As many as 820 children in New York City Housing

Authority (NYCHA) developments tested positive for elevated levels of lead in recent years, the de Blasio administration has admitted.

Published reports indicated that between 2012 through 2016, 820 children ages five and under living in NYCHA apartments tested positive for elevated lead levels of 5 to 9 micro-grams per deciliter of blood.

Elevated blood-lead levels have been connected with developmental delays in young children.

Since 2012, the Centers for Disease Control and Prevention (CDC) has recommended public health intervention for any child up to five years of age with blood-lead levels of 5 micro-grams or greater.

However, the city’s Health Department was continuing to base its intervention on the CDC’s old 10-microgram standard, the Daily News reported, meaning the 820 positive tests did not trigger a home inspection by the city.

While the Health Department was aware of the elevated lead levels in public housing, it did not notify NYCHA or inspect apartments for lead paint.

The Health Department released the information in response to a media request for data on children in NYCHA housing with elevated blood-lead levels.

Council Speaker Corey Johnson and the Health Department announced that the city was enacting more stringent measures to reduce lead exposure for children, by conducting investigations for all children under 18 years old with a blood-lead level of 5 micrograms per deciliter, according to a

press release.The Health Department has already begun

to conduct these investigations for children in public housing and will begin implementing beyond that by the end of the year, said the press release, which noted that the city’s lead prevention programs had led to a nearly 90

percent overall reduction in the number of children with elevated blood-lead levels.

“Lead poisoning is down almost 90 percent since 2005. But that’s not good enough,” said de Blasio in a statement. “We’ve already made our testing protocols stricter for kids in public housing and we are now extending that standard to the entire city. It’s our job to always push the envelope when it comes to our kids’ health.”

Currently, the families of children with a BLL of 5 mcg/dL and their health care providers receive guidance from the Health Department on how to reduce exposure.

With the program expansion, families will receive an environmental investigation to determine possible sources of lead exposure, which can include lead-tainted cooking ware or toys, peeling paint, food products or contamination from a parent’s place of work.

The expansion will be implemented as a policy change and further codified by City Council legislation, officials said.

City Comptroller Scott Stringer slammed the de Blasio administration for its handling of the elevated blood-lead levels and promised to launch an investigation.

Small businesses would offer “safe haven”

In response to the stabbing death of 15-year-old Lesandro (Junior) Guzmán-Feliz, two Bronx legislators are seeking to compel small businesses to act to protect an injured or endangered child or youth in need of assistance.

State Senator Luis Sepúlveda and Assemblyman Victor Pichardo announced the introduction of “Safe Havens for Endangered Children” legislation this past Tues., July 10th.

The proposed bill, to be known as “Junior’s Law,” comes after Guzmán-Feliz was dragged from the Chiky and Cruz bodega where he had sought refuge and was stabbed to death allegedly by street gang members that had been chasing him, incidents that were captured on surveillance videos.

Joined by the slain youth’s father, community leaders and elected officials gathered at a press conference outside the grocery store on East 183rd Street and Bathgate Avenue where the teen was murdered.

Advocating for “Junior’s Law”

Sepúlveda and Pichardo said the Safe Havens bill would also amend the education law to help create “Safe Walking Home Zones” by having school officials work with local chambers of commerce to create safe pathways to and from schools.

A second piece of legislation would also require small businesses to keep and maintain First Aid kits on their premises.

“While the bodega owner where the incident occurred did try to help, and did call 911 twice, according to police, we want to make sure that any business owner or their employees who encounter a situation involving a minor who has been abused or may be in danger has a duty to try to help,” said Sepúlveda. “Community businesses should be safe havens for our youth. They should promptly notify police.”

“The murder of Junior has devastated our close-knit Bronx communities,” said Pichardo. “We as legislators must do more to address the scourge of gang violence that has claimed far too many lives here. The safety of our children and families is always paramount.”

Father Lissandro Guzmán said, “With all my heart, I hope this bill that carries my son’s

name gets passed so it can prevent situations like this from happening again, and so we can create more security for our beloved children.”

As currently drafted, the bill would mandate that if a business with fewer than 50 employees fails to “provide a safe refuge

for a child who had physical injury inflicted upon him or is in imminent danger of such injury until authorities arrive,” it would be subject to penalties to be determined by the Commissioner of the State Office of

El 30 de junio se celebró el primer aniversario de un tiroteo fatal en el

hospital Bronx-Lebanon en mi distrito.

Un paciente y múltiples médicos recibieron disparos. Una médica, la Dra. Tracy Tam, fue asesinada.

La Dra. Tam ni siquiera debería haber trabajado en Bronx Lebanon ese viernes a fines

de junio de 2017.En realidad estaba cubriendo

un turno para otro colega. Mi corazón está con la familia de

June 30th marked the one-year anniversary of a fatal

shooting at Bronx-Lebanon Hospital in my district. One patient and multiple physicians were shot. A physician, Dr. Tracy Tam, was killed.

Dr. Tam should not even have been working at Bronx Lebanon that Friday in late June of 2017.

She was actually covering a shift for another colleague. My heart goes out to Dr. Tam’s family,

her colleagues and to the others who were wounded that day.

This incident is a painful reminder that we must do more to ensure that all of our healthcare workers – including physicians – have a safe and secure work environment. We must do everything in our power to protect these professionals, who have dedicated their lives to improving the health and well-being of others.

That is why I have joined with my Senate colleague, Rich Funke from Rochester, to introduce legislation to make it clear that physicians are among the medical professionals who are protected under our penal law. Current law has strong protections for assaults against registered nurses, LPNs, paramedics, public health

sanitarians and several other workers – but it does not include doctors.

It must.Our legislation, the Physician Protection

Act, would address this glaring omission. It would make it clear in the law that licensed physicians are given the same level of protection as other healthcare professionals while also ensuring that those providing direct patient care are covered in all practice settings.

According to the Bureau of Labor Statistics, 74 percent of all non-fatal assaults that happen within the workplace involve healthcare workers. Studies cited in a 2016 New England Journal of Medicine (NEJM) article on workplace violence found that 78 percent of emergency physicians have reported being targets of workplace violence in the prior year with 21 percent being physical assaults. One third of pediatric residents reported being assaulted during their training.

The 2016 NEJM article also found high rates of abuse toward family physicians, primarily by patients displaying narcotic-seeking behavior. While physicians work to help those suffering from drug addictions, they should not be harmed trying to do so.

The Mayor’s Office of Immigrant Affairs (MOIA) has announced

that it is coordinating a multi-agency effort to offer services to the children who were forcibly separated from their parents and sent to New York City as part of the Trump “zero tolerance” policy.

Services for separated children

“New York City has stepped up to provide more resources for the separated children in our city,” stated the MOIA. “Under the city’s investment in immigration legal services, we’re offering additional legal help to these kids and potential sponsors.”

Services will include legal services, physical and mental health care, as well as increased security at day facilities and during transportation from intake centers to foster homes. Specialized New York Police Department (NYPD) patrols will provide the security.

City officials, including David A. Hansell, Commissioner of the NYC Administration for Children’s Services, and MOIA General Counsel and Policy Director Sonia Lin, spoke at a briefing on July 3 about the initiative.

Although the separated children are in the city under the jurisdiction of the federal government, which holds contracts with the nonprofit agencies currently providing care, city officials are offering direct services. The latter will include training for foster parents and staffers at the day facilities where the children spend most of the day.

“We’ve visited some of the facilities where these kids get services, and we’ve seen children who range in age from infants to teenagers,” said ACS Commissioner Hansell. “They’re resilient, but they’re also

frightened, confused, and in some cases clearly traumatized. While these children are under the care and legal responsibility of the federal government, they are in New York City now and we are doing everything in our power to make sure they are safe and healthy.”

Mental health services will include on-site child and adolescent psychiatric

consultation services to agency mental health staff caring for the children. Recreational and educational services will also be offered, from field trips to museums and zoos to toys, teddy bears, art supplies, soccer balls, and children’s books.

It’s an assault.

Gary LaBarbera, President of the Building and Construction Trades Council of Greater New York, said the current state of affairs in the United States, including recent Supreme Court decisions, amounted to an “assault on working men and women.”

LaBarbera was referring to the Supreme Court’s recent Janus v. AFSCME ruling, which decided that public sector unions no longer can collect agency fees.

“Whether it’s in the public sector with this terrible Janus decision, or the private sector or in the building trades, we’re all in the same fight,” remarked LaBarbera. “The fight is to preserve middle class careers, middle class jobs, and a middle class lifestyle.”

The impact is already being felt in New York State, where State Comptroller Thomas DiNapoli already announced that state employees who do not belong to a union will no longer have “agency shop fees” deducted from their paychecks beginning July 11 for administrators and July 19 for rank-and-file workers.

“I will go after companies that use their outsized powers and influence to protect themselves from lawsuits, accountability, transparency, because forcing workers to sign mandatory arbitration clauses as a basic condition of employment denies them a right to their fair day in court,” stated James.

She said she takes issue with arbitration contracts as a precondition of employment.

“It’s these contracts that have allowed for this corrosive and abusive behavior to continue,” she remarked.

LaBarbera threw his support squarely behind James for Attorney General, noting her longtime alliance with organized labor.

“She is not afraid to stand up and say, ‘Union,’” LaBarbera said. “She’s not afraid to take on power.”

Stuart Applebaum, President of the Retail, Wholesale and Department Store Union (RWDSU), said James had fought for the working class as Public Advocate, “and that’s why Tish James is better prepared than anybody else as Attorney General.”

“We’re all in the same fight,” said Gary LaBarbera, President of the Building and Construction Trades Council.

The bill to require First Aid kits in small businesses would amend state labor and public health laws to require small businesses to have and maintain a first aid kit on the premises at all times. Compliance would be checked during regular health or safety inspections.

“We need to ensure that businesses are equipped to help those who are injured to save lives,” said Sepúlveda.

Twelve alleged members of the Trinitarios gang are now under arrest in connection with the June 20 attack. They

face charges of murder, manslaughter, gang assault and criminal possession of a weapon, according to police.

“Junior died because we failed as a community,” said community advocate David Aviles. “Many could’ve help him at

any given point in this horrific attack, but choose to stand down and not provide any human compassion to him We the people have vowed to let no other child in danger go without help. We must be every child’s keeper.”

“We need to ensure this never happens again,” added educator Luis Torres. “Parents cannot continue to bury their children. We as a community must work together to find solutions to problems the plague our community.”

medical associations including the State Academy of Family Physicians, and an Albany-based physician who was the victim of an assault in his practice two years ago.

The physician, Dr. Christopher Gabriels described how on an otherwise quiet day a man walked into his office, pulled out a gun and assaulted Dr. Gabriels and his father, another practicing physician. Dr. Gabriels was able to fight back and the man ran away. However, based on what the man left behind in a bag, the

doctors believe he intended to seriously harm and rob them, or worse. As Dr. Gabriels said at the news conference, this violent assault has changed the way he practices medicine.

Sadly, there are stories like Dr. Gabriels and Dr. Tam that have been repeated across the state. And we know that hospitals, clinics and physician offices are instituting new policies and procedures to increase security and readiness like practice drills, improved communications and other measures.

However, many offices do not have the financial means to hire security guards, install security systems or retrofit physical space. Instead, it is incumbent on the state to extend the same protections in law that we have in place for other healthcare professionals to physicians.

This is critical both to serve as a deterrent

and also to demonstrate to physicians that we value their service. In my community, we face severe shortages of physicians in primary care and other specialties. We do not want a lack of safety and security to serve as another barrier to physicians practicing in our neighborhoods, both urban and rural.

Finally, right now the law spells out specific settings like hospitals, nursing homes and hospital emergency or surgery

centers where those providing direct patient care are protected. With more and more care being provided on an outpatient basis in clinics, private offices and other ambulatory care settings, we must be sure that healthcare workers providing direct patient care are covered under the law, regardless of where they are providing such care.

These are loopholes in our law that must be closed so that those who devote their careers to the care of others receive the

protections they so richly deserve. I am so proud of these local heroes who call New York home.

I am looking forward to passing the Physician Protection Act this session so no physician is left less protected than their healthcare worker counterparts.

“It is about time that somebody stood with labor and fought for basic protections,” added Gina Strickland, First Vice President of CWA Local 1180.

Since announcing her candidacy for Attorney General, James has received the endorsement of ten major labor unions, including 1199 SEIU, 32BJ SEIU, TWU Local 100, DC 37, and the New York State Nurses Association (NYSNA).

James explained that as Attorney General, she would form an Arbitration Review Team to screen complaints from workers subjected to forced arbitration and bring enforcement actions.

She said she would push for state legislation to ensure that companies cannot hide behind non-disclosure agreements in matters involving harassment.

“It’s really critically important that individuals have the right to seek action in court regarding allegations of sexual harassment or other types of abuses,” said James.

She also said she would “not hesitate” to prosecute violators of New York’s Labor Law and corporations suspected of wage theft, focusing on problem industries, and

also seek legislation that would allow workers with successful wage theft claims to put liens on businesses.

James noted that more radical worker protections were needed in the wake of decisions being made in Washington, and suggested her progressive background compared favorably with that of her opponents in the Attorney General’s race.

“There’s no denying my progressive credentials,” James remarked. “There’s no denying that I have been a strong voice on a wide range of issues in the city and state of New York. I look forward to debating anyone who calls into question my credentials or my ability to speak truth to power.”

“It is horrifying that the Department of Health kept this information under wraps and it is outrageous that the city continues to justify and minimize this scandal,” Stringer said in a statement.

“Today, we are launching an investigation to hold officials accountable from the Department of Health to NYCHA to City Hall. Nothing is more important than protecting the most vulnerable children in our city,” he said. “Our investigation will look into the city’s procedures for addressing lead poisoning hazards to protect the health of all children. Agencies must be held accountable for coordinating and following all laws as well as best practices to keep our kids safe and healthy.”

In a July 9 interview with NY1, de Blasio revealed that there could be as many as

130,000 NYCHA apartments contaminated with lead – nearly three times the number the city gave last November.

Hasta 820 niños en desarrollos de la Autoridad de Vivienda de la Ciudad

de Nueva York (NYCHA, por sus siglas en inglés) dieron positivo a niveles elevados de plomo en los últimos años, admitió la administración de Blasio.

Los informes publicados indicaron que entre 2012 y 2016, 820 niños de cinco y menos años que vivían en apartamentos de NYCHA dieron positivo para niveles elevados de plomo de 5 a 9 microgramos por decilitro de sangre.

Los niveles elevados de plomo en la sangre se han relacionado con retrasos en el desarrollo de niños pequeños.

Desde 2012, los Centros para el Control y Prevención de Enfermedades (CDC, por sus siglas en inglés) han recomendado la intervención de salud pública para cualquier niño de hasta cinco años de edad con niveles de plomo en la sangre de 5 microgramos o más.
