Mr. Bratcher and Mr. Whitlock,

Yates Petroleum Corporation would like to submit the following plan of work to you regarding the release that occurred at the above mentioned facility on November 6, 2013. The release was 80 barrels produced water and 20 barrels of oil, with ho amounts recovered. The release occurred as a result of a cow knocking a valve open on the wellhead. The release flowed across the production pad and into the pasture off the west side of the pad. After the release occurred, Yates excavated all visually impacted soils from the pad area (approximately 6") and off pad area (approximately 1 '-1.5').

Initial TPH/BTEX and Chloride delineation samples were taken and were sent to a NMOCD approved facility. The release area was split and sampled in two separate sections (off pad composite and pad composite), please see analytical report H400013. The initial analytical results showed elevated chloride levels in the off pad composite sample at 3', and as a result Yates did further vertical delineation in the off pad composite are, please see analytical report H400424.

Based off of vertical delineation analytical results, Yates Petroleum Corporation proposes the following.

Production pad: » 1' to be excavated and backfilled with clean-like materials.

Off Production pad: o Yates feels that the elevated chlorides found at 3' in the off pad area are a result of an

isolated chloride pocket that we feel will not cause harm. Yates proposes to only backfill the area that has already been excavated with clean-like materials.
