TITLE, APPLICATION, PURPOSE AND OBJECTIVES _. -

Section 101 TITLE AND SHORT TITLE --- 101.1

Title

An Ordinance permitting, prohibiting, regulating, restricting and determining the uses of land and watercourses; the size, height, bulk, location, erection, construction, repair, main- tenance, alteration, razing, removal and use of structures; the areas and dimensions of land to be occupied by uses and structures as well as ccurts, yards and other open spaces and distances to be left unoccupied by uses and structures; the intensity of use; and providing for the administration of such Ordinance.

Short Title

This Ordinance shall be known as, and may be cited as, the “Port Carbon Borough Zor.ing Ordinance”.

Section 102 APPLICATION OF ORDINANCE

Except as hereinafter provided, no building, structure, land, or parts thereof shall be used or occupied, erected, moved, enlarged or structurally altered unless in conformity with the regulations of this Ordinance.

Section 103 PURPOSE

The provisions of this zoning ordinance are designed to pro- mote, protect and facilitate the following: the public health, safety, and general welfare; the coordinated and practical development OS the community; and the provision of adequate light and air, vehicle parking and loading space, transportation, public yrounds and other public requirements; as well as

To prevent the followinq: overcrowding of land; blight; danger and congestion in travel and transportation; loss of health, life or properti. from fire, flood, panic or other dangers.

To provide that reasonable consideration be given to the following: the charact.er of the districts and their peculiar suitability f o r particL:I.ar uses and with a view to conserving the value of buildings and encouraging the most appropriate use of land throughout the Borough.

Floor Area or Gross Flox Area: The gross floor space of the building or buildings, measured from the exterior faces of exterior-walls or fr*;m the center line of walls separating buildings. In particular, the floor area of a building or buildings shall include:

ARTICLE VI NONCONFORMING LOTS, USES, STRUCTURES, AND PREMISES

Section 601 STATEMENT OF INTENT - Within the zoning districts established by this ordinance or subse- quent alnendments thcrcto, thcrc cxists or will exist certain non- conformities which, if lawftil before this Ordinance was passed or amended, may be continued, sukject to certain limitations, although such nonconformities would be prohibited, regulated, or restricted under the terms of this Ordiniirrce or future amendments thereto.

To avoid undue hardship, nothing in this Ordinance shall be deemed to require a change in the plans, construction, or designated use of any building on which actual construction was lawfully begun prior to the effective date cf adoption or amendment of this Ordi- nance and on which actual builsing construction has been diligently carried on.

Section 6 0 2 NONCONFORMING LOI.'S OF RECORD

In any district in which single family dwellings are permitted, a single family dwelling and customary accessory buildings may be erected on any single lot of record at the effective date of adop- tion or amendment of this Ordinance, notwithstanding limitations imposed by other provisions 01 this Ordinance. This provision shall apply even though such lot fails to meet the requirements for area or width, or both, that are generally applicable in the district, provided that yard diminsions and requirements, other than those applying to area or width, or both, shall conform to the regulations for the district in which suct lot is located. Variance of yard requirements shall be obtainec? only through action of the Zoning Hearing Board.

If two or more lots, combination of lots and portion of lots with continuous frontage in single ownership are of record at the time of passage or amendment of this Ordinance, and if all of part of the lots do not meet the requ;rements established for lot width and/or area, the land involved shall be considered to be an undivided parcel for the purpose of thi:, Ordinance, and no portion of said parcel shall be used or sold In a manner which diminishes compliance with lot width and/or area recluirernents established by this Ordi- nance, nor shall any division of any parcel be made which creates a lot with width or area below the requirements stated in this Ordinance.

Negligence to apply for a sign permit is punishable by a fine as prescribed by this Ordinance. Payment of said fine does not grant approval to erect a sign.

S c c L i v n 703 INSPECTIONS

It shall be the duty of the Zcning Officer, or his fully appointed reprcsentative, to make the fcllowing minimum number of inspections on property fo r which a permil has been issued:

703.1 At the Beginning of Cor,struction

A record shall be made indicating the time and date of the inspection and the finaing of the Zoning Officer in regard to conformance of the construction with plans submitted with the application for the zoning permit.

If the actual construction does not conform to the application, a written notice of a violation shall be issued by the Zoning Officer, and such violation shall be discontinued. Upon proper correction of the violation and receipt of written notice f rom the Zoning Officer, construction shall proceed.

703.2 At the Completion of Construction

A record.shal1 be made indicating the time and date of the inspection; the findings of the Zoning Officer in .regard to conformance to this Ordinance; and the opinion of the Zoning Officer in regard to the issuance of an occupancy permit.

804 .4 The Zoning Hearing B0a:r.d may conduct a hearing and take ev'idence on a substant:ve challenge and amendment to this Ordinance filed LJ:; a landowner. The Board may further make findings of fact :dative to the challenge, and cause to be made a record or transcript, which may serve as the basis for further acti(-Bn. The Zoning Hearing Board shall nut make recoirunendatio:-is or render an opinion in such matters, and has no auxhority to alter, change, or other- wise grant relief in such cases.

Section 8 0 5 PROCEDURES

805.1 Variance

1) The landowner shall file a request for a variance with the Zoning Officer along with all maps, plans and text which may be relevant to the request. Said request shall be accompanied by a fee specified by the Borough Council.

3 ) Upon receipt of a request for variance, the Board shall establish a {Lime and place to hear said re- quest within thirt:r (30) days.

Sec t ion 807 APPEALS

Appeals f r o m a d e c i s i o n of the : Zoning Hearing Board s h a l l be f i l e d and handled i n t h e manner p re sc r ibed by A c t 247 , as amended, t h e "Pennsylvania Munic ipa l i t i e s Planning Code".

ARTICLE IX ADOPTION AND AMENDMENT

Section 901 RDOPTION

This Zoning Ordinance is adopted in compliance with the provision, of Article VI, Sectior 607 and 608 of Act 247, as amended, known and cited as the "Penrsylvania Municipalities Planning Code".

Section 902 AMENDMENT -

This Zoning Ordinance may be amended from time to time as deemed necessary for the public welfare or convenience, in compliance with the provisions of Article VI, Section 609 and Section 609.1 of Act 247, as amender?, known and cited as the "Pennsylvania Municipalities Planning Code".

902.1 Enactment of Anendment

An amendment to this Ordinance may be initiated by the Borough Council or the Planning Comrnission. Before voting on the enactmen: of an amendment, the Borough Council shall hold a public hearing thereon, pursuant to public notice. In the case of iin amendment prepared by other than the Plan ning Commission, the Borough Council shall submit said amendment to the Planning Commission for recommendations, a least thirty (30) days prior to the public hearing. If, after any public: hearing held upon an amendment the propose( amendment is revised or further revised to include land not previously affected by it, the Borough Council shall hold another public k.earing pursuant to public notice before pro. ceeding to vote on the amendment. Thirty (30) days prior to the public hearing held by the Borough Council, the Boroi Planning Commission shall submit the proposed amendment to the County Planning Commission for recommendations.

Section 903 PROCEDURE UPON CURATIVE AMENDMENT

A landowner who desires to challenge on substantive grounds the validity of this ordinance or any.provision hereof which prohibits or restricts the use or development of land in which he has an interest, may submit a curative amendment to the Borough Council with a written request that his challenge and proposed amendment or amendments be heard and decided in the manner prescribed by Act 247, the "Pennsylvania Municipalities Planning Code" and furthe defined as follows:

The r eques t s h a l l be accompanied by p l ans and o t h e r materials desc r ib ing t h e use or development proposed by the landowner. Such p l ans and o t h e r material may be gene ra l i n na ture , b ~ t should provide a s u f f i c i e n t base for eva lua t ing the c:mllenge.

Any persons, pa r tne r sh ip o r ca rpora t ion who o r which s h a l l violate t h e p rov i s ions of t h i s Zoning Ordinance enacted under A c t 247 a s amended s h a l l , upon conv ic t io , i thereof i n a summary proceeding, be sentenced t o pay a f i n e of no? more than f i v e hundred d o l l a r s ( $ 5 0 0 . 0 0 ) . members of such p a r t n e r s h i p , or o t h e r officers of such corpora t ion s h a l l be liable t o imprisonment f o r not more than s i x t y (60 ) days.
