the pursuer, William Middleton, junior, wright, Dykelands, the defender John Brebner, railway contractor, Dunthill. It appears that the pursuer entered into a written agreement with the defender in November last, to serve him as wright until the term of Whitsunday next, at the rate of 18s per week. He accordingly entered into the defender's service, and continued therein until about the 12th April last, when he was dismissed by the defender upon the grounds that he refused to work an additional hour each day, without receiving any additional pay. The pursuer, therefore, raised an action of damages against the defender for breach of bargain -- when the defender pleaded that the pursuer was receiving extra wages, and therefore he was entitled to extra work; but as there were no hours of labour specified in the agreement, the Sheriff found that the defender had no case, and decerned against him for damages and expenses, which amounted to nearly £4 sterling.

ago, John Brebner was a working dyker in and about Banchory-Devenick. In this humble occupation he had a name for the stability of his jobs and the way he pushed his work along, and, some time after the Aberdeen line began to be made, he got a sub-contract. From the prices then given for this sort of labour, Mr. Brebner's contract turned out a most fortunate affair -- in fact, it made him, as the undertaking made several others of his class. Having thus had a pretty round sum at his banker's, he was able to take in hand works on a larger scale; and his success in his undertakings may be fairly guessed at when it is stated that, at the commencement of the present year, when he died, he held contracts for the whole of the Pitcaple and Turriff Railway (eighteen miles in length), the whole of the Alford Valley Railway (sixteen miles). a section of the Keith Extension, and a large section of the Inverness and Aberdeen Junction Line. The number of men he kept in employment was enormous -- no fewer than 1400 being engaged on the Pitcaple and Turriff contract alone. The value of his working stock was also, of course, great. In the one article of horses he had a comfortable fortune -- those belonging to his estate, and working on the Pitcaple line, being set down as worth not less than £4000! When, six months ago, Mr. Munro (of Kinnear and Munro, solicitors, Stonehaven) was, by order of the Court of Session, appointed judicial factor for Mr. Brebner's estate, we believe he was entrusted with one of the largest factorships ever given to a Scottish agent. In a slump, it has been named at £300,000, and we have reason to know this does not exceed the actual amount. So much for energy, had work, and another virtue -- shrewdness. John Brebner was never but three months at school, one winter he had a pound or two by him; and though his correspondence was not quite according to Johnson, he was a most expert and accurate calculator, and so orderly in his business habits that, till within a day or two of his death, it is stated, he kept a memorandum book with the most minute particulars of what he was doing himself, and how his undertakings were progressing. He worked too hard, however, body or brain could not stand it, and the humble dyker of a dozen years back died in January last, one of the wealthiest contractors in Scotland."

From Wikipedia, the free encyclopedia Sir Alexander Brebner CIE (19 August 1883 - 5 March 1979) was a British civil engineer who spent most of his career in India. Brebner was born in Edinburgh , where he was educated at George Watson's College and the University of Edinburgh . He joined the Indian

Public Works Department as an Assistant Engineer in 1906 and was promoted to Executive Engineer in 1912. He was appointed Under-Secretary in Bihar and Orissa in 1919 and Under-Secretary to the Government of India later the same year, a position he held until 1923 when he was promoted to Superintending Engineer. He served as Chief Engineer to the Government of India from 1931 until his retirement in 1938.

Returning to his native Scotland , Brebner served as Chief Divisional Food Officer for Scotland with the Ministry of Food from 1940 to

1942 and Licensing Officer for Scotland with the Ministry of Works from 1942 to 1954. He also served on the Council and Executive of the National Trust for Scotland until 1961 and on the Board of the Scottish Special Housing Association from 1954 to 1961, and was Acting Secretary of the Royal Scottish Academy from 1954 to 1955.

Brebner was appointed Companion of the Order of the Indian Empire (CIE) in the 1920 New Year Honours and was knighted on his

retirement from India in 1938.
