, 2020 at the Brown County Courthouse, New Ulm, MN:
WHEREAS, Michael Curley resigned as a Commissioner on the Red Rock Rural Water System (RRRWS) Board of Commissioners effective July 1, 2020; and
WHEREAS, Paul A. Johnson has agreed to replace Mike Curley on the RRRWS Board of Commissioners; and WHEREAS, On May 14, 2020 the RRRWS Board of Commissioners unanimously adopted a Motion which recommends that Paul A. Johnson be appointed to RRRWS Board of Commissioners to complete Mike Curley’s term which is scheduled to expire on December 31, 2023; and

WHEREAS the Brown County Board of Commissioners believes that Paul A. Johnson is qualified to act as a Commissioner on the RRRWS Board of Commissioners and are worthy of re-appointment.
RESOLUTION BE IT NOW RESOLVED, that the Brown County Board of Commissioners hereby recommends that
Paul A. Johnson be appointed to the Red Rock Rural Water System Board of Commissioners pursuant to and provided for by Minnesota Statutes §116A et seq. to complete the remaining portion of Mike Curley’s term which is scheduled to expire on December 31, 2023.
Seconded by Commissioner Veerkamp and the same being put to a vote was duly carried. This Resolution shall become effective immediately and without publication. ______________________________ A motion was offered by Commissioner Berg, and was seconded by Commissioner Borchert, to accept and file the 2020 2nd Quarter (Cash Basis and Unaudited) Budget Report which reflects activity at 50% of the budget year as follows: Expenditures of $15,734,549.13 or 40.3%, and revenues of $21,128,524.50 or 54.1%; and the 2020 2nd Quarter Supplemental Budgets Report noting expenditures of $1,047,362.78 or 50.9%, and revenues of $1,365,868.48 or 65.4% of budgeted activity. This motion carried unanimously.
______________________________ A motion was offered by Commissioner Windschitl, and was seconded by Commissioner Simonsen, to accept and file the July 2020 Budget Report (Cash Basis and Unaudited) which reflects activity at 58.3% of the budget year as follows: expenditures of $19,713,436.42 or 50.5%, and revenues of $24,402,485.04 or 62.5%; and the July 2020 Supplemental Budgets Report noting expenditures of $1,513,078.10 or 73.5%, and revenues of $1,547,464.16 or 74.1% of annual budgeted activity. This motion carried unanimously.

A motion was offered by Commissioner Simonsen, and was seconded by Commissioner Borchert, to approve the Memorandum of Understanding Between Melissa Fluegge, Parent Support Group Facilitator and Brown County Human Services in the amount not to exceed $1,875 for the period 8-18-2020 through 12-31-2020 for additional child protection services for families affected by addiction. Brown County Resolution Commitment to Regional Transportation Coordinating Council Phase 2 Implementation Effort
The following Resolution was offered by Commissioner Windschitl and moved for adoption at a Regular Meeting held on August 18, 2020 at the Brown County Courthouse, New Ulm, MN:
WHEREAS; the Minnesota Department of Transportation (MnDOT) Office of Transit and Active Transportation and the Minnesota Council On Access (MCOTA) seek to formalize and increase coordination between transportation providers that will result in better connections between providers, identification and elimination of transportation service gaps, identification and elimination of system redundancies, and development of a more efficient system of transportation, and easier customer access to providers that meet their travel needs; and WHEREAS; MnDOT is providing the financial and technical support for the creation of a statewide network of Regional Transportation Coordination Councils (RTCCs) throughout Greater Minnesota to meet those goals; and WHEREAS; the Mankato/North Mankato Area planning Organization (MAPO) administered an RTCC Phase 1 planning grant and led the coordination of transportation stakeholders in South-Central Minnesota to create an Operational Implementation Plan for the Southern Minnesota RTCC; and WHEREAS; Brown County is a transportation stakeholder in South-Central Minnesota that seeks to ensure an efficient and cost-effective transportation system that improves the mobility of “transportation-disadvantaged” individuals, such as older adults, individuals with disabilities, individuals with low incomes, and/or military veterans; and WHEREAS; Brown County understands that the RTCC Phase 2 implementation effort will include (but not necessarily be limited to):
Organizing the RTCC membership, board, and staff to implement the RTCC Work Plan tasks Implementing Work Plan tasks such as coordinating transportation services and resources;
providing communication, training, and organizational support; and implementing mobility strategies.
Working towards statewide coordination emphasis areas such as a Transportation Management Coordination Center (TMCC) and volunteer driver programs
NOW, THEREFORE, BE IT RESOLVED, that Brown County supports the Southern Minnesota RTCC to apply for Phase 2 implementation funding from MnDOT; and BE IT RESOLVED FURTHER, that Brown County commits to working in good faith with the Southern Minnesota RTCC and other regional transportation stakeholders through the RTCC Phase 2 implementation effort, which will include providing staff time to assist the RTCC board and staff with input and feedback at critical decision-making stages. Board Action Requested: Schedule a public hearing for 9 a.m. on September 15, 2020 for consideration of the proposed drainage assessments. Background: On August 18 the Drainage Committee met and discussed the proposed assessments for 2021. The recommendations of that committee are listed on the attached spreadsheet for consideration. In setting the assessments the committee considered multiple factors, including, but not limited to, the average expenditures of that system for the past ten years, the unallocated costs, anticipated repairs, outstanding assessments and loans. The general philosophy applied remains . . . current balance less average expenses for two years and adding $2,000 as a small cushion for unanticipated expenditures. The total assessments that will be considered at the public hearing totals $1,924,100. Repayment options will be addressed at the public hearing along with setting the interest rate for those landowners who opt to pay over the three year lien period. The public notice will be published once during the week of September 8th in the county newspapers and will be posted on the county website. (The sample public hearing notice is attached)

Board Action Requested: Consider extending the number of hours for temporary help to assist with the 2020 General Election. Background: Dianne Melzer has been working with our team during the 2020 election cycle beginning with the Presidential Nomination Primary. Her salary costs were covered by the State in their entirety for that election. Due to the pandemic, a request was made to move the funds budgeted in the Elections overtime budget to part-time and this allowed her to help with preparations for the Primary in August. She worked with getting the election judge materials prepared, purchases and organization of the PPE’s required in the polling places, adjusting to all of the rule changes created by the pandemic along with many other tasks. Her help was invaluable. Now we are feverishly working on the General Election for November in addition to completion of the 2020 financial statement, proposed notices for 2021, drainage assessments and getting ready for the second half of tax collections. This election is going to be closely monitored and all processes have to be documented. We have over 4,500 AB ballots already requested and anticipate this to increase in the days/weeks ahead. We have worked with the Recorder and they will be helping with preparation of the mass mailing of ballots to go out October 3rd. They are also going to assist as members of the AB/MB ballot board with accepting and processing ballots for tabulation. This is most helpful as well. The workload is overwhelming at times, and it is important that we do not ask staff to put in excessive overtime as that is difficult with the continuous accuracy required. We hope to utilize Dianne for approximately 30 hours a week for the next eight – nine weeks. That would be an investment of approximately $5,000. I have checked with Clifton Larson Allen and we have determined that this expenditure would qualify under the CARES act.

Background: Alesia Slater was one of six interviewed for FT Eligibility Worker position. The Interview Committee (Human Services Director, Financial Assistance Supervisor, County Administrator and HR Director) recommends the appointment of Alesia Slater at the hourly wage of $22.50 (Grade XII, Step 1). Alesia is currently working as a FT Child Care Specialist in the Human Services Income Maintenance Unit. Board Action Requested:
1) Approve applying the market adjustment of 6% upon three years’ service (Level 2) and 12% upon six years’ service (Level 3) plus a wage scale market adjustment of 10% to the Chief Deputy County Attorney position.
2) Approve the appointment of Dan Kalk as Chief Deputy County Attorney at $_________/hour (Grade XXI, Step 5), effective 8/28/2020. Note: If the Board approves the market adjustments in #1) above, the hourly rate would be $44.37.
Background: 1) At the June 2, 2020 meeting, the Board approved the PAC assigned 405 points to the Chief Deputy County Attorney position description placing it in Grade XXI on the salary schedule.
At the September 25, 2018 meeting, the Board approved the Assistant County Attorney position market adjustment of 6% upon three years’ service (Level 2) and 12% upon six years’ service (Level 3) as Brown County Assistant County Attorney. Then on February 18, 2020, the Board approved another market adjustment of 10% to the Assistant County Attorney position in addition to the market adjustments that were approved in September of 2018.
The County Attorney is requesting that the same market adjustments be applied to the Chief Deputy County Attorney position. Attached is the wage range for this position with these market adjustments. Also attached is a Chief Deputy County Attorney salary survey of the 15 comparable counties.
2) County Attorney Hanson is requesting to appoint Dan Kalk, a current Assistant County Attorney, with the consent of the County Board to this position.
Per Minnesota Statute 388.10:
388.10 ASSISTANTS.
The county attorney of any county in this state who has no assistant is hereby authorized to appoint, with the consent of the county board of the county, one or more attorneys for assistance in the performance of duties. Each assistant shall have the same duties and be subject to the same liabilities as the county attorney and hold office during the pleasure of the county attorney. Each assistant shall be appointed in writing and the assistant's oath and appointment shall be recorded with the county recorder. The county board of such county shall fix the salary of each assistant county attorney appointed pursuant to the provisions of this section, and the salary when so fixed by such county board shall thereafter be paid by the county in equal monthly installments upon the warrant of the county auditor during the period for which such salary is so fixed or during such portion thereof as an assistant county attorney continues in office.

Dispatcher. Leah Peterson was employed with Brown County as a Full-Time Dispatcher and recently
resigned from that position on August 17, 2020.

At 9:00 AM, on Tuesday, August 4,2020, the Board of Brown County Commissioners met in Regular Session in Law Enforcement Center Training Room of the Brown County Courthouse/Law Enforcement Center located in New VIm, Minnesota 56073. Commissioners present were David Borchert, Anton Berg, Scott Windschitl , Dean Simonsen (via WebEx), and Jeff Veerkamp, along with County Administrator Sam Hansen, and County Attorney Charles Hanson (via WebEx). NVCAT staff was present and Media Representative Fritz Busch (via WebEx) of the Journal was also present.
Chairman Borchert convened the Regular Meeting at 9:00 AM, at which time the printed agenda was accepted along with the following addenda: remove REA #7 Temporary IPT Heartland Express Bus Driver; remove REA #8 Public Health Staff Layoff; II a. Public Health Nurse Resignation; II g. Public Health Account Technician Resignation; C-2. Commissioner Windschitl report on the Enterprise North meeting; C-3. The County Board considered Brown County Resolution 2020-23 for accepting the $] 0,000 FY21 CVSO Operational Enhancement Grant as follows:

The following Resolution was offered by Commissioner Windschitl and moved for adoption at a Regular Meeting held on August 4,2020 at the Brown County Courthouse, New Ulm, MN:
BE IT RESOLVED, that the County enter into the attached Grant Agreement with the Minnesota Department of Veterans Affairs (MDVA) to conduct the following Program: County Veterans Service Office Operational Enhancement Grant Program. The grant must be used to provide outreach to the county's Veterans; to assist in the reintegration of combat Veterans into society; to collaborate with other social service agencies, educational institutions, and other community organizations for the purposes of enhancing services offered to veterans; to reduce homeless ness among veterans; and to enhance the operations of the county Veterans service office, as specified in Minnesota Laws 2019, Chapter 10, Article I, Section 37, Subdivision 2. This Grant should not be used to suppJant or replace other funding.
BE IT FURTHER RESOLVED by the Brown County Board of Commissioners that Greg Peterson, the Brown County Veteran Service Officer, be authorized to execute the attached Grant Contract for the abovementioned Program on behalf of the County.
