BOTSWANA >> Regulation Overview Second Hand Vehicles

Botswana has with immediate effect banned all imported second-hand vehicles from passing through its territory, a development that will affect imports from Europe through Namibia. Zimbabweans who import European vehicles through Walvis Bay Port in Namibia mostly drive through Botswana, though some go through Zambia via the Trans-Caprivi Corridor rather than the Trans-Kalahari Corridor. South Africa already has a similar ban in place and cars from Asia that come through Durban Port must be ferried on vehicle carriers up to Beitbridge. This significantly increases the cost of importing a vehicle into Zimbabwe.

The main reason for the ban is in compliance to the Road Traffic Act Sections 6 and 16, which states that only vehicles registered in Botswana are allowed on the road. Any unregistered vehicle found on Botswana's roads will be impounded according to a circular released on 19/12/13. Vehicle importers must use registered car transporters or flat-bed truck carriers. South Africa took a similar step 5-years ago.

SOLUTIONS

Registering the car in the country of arrival on the continent [Namibia if Walvis Bay, South Africa if Durban], then comply to the regulations of Botswana to allow the vehicle to drive through Botswana

Carry the car on a registered car transporter or on a train

Both solutions might be costly for the carrier.

Restricted Imports

These are goods, whose importation require a permit issued by a Regulatory Authority or are subject to quantitative restrictions. From time to time, the Ministry of Trade and Industry publishes Restricted Imports and Exports Regulations detailing restricted imports and exports as well as the manner in which the restrictions are to be applied. The Regulations may change in a very short time, especially with respect to agricultural goods, and it is therefore essential that if a traveler or trader is in any doubt of whether the importation or exportation of a specific group of goods is prohibited or restricted to contact any BURS (Customs & Excise Division) office. Domestic Animals

Importation and exportation of domestic animals is closely regulated for public health reasons and wellbeing of the animals. Pets and livestock may be imported into Botswana subject to an Animal Health Certificate issued by the Director of Animal Health and Production, Private Bag 0032, Gaborone, Botswana. (Note: A valid Certificate

Importation and exportation of wild animals or their products (trophy or meat) is prohibited unless accompanied by an export permit issued by the Department of Wildlife and National Parks, P.O. 131, Gaborone, Botswana. Plants, Seeds, Fresh Produce and Bulbs

These may be imported subject to plant health restrictions. Details in this regard can be obtained from the Chief Agricultural Research Officer, Private Bag 0033, Gaborone, Botswana. (Note: South African transit permits may also be required in respect of plants shipped through South Africa. Soil is considered the loose surface material of the earth in which plants, trees and scrubs grow. In most cases the soil consists of disintegrated rock with an admixture of organic material and soluble salts. The importation of soil is prohibited unless accompanied by an import permit from the Director of Crop Production and Forestry, Private Bag 003, Gaborone, Botswana. Boats

No boat, mokoro or aquatic apparatus may be imported into Botswana unless the owner is in possession of an Import Permit issued by Department of Water Affairs. Firearms and Ammunition

Firearms and ammunition may only be imported into Botswana upon production of a Police permit issued by the Central Arms Registry, P O Box 334, Gaborone, Botswana.

The issue of firearms licences in Botswana is strictly controlled and all firearms imported under the authority of an import permit must be licensed immediately upon arrival in Botswana.

The importation of firearms, which do not have the manufacture’s serial number or other number by which they can be identified, stamped or engraved on a metal part of the weapon, is totally prohibited.

It should also be noted that Police permits for firearms are issued on a limited quota basis and there can be a considerable delay in obtaining a permit, particularly on first importation. It is advisable for importers to make application well in advance of dispatch so that unnecessary inconvenience and expenses are avoided.

The Standards Import Inspection Regulation established in 2008 as provided by section 16 of the Standards Act of 1997 under the Ministry of Trade and Industry states that an imported commodity must be accompanied with a Compliance Certificate.

Bureau Veritas has been notified to issue Compliance Certificates for several groups of products (see following pages) exported to Botswana.

Under SIIR Programme, Bureau Veritas carries out verification of conformity to standards,physical inspections / sampling in the country of supply prior to shipment, laboratory testing when needed, and issuance of certificate.

Government Services & International Trade (GSIT)

The Standards Import Inspection Regulation established in 2008 as provided by section 16 of the Standards Act of 1997 under the Ministry of Trade and Industry states that an imported commodity must be accompanied with a Compliance Certificate.Bureau Veritas has been notified to issue Compliance Certificates for several groups of products (see following pages) exported to Botswana.

STANDARDS IMPORT INSPECTION REGULATION

IN BOTSWANA

Bureau Veritas is one of the most widely represented Conformity Assessment companies in the world. This worldwide coverage is provided by nearly 1000 offices and 330 laboratories, located in 140 countries on every continent with a total workforce of more than 48 000.

Under SIIR Programme, Bureau Veritas carries out verification of conformity to standards, physical inspections / sampling in the country of supply prior to shipment, laboratory testing when needed, and issuance of certificate.

Exporters to Botswana should present documents showing the conformity of their products in accordance with the specified standards.The Certificate of Conformity (CoC) issued by Bureau Veritas shall be provided to Botswana Bureau of Standards.

By performing missions such as pre- and post-shipment inspection of goods for clients, Bureau Veritas provides customer countries with the level of assurance they need.

Through its International Trade activities – GSIT Division, Bureau Veritas makes a significant contribution to trade facilitation for the benefit of many countries.

BOTSWANA6. Certificate Delivery:The electronic Certificate will be transmitted to the importer and/or exporter. A paper copy of the Certificate of Conformity is required for BOBS. BOBS will issue a Note of Recognition to allow clearance of goods.7. Facilitation Procedures:Frequent traders, who have set a quality system to assure conformity of the products, could benefit from facilitation schemes which reduce the level of intervention on every shipment.

BOTSWANA1. The importer must open a file with BOBS using the form A of the SIIR, 2008. To open the file, he/she must include the following documents:

• Application fee • Samples if not inspected/tested prior• Packing list• Pro forma Invoice• Transport document• Compliance certificate from Bureau Veritas

EXPORTING COUNTRY2. Contact with the exporter:The Regional Centre (RC) in the region of supply is in contact with the exporter requesting when/where the goods will be ready for inspection and the following information:

1. Technical details of the products,2. Available conformity documentary evidence, such as:

• Third party Certificate of Conformity to relevant safety standard (Botswana or international standards)

• Third party Test reports,3. Documentary Check:The Regional Centre evaluates all the information provided by the exporter to verify whether the product complies with the required standard. If insufficient proof of conformity, samples will be taken for control testing in an accepted laboratory.4. Physical Verification:The objective of the physical verification is to ensure that:

• The goods being shipped are those identified in the documentary checks;• The goods are in compliance with the relevant standards (including Botswana specific

requirements);• The goods are in compliance with the importer’s inspection order.

If any doubt, inspector will take samples for control testing in an accepted laboratory. Critical non conformities will result in a rejection of shipment and Discrepancy Report issuance. Used vehicles will be inspected upon arrival. Upon satisfactory inspection a specific certificate will be delivered for Customs clearance.5. Certification of Conformity:With satisfactory inspection report, conformity documents and/or laboratory control test reports, the Regional Centre evaluates the compliance of the shipped products with the required Standards. If full compliancy is established, an electronic Certificate of Conformity is issued.
