2 India: Country-wide B2G Feedback Loops on Business Regulation Reforms
2.1 An Approach Note
2.1.1 Background
1. In late 2014, the Department of Industrial Policy and Promotion (DIPP) prepared an ambitious action plan for implementing business regulatory reforms in all States and Union Territories (UTs). The Action Plan consisted of 98 specific reforms in a range of regulatory areas. The States and UTs were expected to implement these and report back on reforms implemented, including reforms that they may have introduced prior to the preparation of the Action Plan. They were also required to provide adequate justification for their reform claims. Following an exercise to validate the reforms claimed by the States, DIPP published a report in September 2015 on the State of reform implementation in the various jurisdictions, Assessment of the State Implementation of Business Reforms.
2. A powerful feature of this pioneering exercise was a ranking of States and UTs in terms of their reform record. This report, including the ranking, drew considerable attention and catalyzed healthy competition among the jurisdictions for carrying out further reforms and improving their score. The role played by the competitive urge is reflected in the fact that, in the one year following the publication of the report, more reforms have been carried out in the relatively lagging States than in the ones with the highest ranks, thus resulting in some convergence in the scores and changes in ranks. Meanwhile, DIPP expanded the number of reform actions to 340 and, in December 2015, issued a guidance note on these reforms, Business Reform Action Plan for States/UTs- Implementation Guide for States.
3. The validation of the reforms has so far been an intra-governmental exercise whereby DIPP checked the reform claims of the States and UTs based on evidence presented by them. This evidence is largely about reforms on paper and does not demonstrate whether reforms are being implemented well on the ground and being felt by the intended beneficiaries, i.e., the businesses. In order to address this gap, DIPP now intends to carry out a fairly comprehensive business-to- government (B2G) feedback exercise whereby data will be collected from businesses on the implementation quality of the reforms claimed by the States and UTs. This note lays out an approach and options for carrying out such an exercise.
4. The note has benefited from the useful deliberations at a November 23, 2016 meeting organized by DIPP with the participation of government officials, private sector representatives, think-tanks and donors. The meeting identified a number of issues to consider related to the design and deployment of B2G feedback exercises. The meeting also highlighted the need to be clear about the objectives of the exercise and suggested that the aim of the exercise should be to be close implementation gaps in specific reform areas as well as build a sustained accountability culture in government, based on regular feedback from stakeholders.
5. It is expected that the feedback exercise will be repeated every year. This will not only help assess if the overall quality of reform implementation is improving but also, for individual reform areas, whether corrective actions taken following an initial feedback survey has led to results. On the latter, individual States may decide to carry out feedback exercises on their own during the course of a year without waiting for the annual nation-wide exercise to assess the impact of corrective actions.

6. Six surveys shall be carried out in each State and UT, each of which will cover one or more of the 12 regulatory areas included in the Business Reform Action Plan for States/UTs. Each survey shall have a minimum sample of 75 firms; however, in some cases the number of enterprises experiencing a particular regulatory interface in the jurisdiction may be small and thus an exception may need to be made to this general rule. There is likely to be little overlap in the samples for each of the surveys. This means that, at a minimum, 400-450 firms will be covered in each State, resulting in around 16,000 respondents country-wide.

8. In each survey, it will be difficult to cover all the recommended reforms. However, that is not necessary for a couple of reasons: a) Since the feedback exercise will cover all jurisdictions (States and UTs) only reforms carried out by all States should be included for comparability purposes; and b) The core purpose of this year’s feedback exercise is not to produce a comprehensive assessment of implementation on the ground but to show that reforms on paper may not necessarily translate into reforms on the ground, and that B2G feedback loops are useful ways to obtain alerts on implementation gaps leading to corrective actions by the relevant government agencies. Thus, a selective approach may be taken in order to keep the exercise manageable yet powerful.
9. DIPP may select the reforms to be covered in each survey in consultation with the States and UTs. Once the final selection has been done, the list will be binding on all jurisdictions. A State or UT may include additional areas outside this core list if it has a particular interest in these. However, to maintain comparability, the feedback scores for such reforms will not count as part of the overall score for each State.
Questionnaires
10. The feedback questions will be fairly granular and either binary or multiple-choice. The bulk of the questions will be quantitative but some may be open-ended to allow comments and suggestions. Only the quantitative answers will feed into the scores. For each State, the scores will be aggregated over all the six surveys to yield an overall score for the State. The scores may be presented as a percentage with the gap between 100% and the actual score being a measure of the average implementation gap for that State. Such quantification will allow comparisons across jurisdictions as well as over time (in the latter case, care has to be taken to ensure that the comparisons are valid since it is likely that the coverage of the surveys will change each year).
11. The score for each reform may have equal weight in the aggregation. However, if there is a consensus that some reforms are more important than others, these may be given greater weight. If a separate survey is carried out asking businesses which areas are more important than others (e.g. a “pain-point” survey), it may be possible to assign weights based on this.
12. For each survey, DIPP may come up with a list of questions and each State/UT shall ask that common set of questions. Ideally, there should be no more than 20 questions per survey. Since very few firms are likely to be covered by more than one survey, this will be a manageable burden for the surveyed firms.
Survey sampling
13. The survey samples should be fairly representative in terms of age, size, location, sector and gender of owner. The sampling sizes for each of these categories may be decided in consultation with experts who are familiar with the enterprise landscape of various States. One question to resolve is whether the composition of the samples in terms of the above features will be the same across the States for a particular survey or should it vary by States. The latter option may better capture the characteristics of each State’s enterprise sector but may make inter-State comparisons less robust.
14. One of the important first tasks is to identify the sampling frames for each of the broad regulatory areas. For each area, each State will identify the data source for locating the enterprises that have experienced the regulatory interface. For example, in the case of construction permits, it could be the list of architects who have helped clients go through that process. Private sector collective bodies may also be able to help develop such a list. Once the list is developed, a representative sample will be selected using an objective process.
Survey methods
15. There are two broad categories of feedback-gathering methods, i.e., paper-based survey vs. technology-enabled survey, each with their pros and cons. Moreover, there are several options that leverage technology, each with its advantages and disadvantages. The main advantages of the technology-based surveys are low cost, greater reach and automated and real-time analysis (the second advantage is especially true for telephone surveys and mobile-based surveys conducted through SMS or Interactive Voice Response systems, and less so for internet or smart-phone surveys since many small firm owners may not have easy access to these technologies). However, technology-based surveys often yield low response rates compared to face-to-face surveys. These considerations will have to be weighed in deciding the mode of feedback gathering.
16. There are open source tools which can be configured to support both surveys implemented by enumerators and fully online/mobile versions. The advantage of this approach would be twofold: (i) opportunity to collect more specific feedback on reform gaps; and (ii) the ability to fine tune the questionnaire through direct interaction with the respondents. Feedback from the enumerators on which questions the participants found difficult to respond to would help in clarifying the questionnaire for future iterations.
17. A particularly promising technology tool is the mobile-based Interactive Voice Response (IVR) approach whereby firms will receive a call with a pre-recorded voice message (preferably from an important person, such as the Chief Minister or an important minister) highlighting the importance of the survey and conveying the government’s commitment to take follow-up action based on the survey findings. The message will be followed by a small number of audio questions designed to get feedback on implementation quality. The responses are submitted using the keypad of the mobile phone and are processed immediately by the technology-enabled feedback platform and enter into a dashboard that will produce the summary statistics of interest. To ensure that only the target group will answer the feedback survey and to increase the likelihood of higher response rates, this method will require the collection of the phone numbers of the firms to be surveyed.
18. With such an approach, the surveys can be rolled out simultaneously for all six areas in all jurisdictions. However, since a communication campaign will be needed to build awareness of the feedback exercise and trigger adequate response, government may decide to stagger this exercise, with two surveys (covering two areas) rolled out every 2 weeks. All six surveys can then be completed in 6 weeks. If it takes 2 weeks to get an adequate response for each survey, then the entire feedback exercise can be completed in two months.
10. For the initial feedback exercise, it may be preferable to opt for telephone or face-to-face surveys, with
appropriate technology support. Given the relative complexity of the survey and the need to zero in on root causes of reform gaps this approach may yield more useful information. Follow up surveys could be done online or through mobile, perhaps at 12 month intervals. If this is done, 60-70% of the questions may remain the same to allow comparisons over time, with the new questions focusing on persistent implementation gaps or emerging issues.
20. The surveys may be augmented with effective use of social media. Depending on the level of social media savviness, these channels could be utilized to promote participation in the survey, collect additional feedback to help explain survey results once they are published and promote advocacy by businesses to close the implementation gaps identified. If resources and mandate permit, approaches such as Indonesia’s Citizens’ Aspirations and Complaints Online System (LAPOR) may be used to collect feedback on specific reform implementation issues in lagging jurisdictions, using a case management system like Indonesia’s to direct this feedback to the appropriate authorities.
Use of the results
21. The feedback scores may be used to generate a ranking of States in terms of de facto reform implementation. It is quite possible that such a ranking will be different form the current ranking, which is a ranking of de jure reforms (or reforms on paper). Such a divergence will send a powerful message since it will show clearly that reforms on paper do not necessarily mean reforms on the ground and thus, a State which does well with de jure reforms may not do well with de facto reforms. The two rankings may be presented side-by-side. Alternatively, the current de jure ranking may be modified by combining it with the de facto ranking to produce an Implementation Quality- adjusted Reform (IQRI) Index. Such a composite index will reward States for both carrying out reforms on paper (which is important, especially at the early stages of a reform momentum) and for paying attention to implementation on the ground. The relative weights given to de jure and de facto reforms in calculating the composite index may change over time, shifting in favor of de facto reforms.
22. The ranking may help generate an implementation momentum whereby different jurisdictions compete to take corrective actions and reduce/close the implementation gap. A first step for the States and UTs will be to organize meetings with businesses in order to better understand the findings, discuss and agree on corrective actions, and signal the government’s commitment to taking such actions. A follow-up feedback exercise after a few months can validate if the corrective actions have improved the implementation quality.
23. Annex 1 contains examples of questions (related to some of the reform areas to be covered) that may be asked in the feedback exercise. Annex 2 describes the approach for constructing the Implementation Quality-Adjusted Reform Index.

• Implementation quality index for a reform area for a State
• Combined implementation quality index across all reform areas for a State (IQ index)
• Implementation quality adjusted reform index for a State (IQRI index)
The following sections explain how these indices may be constructed, with the help of a few hypothetical examples.
A. Implementation Quality Index for an individual reform area for a State
Consider the case of an Online Single Window reforms. Here are hypothetical answers from a respondent (the
tick marks show the answer). Here, for reference is the scoring criterion.

Note that for Yes/No answers, a Yes scores 1 and a No scores 0. For other Statements, the scores are self-evident. In this case, the maximum score possible is 30. For this respondent, the score is 18 out of 30, i.e., 0.60. If the respondent answers NA to one or more Statement, the number of Statements with a NA response will be taken out of the denominator. Thus, if 4 Statements had a NA response, the score will be out of 6 in this case. If we take the average score for all respondents in a State/UT, we shall get the Implementation Quality Index for this particular reform area (in this case Online Single Window) for this State/UT. We may call this IQij, i.e., implementation quality index for reform area “i” for State/UT “j”.
Please note that we have assumed equal weights for all the 10 Statements for this reform. Another option will be
to consider differing weights if some outcomes are considered more important than others.

Here is a hypothetical example of the IQ scores across all areas for a State or UT. For illustrative purposes,
we have only listed areas for which we provided sample questions in Annex 1. However, the same principles will
hold true if other areas are added.

In this hypothetical example, the un-weighted Overall Implementation Quality (IQ) Index for this particular
jurisdiction (State or UT) is 0.532, where a score of 1 would be considered very high quality implementation.
When different weights were used for the different reform areas, the Overall Implementation Quality Score
was better because the jurisdiction happened to do well in some of the areas with higher weights, such as
single window clearance and labor registration enablers. In this example only two types of weights were used,
i.e., 1 and 0.5, but a wider range of weights can of course be used. It should also be noted the weights used here are
purely arbitrary for only for purposes of illustration.
C. Implementation Quality Adjusted Reform Index for a State
Once the Overall Implementation Quality (IQ) score is obtained for any jurisdiction, it may be multiplied
by the Reform Implementation Score currently given to the States and UTs to arrive at the Implementation
Quality Adjusted Reform Index for a State (IQRI). When this is done for all jurisdictions, an alternative
ranking will emerge, that provides a de facto, rather than only a de jure, picture of relative performance. Here
is a hypothetical example which shows how ranks may change once the quality of reform implementation is
taken into account.

As we can see in this hypothetical example, there is considerable difference in the IQRI Score for many
jurisdictions. In this hypothetical example, the top ranking State in de jure terms remains at top even after
the rank is adjusted for the quality of implementation. We also note that of the 10 top ranking jurisdictions,
eight suffer a decline in ranking (in some cases by a significant amount) once the de jure rank is adjusted
for implementation quality. Among the States/UTs that ranked between the 11-20 positions in the de
jure ranking several see an improvement in ranking. This suggests that, in our hypothetical example,
jurisdictions that were a bit behind the leading reformers (de jure) on average did better in terms of the
quality of implementation. De facto they recovered some ground compared to their de jure ranking.
This hypothetical example indicates the importance of assessing implementation quality. Such an
assessment, which gives a more accurate picture of what businesses are experiencing on the ground, may
show a different picture from a de jure ranking. As mentioned before, the IQRI index does incorporate
reforms on paper while also looking at implementation on the ground. Thus, States and UTs do get
credit for carrying out reforms on paper. In the early stages of a reform momentum, reforms on paper
are not unimportant.
