Page 2 of 3 BrewerandTomEdwardsandthediscussionwasonfundsforEVS,KiwanisOvalgrantmoneyused.TherearedecisionstobemadeandwewillhavediscussioninExecutiveSession.CouncilmanCapozzolireportedthattheywillbehavingcoffeewithacopandthiswillprovidethecommunitywithabetterwaytocommunicatewithourPoliceDepartmentonNovember14thattheCommunityCenterfrom9AM‐11AM.TrickorTreatingwillbeontheAvenuefrom12‐4PMthecrossingguardswillbecrossingandheencourageseveryonetoattendtomeetnewpeopleandseewhatthedowntownhastooffer.CouncilmanCapozzoligaveaspecialthankyoutoparticipatingmerchantsforthatday.CouncilmanCascaranoreportedthathehasbeenintouchwiththechairofPublicSafetyCouncilmanCapozzoliregardingthecrossingonGouldandBloomfieldAvenueandwehavebeentryingtoaddressthisbuttheproblemistheroadisaCountyroad.TheyhavebeenincontactwiththeCountyandwearetryingtofindaresolutionthatisgoodforthepedestriansandthebestinterestofsafety.HehasbeenintouchwithMs.KeenanourCountyLiaisonandboththeMayorandCouncilmanCapozzoliwillbemeetingthisMondayinordertotryandfindawaytoaddressit.NEWBUSINESS:

1. 2015BestPracticesInventory

PaulCarellireportedthatthisiswhatneedstobefiledtotheStateandneedstobememorializedandputontheagendawhichisbasicallywhatthisis.

REPORTOFMAYOR:MayorDassingreportedthatshemetwiththeassistanttotheAdministratorfromVeronaStevenNeilandheexpressedinteresttoEZRideshuttlebusaswell.ThenextstepistohaveEZridemakeapresentationtotheCouncilandVeronawasmeetinglastnightandStevenisgoingtogetbacktomeandletmeknowwhatVeronathinks.Theyarelookingattwobusesstartinga6AMeachbusholds25passengers.VeronahasasoftwareprogramthatresidentscansignupforcommunityrecreationprogramsandtheythinktheycanretrofitittosignupforannualpassesfortheEZride.EverythingwouldbedoneonlineexceptifweweretosellbooksofticketsmaybeatthePoliceDepartmentandtheCommunityCenter.Wewouldneed100riderstocoverthecostofthebuses.TheMayorthankedtheFireDepartmentforanamazingjobat10HatfieldStreettheirbraveryandcommitmentisoutstanding. SewerplantclarifierreplacementwillbeawardedonNovember5,2015. GeorgeLibrizziwillbemovingintothenewtax/financeofficeandheisdoingagreatjobautomating

everything. There‐valhasbeenpushedoffforoneyear. Thetaxmapsarebeingreviewed. AllwindowshavebeenreplacedontheBoroughside.Thelasttwoofficeswillbeworkedonnext.

REPORTOFBOROUGHATTORNEY:GregMascerareportedaboutthere‐valandthecurrentratiointowniswithintheacceptablelimits.Normallywhenacountyordersare‐valbecausetheequalizationratioisbeyondanacceptableratiotheBorough’sratiois92%or93%whichisstillanacceptableratio.Theurgencytohaveanappealisnotthereasitwouldbeinsomeinstances.GreghandedoutadraftedcopyoftheHistoricPreservationordinancethefirstreadingwasonOctober6ththesecondreadingwillbeNovember5ththereweresomechangesthatMs.Buckleyaskedforverificationthatwediscussedanditisimmaterialsothereforeitwillnotrequiretheintroductionoftheordinance.REPORTOFPOLICECHIEF:ChiefBongiornoinvitedalltheresidentstoCoffeewithaCop.Thiswillgiveustheopportunitytomeetyouandyoutomeetus.REPORTOFCOUNTYLIAISON:PatriciaKeenanreportedthattherearetwoupcomingeventsforHalloweenonFriday,October23rdfrom6‐9PMattheIrisGardenstherewillbeJack‐o‐lanternscavedbystudentartistsfromseveralEssexCountyhighschoolswhichwillbelinedupintheGardens.OnOctober24thisaStrutyourMuttParadeattheEssexCountyBrookdaleDogParkandEssexCountySouthMountainDogPark.OPENPUBLICMEETING:MovedbyCouncilmanCapozzolisecondedbyCouncilmanCascaranotoopenmeetingtothePublic.RichardBasta,21WashburnPlacereadaletterfromtheHistoricPreservation.HildaMoore,23PersonetteStreetaskedifthespeedmonitorcanbelookedatshedoesn’tthinkit’sworkingonPersonette.

Paul  I have called several of the references provided by JEV Construction, the apparent low bidder on the clarifier project. I purposely avoided any of the projects involving Hatch Mott McDonald to avoid any conflict of interest.  I received responses from the following four references:  Gary Lattimer, Alaimo Engineering ‐ he stated that JEV is an excellent contractor and they had no problems on the job. William Kirchner, Environmental Resolutions Inc. ‐ he stated that JEV is the best contractor he has ever worked with. Justin Mendinsky, HRG Engineering ‐ good experience, no change orders, quality work. Davis Coats, CME Associates ‐ great submit talks, good work, minor change orders, fairly priced.  Based on these responses, I would recommend the award of the clarifier contract to JEV Construction.  Please let me know if you have any questions.  Greg Seaman

A.ItistheintentionoftheCaldwellgoverningbodytomaintainanagencytoassistintheidentificationofhistoricdistricts,historicalstructuresandlandmarkswithinthemunicipalityandtocreateasystembywhichtoadministerregulationsdesignedtopreserveandregulatesuchhistoricdistricts,historicalstructuresorlandmarksbaseduponarationalplanandobjectivewhichwillcomplementexistinglanduselegislation.

B.Nothinghereincontainedshallsupersedethepowersofotherlocallegislativeorregulatorybodiesorrelieveanypropertyownerofcomplyingwiththerequirementsofanyotherstatestatuteormunicipalordinanceorregulation.

C.Intheeventofanyinconsistency,ambiguityoroverlappingofrequirementsbetweenthisarticleandanyotherrequirementenforcedbythemunicipality,themorerestrictiveordinanceorrequirementshallapply,totheextentthatstateorfederallegislationpermits.

D.Thisarticleshouldnotbeviewedasrequiringorprohibitingtheuseofanyparticulararchitecturalstyle.Instead,theintentionofthisarticleistopreservethepastbymakingthepastcompatiblewiththepresent.

(2)Thetermsforregularmembersshallbefouryears.(3)Alternatemembersshallservefortermsoftwoyears.(4)Avacancyinthetermofanyregularoralternatememberoccurringotherwisethanbyexpirationofatermshallbefilledfortheunexpiredtermonly.(5)Despiteanyotherprovisioncontainedherein,thetermofanymembercommontotheCommissionandtothePlanningBoardshallbeforthetermofthemembershiponthePlanningBoard,andthetermofanymembercommontotheCommissionandtheBoardofAdjustmentshallbeforthetermofmembershipontheBoardofAdjustment.D.TheCommissionshallelectaChairmanandViceChairmanfromitsmembersandshallselectaSecretarywhomayormaynotbeamemberoftheCommissionoramunicipalemployee.E.Alternatemembersmayparticipateindiscussionsoftheproceedingsbutmaynotvoteexceptintheabsenceordisqualificationofaregularmember.Avoteshallnotbedelayedinorderthataregularmembermayvoteinsteadofanalternatemember.Intheeventthatachoicemustbemadeastowhichalternatememberistovote,AlternateNo.1shallvote.F.NomemberoftheCommissionshallbepermittedtoactonanymatterinwhichheorshehas,eitherdirectlyorindirectly,anypersonalorfinancialinterest.G.AmemberoftheCommissionmay,afterpublichearingifpublichearingisrequestedbysuchmember,beremovedbytheBoroughgoverningbodyforcause.H.Responsibilities.TheCommissionshallhavetheresponsibilityto:(1)Prepareasurveyofthehistoricsitesofthemunicipality,pursuanttocriteriaidentifiedinthesurveyreport.(2)MakerecommendationstothePlanningBoardonthehistoricpreservationplanelementoftheMasterPlanandontheimplicationsforpreservationofhistoricsitesofanyotherMasterPlanelements.(3)AdvisethePlanningBoardontheinclusionofhistoricsitesintherecommendedcapitalimprovementprogram.(4)AdvisethePlanningBoardandtheBoardofAdjustmentonapplicationsfordevelopment,pursuanttoN.J.S.A.40:55D‐110.(5) Providewrittenreports,pursuant toN.J.S.A.40:55D‐111,on theapplicationof theZoningChapterprovisionsconcerninghistoricpreservation.(6) Carry out such other advisory, educational and informational functions as will promote historicpreservationinthemunicipality.S130‐5Appropriations;EmploymentofExpertsandStaff.A.ThegoverningbodyshallmakeprovisioninitsbudgetandappropriatefundsfortheHistoricPreservationCommission.B.TheHistoricPreservationCommissionmayemploy,contractforandfixthecompensationofexpertsandotherstaffandservicesasitshalldeemnecessary.TheCommissionshallobtainitslegalcounselfromtheMunicipalAttorneyattherateofcompensationdeterminedbythegoverningbody,unlessthegoverningbody, by appropriation, provides for separate legal counsel for the Commission. Commissionshallnotexceed,exclusiveofgiftsorgrants,theamountappropriatedbythegoverningbodyfortheCommission'suse.S130‐6RegulationofHistoricStructuresandLandmarks;PermitsA.ThePlanningBoardandBoardofAdjustmentshallrefertotheHistoricPreservationCommissioneveryapplicationfordevelopmentsubmittedtoeitherBoardfordevelopmentofanypropertywithinanhistoricdistrict,alandmarkdesignatedontheZoningMaportheofficialmaporidentifiedinanycomponentoftheMasterPlan,inaccordancewithN.J.S.A.40:55D‐110.B.InadditiontosuchotherpermitsthatmightberequiredbyotherapplicableordinancesoftheBorough,apermitshallberequiredbeforeanyofthefollowingactivitiesarecommencedonanypropertywithinanhistoricdistrictoranypropertythathasbeendesignatedbyordinanceasahistoricsiteorhavinguponitanhistoricstructure:(1)Demolitionofanybuildingorstructurewithinanhistoricdistrictordemolitionofanhistoricstructureorlandmark.(2)Relocationofanyhistoricstructureorlandmark.(3)Changeintheexteriorappearanceofanybuildingwithinanhistoricdistrict,orofanyexistinghistoricstructureorlandmark.(4)Changesinoradditionofnewsignsorexteriorlighting,exceptthatnopermitshallberequiredforoneunlighted sign per premises if the surface area of such sign does not exceed one square foot for anidentificationsignor foursquarefeet foracommercialsign,providedthatsuchsign isattachedtoandparalleltothefacadeofthebuildingorstructure.(5)Anynewconstructionofaprincipaloraccessorystructure.C.Exceptions.(1) Apermitshallnotberequired if theproposedchangetothehistoricalstructureor landmarkwasapproved by the Planning Board or the Board of Adjustment in connection with an application fordevelopment,pursuanttoN.J.S.A.40:55D‐1etseq.andThePlanningBoardorBoardofAdjustment,asthecasemaybe,hadreferredtheapplicationfordevelopmentpursuanttopartAofthissection130‐7.(2)Apermitshallnotberequiredforanyrepaintingofthesamecolor,repairorexactreplacementofanyexistingimprovement.Intheeventthatthecolororexteriorsurfacematerialoftheimprovementshallbechangedasaresultofsuchrepainting,repairorexactreplacement,apermitshallnotberequiredifthenewcolororexteriorsurfaceisonethathasbeenpreviouslyapprovedbyregulationdulypromulgatedbytheCommissionforsimilarimprovements.D.ApplicationforapermitpursuanttothisarticleshallbefiledwiththeBoroughConstructionCodeOfficialonaformtobesuppliedbytheBorough.Atthetimeoffiling,theapplicantshallpayanapplicationfeeintheamountsetforthinChapterA270,Fees,oftheCaldwellCode.E. TheConstructionCodeOfficialshallreviewtheapplicationwiththeadministrativeofficerandshallclassifytheapplicationasaminorapplicationoramajorapplicationasdefinedinthisarticle.F.Minorapplications.(1)IfthepermitapplicationhasbeenclassifiedbytheadministrativeofficerandtheConstructionCodeOfficialasaminorapplication,theConstructionCodeOfficialshallrefersuchapplicationtotheCommissionfor its report and its recommendation. In such instance, in accordance with NJSA 40:55D‐111, theCommissionchairpersonmayactintheplaceofthefullcommission.

(2) The Commission shall report to the Construction CodeOfficialwithin 45days from the date suchapplicationwasreferredtotheCommission.Ifwithintheforty‐five‐dayperiodtheCommissionrecommendstotheConstructionCodeOfficialagainsttheissuanceofapermitorrecommendsconditionstothepermittobeissued,theConstructionCodeOfficialshalldenyissuanceofthepermitorincludetheconditionsinthepermit,asthecasemaybe.Failuretoreportwithintheforty‐five‐dayperiodshallbedeemedtoconstituteareportinfavorofissuanceofthepermitandwithouttherecommendationofconditionstothepermit.IftheCommissionrecommendsissuanceofthepermit,thentheConstructionCodeOfficialshallthereuponissuethepermit,andsuchpermitshallcontainsuchconditionsastheCommissionshallrecommend.G.Majorapplications.(1)Ifthepermitapplicationhasbeenclassifiedasamajorapplication,theConstructionCodeOfficialshallrefersuchapplicationtotheCommissionforitsreportanditsrecommendation.ThereferralshallstatethattheapplicationhasbeenclassifiedasamajorapplicationandthattheCommissionshallsubmititsreportdirectlytothePlanningBoard.(2) ThePlanningBoardshallhave theauthority to reviewmajorapplications forpermits, to considerrecommendations of the Historic Preservation Commission and to make recommendations to theConstructionCodeOfficialwithregardtosuchapplications.(3)ThePlanningBoardshallreporttotheConstructionCodeOfficialwithin45daysfromthedatetheapplication was referred to the Commission. If within the forty‐five‐day period the Planning BoardrecommendstotheConstructionCodeOfficialagainsttheissuanceofapermitorrecommendsconditionstothepermit tobe issued, theConstructionCodeOfficialshalldeny issuanceof thepermitor includetheconditions in thepermit,as thecasemaybe.Failuretoreportwithinthe forty‐five‐dayperiodshallbedeemed to constitute a report in favor of issuance of the permit andwithout the recommendation ofconditionstothepermit.IfthePlanningBoardrecommendsissuanceofthepermit,thentheConstructionCodeOfficialshallthereuponissuethepermit,andsuchpermitshallcontainsuchconditionsasthePlanningBoardshallrecommend.(4)TheapplicantshallbegivennoticeofallhearingsontheapplicationandshallhavetheopportunitytobeheardbythePlanningBoardontheapplication.

S130‐7StandardsForConsideration.

ThefollowingstandardsshallbeconsideredbytheHistoricPreservationCommissioninconnectionwithreferralspursuanttoN.J.S.A.40:55D‐110;andbytheHistoricPreservationCommissionandPlanningBoardinconnectionwithpermitsrequiredbythischapter;andbythePlanningBoardandBoardofAdjustmentinconnectionwithdevelopmentapplicationspursuant toN.J.S.A.40:55D‐1et seq.when thedevelopmentapplicationinvolvesapropertywhichhasbeendesignatedbyordinanceasahistoriclandmarkorhistoricstructure.

A.Demolitions. With regard to anapplication todemolisha structurewithinanhistoricdistrict, or todemolishanyhistoricstructureorlandmark,thefollowingmattersshallbeconsidered:(1)Itshistoric,architecturalandaestheticsignificance.(2)Itsuse.(3)Itsimportancetothemunicipalityandtheextentofitsvaluetoanhistoricdistrictandtheextenttowhichitshistoricorarchitecturalvalueissuchthatitsremovalwouldbedetrimentaltothepublicinterest.(4)Theextenttowhichitisofold,unusualoruncommondesign,craftsmanship,textureormaterialthatitcouldnotbereproducedorcouldbereproducedonlywithgreatdifficulty.(5)Theextenttowhichitspreservationwouldpromotethegeneralwelfarebymaintainingandincreasingrealestatevalues;generatingbusiness;creatingnewjobs;attractingtourists,students,writers,historians,artists,artisansandnewresidents;encouragingstudyandinterestinAmericanhistory;stimulatinginterest

andstudyinarchitectureanddesign;educatingcitizensinAmericancultureandheritage;ormakingthemunicipalityamoreattractiveanddesirableplaceinwhichtolive.B.Removalsoutofthemunicipality.Withregardtoanapplicationtomoveanhistoricstructureorlandmarktoalocationoutsideofthemunicipality,thefollowingmattersshallbeconsidered:(1)Thehistoriclosstothesiteoforiginallocation.(2)Thecompellingreasonsfornotretainingthelandmarkorstructureatitspresentsite.(3) The proximity of the proposed new location to themunicipality, including the accessibility to theresidentsofthemunicipalityandothercitizens.(4)Theprobabilityofsignificantdamagetothelandmarkorstructureitself.(5)TheapplicablematterslistedinSubsectionAabove.C.Removalswithinthemunicipality.Withregardtoanapplicationtomoveanhistoriclandmarkorhistoricstructuretoanewlocationwithinthemunicipality,theCommissionshallconsiderthecompatibility,natureandcharacteroftheproposedsurroundingareaintowhichthelandmarkorstructurewillbemovedastheyrelatetotheintentandpurposesofthisarticle.D.Considerationonotheractions.Withregardtoanapplicationforotherapprovalofanyproposedactionassetforthinthisarticle,thefollowingmattersshallbeconsidered:(1)Theimpactoftheproposedchangetothehistoricdistrictandonthehistoricarchitecturalcharacterofthelandmarkorstructure.(2)Thehistoricorarchitecturalimportancetothemunicipalityandtheextenttowhichsuchinterestwouldbeaffectedbytheaction.(3)Theextenttowhichtherewouldbeinvolvementoftexturesandmaterialthatcouldnotbereproducedorcouldonlybereproducedwithgreatdifficulty.(4)Theuseofthestructure.(5)Theextenttowhichtheproposedactionwouldadverselyaffecttheviewofalandmarkorstructurefromapublicstreet.E.Visualcompatibilityfactors.Inassessingtheeffectofanyproposedchangeunderapplicationforanylandmarkoranystructurewithinanhistoricdistrict,thefollowingvisualcompatibilityfactorsshallbeusedtoanalyzetheeffectthatthechangeappliedforwouldhaveonthelandmarkandonthosestructurestowhichthelandmarkisvisuallyrelated:(1)Height.Theheightoftheproposedbuildingshallbevisuallycompatiblewithadjacentbuildings.(2)Proportionofthebuilding'sfrontfacade.Therelationshipofthewidthofthebuildingtotheheightofthefrontelevationshallbevisuallycompatiblewithbuildingsandplacestowhichitisvisuallyrelated.(3)Proportionofopeningswithinthefacility.Therelationshipofthewidthofwindowstotheheightofwindowsinabuildingshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(4)Rhythmofsolidstovoidsonfacadesfrontingonpublicplaces.Therelationshipofsolidstovoidsinsuchfacadesofabuildingshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.

(5)Rhythmofspacingofbuildingsonstreets.Therelationshipofthebuildingtotheopenspacebetweenitandadjoiningbuildingsshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(6)Rhythmofentranceand/orporchprojections.Therelationshipofentranceandporchprojectionstothestreetshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(7)Relationshipofmaterials,textureandcolor.Therelationshipofmaterials,textureandcolorofthefacadeandroofofabuildingshallbevisuallycompatiblewiththepredominantmaterialsusedinthebuildingstowhichitisvisuallyrelated.(8)Roofshapes.Theroofshapeofabuildingshallbevisuallycompatiblewithbuildingstowhichitisvisuallyrelated.(9)Wallofcontinuity.Appurtenancesofbuildings,suchaswalls,open‐typefencingandevergreenlandscapemasses,shallformcohesivewallsofenclosurealongastreet,totheextentnecessarytomaintainvisualcompatibilityofthebuildingwiththebuildingsandplacestowhichitisvisuallyrelated.(10)Scaleofbuilding.Thesizeofabuilding,themassofabuildinginrelationtoopenspaces,thewindows,dooropenings,porchesandbalconiesshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(11)Directionalexpressionoffrontelevation.Abuildingshallbevisuallycompatiblewithbuildingsandplacestowhichitisvisuallyrelatedinitsdirectionalcharacter,whetherthisbeverticalcharacter,horizontalcharacterornon‐directionalcharacter.S130–8IdentificationandDesignationofHistoricDistricts,HistoricStructuresandLandmarks;procedureA.TheHistoricPreservationCommissionshallperformacomprehensivesurveyoftheBoroughofCaldwelltoidentifypotentialhistoricdistricts,historiclandmarksandhistoricstructuresthatareworthyofprotectionandpreservation.B.Inevaluatingandidentifyinghistoricstructuresandlandmarks,theHistoricPreservationCommissionshall be generally guidedby theNationalRegister criteria.TheHistoricPreservationCommissionmayidentifyandrecommendfordesignationanyrealpropertyorimprovement,suchasabuilding,structure,ruins,foundation,route,trail,placeorobject,includingbutnotlimitedtoacave,cemetery,burialground,camp or village area or a natural object or configuration, geological formation or feature, which is ofparticular,historic,cultural,scenicorarchitecturalsignificancetothemunicipalityandinwhichthebroadcultural,political,economicorsocialhistoryofthenation,state,ormunicipalityisreflectedorexemplified;orisidentifiedwithhistoricalpersonagesorwithimportanteventswithinthemaincurrentofnational,stateorlocalhistory;orshowsevidenceofhabitation,activity,orthecultureofprehistoricman;orembodiesadistinguishingcharacteristicoranarchitecturaltypevaluedasrepresentativeofaperiodorastyleormethodof construction; or presents a work of a builder, designer, artist or architect whose individual stylesignificantly influenced the architectural history of the municipality; or is imbued with traditional orlegendarylore.C.TheHistoricPreservationCommissionmayinitiatetheidentificationofapotentialhistoricdistrict,historicstructureorhistoriclandmark.Otherswishingtonominateadistrict,structureorlandmarkforidentificationmaycontacttheHistoricPreservationCommissionregardingconsiderationoftheproposedhistoricdistrict,landmarkorstructure.TheHistoricPreservationCommissionshallhavethepowertoestablishandpublishformalnominationprocedures.D.TheHistoricPreservationCommissionshallscheduleapublichearingtoconsidertheidentificationofanypotentialhistoricdistrict,landmark,historicstructureorhistoricsite.Suchhearingshallbeonatleast10days'writtennotice,bycertifiedmail,returnreceiptrequested,totheownerofpropertywhichisbeingconsidered for identification. At the hearing, the Historic Preservation Commission shall consider the

commentsandquestionsoftheownerofsuchpropertyorpropertiesandofanyinterestedpartiesandcommentsofthepublic,alongwithotherrelevanttestimony,exhibits,orotherphysicalevidencewhichaddressestheworthinessofsuchpropertyforidentificationassetforthherein.E.Duringthecourseofthepublichearingorhearingsontheidentificationofapotentialhistoricdistrict,landmark,historicstructureorhistoricsite,theHistoricPreservationCommissionshallmakewrittenrequestoftheownersofallpropertieswithinaproposedhistoricdistrictandoftheownerofanysuchotherpropertybeingconsideredfor identificationasa landmark,historicstructureorhistoricsiteforsuchowner’sorowners’writtenconsenttothecreationbyordinanceofanhistoricdistrictorthedesignationofanypropertybyordinanceasalandmark,historicstructureorhistoricsite.F. At the conclusion of the public hearing on the identification of a potential landmark, the HistoricPreservationCommissionshallmakeitsrecommendationintheformofawrittenreporttobeadoptedbyresolutionoftheCommission.G.IftheHistoricPreservationCommissionshalldeterminethatanhistoricdistrictshouldbecreatedorthatapropertyisworthyoflandmarkidentification,thentheHistoricPreservationCommissionshallforwarditsrecommendationtotheBoroughPlanningBoard.H.Iftheownerofapropertywithinaproposedhistoricdistrictorapropertywhichhasbeenidentifiedasapotential landmark or historic structure or historic site by the Historic Preservation Commission hasconsentedinwritingtothecreationofsuchhistoricdistrictorthedesignationofsuchhistoricpropertyasalandmark,thentheHistoricPreservationCommissionshallforwarditsrecommendationandthewrittenconsentoftheownerofsuchpropertytotheBoroughMayorandCouncil.UponreceiptofconsentandtherecommendationoftheHistoricPreservationCommissiontocreateanhistoricdistrictortodesignateanyproperty as a landmark, historic structure or historic site, theMayor and Council may consider suchdesignationbyordinancepursuanttoN.J.S.A.40:55D‐65.1.I.Thepropertiesanddistrictssetforthattheconclusionofthischapter,asamendedfromtimetotimeare,orwillbe,designatedas"Historic"andshallbeportrayedassuchontheBoroughZoningMap.Inaddition,theBoroughTaxAssessor,TaxCollectorandConstructionCodeOfficialshallidentifyallsuchpropertiesanddistrictsas"Historic“Historic”,“HistoricLandmark"or“HistoricStructure”onpublicrecordsmaintainedforsuchproperties.J.RegulationofanypropertiessetforthattheconclusionofthischapterinaccordancewiththischaptershallbeinadditiontosuchdesignationandregulationastheBoroughZoningOrdinance(Chapter250oftheCaldwellCode)mayotherwiserequire.S130–9NoticeofViolations;ViolationandPenalties.A.Ifanypersonshallperformorundertakeanyactivityuponanystructurewithinanhistoricdistrict,anylandmarkpropertyorhistoricstructurewhichrequiresapermitandsuchpersonhasnotfirstobtainedapermit,thensuchpersonshallbedeemedtobeinviolationofthisarticle.B.Uponlearningoftheviolation,theConstructionCodeOfficialshallpersonallyserveupontheownerofthelotwhereintheviolationisoccurringanoticedescribingtheviolationindetailandgivingtheowner10dayswithinwhichtoabatetheviolationbyrestoringthelandmarkorimprovementtoitsstatusquoante.Iftheownercannotbeservedpersonallywithinthemunicipalitywithsaidnotice,acopyshallbepostedonthesite,andacopyshallbesent,bycertifiedmail,returnreceiptrequested,totheownerathislastknownaddressasappearsonthemunicipaltaxrolls.C. In the event that the violation is not abatedwithin 10 days of service of a notice of violation, theConstructionCodeOfficialshallissueasummonsandcomplaint,returnableintheCaldwellMunicipalCourt,chargingviolationofthisarticle.Eachseparatedaythatsuchviolationofthisarticlecontinuesshallconstituteaseparateviolation.Thepenaltiesforviolationsofthisarticleshallbeasfollows:

The Construction Code Officialmay allowtemporaryrepairstopreservecontinuedhabitabilityorpublicsafetypriortotheHistoricPreservationCommission'sreviewwhenrepairsarenecessary forabuilding'soccupancyor forpublicsafety. Inallcircumstances,suchemergencyrepairsshallbemadetoconformtotheprovisionsofthisChapterwithin90days.

S130‐11PermitReview

ItshallbethedutyofallmunicipalofficialsreviewingallpermitapplicationsinvolvingrealpropertyorimprovementsthereontodeterminewhethersuchapplicationinvolvesanyactivitywhichshouldalsobethesubjectofanapplicationforapermitunderthisarticleandtoinformboththeSecretaryoftheHistoricPreservationCommissionandtheownerofsuchpropertyoftheneedforanysuchpermit.

AN ORDINANCE AMENDING CHAPTER 53 OF THE CODE OF THE BOROUGH OF CALDWELL, BEING THE SECTION REGULATING LICENSING OF ALCOHOLIC BEVERAGES BE IT ORDAINED by the Council of the Borough of Caldwell as follows: That Chapter 53, Section 6 of the Code of the Borough of Caldwell, New Jersey be amended as herein set forth: That Chapter 53, Section 6 of the Code of the Borough of Caldwell, the section titled “Hours of sale for consumption off the licensed premises” is amended as follows: Delete Section A. (1) and replace with the following: (1) Saturday from 10:00 p.m. to Sunday 9:00 a.m.

This Ordinance shall take effect immediately upon final passage, approval and publication as required by law.
